    ae-" Defendant Michael McMullen explains in hiscertification many of the abusive practices taken by Regions during its pursuit of foreclosurelitigation. It now appears that Regions is renewing its YOW to injure the McMullen family.Defendants are aware that their time in their home wil l not last forever. They are asking this togrant the relief sought o n- tw o primary bases. 1) A party not entitled to eviction is seeking

    enforcement; 2) the notice of eviction dated January 10, 2012 was not delivered to Defendantuntil February 11 thereby inequitably removing from them the opportunity to pack, find a newresidence, and peacefully leave th e premises.

    LEGA L A RGUM EN TThe New Jersey Legislature has enacted a strict set of guidelines as to the ma:tmer in

    which sheriff sales and evictions are to occur. These guidelines are more than mere formalitiesin light of the heightened risk of damaging consequences to homeowners that would occur if asale or eviction occurred in a faulty manner. See G.E. Capital Mortg. Services, Inc. v. ManIao,352 N.I.Super. 274, 284 (App .Div , 2002).

    Among the requirements are steps to document who acquires a borne at sheriff sale, tomake sure that that only the true title owner of the home is capable of carrying out an eviction.Record of sale is taken d0WD in an affidavit pursuant to NJ.S.A. 2A:61-9. Pursuant to thestatute, the certification is to state the following:

    I, A.B., sheriff, et cetera, do solemnly swear that the real estatedescribed in this deed made to C.D. , was sold by me by virtue ofan execution (or as the case m ay be) as is therein recited, that th emoney ordered to be paid has' not been paid, to my knowledge orbelief, that the time and place of the sale of said real estate wereduly advertised as required by law, a n d that the same was sold to abona fide purchaser for the best price that could be obtained.

    Defendants have sought but have been unable to obtain any affidavit documenting thesale as required by N.J.S.A. 2A:61-9.

    Januru:y 10,2012. {Certification of Michael McMullen] That document states the identity of theparty pursuing eviction as Regions Mortgage. [Exhibit 1: Notice of Eviction] The Gertifica!ion

    1: Notice of Eviction; certification of writ of possessicnjo.]On February 18, 2012, Defendants obtained the Country records evidencing ownership of

    the subject property. The records reflect that on October 30, 2007, a sheriff sale was held andthe property in question was purchased by Federal National Mortgage Association, commonlyknown as "Fannie Mae." [Exhibit 2: County Records] The tax records reflect that the recordowner of the subject property is Fannie Mae for the years 2009,2010,2011,20]2. [Id.] In fact,the deed is also recorded under the name Federal National Mortgage Assoc. within Book 3210,page 9 of the county records.

    Mr. Michael McMullen obtained further confirmation of the sale to Fannie Mae andcontinued ownership of the property by Fannie Mae. Tbis information is reflected in theCertification of Michael McMuHen.

    CONCLUSIONThe eviction now scheduled for February 29, 2012 should be stayed and the Court should

    conduct an investigation as to why Regions claims a right to eviction, and why the notice ofeviction was delivered thirty days after the date upon which it was executed. The Court should

    also look into the certification of Plaintiff's attorney which falsely states Regions relationship tothe home in question.

    4. O ur financial problems began in 2006 when my wife Roseman e was diagnosed withbreast cancer. We borrowed money to pay medical bills and ultimately fell behind on ourmortgage. Luckily Rosemarie is currently free from cancer after undergoing treatment.

    20. In tbe interest of justice I am asking that the Court conduct a hearing as to the conduct ofRegions with regard to its attempt to evict my family.

    21. The Notice of Eviction was filed by the law finn of Stem, Lavinthal, Frankenberg, &Norgaard. Their-attorney Fei'F. Lam, Esq. certified falsely that-Plaintiff-Regions'Mortgage is entitled to enforce a writ of eviction and remove us from our home. Theonly entity known to have a right to do so is Fannie Mae.

    22. Afrer obtaining thenotice-of eviction I began researching.the issue- of who owns ourhome and have confirmed that Fannie Mae is that entity ..

Atapproximately 2:25pm she told me to expect a phone call from a Chase representativebecause although Chase-had been sending-us-correspondence regarding our horne, herintemalsrecords show that.the.title owner of the home is Fannie.Mae.

    24. On February 17,20121 spoke-to Danielle from-the Sussex. County Secial Servicesdepartment who told me to call the Sheriffs department and ask them to verify the ownerof the home and purchaser at sheriff sale. 1 callen he Sheriff S office at 3:00pm that_sameday and'obtained'confirmation from employee Beckystha Fannie Mae purchasedthe deed at-sheriff sale.

    25. 0nFebruary-2.J-, 2012, I spoke with Loraine, a representative of the Housing Authority inTrentoQ,.tU ho also confirmed that Fannie Mae is the registered owner of my home.Loraine recommended that I callthe New Jersey Department ofBanldng.
