Public Comment: (Discussion) Chairman Emme called for public comment. There was none. III. Approval of Agenda: (For Possible Action) Chairman Emme requested comments from the members on the agenda. Hearing none, agenda was approved. IV. Approval of Meeting Minutes: (For Possible Action) Chairman Emme requested comments from the minutes. David Gaskin made a motion to approve the March 15, 2016 meeting minutes with a few minor corrections. With the corrections made Leo Drozdoff seconded the motion. The motion approved unanimously. V. Update on NDOT Stormwater Program Staffing: David Gaskin gave a power point presentation of the Stormwater Program update, and provided history on the development of the NDOT Stormwater Program. NDOT is working with the EPA and Nevada Division of Environmental Protection to implement a Stormwater Program that meets or exceeds all requirements. (Attachment 1). Mr. Gaskin displayed an organizational chart of the positions hired to date and stated managers were there to introduce themselves and give a brief background. Cricket Vonjames, Information Manager, has a background in technology, compliance, rules and regulations as the Database and Applications manager for the Attorney General’s Office. Gary Lyon was hired as the Project Manager, and Ana Navarro as the Business Process Analyst.

V Update on NDOT Stormwater Program Staffing David Gaskin gave a power point presentation of the

Stormwater Program update and provided history on the development of the NDOT Stormwater Program

NDOT is working with the EPA and Nevada Division of Environmental Protection to implement a Stormwater

Program that meets or exceeds all requirements (Attachment 1)

Mr Gaskin displayed an organizational chart of the positions hired to date and stated managers were there to

introduce themselves and give a brief background

Cricket Vonjames Information Manager has a background in technology compliance rules and regulations

as the Database and Applications manager for the Attorney Generalrsquos Office Gary Lyon was hired as the

Project Manager and Ana Navarro as the Business Process Analyst

Tyler Thew Design and Planning Manager has over 20 years of stormwater experience and his responsibilities

involve incorporating stormwater improvements into construction projects The Environmental Scientist IV

position is filled and interviews are pending for the Environmental Scientist III position This section will be

monitoring evaluating and identifying problems to hand over to the Design Section which will be carrying

out the actual construction projects and plans for those improvements Chris Holman is the Supervisor for the

Design Section and interviews have been conducted for the engineering positions

James Murphy Program Development Manager has 8 years of experience in the program and will focus his

attention on overseeing Program Development specifically in regard to stormwater training public education

and outreach The section will ensure that projects are compliant with Section 404 and Section 401

permitting Staffing for this section is approximately two-thirds complete Karin West Supervisor II and Jason

Perock Staff II Engineer previously worked in NDOTs Environmental Services This section is in the process of

hiring a Training Manager and Troy Orosco Officer II is developing stormwater training materials Kim Smith

PIO has been remarkable with the public education and outreach efforts

Michael Simmons PE Compliance and Enforcement Supervisor has approximately 20 years of experience in

the construction field His primary function is to develop and implement compliance and enforcement

protocols that will help govern their MS 4 under the guideline of the permits Recently theyrsquove hired Mickie

Reid from NDEP and she brings good knowledge to the program They have six internal compliance and

enforcement personnel which are imbedded within the districts

Leo Drozdoff asked how the compliance and enforcement group was going to work together

Mr Simmons stated staff will work extremely hard with business partners in the field to ensure they comply

and if they canrsquot it will be turned over to the enforcement side Program and policy decisions are still

developing He believes that they will incorporate the public in discussions to make sure all requirements of

the permit are met and the requirements of the consent decree Most importantly comply with the state

statutes and regulations

Craig Madole mentioned therersquos concern in the construction community that they are being held responsible

for their permit by an entity other than NDOT but now also through NDOT The Silver Book is silent on this

and there is nothing in their bid docs

Mr Simmons stated that Section 637 in the Silver Book is being revised to clean up some of those loopholes

or misconceptions and to put it all in one place so the contractor can easily reference it A new SWPPP

template is being generated to simplify it for the contractor resident engineer and program staff The

contractorrsquos name is on the permit and NDOT the owner so NDOTs job is to make sure the project is

compliant with the permit NDOT wants the resident engineers and the construction groups to manage the

stormwater permit to the best of their ability in the field

Mr Tinney committed to taking the draft SWPPP to the AGC and the ACTSWM Board

Mr Fraser asked what Environmental Protectionrsquos role is in compliance and enforcement

