NAME ABAILABILITY SEARCH:Go to www.camaramedellin.com.co, select Registration Services, then Mercantile Registration, Consultations, click on Search Name to verify whether the selected name is already being used by a registered merchant or any other commercial establishment. You can also request this information at any of our facilities.

WHO IS CONSIDERED A MERCHANT?

People professionally engaged in any activity considered commercial by the law. The quality of merchant is acquired even if the commercial activity is practiced through an attorney, intermediary or proxy.(Commercial Code, Article 10).

WHO IS EXPECTED TO REGISTER AS A MERCHANT?

All natural or legal entities (commercial corporations, sole proprietorships, and associative businesses), engaged in any commercial activity.

Natural persons must request a Mercantile Registry within the month following the date of commencement of any commercial activity. Legal persons should do so through their legal representative within the month following the date of the public deed or private formation document.

The professional practice of commerce without a Mercantile Registry will result in the imposition of a �ne by the Superintendence of Industry and Commerce (Commercial Code, Article 37).

REQUIREMENTS TO REQUEST A MERCANTILE REGISTRY:

Natural persons must complete the registration form available at www.camaramedellin.com.co. Select Registration Services, Commercial Register, and go to Virtual Procedures: Natural Person Registration.

The Commercial Code, Article 35 prohibits the Chambers of Commerce to register merchants or establishments under any name which is already in use.

The municipal information form for simpli�ed procedures DIAN-SM Annex only applies to business establishments located in Medellín or Santa Fe de Antioquia.

Legal persons may go to any facility of the Chamber of Commerce to obtain the registration form and the annex format DIAN-SM (National Direction of Customs and Taxes - Municipality Secretariats), which must be completed and signed by the legal representative.

To �le documents as a natural person you must �ll out the previously mentioned documents and attach a copy of the legal representative's citizenship card. To do so as a legal person, you must �le a true copy of the public deed or private formation document and deliver it to the Chamber of Commerce’s o�ce.

Upon delivering the form you will receive an invoice issued by a costumer service employee.

Pursuant to Law 1429 of December 2010, natural and legal persons who constitute small enterprises whose payroll does not exceed 50 employees, total assets do not exceed 5,000 Colombian monthly legal minimum wages, and that are not associated to the exclusions regime pursuant to Decree 545, Article 6 of February 25, 2011, are allowed a discount on both the �rst registration and the registration renewal progressive fees.

The discount contained in Article 7 of the aforementioned Law, concerns progressive payment of registration and renewal fees and falls under the following parameters:

Zero percent (0%) of the total fee established for the �rst Mercantile Registry, throughout the �rst year of development of the main economic activity.

Fifty percent (50%) of the total fee for the Mercantile Registry renewal, throughout the second year of development of the main economic activity.

Seventy-�ve percent (75%) of the total fee established for the Mercantile Registry renewal, throughout the third year of development of the main economic activity.

One hundred percent (100%) of the total fee established for the Mercantile Registry renewal, throughout the fourth year of development of the main economic activity.
