Merced Community College District Board of Trustees meeting held March 4, 2014 1. Public Session Call to Order The Board President (Dennis Jordan) called the meeting to order at 5:00 p.m. The meeting was held in the Margaret M. Randolph Board Room on the Merced College Campus in Merced. 2. Hearing of the Public An opportunity was provided for members of the public to address the Board on matters of general district business. Board President Jordan read a statement which included the following complaints and charges against Dean Jim Andersen: Recent audits of the Colleges Ag Department conducted by the District’s auditors have determined that that there were several deficiencies in the Ag Department’s accounting procedures, including: insufficient receipting documentation for cash sales by the Ag Department; insufficient documentation of pricing judgments for sales by the Ag Department; and, lack of documentation and inconsistent procedures over periodic inventory observations to aide in the safeguarding of the Ag Department. Failure of Dean Andersen to comply with Board Policy 6550, Disposal of Property, with regard to at least two pieces of College personal property, a 590 B Case back hoe and the disposal of a set of John Deere rubber tractor tracks. Dean Andersen’s act of leasing District real property to Brooks’ Ranch for pasturing of horses without the requisite Board approval of any written agreement with Brooks’ Ranch. The Ag Department’s practice of not being timely in turning in classes, replacing classes with other unapproved classes and deleting classes in an untimely manner. The Ag Department’s failure to comply with Merced County Code section 7.04.090 regarding lawful livestock fences in the case of the Brooks’ Ranch horses being kept on District property. The Ag Department’s practice of draining irrigating tail water into the creek rather than pumping it into the containment pond. Kevin Kistler, Marianne Tortorici, Bryan Tassey, Ramon Avila, Jr., Harry Maddox, Jamie Farrao, and Darol Fishman expressed their concerns regarding the Board’s action to discuss Dean Jim Andersen’s employment. Jim Andersen requested the Board to not take action on his employment until his attorney is present. 3. 1. Public Session Call to Order The Board President (Dennis Jordan) called the meeting to order at 5:00 p.m. The meeting was held in the Margaret M. Randolph Board Room on the Merced College Campus in Merced.

4. Resume Public Session

The public session reconvened at 6:30 p.m. in the Margaret M. Randolph Board Room on the Merced College Campus in Merced. Members Present: Dennis Jordan, Cindy Lashbrook, Les McCabe, Gary Arzamendi, Wayne Hicks, Jean Upton, Joe Gutierrez, Janique Johnson Others Present: Ronald C. Taylor, Kevin Kistler, Everett Lovelace, Joanne Schultz, Keith Law (MCFA), Ramon Avila, Jr. (CSEA), Dee Sigismond (Academic Senate), Charlene Reed (Classified Senate), Karyn Dower (Management), Karen Fritz, Annette Haugen, Teena White, Cherie Davis, Susan Walsh, Joe Allison, Stacey Hicks (Recording Secretary) Trustee Gutierrez led the Pledge of Allegiance. There was no action taken in closed session and a second closed session will be required.

Keith Law, Jim Andersen, Ramon Avila, Jr., Rich Randall, and Diana Butts expressed their views regarding a contract on the consent agenda with Hanover Research and the data to be included in a benching study for management.

6. Additions and/or Changes to the Agenda None.

7. Granting of Tenure Dr. Kistler gave a brief explanation on the process of becoming eligible for tenure. He then introduced the deans of each professor who are eligible for tenure and they provided background information on each candidate. MSC (McCabe/Arzamendi) to grant tenure to professors Tina Aker-Porter, Karen Fritz, Carin Heidelbach, and Travis McDonald. The student advisory vote was aye.

A short break was taken so the Board could congratulate the tenured faculty.

8. Presentations a. February Student of the Month

Professor Karen Fritz introduced Professor Annette Haugen.

Professor Haugen introduced Teena White. Teena is a leader in class, takes charge, provides support to her fellow students, and is extremely focused and has persevered through many personal struggles. Ms. White thanked everyone for their support and said she wants to make her family proud.

b. Board Education – 2013 Accountability Reporting for Community Colleges/Student Success Scorecard Cherie Davis provided a review of the 2013 ARCC/Student Success Scorecard data for Merced College. This data highlighted persistence, completion, achievement of 30 units, remedial, and career technical education for the current year as well as five-year data. Trustees stated they could see this as a tool for: outreach to TK through 12 schools to better prepare students for college; testing preparation for incoming students; high school teachers to be made aware of what their students need to be prepared for to be successful in college; opening up pathways for incoming students to explore areas they may have overlooked; and as part of an ambassador program for incoming students. Trustees also said the prepared and unprepared data in CTE could be more complete. Also the data would be useful if separated for Merced and Los Banos.

Jim Andersen said he has asked for additional data to be included in the CTE area so the data is more accurate to include incumbent workers and certificates that are not awarded from the Chancellor’s Office.

c. Board Education – 3 CSN Professional Development Opportunity Dr. Kistler and Dean Michael McCandless provided information on an upcoming regional professional development opportunity being hosted at Merced College.