Chairman Emme stated NDEPrsquos role is to enforce the MS4 and stormwater permits that are issued by NDEP

Mr Drozdoff stated that we all wear different hats and so if there are things that NDEP or DCNR can do to

assist in training or anything else we certainly can assist formally or informally

Mr Gaskin commented that they are in close contact with the Transportation Board Rudy Malfabon

Director the Legislature and meeting with EPA quarterly

Mr Drozdoff stated NDEP will do the formal inspection If and when therersquos another audit there will be

enough checks and balances done either NDOT specific or NDOTDNCR specific that makes that next audit a

positive one

VI Status Report on Settlement of EPA Enforcement Action (For Possible Action) Mr Gaskin stated NDOT is

taking the legal steps to finalize the Consent Decree It was brought to the State Board of Examiners Meeting

for approval last week and they pulled it from the agenda for a technicality The Governorrsquos Office made it

public so now it will go back to the BOE on July 12 to get final approval It doesnrsquot slow down work to build

the program

Mr Drozdoff commented that the Governor made it public record and the penalty is $12000000 which in his

view is very small NDEP will receive $6000000 and EPA $6000000 which is a big success

VII Status Report on Development of NDOT Stormwater Management Program (For Possible Action)

Mr Gaskin gave an overview of meetings attended since the last ACTSWM meeting (Listed in Attachment 1)

In addition Mr Gaskin and Mr Tinney will be meeting with EPA in July

Mr Tinney gave an update on equipment purchases approved by the Legislature at the last session (Listed in

Attachment 1)

Mr Tinney discussed NDOTrsquos updates on Program Implementation

Completed the SWPPP Template for construction activities and a checklist for Resident Engineer

Start inspections in District II over the next couple of weeks to roll out the construction site stormwater

inspection forms

The Drone RFP is closed and being reviewed and the scope of this contract will be used for training

purposes as well as BMP inspections The total cost of that contract is up to $400000 and the intent is to

show the BMP are there from day one from start to finish as addressed in the Consent Decree

James Murphy has updated the eight hour training course which is required for staff members that

handle contracts inspections and field work NDOT has a thirty minute online training and AGC has a

sixteen hour training for NDOT and AGC has agreed to three additional trainings this month for our

District II staff

Continue to work on the Illicit Discharge Detection and Elimination IDDE and a form is on our website

that anyone can fill out and turn in an IDDE

Contract with UNR on the new Public Outreach Campaign

The new wash racks for equipment are set up in Carson City and in Reno

NDOT built new offices for the Stormwater Division on the second floor of the NDOT building

Kim Smith PIO NDOT Stormwater stated UNR Students at the School of Journalism conducted research and

developed a campaign based on their research data The challenge presented was how to reach out to

people and educate them about stormwater The students did some research and came up with the slogan

ldquoLove NV Watersrdquo Their research indicated that Love NV Waters creates personal connection with people

and creates a sense of ownership and responsibility to our waters Love NV waters communicate NDOTrsquos

commitment to protect our waters and this campaign incorporates all of that NDOT has a new logo our

media team developed the water drop with Nevada symbol inside of it and incorporated ldquoLove NV Watersrdquo

NDOT Storm water Program The UNR students determined social media platforms are the biggest way to

reach their group of people The social media platforms NDOT is launching are Twitter Love NV Waters

