RE: APPOINTMENT OF ENFORCEMENT OFFICER AND DESIGNATION AS PROVINCIAL OFFENCES OFFICER

____________________________________________________________________________KEY ISSUEApproval to appoint a Toronto and Region Conservation Authority staff member as an Officer and Provincial Offences Officer.

RECOMMENDATION

THAT the appointment of Michael Brestansky as an Officer under the Conservation Authorities Act, as per Section 28(1)(d)(e), and as a Provincial Offences Officer be approved for the purposes of:

i) Enforcing Regulations made by Toronto and Region Conservation Authority (TRCA) pursuant to Section 28 and 29 of the Conservation Authorities Act; andii) Enforcing the Trespass to Property Act.

BACKGROUNDThe Conservation Authorities Act provides for a conservation authority to appoint officers to enforce its regulations. Furthermore, the Minister of Natural Resources has implemented, under the authority of Subsection 1(3) of the Provincial Offences Act R.S.O. 1990 , a class designation process for all conservation authorities whereby any conservation authority officer appointed under Section 28 (1)(d)(e) of the Conservation Authorities Act shall be designated by the Minister simultaneously as a Provincial Offences Officer. Once appointed, officers have the authority to enforce all offences and Regulations under the Conservation Authorities Act , in addition to the Trespass to Property Act , when carrying out their duties within the jurisdiction of the conservation authority.

The prerequisite to the Minister’s Provincial Offences Officer appointment is that all candidate officers:

be adequately trained in the legislation to be enforced, including the Provincial Offences

Act;have proof of a clean criminal record check, and;

be appointed as an officer to enforce conservation authority legislation at an official

board meeting.

Pursuant to the approval of the above noted appointment, the Minister’s requirements will have been addressed.

RATIONALEMr. Michael Brestansky has been employed with TRCA since 2007 and has recently joined the Enforcement and Compliance section as a Compliance Officer. He has successfully completed the Natural Resources Law Enforcement Program from Sir Sandford Fleming College. His appointment as an Officer will enable him to assist with TRCA's regulatory requirements and compliance objectives.

RE: APPLICATIONS FOR PERMITS PURSUANT TO ONTARIO REGULATION 166/06Development, Interference with Wetlands and Alterations to Shorelines and Watercourses

____________________________________________________________________________KEY ISSUEPursuant to Ontario Regulation 166/06, written permission from the Authority is required for:

a) straightening, changing, diverting or interfering in any way with the existing channel of a river, creek, stream or watercourse, or for changing or interfering in any way with a wetland;

b) development, if in the opinion of the authority, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development.

A permit may be refused through a Hearing Process, if in the opinion of the Authority, the control of flooding, erosion, dynamic beaches, pollution or the conservation of land is affected.

RECOMMENDATION

THAT permits be granted in accordance with Ontario Regulation 166/06 for the applications which are listed below:

The permit will be issued for the period of February 7, 2014 to February 6, 2016 in accordance with the following documents and plans which form part of this permit:

Letter of Undertaking to revise the engineering and landscape drawings to the

satisfaction of TRCA staff and provide the landowner authorization on the City/Region letterhead and a copy of all landowner agreements; prepared by Durham Region; dated January 22, 2014; received January 22, 2014.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The Region of Durham has proposed the installation of a new 1200 mm diameter feedermain along Tillings Road, from approximately 13 m south of the Canadian Pacific Rail (CPR) tracks to Concession Road 4, then turning west on Concession 4 Road to Taunton Road, continuing west on Taunton Road and ending at Infrastructure Ontario property, in the City of Pickering. In addition, a new 1200 mm diameter sanitary sewer will be installed on Tillings Road from 13 m south of the CPR tracks to Concession Road 4 and a 200 mm diameter Polyvinyl Chloride (PVC) sanitary sewer will be constructed on Concession Road 4, from Tillings Road to Taunton Road. Both the watermain and the sanitary sewer will be installed using a combination of open cut and jack and bore tunnelling techniques.

Control of Flooding:The proposed works are not anticipated to have impacts to the control of flooding.

Pollution:Standard erosion and sediment control measures (silt fence, pea gravel bag cofferdam) will be implemented prior to construction and maintained for the duration of construction, and until the site is stabilized and restored, in order to prevent construction generated sediments from entering any watercourse or wetland. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction .

Dynamic Beaches:Not applicable

Erosion:No geotechnical/slope stability issues have been identified.

Conservation of Land:The Redside Dace fisheries timing window of July 1 to September 15 will be applied to the project unless otherwise specified in writing by the Ministry of Natural Resources (MNR).

PlantingsAll disturbed areas will be stabilized and restored with a native non-invasive seed mix and 12 additional trees upon completion of the works. A net ecological gain will be achieved for this site.

Policy Guidelines:This proposal complies with Section 4.3 - Infrastructure and Servicing - of the Toronto and Region Conservation Authority's Valley and Stream Corridor Management Program.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The purpose is to recognize the installation of a culvert and existing grading works around an existing man-made pond within a Regulated Area of the Humber River watershed. The man-made pond is not fed by a defined watercourse but receives overland flow. The pond outlets through a culvert under an existing driveway to a shallow and mild draw feature which forms a part of the East Humber River Valley Corridor. This permit will resolve an outstanding violation issued by TRCA Enforcement Staff (Violation no. V2634, issued May 10, 2013)

The works which form this permit only include the installation of the culvert (which replaces a previously existing smaller culvert), associated grading works as well as other additional grading works relating to upgrades to the driveway within the TRCA regulated portion of the property. The grading works located within the TRCA regulation limit are minor in nature.

Based upon an engineering report by the applicant's consultant, TRCA Water Resources Engineering staff are satisfied that the new culvert has been adequately sized and appropriate erosion control measures are proposed. The downstream end of the culvert is to be restored with native, non-invasive vegetation which will ecologically enhance the draw feature.

Fee:As the works were commenced prior to the issuance of a permit under Ontario Regulation 166/06 and without prior review by TRCA staff, an additional administrative fee has been applied to this application.

Control of Flooding:The subject property is not located within the Regional Storm Flood Plain. There will be no impacts on the storage or conveyance of flood waters.

Pollution:Sediment control fencing has been erected to prevent the transport of sediment off of the site and into the valley feature.

Dynamic Beaches:Not applicable.

Erosion:There are no geotechnical concerns associated with this application.

Conservation of Land:As a watercourse will not be impacted by the proposal, no fisheries concerns will result. There are no other significant natural features on or adjacent to the property that may be negatively impacted by the proposal.

PlantingsAn area of the drawing feature located near the outlet of the culvert will be restored with native, non-invasive planting. All other areas will be restored to the previously existing sodded condition and will not affect any significant natural features.

Policy Guidelines:The proposal is consistent with Section 4.2.2 E) - Property Improvements and Ancillary Structures - of the Authority's Valley and Stream Corridor Management Program.

MINOR WORKS LETTER OF APPROVAL

Permission for Minor Works Letter of Approval are implemented by Planning and Development Division staff and are received monthly by the Executive Committee. The permission of minor works is subject to authorization by the Director, Planning and Development and signed by an appointed enforcement officer.