9. Consideration of Consent Agenda MSC (Hicks/Gutierrez) to approve the consent agenda items as summarized below. The student advisory vote was aye. Item 9b was removed from the consent agenda by Trustee McCabe.

MSC (Upton/Arzamendi) to approve Contracts as summarized on Schedule 14-48. The student advisory vote was aye.

10. To the Board for Discussions and/or Action

a. Midterm Accreditation Report Dr. Walsh provided information on the Midterm Report. This report is a standard report which is to be completed midway through the six year cycle of accreditation. She thanked everyone who contributed to this report and for their hard work on it.

The Board thanked Dr. Walsh for her dedication to this project and everyone who participated in this report’s completion.

MSC (Hicks/Upton) to approve the 2013 Midterm Accreditation Report as presented. The student advisory vote was aye.

b. Uniform Public Construction Cost Accounting Procedures Dr. Schultz said in 2006 the Board adopted a resolution for this item and it is needed once again. She explained the program and the requirements.

MSC (Hicks/Arzamendi) to approve the authority vested to the delegates by statute as listed in Resolution 14-60 and revises the monetary limits in accordance with Public Contract Code 22032. The student advisory vote was aye.

c. Resolution to Honor Women’s History Month Dr. Taylor stated this is a resolution to honor Women’s History Month.

MSC (Arzamendi/Lashbrook) to adopt Resolution 14-61 honoring Women’s History Month in March 2014. The student advisory vote was aye.

d. Employment Agreement with MCFA Chapter 770 Keith Law thanked the District’s team for their collaboration and MCFA is happy to have a contract which will be for three years.

MSC (Upton/McCabe) to approve the tentative agreement with MCFA Chapter 770 as presented and ratified by their membership. The student advisory vote was aye.

e. Celebration of Talent Event Dr. Taylor explained that Trustee Jordan asked for this event to be organized. With the amount of staff time and effort which will be required by this, it needs a formal action by the Board to show their support of devoting resources to the event. MSC (Upton/Hicks) to support the Celebration of Talent Event for Merced College. The student advisory vote was aye.

f. Request to Serve Wine at Merced College Foundation Emeritus Directors Reception Robin Shepard provided the information on the proposed reception. MSC (Hicks/Arzamendi) to approve the serving of wine at the Merced College Foundation’s Emeritus Directors Reception on March 18, 2014,

at 4:30 p.m. Trustee McCabe voted no. The student advisory vote was aye.

g. Request to Serve Wine at Sports Hall of Fame Dinner Robin Shepared provided information on the Sports Hall of Fame Dinner. MSC (Upton/Hicks) to approve the serving of wine at the Sports Hall of Fame Dinner on May 3, 2014. Trustee McCabe voted no. The student advisory vote was aye.

h. Second Reading of Board Policies and Administrative Procedures Dr. Taylor said these came to the Board for a first reading last month and provided a brief review of these proposed changes. Discussion occurred. MSC (Upton/Hicks) to amend AP 4010 to read Veterans Day on November 11. The student advisory vote was aye. MSC (Upton/Arzamendi) to amend the title of BP/AP 4010 to read Academic/Institutional calendar. The student advisory vote was aye. MSC (Hicks/Upton) to approve Board Policy 1200 – District Mission and Board Policy and Administrative Procedure 4010 – Academic/Institutional Calendar. The student advisory vote was aye.

i. Finalization of Board Goals Dr. Taylor stated these goals come from the discussion at the last meeting and are aligned with accreditation standards. Discussion occurred. MSC (Arzamendi/Upton) to amend the goals so item 2b states “support” instead of “ensure”. Trustee McCabe voted no. The student advisory vote was aye. MSC (Upton/Hicks) to adopt the 2014-16 Board of Trustees Goals dated March 4, 2014, as amended. Trustee McCabe voted no. The student advisory vote was aye.

j. Administrative Reorganization Dr. Taylor said this was presented to the Board last month and he has corrected a few items. Discussion occurred.

MS (Upton/Gutierrez) to approve the Administrative Reorganization as proposed in the memorandum to the Board of Trustees from Ron Taylor, Superintendent/President dated January 26, 2014 – corrected Feb. 24, 2014. Trustees McCabe, Lashbrook, Arzamendi, Hicks, and Jordan voted no. The student trustee abstained.

11. To the Board for Information a. Resolution in Support of Community College Baccalaureate Degrees

Dr. Taylor explained this item is for information only. He is interested in having the input from the Academic Senate.

Discussion occurred. The consensus of the Board was they would like to hear more information at the next meeting.

b. District-wide Water Conservation Planning Dr. Schultz provided a presentation on a District-wide water conservation plan which outlined the process utilized to develop the plans and the plans for grounds, other areas, plant science, and the College farm.

Discussion occurred.

c. Quarterly Financial Status Report, 2013-14 Fiscal Year; Quarter Ended December 31, 2013 Joe Allison provided a review of the 311Q for the quarter ended December 31, 2013. This included the activity through the second quarter, changes from the 2013-14 adopted budget, review of 2012-13 second quarter projections, and a summary of bookstore activity through January 31, 2014.