Facebook ndash Love NV Waters You Tube ndash NDOT Stormwater News and Instagram PSAs and education

materials are being developed for educators teachers and community groups NDOT is hoping to launch this

campaign this summer 2016

The recent outreach events were Earth Day in Reno SR 28 Public Meeting Reno River Festival Snap Shot Day

with NDEP Outdoor classroom and met with 5th Grade Students in Elko and NDOT Bring Your Kids to Work

Day

Two videos were shown New Wash Station amp Best Management Practices for stormwater compliance These

videos can be found on under You Tube NDOT Stormwater news

The next meeting is scheduled Sept 14 900 am in Carson City with the room location within DCNR to be

determined

STORMWATER PROGRAM UPDATE

BACKGROUND

In 2011 NDOT was audited by the US Environmental Protection Agency

and the Departmentrsquos Stormwater Program was found to be inadequate

In June of 2015 the Nevada Legislature approved Senate Bill 324 and a

budget amendment which gave NDOT the resources and authority

necessary to build a fully compliant Stormwater Program

SB 324 provided NDOT with enforcement authority to prevent unauthorized

discharges onto state highways rights-of-way and conveyance systems The

bill also established a new Deputy Director position and created the

Advisory Committee on Transportational Storm Water Management to

oversee implementation of the program

NDOT is working with the EPA and Nevada Division of Environmental

Protection to implement a Stormwater Program that meets or exceeds all

requirements

and if they canrsquot it will be turned over to the enforcement side Program and policy decisions are still

developing He believes that they will incorporate the public in discussions to make sure all requirements of

the permit are met and the requirements of the consent decree Most importantly comply with the state

statutes and regulations

Craig Madole mentioned therersquos concern in the construction community that they are being held responsible

for their permit by an entity other than NDOT but now also through NDOT The Silver Book is silent on this

and there is nothing in their bid docs

Mr Simmons stated that Section 637 in the Silver Book is being revised to clean up some of those loopholes

or misconceptions and to put it all in one place so the contractor can easily reference it A new SWPPP

template is being generated to simplify it for the contractor resident engineer and program staff The

contractorrsquos name is on the permit and NDOT the owner so NDOTs job is to make sure the project is

compliant with the permit NDOT wants the resident engineers and the construction groups to manage the

stormwater permit to the best of their ability in the field

Mr Tinney committed to taking the draft SWPPP to the AGC and the ACTSWM Board

Mr Fraser asked what Environmental Protectionrsquos role is in compliance and enforcement

Chairman Emme stated NDEPrsquos role is to enforce the MS4 and stormwater permits that are issued by NDEP

public so now it will go back to the BOE on July 12 to get final approval It doesnrsquot slow down work to build

the program

Mr Drozdoff commented that the Governor made it public record and the penalty is $12000000 which in his

view is very small NDEP will receive $6000000 and EPA $6000000 which is a big success

Completed the SWPPP Template for construction activities and a checklist for Resident Engineer

Start inspections in District II over the next couple of weeks to roll out the construction site stormwater

inspection forms

The Drone RFP is closed and being reviewed and the scope of this contract will be used for training

purposes as well as BMP inspections The total cost of that contract is up to $400000 and the intent is to

show the BMP are there from day one from start to finish as addressed in the Consent Decree

James Murphy has updated the eight hour training course which is required for staff members that

handle contracts inspections and field work NDOT has a thirty minute online training and AGC has a

sixteen hour training for NDOT and AGC has agreed to three additional trainings this month for our

District II staff

Continue to work on the Illicit Discharge Detection and Elimination IDDE and a form is on our website

that anyone can fill out and turn in an IDDE

and creates a sense of ownership and responsibility to our waters Love NV waters communicate NDOTrsquos

commitment to protect our waters and this campaign incorporates all of that NDOT has a new logo our

media team developed the water drop with Nevada symbol inside of it and incorporated ldquoLove NV Watersrdquo

