ACTION REQUESTED Adopt a Resolution authorizing the Sheriff's Office to submit a Criminal Justice Facilities Construction Financing Program Proposal to the Board of State and Community Corrections (BSCC) 2017 Jail Construction Financing Program, Senate Bill 844 (SB 844), in the amount of $30 million, to provide funding to assist with the construction of a 120-bed medium security facility and associated educational, vocational, behavioral and life-skills training space. BACKGROUND On August 18, 2015, your Board approved a Resolution authorizing the Sheriff's Office to submit an application to the BSCC Jail Construction Financing Program under Senate Bill 863 (SB 863). A funding request in the amount of $40 million was submitted to assist with the construction of a 168-bed medium security facility, and associated educational, vocational, behavioral, and mental health treatment space. Total project costs at the time were estimated to be $44 million, with $40 million anticipated to be provided through BSCC Jail Construction Financing, and a 10% required County Match of $4 million from the Public Safety Operations Fund, Assigned-Contingencies. In November 2015, Placer County received a $9.5 million partial award of the $40 million requested under SB 863. In January 2016, the Sheriff's Office submitted a Scope Reduction Plan to BSCC for use of the $9.5 million partial award to assist with construction of a 12,500 square foot, 45~bed Mental Health Unit for acute and chronic mental health inmates to be housed at the South Placer Jail (SPJ) located in Roseville. Funding for the "SB 863 Acute Mental Health Housing" project, including the $9.5M partial award and the required 10% County Match of $950,000, is included in the FY 2016-17 Final Budget. With funding made available in the Sheriff's FY 2016-17 Final Budget, the remaining 180 previously constructed jail beds at SPJ have been opened, increasing the total number of jail beds i.n Placer County to a combined 912 beds, with 492 located at the Auburn Jail (AJ), and 420 at SPJ. As inmates are transitioned from Auburn to South Placer, Housing Unit 3 at AJ will be closed and retrofitted for "program specific" beds. Once the AJ retrofit is complete, total jail beds in Placer County will be reduced by 76, with 416 beds in Auburn and 420 beds in South Placer. Upon completion of the 45- bed SB 863 Acute Mental Health Housing project at SPJ, inmates will be transitioned to SPJ and 45 beds will be closed at AJ, maintaining the total number of jail beds in Placer County at 836. On September 22, 2016, representatives from the Sheriff's Office attended the BSCC Executive Board meeting to advise them of our intent to submit a Request for Proposal (RFP) for the 2017 Jail Construction Financing Program under SB 844. Should we be successful in securing funding through SB 844, Placer County would be eligible to receive $30 million dollars in jail construction financing through the program, and would be required to provide a 10% County Match of $3 million. With this funding, the long-term plan for Corrections and Detention would be to add 120 beds at SPJ with the - construction of two new-60..,bed_ housing..JJaits,_ and once completed, to close a cgrnmensurate number of beds at AJ.

. ACTION REQUESTED Adopt a Resolution authorizing the Sheriff's Office to submit a Criminal Justice Facilities Construction Financing Program Proposal to the Board of State and Community Corrections (BSCC) 2017 Jail Construction Financing Program, Senate Bill 844 (SB 844), in the amount of $30 million, to provide funding to assist with the construction of a 120-bed medium security facility and associated educational, vocational, behavioral and life-skills training space.

The SB 844 jail construction financing would be used to help facilitate implementation of the original long­term Corrections and Detention plan submitted under SB 863, which was consistent with the Criminal Justice Policy_ C_9mmitte_e's response to Public Safety Realignment (f\B 109) in the Placer County Criminal Justice Master Plan. The initial plan submitted under SB 863 requested firiancfng iii the-amount of $40 million, and required a $4 million County Match, which was conceptually approved by your Board. Given the partial award of $9.5 million allocated to Placer County under SB 863, only $950, 000 of the initially approved $4 million County Match was required at the time.

Under the proposed long-term plan, total jail beds in Placer County would be reduced from the current number of 912, down to 836, a reduction of approximately 8%. If successful in this more program­based Corrections and Detention approach, the Sheriff's Office anticipates experiencing operational efficiencies between the two facilities; with no additional staffing requirements. As a condition of the SB 844 funding, the project would be encumbered by the State for the term of the lease bond financing.

The SB 844 funding application is being prepared by Sheriff's Office staff, but has not yet been finalized. The full application will be made available at the Clerk of the Board's Office once it has been completed.

FISCAL IMPACT Total cost for the SB 844 120-bed minimum security construction project is estimated at $33 million, with $30 million anticipated to be provided through BSCC Jail Construction Financing, and a 10% required County Match of $3 million from the Public Safety Operations Fund, Assigned-Contingencies.

BE IT RESOLVED by the Board of Supervisors of the County of Placer, State of California, that this Board hereby authorizes the Sheriff's Office to submit an application to the Board of State and Community Corrections 2017 Jail Construction Financing Program, SB 844, in the amount of $30 million, to provide funding to assist with the construction of a 120-bed medium security facility and associated educational, vocational, behavioral and additional life-skills space at the South Placer Jail , located in the Bill Santucci Justice Center, a County owned parcel in Roseville , CA.

BE IT FURTHER RESOLVED that the Board of Supervisors hereby:

A Appoints Lisa James, Capital Improvement Project Manager, as the County Construction Administrator; Valerie Bayne, Administrative Services Manager, as the Project Financial Officer; and Lieutenant Carol Walsh as Designated Project Contact Person and Coordinator.

B. Approving the forms of the project documents deemed necessary, as identified by the State Public Works Board to the Board of State and Community Corrections, to effectuate the financing authorized by the legislation.

C. Authorization of, Jennifer Montgomery, Chair of Board of Supervisors to sign the said application and submit the proposal for funding .

D. Assures that the County will adhere to state requirements and terms of the agreements between the County, The Board of State and Community Corrections and The State Public Works Board in the expenditure of state financing and county match funds.

E. Assures that the County has appropriated, and assures an adequate amount of available matching funds to satisfy the counties' contribution; the amount of match is identified by the County on the funding proposal forms submitted to the Board of State and Community Corrections; The identified matching funds are compatible with the states' lease revenue bond financing.

F. Assures that the County will fully and safely staff and operate the facility that is being constructed ( consistent with Title 15, California Code of Regulations. Chapter 1, Subchapter 6 section 1756 U) (5), within ninety days after project completion.

G. Assures that the County has project site control through fee simple ownership of the site, and right of access to the project sufficient to assure undisturbed use and possession of the site, and will not dispose of, modify the use of, or change the terms of the real property title, or other interest in the site of facility subject to construction, or lease the facility for operation to other entities, without permission and instructions from the Board of State and Community Corrections, for so long as the State Public Works Board lease­revenue bonds secured by the financed project remain outstanding; and,

H. Attestation to $387,000.00 as the current fair market land value for the proposed new or expanded facility, actual on-site land value has been documented from an independent appraisal by Bender Rosenthal of Sacramento.