12. Reports a. From Academic Senate

Dee Sigismond provided statistics on the work done by the Curriculum Committee so far this academic year. A resolution of appreciation to a faculty member who recently retired was just passed. Dee thanked Edward Modafferi and Patrick Mitchell for their hard work on the Midterm Accreditation Report. GE learning outcomes are being worked on and a resolution is going through the Senate on these. Two brown bag lunches have been held for faculty to discuss issues.

b. From Faculty Association There was nothing to report.

c. From Classified Senate Charlene Reed provided the Board with a fact sheet on the differences between Classified Senate and CSEA. Board is working on updating their constitution and they hope to bring it to the Board in May.

d. From CSEA Richard Zeunges thanked the Board for their action regarding Veterans Day.

e. From Management Team Karyn Dower said the officers have met with Dr. Taylor for the first time and will continue to meet with him throughout the year. He was asked to address the management team this Thursday on specific issues. The Emerging Leaders Institute training is beginning on March 27. Managers are the pilot group for this new program.

f. From Board Members Trustee Gutierrez congratulated the Student of the Month. He is looking forward to hosting the meeting in Los Banos next month. He congratulated the Lady Blue Devils basketball team on their continued success this season.

Trustee Lashbrook continues to be pleased with the caliber of students graduating from the nursing program. Trustee McCabe expressed concern over the condition of equipment in some classrooms. Trustee Hicks congratulated the faculty who were granted tenure tonight. He thanked Dr. Schultz, Jim Andersen, and Bryan Tassey for their presentation on water conservation. He liked seeing the participation of the staff in tonight’s meeting. Trustee Upton attended the Merced College Foundation workshop this last weekend. She reminded Trustees of the State of the College event scheduled for April 11 and hopes each Trustee will buy a ticket to the event. Trustee Arzamendi congratulated the faculty who were granted tenure. He appreciated all the presentations tonight. The mini-grant winners through MCOE will be announced at the next meeting. Trustee Johnson thanked the students who attended tonight’s meeting. Blue Devil bazaar will be taking place in March. ASMC elections will be taking place soon. She thanked everyone who supported the BSU gospel concert last month. Trustee Jordan had no report.

g. Superintendent’s Report Dr. Taylor echoed the congratulations to tenured faculty and the Student of the Month. He thanked everyone for their hard work on the Midterm Report. He is looking forward to the continued success of the Lady Blue Devils basketball team. He will be meeting with CEOs and ACCJC representatives tomorrow to have discussion on the accreditation process. He provided the Trustees with the finalized College profile brochures. On March 17 from 3:30 p.m. to 7:00 p.m. is a Board workshop. He highlighted a few upcoming statewide workshops/conferences for Trustees. Work is continuing on bringing an informative presentation on Higher One to the Board.

13. Future Discussion Items from Board Members Trustee Upton would like to continue discussion on the Administrative Reorganization. Trustee Jordan asked for a presentation from Academic Senate regarding the resolution on Baccalaureate Degrees. He would also like to discuss the meeting schedule of the Board.

14. Second Closed Session

The Board voted unanimously to approve a settlement for items 3g and 3h. No other action was taken.

1. Public Session Call to Order The Board President (Dennis Jordan) called the meeting to order at 3:35 p.m. The meeting was held in the Margaret M. Randolph Board Room on the Merced College Campus in Merced. 2. Hearing of the Public An opportunity was provided for members of the public to address the Board on the matter listed. No one addressed the Board.

3. Workshop on Board Governance Dr. Taylor introduced Mr. Bill McGinnis, Trustee at Butte-Glenn Community College District. Mr. McGinnis provided some brief information on his background. He led a presentation and discussion on board responsibilities, board practices/behavior, board development/training, board self-evaluation, board ethics, board/CEO delegation, and issues on the horizon for Merced College and the California Community College system. The board was asked to think about how they would like to have the Student Success/Achievement data presented to them and provide an answer to Dr. Taylor at a future meeting. This addresses one of the Board’s goals. Trustee McCabe left the meeting. There were discussions and questions on the items presented. The board was asked to let Dr. Taylor know what the most significant thing they each got out of the workshop and what they would like to discuss further.

