It has come to our attention that a right-of-way ( ROW) for a Communication Site held by Garfield Countyunder serial number COC-42064 has expired on July 30,2016.

The ROW is located on public land described as:

Sixth Principal Meridian, Eagle County, ColoradoT.3 S., R.87 W.,

sec.24, SENW.

In accordance with current regulation in 43 CFR 2807.22, you must apply to the BLM to renew the grant atleast 120 calendar days before your grant expires. Failure to apply for renewal will result in the grant expiringon its own terms resulting in a trespass situation. To reapply you will need to submit an Application forTransportation and Utility Systems and Facilities, SF-299(http://www.gsa.gov/portal/forms/download/l17318). All applicable fees will be determined at the time wereceive the renewal application.

If you do not intend to renew the grant, please inform us of your intentions in writing. The authorized officerwill ensure that all grant terms and conditions pertaining to site restoration and/or rehabilitation are compliedwith prior to relieving you of your obligations of the current grant.

The Garfield County staff has the technical capability to manage any potential future design and construction ofproposed communication site with project managers on staff. The County dedicates a budget annual for themaintenance of the multiple communication s¡te for which they successfully mange. Garfield County currently manages4 other communication sites: Lookout Mountain COC23456, Harvey Gap COC36784, Anvil Points COC77193 andSunlight Peak COC11300. The Harvey Gap was recently improved w¡th new paint on the building (BLM specified color)with a new door, replacement of stairs, removal of obsolete propane tank, general cleaning of the site a new bank ofsolar batteries. The Anvil Points tower has recently been relocated and is now fully operational. The Lookout Mountaincommun¡cation tower is in the process of being replaced. Sunlight Peak Tower has been budgeted for replacement in

the 201 8 budget.

This information is needed by the Forest Service to evaluate the requests to use National ForestSystem lands and manage those lands to protect natural resources, administer the use, and ensurepublic health and safety. This information is required to obtain or retain a benefit. The authority forthat requirement is provided by the Organic Act of 1897 and the Federal Land Policy andManagement Act of 1976, which authorize the secretary of Agriculture to promulgate rules andregulations for authorizing and managing National Forest System lands. These statutes, along withthe Term Permit Act, National Forest Ski Area Permit Act, Granger-Thye Act, Mineral Leasing Act,Alaska Term Permit Act, Act of September 3, 1954, Wilderness Act, National Forest Roads and TrailsAct, Act of November 16, 1973, Archeological Resources Protection Act, and Alaska National lnterestLands Conservation Act, authorize the Secretary of Agriculture to issue authorizations or the use andoccupancy of National Forest System lands. The Secretary of Agriculture's regulations at 36 CFRParl251, Subpart B, establish procedures for issuing those authorizations.
