PLANNING FOR LONG TERM CARE

Individuals must assess their options in funding long-term care. If the individual is not financially independent, other options, including Medicaid, should be evaluated. Appropriate legal and financial planning can solve the problems encountered when applying for Medicaid benefits. Even after a person has entered a nursing home, planning can be effective.

MEDICAID IN TEXAS

The State of Texas provides financial assistance for long-term healthcare through the Medicaid Program of the Texas Department of Human Services. A complicated application process is used to qualify potential recipients for Medicaid.

QUALIFYING CRITERIA

To receive Medicaid benefits, an irdividual must:

Be a US Citizen Be a Texas Resident Meet health criteria Be in a nursing home for 30 days Be under the income cap limit Be under the resource limit

COMPLICATED PROCESS

Medicaid law is complicated. The Texas Department of Human Services does not provide financial and legal advice to healthcare consumers.

Thousands of senior citizens, their spouses and families, are burdened with unnecessary expense because of their lack of knowledge about available Medicaid resources. Without legal advice and planning, financial assets become depleted, creating further stress for a spouse and family members.

My process for creating a financial plan to qualify for Medicaid benefits consists of four basic activities:

1. Establishing the current situation, including financial spreadsheets

2. Reviewing the goals and objectives of the spouse and family

3. Comparing the cunrent situation vs. goals through a comprehensive analysis

4. Providing recommendations that will help the family achieve their goals and objectives

P U T T I N G THE P L A N INTO ACTION

A thorough review of the individual's current situation and explanation of my suggested course of legal action is completed. The client then implements the recommendations of my law firm. All necessary legal documents are prepared for signature and as a final step, my law firm prepares Medicaid Form 1200 for submission to the Texas Department of Human Services requesting Medicaid benefits.