AT THE April 1, 2014 MEETING OF THE BOARD Item: Approval of Supplemental Employee Retirement Plan (SERP)—Faculty Presented by: Ron Taylor For Information X For Action Background Information Keenan Financial Services has projected considerable net savings over five years, even if all faculty in the list of enrollees are replaced. This cumulative savings level is due to the salary differential between the retirees and those who would be hired to replace them, and the calculation takes into account the level of retirement that would normally occur without a SERP offering. The administration estimates an actual cumulative five-year savings of just over $1 million. The difference in the two estimates has to do with categorical funding available to support some positions in the list of enrollees to be replaced, and the fact that the administration’s estimate does not back out an amount based on retirements that would likely occur without a SERP offering. In addition, based on the replacement plan, the administration estimates an additional annual savings of approximately $205,000 until such time as deferred positions are replaced. Thus, with some replacements covered by categorical funding and a small number deferred, implementation of this SERP will achieve significant savings. Actual savings will depend partially on the specific salary placements of those hired to replace the retiring faculty. Recommended Action It is recommended that the Board approve the SERP offering for eligible faculty who have duly completed the enrollment process, to be effective in July 2014 (first plan payment in August, 2014). Also, in accordance with BP 2310, it is acceptable for the Board to reconsider the matter despite a negative vote at the March 4 meeting, since Robert’s Rules of Order indicate that a member on the prevailing side may request that the matter be reconsidered—and I have received such a request. Recommended Action Approval of the attached list of actions, reassigning administrative duties for several positions, and authorizing reclassification of a few positions, as well as one recruitment to replace an existing vacancy. In keeping with BP 2430 (Delegation of Authority to Superintendent/President) and my 2012 employment contract, I am bringing this matter back to you in an adjusted form. Also, in accordance with BP 2310, it is acceptable for the Board to reconsider the matter despite a negative vote at the March 4 meeting, since Robert’s Rules of Order indicate that a member on the prevailing side may request that the matter be reconsidered—and I have received such a request.

I am glad for another opportunity to present a recommendation on administrative reorganization, since I believe that the investment of time and energy in this complex set of issues by the Administrative Reorganization Task Force deserves every consideration. No solution is perfect, and no solution will satisfy all parties, but additional consideration will serve to acknowledge the work of the Task Force.

CAVEATS AND CORRECTIONS Consideration of Cost: I acknowledge that there has been confusion on whether the Task Force was asked to consider cost in making their recommendations. I have always seen cost as an important (but not the only) consideration. To some degree, the Task Force did consider cost, and some of their proposals did embody cost savings. Toward the end of their work in Fall 2013, I excused them, if they so chose, from doing a thorough “costing” of their recommendations. While the overall proposal from the task force does not result in savings, the recommendation for implementation does. I did this in consideration of their time, the burden that such a task represented, and the expertise required. It was more important that they reach consensus on a set of recommendations, which they did. Then, it would be my job to “cost out” the recommendations, which I attempted to do in my January 26, 2014 memo. I return to related questions here, in an altered format.

Not related to SERP: Also on the present meeting agenda, you will have recommendations related to the classified/management retirement incentive. This reorganization proposal bears no relationship to those recommendations. At present, we must consider these actions as independent, despite the fact that non-replacement of a manager might result in a different, department-level reorganization.

Not related to Management Benching Study: As the Board knows, we have embarked on a comparative study of management compensation. While the results of this study may, in time, provide insight leading to changes in management compensation, these results are not available for consideration in the present reorganization proposal, so naturally there is no connection between that project and this one.

SUPERINTENDENT/PRESIDENT’S RECOMMENDATION In February, my recommendation was presented as part of a longer-term plan, much as I had done in February of 2013. Moreover, I was attempting to respond to each of various recommendations included in the Task Force report. Item: Request to Award Bid for Proposition 39 Project Los Banos Campus: Virtual Desktop Infrastructure Equipment Presented By: Joanne Schultz For: Information Action X Background Information Proposition 39, the California Clean Energy Jobs Act, passed on November 6, 2012. SB 73 establishes that eleven percent of the funds deposited annually into the Clean Energy Job Creation Fund be allocated to the California Community College Chancellor’s Office to be made available to community college districts for energy efficiency upgrades and clean energy installations. On May 14, 2013, the Board of Trustees was advised about the passage of Proposition 39, the California Clean Energy Jobs Act. Administration worked closely with Merced Irrigation District and Pacific Gas and Electric Representatives to identify potential Proposition 39 projects. Whenever possible, Proposition 39 funding was offset by any allowable utility rebates, which provided additional funding for projects. Merced Community College District applied for and was approved for energy project funding in the amount of $279,143. Merced College received this funding on February 18, 2014. One of the approved projects was for Virtual Desktop Equipment for the Los Banos Campus. As required by Public Contract Code 20651, Administration conducted a competitive bidding for equipment and formal requests for bids were issued and advertised through the Merced Sun Star, Los Banos Enterprise and three separate builders’ exchanges. Below are details of this project:

Project Budget Virtual Desktop Equipment (108 units) - A virtual desktop is an individual user’s interface in a virtualized environment. The virtualized desktop is stored on a remote server rather than local. The benefits of desktop virtualization include:

• Cost savings because resources can be shared and allocated on an as-needed basis. • More efficient use of resources and energy. • Improved data integrity because backup is centralized. • Centralized administration. • Fewer compatibility issues.