NDOT Storm water Program The UNR students determined social media platforms are the biggest way to

reach their group of people The social media platforms NDOT is launching are Twitter Love NV Waters

Facebook ndash Love NV Waters You Tube ndash NDOT Stormwater News and Instagram PSAs and education

materials are being developed for educators teachers and community groups NDOT is hoping to launch this

campaign this summer 2016

BACKGROUND

In 2011 NDOT was audited by the US Environmental Protection Agency

and the Departmentrsquos Stormwater Program was found to be inadequate

In June of 2015 the Nevada Legislature approved Senate Bill 324 and a

budget amendment which gave NDOT the resources and authority

necessary to build a fully compliant Stormwater Program

SB 324 provided NDOT with enforcement authority to prevent unauthorized

discharges onto state highways rights-of-way and conveyance systems The

bill also established a new Deputy Director position and created the

Advisory Committee on Transportational Storm Water Management to

oversee implementation of the program

NDOT is working with the EPA and Nevada Division of Environmental

Protection to implement a Stormwater Program that meets or exceeds all

requirements

Kim Smith PIO NDOT Stormwater stated UNR Students at the School of Journalism conducted research and

developed a campaign based on their research data The challenge presented was how to reach out to

people and educate them about stormwater The students did some research and came up with the slogan

ldquoLove NV Watersrdquo Their research indicated that Love NV Waters creates personal connection with people

and creates a sense of ownership and responsibility to our waters Love NV waters communicate NDOTrsquos

commitment to protect our waters and this campaign incorporates all of that NDOT has a new logo our

media team developed the water drop with Nevada symbol inside of it and incorporated ldquoLove NV Watersrdquo

NDOT Storm water Program The UNR students determined social media platforms are the biggest way to

reach their group of people The social media platforms NDOT is launching are Twitter Love NV Waters

Facebook ndash Love NV Waters You Tube ndash NDOT Stormwater News and Instagram PSAs and education

materials are being developed for educators teachers and community groups NDOT is hoping to launch this

campaign this summer 2016

The recent outreach events were Earth Day in Reno SR 28 Public Meeting Reno River Festival Snap Shot Day

with NDEP Outdoor classroom and met with 5th Grade Students in Elko and NDOT Bring Your Kids to Work

Day

Two videos were shown New Wash Station amp Best Management Practices for stormwater compliance These

videos can be found on under You Tube NDOT Stormwater news

The next meeting is scheduled Sept 14 900 am in Carson City with the room location within DCNR to be

determined

BACKGROUND

In 2011 NDOT was audited by the US Environmental Protection Agency

and the Departmentrsquos Stormwater Program was found to be inadequate

In June of 2015 the Nevada Legislature approved Senate Bill 324 and a

budget amendment which gave NDOT the resources and authority

necessary to build a fully compliant Stormwater Program

SB 324 provided NDOT with enforcement authority to prevent unauthorized

discharges onto state highways rights-of-way and conveyance systems The

bill also established a new Deputy Director position and created the

Advisory Committee on Transportational Storm Water Management to

oversee implementation of the program

NDOT is working with the EPA and Nevada Division of Environmental

Protection to implement a Stormwater Program that meets or exceeds all

requirements

BACKGROUND

In 2011 NDOT was audited by the US Environmental Protection Agency

and the Departmentrsquos Stormwater Program was found to be inadequate

In June of 2015 the Nevada Legislature approved Senate Bill 324 and a

budget amendment which gave NDOT the resources and authority

necessary to build a fully compliant Stormwater Program

SB 324 provided NDOT with enforcement authority to prevent unauthorized

discharges onto state highways rights-of-way and conveyance systems The

bill also established a new Deputy Director position and created the

Advisory Committee on Transportational Storm Water Management to

oversee implementation of the program

NDOT is working with the EPA and Nevada Division of Environmental

Protection to implement a Stormwater Program that meets or exceeds all

requirements
