Overseas Collection

MCT is a member under CISAC: The international Confederation of Societies of Authors and

Composers. Therefore, MCT has signed Reciprocal Agreement with Authors and Composers societies

worldwide as we called sister societies, now with 39 sister societies and cover around 90 countries all

over the world.

That is the reason why, when MCT’s Thai repertoires are used for music work of public

performing rights in other countries territories (the country list of MCT’s sister societies as the

table next page) the rights will be protecting and license the royalties back to the right

owners in Thailand. Same as International Repertoires are used in Thailand territory. There will

be protecting on the same worldwide standard.

Furthermore, if the musical work is used in other countries, the society can license from others country because of the Reciprocal Agreement that MCT signed with more than 39 sister societies cover over 70 countries around the world.”

NEW MUSIC SERVICES IN THAILAND

In year 2012, there are two big global music services providers launched their service in

Thailand which has upgraded our music business to the next level. The two biggest global music

services providers are iTunes from Apple Inc., United State and Deezer from Blogmusik SAS, France.

The service descriptions for both service providers as below:

iTunes is use for watching movies or listening to

music (same as Window Media Player that comes with Microsoft Window). We can found iTunes on PC, Mac, iPhone, iPad, and iPod. It’s produced by Apple Inc. also as iPhone, iPad, and iPod and Mac. Moreover, this program is able to run on Microsoft Windows e.g. XP or 7, and Mac OS. Importantly , iTunes is use for connecting PC with iPhone, iPad, or iPod and it will copy file from PC to device or from device to PC, backup or restore data, update latest iOS, download Apps, songs, and videos via iTunes store (free and pay).

Furthermore, on June 22nd, 2012, Apple Inc. launched Asia iTunes Music Store by added iTunes store in Thailand so that Thai people can purchase songs, movies, and music videos. Apple announced in Press Release that this is a full opening iTunes store in 13 countries (Thailand, Malaysia, Singapore, Indonesia, Philippines, Hong Kong, Taiwan, Brunei, Cambodia, Macau, Sri Lanka, Laos, and Vietnam). Currently, Apple Inc. has opened more than 50 iTunes store worldwide leads to higher in purchasing songs and movies legally. iTunes is another way to gain more revenue and pay back to music creators.

DEEZER is a music application for listening to

music by streaming from France. Deezer’s users can

listen to music everywhere and every time via variety

electronic devices, such as smart phone or tablet,

without downloading so it won’t waste devices

memory. Besides, user can share their favorite songs

or Play List on Facebook or Twitter easily. This could

count as a Social media Music Streaming that

connecting to society completely. Deezer also

provides song from artists in the past till present, just

like bring users back in each period of life. The

famous artists in each period are Frank Sinatra, The

Beatles, Aerosmith, Madonna, Michael Jackson, etc.

This application is a new trend for listening to music

for Thai people.

Apart from providing unlimited new enjoyment of

listening to music to users, it’s also support legal

listening. Moreover this is another way to connect

between composers, record labels, and listeners in

the way of selling or promoting. The advantages are

not only happen on the customers’ side but also on

artists and record labels. From now on, the old

pattern of selling Ringtone and Ringback Tone which

calculate the artists’ revenue from Download Model

will slightly change to Listening Model. In this way the

artists will receive more royalty and have more spirit

to create work continually.

Nowadays, braking intellectual property

is a national problem. When there’s a buyer,

there’s a seller. When there’s a free product

lover (both good quality and non quality),

there’s a provider. So the solutions like arresting

illegal CDs seller or closing illegal music

download websites are hard to solve. It’s a

solving problem not the root cause because

eventually the problem will arise again.

So, where’re the composers’ revenues come

from? Let’s find out.

In the past, main revenue came from

share of CDs, VCDs sold. However, the revenue

from this “Physical” format is decreasing but

higher in breaking copyright instead. So the

composers should have the “future plan” for

gaining more revenue to replace the missing

part. Even though, this new way isn’t challenge

and the revenue isn’t high as used to but it’s

stable. This could compare with planting a

standing tree. At first it might not bloom but

finally could collect its long term result for whole

life without asking or buying from anyone.

There’re many ways for “future plan”

whether a royalty from “Global Music Service” or

major music business company e.g. iTunes or

Deezer that just opened its business in Thailand

last year. It’s expecting that this kind of “Global

Music Service” prepare to launch more

businesses in Thailand and Asia. The music

service companies have the distribution system

to distribute the money back to per stream’s

copyright owners. Per stream means each time

music played, royalty is back to composers and

record labels. The more listeners, the more

revenues gain. However the distribution is on

the same worldwide standard.

Besides from “Global Music Service”,

another way to gain royalty are from concert,

live performance, event or music has been use

as a backing track in advertisement, TV, etc.

These will create substantial income. Since from

the past, Thai composers usually didn’t receive

royalty from these activities because signed

Monopoly Contract with record labels, except

the composer is the same person with the artist

and performing himself. Most of the record

labels pay only performing right but if they’re

mercy, they might include divided royalty with

performing revenue. On the other hand,

according to the international principal, the

licensed revenue will be huge if the right is

belonging to the composers. This is happening

with worldwide artists and composers, such as

Mariah Carey, Elton John, and Lady Gaga or in

Asia, Psy, a famous artist and the owner of

Gangnum style song. These artists are all

composers both for themselves and other

artists. When there’re shows or concerts, these

artist, who also are composers, will gain income

from two ways; 1.Performing revenue from

record label 2.Royalty from their own composed

songs which receive from music licensing

company that they’re membership. Please notice

that it’s not the same income because

performing revenue is not including in royalty,

unlike Thai composers whose revenues are still

included.

The one important rule, the artists have

to make sure that whether the copyright is

belong to them or not by checking the contract

thoroughly. Nevertheless, if the copyright is still

belonging to the composers, there’s nothing to

concern. The only thing that has to do is to be

careful when choosing organization. The good

organization should have the morality and

managing copyright for the artist’s benefits.

long period of time because music creation is

Where are composer’s revenues come from?

Announce from Central Commission on Prices of Goods and Services or CCP

Central Commission on Prices of Goods and Services (CCP) of Department of Internal Trade

(DIP) gives music copyright company in Thailand a chance to report details of licensed songs to

DIT in order to reduce number of music copyright companies. As a result, there are 15 companies

left from 31 companies that have register with Department of Intellectual Property (DIP). One of

them is MPC Music Co., Ltd.

MPC Music Co., Ltd is administration and grant the licensing in part of musical work for Music

Copyright Thailand Limited (MCT) and in part of sound recording for Phonorights (Thailand)

Limited.

According to the CCP announcement, MCT is able to collect royalty for members who are

authors & composers but not including counter claim works because MCT cannot register counter

claim works in the registration process.