A public bid opening took place on Friday, March 28, 2014 at 2:00 p.m., which was after the board packet for this meeting was compiled. Therefore, the bid tally sheets will be distributed at the board meeting. The successful bidder of the project will deliver all equipment by Friday, May 30, 2014, as set forth in the Notice to Proceed. Recommended/Requested Action It is recommended the Board of Trustees award the Los Banos Campus Virtual Desktop Infrastructure Project to the lowest responsive and responsible bidder. Item: Destruction of Class 3 Records-Disposable Records Presented By: Joanne Schultz and Everett Lovelace _ For: Information______ Action__X___ Background Information As prescribed under the California Code of Regulations (Title 5) Sections 59020 et seq., the attached list of class 3 disposable records are beyond the required retention period and have been determined as having no value to the District’s archives. The student financial aid files from the Los Banos Campus are duplicates of files of the students’ officials being maintained on the Merced Campus. As a result in a change in Student Personnel procedures, duplicate financial aid records are no longer kept at the Los Banos Campus. These records along with the other financial aid files containing confidential information will be shredded by our shredding vendor under purchasing staff supervision. The purchase orders requesting to be destroyed from 2005-06 are part of the District’s annual request to dispose of Class 3 records. Therefore, the Administration is recommending the destruction of these class 3 records in accordance to the above listed regulations. This is an annual housekeeping activity. Item: Ratification of Change Order for Wayfinding Project Bid #012159 Presented By: Joanne Schultz For: Information Action _X Background Information Merced College Wayfinding Project is being delivered with the traditional Contractor delivery approach and change orders are compiled by the contractor and submitted as a single change order to the owner. Change order No. 1 Wayfinding Project Bid #012159 with Turner Signs and Graphics: The Los Banos Campus monument sign was an additive alternate that the District decided to complete and was an unforeseen condition. At the time of the bid date, the District did not know the location of the sign it could not determine the cost for electronical wiring and circuit breaker from Building A to the location of the sign. The additional cost for this work is $1,450. The Business Resource Center monument sign was an additive alternate (No2) in the bid documents. It has been the District’s decision to not to install a sign at this location which created a credit to the bid quote. The credit for the BRC sign is $800. Item: Revised 2013-2014 and 2014-15 Academic Calendars Presented by: Kevin Kistler For: Information Action X Background Information Upon review of the summer schedule after the MOU between CSEA and the District was presented, it was discovered that an adjustment needed to be made to recognize July 3, 2014 and July 2, 2015 as holidays. The MOU approves a 4 x10 schedule for summer 2014 and states that if the July 4th holiday falls on a Friday or Saturday that it will be observed on Thursday. Therefore, to comply with the MOU, for the next 2 years, the holiday needs to be recognized on a Thursday. Recommendation/Requested Action It is recommended that the Board of Trustees approve the revised 2013-2014 and 2014-2015 Merced College Academic Calendars. POLICY ACCESS TO PUBLIC RECORDS It shall be the policy of the Merced Community College District to ensure that the provisions of the California Public Records Act are observed as they relate to the public's right to inspect public records. The District will adopt administrative procedures for the purpose of implementing this policy. The President/Superintendent or his/her designee shall establish procedures for records management, including access by the public, that comply with the requirements of the California Public Records Act. ADMINISTRATIVE PROCEDURE 2470 3300 References: Government Code Sections 6250 et. Seq. ACCESS TO PUBLIC RECORDS In keeping with this policy, the Merced Community College Board of Trustees does hereby adopt the following procedures regulations: 1. Access: District public records are open to inspection during the normal office

hours of the appropriate office. 2. Exemptions from Disclosure: Those records exempted by Government Code

6254 and 6275 (personnel files, legal claims or pending litigation, medical files, test questions or examination for public employment, etc.), shall not be available for public inspection. other provisions of the California Public Records Act, or other provisions of law shall not be available for public inspection.

3. Provision of Records: Public records shall be provided in accordance with

the requirements and timelines set forth in the California Public Records Act. (Government Code sections 6250 et seq.) The District shall, within ten (10) days from receipt of a request, determine whether the request, in whole or in part seeks copies of disclosable public records in the possession of the District and promptly notify the person making the request determination. Extensions of time shall be made in accordance with the requirements of Government Code section 6253. The District shall justify the withholding of any records as required by Government Code section 6255.

4. Copies and Assistance: Any person may receive a copy of any identifiable public

record not otherwise exempt from disclosure. The person making a request to view or receive a copy of such a record must provide enough information to make the record 'identifiable' as no random viewing of a complete records file is allowable. The District will assist the member of the public to identify records and information that are responsive to the request as required by Government Code 6253.1.

5. Fees: As authorized by the California Public Records Act, the District shall recover

the actual cost of providing the copy direct cost of duplication. At the present time, a charge of $.32 per machine copy shall be made where search and copying by a staff member is necessary. The costs for reproduction of other media (micro-film, computer printouts, etc.) shall be as determined by the manager of the office of record. The Vice President, District Administrative Services, is charged with the responsibility of reviewing the fees established by this policy. These fees

shall be adjusted upward or downward as future trends in costs may require. 6. Electronic Records: (A) Unless otherwise prohibited by law, the District shall provide a copy of

an electronic records in the format requested if the requested format is one that has been used by the agency to create copies for its own use or for provision to other agencies and is available. The requester shall bear the direct cost of duplication.

(B) The District shall make the information available in any electronic format in which it holds the information.

(C) If programming or additional computer services are required to produce the record, the requester shall bear the cost of producing a copy of the electronic record, including the cost to construct the record, and the cost programming and computer services necessary to produce an electronic copy of the record when either of the following applies:

the record is that produced only at otherwise regularly scheduled intervals; or

the request would require data compilation, extraction, or programming to produce the record.

(D) The District shall not be required to reconstruct a record in an electronic format if the agency no longer has the record available in an electronic format.

(E) Information shall not be related in electronic format if the release would jeopardize or compromise the security or integrity of the original record or of any propriety software in which it is maintained. (Government Codes 6253.9.)

BOARD POLICY 3560 ALCOHOLIC BEVERAGES Reference: Business and Professions Code Section 25608 34 Code of Federal Regulations Section 668.46(b)

The Superintendent/President is authorized to enact procedures as appropriate and permitted by law regarding serving alcoholic beverages on campus or at fund-raising events held to benefit non-profit corporations. ADMINISTRATIVE PROCEDURE 3560 - Alcoholic Beverages Reference:

Business and Professions Code Section 24045.4, 24045.6, and 25608 34 Code of Federal Regulations Section 668.46(b)

The possession, sale or the furnishing of alcohol on campus is governed by California state law and these procedures. The possession, sale, consumption or furnishing of alcohol is controlled by the California Department of Alcohol and Beverage Control (ABC). However, the enforcement of alcohol laws on-campus is the primary responsibility of the Merced Community College Police Services. The campus has been designated “Drug free” and only under certain circumstances is the consumption of alcohol permitted. The possession, sale, manufacture or distribution of any controlled substance is illegal under both state and federal laws. Such laws are strictly enforced by the Merced Community College Police Services. Violators are subject to disciplinary action, criminal prosecution, fine and imprisonment. It is unlawful to sell, furnish or provide alcohol to a person under the age of 21. The possession of alcohol by anyone under 21 years of age in a public place or a place open to the public is illegal. It is also a violation of this policy for anyone to consume or possess alcohol in any public or private area of campus without board approval. Organizations or groups violating alcohol or substance policies or laws may be subject to sanctions by the District. Alcoholic beverages on campus are permitted if:

• The alcoholic beverage is for use during a non-college event at a performing arts facility built on District property and leased to a nonprofit public benefit corporation for special events such as festivals, shows, private events, concerts, theatrical productions and other such events.

• The alcoholic beverage is for use during a fundraiser held to benefit the Merced

College Foundation when the organization has obtained a license under the Business and Professions Code to do so provided that no alcoholic beverage can be acquired, possessed or used at a football game or other athletic contest sponsored by the District.

• The alcoholic beverage is for use during a fundraiser held to benefit the Merced

College President’s Circle when the organization has obtained a license under the Business and Professions Code to do so provided that no alcoholic beverage can be acquired, possessed or used at a football game or other athletic contest sponsored by the District acquired, possessed, or used during an event sponsored by the District or an organization for the benefit of the District (such as Merced College President’s Circle).

BOARD POLICY 4100 Graduation Requirements for Degrees and Certificates

Reference:

Education Code Section 70902(b)(3); Title 5, Sections 55800 55063, et seq.

The District grants the degrees of Associate of Science for Transfer (AS-T), Associate of Arts for Transfer (AA-T), Associate of Arts, and Associate of Science to those students who have completed the subject requirements for graduation and who have maintained a 2.0 average in subjects attempted. Students must also complete the general education, residency, and competency requirements set forth in Title 5 regulations.

Students may be awarded a Certificate of Achievement upon successful completion of courses of study or curriculum for which the District offers a certificate. The District has designed certificate programs to upgrade and develop occupational and vocational proficiency.

The Superintendent/President shall establish procedures to determine degree and certificate requirements and to assure that graduation requirements are published in the District’s catalog and included in other resources that are convenient for students.

ADMINISTRATIVE PROCEDURE 4100 - Graduation Requirements for Degrees and Certificates Reference:

Title 5, Sections 55800 55063 et seq.; Accreditation Standards 2.1, 4.A and B • For the Associate of Arts (AA) and Associate of Science (AS) Degree:

1. A student must demonstrate competence in reading, in written expression, in mathematics, and in computer and information literacy.

2. The student must satisfactorily complete at least 60 semester units of college work.

3. The work must include the college’s general education/breadth requirements and

at least 18 semester units or 27 quarter units in a major listed in the Community Colleges “Taxonomy of Programs.”

4. Effective for all students admitted to a community college in Fall 2009 and

thereafter, all courses that count towards the associate degree area of emphasis must be “satisfactorily completed” with grades A, B, C, or P (pass). All degree requirements, including general education, must be completed with an overall grade point average of 2.0 or better.

5. The work must include at least 12 semester units of study in residence;

exceptions to the residence requirement can be made by the Board when an injustice or undue hardship would result.

6. The general education requirements must include a minimum of work in the

natural sciences, the social and behavioral sciences, humanities, and language and rationality.

• For the Associate of Arts for Transfer (AA-T) and Associate of Science for

Transfer (AS-T) Degree:

1. The student must satisfactorily complete 60 semester units or 90 quarter units that are eligible for transfer to the California State University.

2. The work must include the appropriate Intersegmental General Education Transfer Curriculum (IGETC) or the California State University General Education – Breadth Requirements.

3. A minimum of 18 semester units or 27 quarter units in a major or area of emphasis, as determined by the community college district.

4. All courses that count towards the major or area of emphasis must be

AP 7220 STAFF DEVELOPMENT PROGRAM

Counselors and Librarians

The day of Convocation, held prior to the start of the Fall Semester, is a mandatory day for regular contracted full-time faculty to engage in division/campus meetings 3 hours for college convocation and 3 hours for Office of Instruction, Area, or Cohort activities. Counselors and Librarians are required to fulfill flex time proportionate to the teaching load in their individual contract as indicated in Title 5 sections 55726a and 55728a (i.e., a counselor contracted to teach one-third (1/3) of a full-teaching load would have one- third (1/3) of a flex requirement, 8 hours) with additional hours, up to a total of twenty four per academic year may be fulfilled through Staff Development. Full-time counselors and librarians who do not teach may fulfill up to (3) additional Staff Development days per academic year at six (6) hours per day, totally (18) Staff Development hours per year. Full-time counselors and librarians who do not wish to participate in Staff Development activities will be required to work. THE S TAFF DEVELOPMENT CONTRACT

At the beginning of each academic year the faculty will be notified by the FLEX Coordinator when the Staff Development forms are ready and where they can be located. Any changes to the process will be reported to faculty at the beginning of the fall semester.

DESIGNATED TIMES FOR STAFF DEVELOPMENT ACTIVITIES

The flex calendar begins on July 1 and ends on June 30. Staff Development can be fulfilled at appropriate times through approved activities. Appropriate times to earn credit for Staff Development activities are times when faculty do not have scheduled responsibilities (i.e., office hours, department, cohort or area meetings, etc.).

AWARD OF STAFF DEVELOPMENT CREDIT

Faculty receive one hour of Staff Development credit for each hour of participation in an approved activity. Faculty who present Staff Development/Flex activities receive three times the Staff Development credit the first time the activity is presented and twice the Staff Development credit for subsequent presentations of the same material. Staff Development credit may be accrued for both the Fall and Spring semesters from July 1 through June 30th. Staff Development hours may not be banked from one academic year to another.

DEADLINE FOR COMPLETING STAFF DEVELOPMENT ACTIVITIES

A completion form identifying completed or proposed Staff Development activities for full-time faculty is due February 1. All Staff Development activities (including proposed activities) for both full-time and adjunct faculty must be completed no later than June 30. All final documentation is due no later than June 30.

STAFF DEVELOPMENT DOCUMENTATION

All Staff Development activities require back-up documentation that provides a description of the activity, the dates and times the activity occurred, and verification of completion of the activity. Documentation may be submitted throughout the year. Appropriate forms of documentation include the following:

• Flex Workshops—Printed name and signature on sign-in roster • Conferences—A brochure or agenda, proof of attendance such as a receipt for

registration fees and an explanation of how it relates to improvement of professional effectiveness

• Enrollment in College Courses—Course description, plus a transcript or official grade report and an explanation of how the course relates to improvement of professional effectiveness

• District, College or Campus Committees—Membership list provided by the committee chair

• Meetings (with the exception of area or cohort meetings for full time faculty as these are professional expectations as stated in Faculty Agreement). Meeting minutes showing attendance or a sign-in sheet provided by the chair

• Research—An explanation of the research problem undertaken, a summary of activities including dates and times, and if applicable an annotated bibliography of all works researched

• Special Projects/Activities with Students—Must occur outside of routine class hours and be documented on a syllabus or student notice and performed on a specific day

• All Other Activities should be fully documented by a log, journal or other document verifying dates, times, and an explanation of the activity, product or outcome information and how it relates to improvement of professional effectiveness

COMPENSATION

Full-time faculty are compensated through their annual salary. Part-time faculty Librarians and Counselors that choose to participate in the Staff Development opportunity will be paid at the median pay rate of the current year's PT faculty salary schedule, up to three hours per semester. Hours earned in excess of Staff Development will not be paid.

PROHIBITION OF DOUBLE PAYMENT

Activities already paid for by other organizations are not acceptable for flex credit. The Flex Committee decides if double payment is an issue.

Examples of Prohibited Double Payment:

a) A faculty member awarded reassigned time for committee service cannot receive additional staff development credit for that service.

b) A faculty member enrolled in a college course for salary schedule advancement cannot receive staff development credit for that activity.

c) A faculty member receiving a stipend for a particular assignment cannot receive staff development credit for that service.

INDIVIDUAL STAFF DEVELOPMENT ACTIVITIES

The FLEX Peer Review Committee will maintain a senate approved list of acceptable activities that can be counted toward Staff Development. Activities from list A will be automatically approved by the FLEX coordinator. Space will be provided on Staff Development contracts so that faculty can be more specific about the dates and times of their activities, but the activities are not subject to the peer review process because they are transparent in their correlation to Staff, Student, and Instructional improvement. Activities from list B will need to be approved by the flex evaluation sub-committee. For activities from list B, instructors will need to be specific about the details of their activities, will need to spell out all acronyms, and should make every effort to attach additional documentation, such as workshop fliers.

• Convocation • Teacher Learning Academy workshops (TLA)/activities • Attending/Presenting Pre-Flex and Flex Workshops • Adjunct orientation • Area meetings and Cohort meetings for adjunct professors only. Full time faculty cannot

NON-QUALIFYING ACTIVITIES Staff Development activities cannot include tasks that are an ongoing part of the regular responsibilities such as attendance of full-time faculty at regularly scheduled area and cohort meetings, etc. Other activities that do not qualify include union, political and religious activities, except for educational opportunities offered by these that relate directly to professional effectiveness. For example, working for political campaigns, going to church, or being an MCFA representative would not qualify for Staff Development credit but some workshops offered by these groups may qualify. Activities for which the faculty member receives other compensation cannot be used for Staff Development credit.

Item: Proposition 39: California Clean Energy Jobs Act Projects under Bid Threshold Presented By: Joanne Schultz For: Information X Action Background Information Proposition 39, the California Clean Energy Jobs Act, passed on November 6, 2012. SB 73 establishes that eleven percent of the funds deposited annually into the Clean Energy Job Creation Fund be allocated to the California Community College Chancellor’s Office to be made available to community college districts for energy efficiency upgrades and clean energy installations. On May 14, 2013, the Board of Trustees was advised about the passage of Proposition 39, the California Clean Energy Jobs Act. Administration worked closely with Merced Irrigation District and Pacific Gas and Electric representatives to identify potential Proposition 39 projects. Whenever possible, Proposition 39 funding was offset by any allowable utility rebates, which provided additional funding for projects. Merced Community College District applied for and was approved for energy project funding in the amount of $279,143. Merced College received this funding on February 18, 2014. Staff is in the process of identifying projects to utilize the remaining funds of approximately $56,000 out of the first year’s allocation. The District has until June 30, 2014 to complete the projects funded out of the 2013-14. These projects fall below the bid threshold of $175,000, under the California Uniform Public Construction Cost Accounting Act (CUPCCAA). To remain competitive in the contract procurement process, and to comply with the strict Proposition 39 requirements, staff compiled informal bid packets. Bids were advertised through the Merced Sun Star, Los Banos Enterprise and three separate builders’ exchanges. Below are the project details.

Los Banos Campus: Window Film Project $14,167 Los Banos Campus: Domestic Water Heater $11,450 Merced Campus: Variable Frequency Drive Pool Pump Project $33,384

Informal bids were received and evaluated after the board agenda packet for this meeting was prepared. Of the three projects, only one project received responsive and responsible bids and that bid tally is attached for the Boards information. Because we did not receive responsive and/or responsible bids for the Domestic Water Heater and the Pool Pump Projects, staff proceeded with the required Request for Quotes (RFQ) procurement process and obtained three quotes for each project. Quote tallies were compiled and evaluated after the board agenda packet for this meeting was prepared. Therefore, the Board will receive copies of the quote tallies the evening of the Board Meeting.

Item: Proposition 39: California Clean Energy Jobs Act Los Banos Lighting Project Presented By: Joanne Schultz For: Information X Action Background Information The Los Banos Lighting Project is a Proposition 39, California Clean Energy Jobs Act Project, under the same regulations and requirements as the Los Banos Window Film, Los Banos Water Heater, and the Merced College Pool Pump projects. Staff worked closely with Pacific Gas and Electric (PG&E) representatives to apply for energy utility rates. The project cost is net of the allowable utility rebate. The purpose of submitting this item under separate cover is that the informal bid was not received until March 28, 2014, at which time the bid(s) will be reviewed and evaluated to determine if they are responsive (meet the bidding requirements) and responsible (within budget). If the District does not receive bids that are both responsive and responsible then the District will need to issue a Request for Quotes (RFQ) under the authority of the California Uniform Public Construction Cost Accounting Act (CUPCCAA). The urgency to bid, implement, and fund this project is to comply with the strict Proposition 39 requirements, which has a deadline of June 30, 2014, to report all expenditures for 2013-14 projects. If the informal bid is received and evaluated as being both responsive and responsible, then a copy of the bid tally will be presented the evening of the Board Meeting. Otherwise, the results of the Request for Quotes (RFQ) will be presented at the next meeting of the Board of Trustees.
