• Governor Signs Regulatory Certainty Bill, SB 1099
I’m happy to report that Governor Brown has signed our
sponsored bill, AB 1671 (Huffman) which is now Chapter 290 of
the 2012 Statutes and will take effect January 1, 2013.
AB 1671 contains two important provisions:
• It will extend the sunset of the zero percent retention provision
for all of California Department of Transportation (Caltrans)
construction projects that contain federal funding from its
current 2014 sunset date to 2020.
•
• It will allow state agencies to utilize electronic bidding by
providing a means to accept bidders security electronically.
Here are the arguments that I used to move this measure through
the Legislature and to ultimately obtain the governor’s signature.
California’s construction industry has experienced one of the
worst economic downturns in its history, with unemployment
levels that have exceeded 30 percent statewide. While the sour
economy has been devastating to virtually every contractor and
his/her employees, there has been one bright spot - government
agencies soliciting bids have reaped the benefits of significantly
lower prices due to increased competition by contractors who are
vying for a much smaller pool of work to bid on.
However, these government agencies have historically withheld
10 percent of the total contract price (called retentions) until all
of the work on the project has been completed. Since the law
has always required contractors to file payment and performance
bonds to guarantee both the completion of the work and to ensure
that all workers and subcontractors have been paid, retentions
are unnecessarily burdensome on contractors. Profit margins on
these contracts typically do not exceed two to four percent at best,
so the retentions created significant cash flow problems for many
contractors.
To address this issue, SB 593 (Margett), Chapter 341 of the
2008 Statutes, was signed into law in 2008. This bill prohibited
the Department of Transportation, until January 1, 2014, from
withholding retention proceeds to its contractors when making
progress payments for work performed on any transportation
project.
Because of its extremely positive impact on the construction
industry, and because Cal Trans has not experienced ANY
problems since the enactment of the existing provision, AB 1671
proposes to extend the sunset until 2020.
At the request of Caltrans, we amended this measure to help
facilitate the use of electronic bidding by state agencies, which
will significantly reduce costs for both state agencies and for
contractors bidding on state public works projects. Specifically,
existing law, Public Contract Code (PCC) Section 10167 provides
that bids for public contracts are submitted under sealed cover and
require a bidder’s security in the form of cash, a cashier’s check,
certified check, or a bidder’s bond executed by an admitted surety
insurer.

The advent of electronic methods of bidding enables state
departments to accept bids in a manner that is more efficient both
for the agency and for contractors. However, electronic bidding
does not provide a means to accept cash or check for a bidder’s
security under sealed cover as existing law requires for state
departments.
AB 1671 will enable state departments to use an all-electronic
bidding method by allowing the use of electronic forms of bidder
security when electronic forms of bidding are used. The bill
will still allow for the security to be provided by paper means
received by the department prior to bid opening if the contracting
Department so chooses.
I am proud to report that this measure received unanimous
approval throughout its journey through the legislative process! If
only ALL of our bills would move through this easily!!
Governor Signs SB 1099 Which Creates Regulatory Certainty
Another measure that we co-sponsored, SB 1099 (Wright), which
helps create regulatory certainty for businesses was signed by
Governor Brown this week.
SB 1099 (Wright) - Chapter Number 295 of 2012 Statutes,
provides certainty for business by creating a predictable and easy-
to-track implementation schedule for new regulations and provides
the language online that is contained in the new regulations,
making for much for easier access.
In addition, SB 1099 provides that all regulations must go into
effect quarterly on January 1, April 1, July 1 or October 1, while
still allowing for the adoption of emergency regulations when
necessary.
The bill also requires the Office of Administrative Law (OAL)
to make available on its website a list of regulations awaiting
implementation. State agencies must post on their website each
regulation filed with the Secretary of State and provide OAL with
electronic links to those regulations.
Each year, state agencies draft and implement numerous
regulations that go into effect 30 days after being filed with the
Office of the Secretary of State. Keeping track of these regulations
throughout the year presents a difficult challenge for California
businesses, especially small businesses that employ small staffs
and have limited resources.
The current regulatory process often results in businesses being
out of compliance and administrative penalties being levied.
SB 1099 addresses this issue by creating a single, reliable source
for businesses to learn about any pending regulations.

Kalb's Q&A for Contractors By David Kalb & Shauna Krause, Capitol Services, Inc.
With more than 30 years assisting contractors you might think wehavehearditall,butthat’snotlikelytohappen.Ourfirstquestion is a good example of why we never rest on our reputa-tion but always look for changes in practice or interpretation of contractor’s regulation. Like France has a different word for everything, each state has it’s own rules for contracting…
Q: I’ve recently read an article at your cutredtape.com website which stated in part: “…According to the Board, the practice of paying “inducements” or what are often called, ‘finder’s fees’ is ap-parently prevalent in several industries…The Board’s Enforcement staff held a sting operation in Riverside in March and all 9 contrac-tors (licensed and unlicensed) who showed up to bid clearly stated that referral fees would be paid once the “homeowner” signed a contract…”
I was interested in finding out more about this as I have couple friends who are interested in having me help them find leads for construction. They have licenses but I don’t know if the above applies, as I would only be handling the leads sort of like what a national Service company does. Any information or direction that I can take to find out more would really be appreciated.
A: We cannot tell you how this national “service” company handles referrals or “leads”; however, our guess is that their business model has been reviewed by the CSLB and deemed to be proper (i.e. not involving “inducements”). That said, if you enter into a home improvement contract with a homeowner that involves kickbacks or inducements with other contractors, you might be subject to a fine. If you have not already done so, I would suggest checking out the CSLB web site link on this subject (http://www.cslb.ca.gov/Newsletter/2010-Fall/page3.htm).
You also want to be careful that you’re not operating as a “home improvement salesperson” for these contractors. If “finding these leads” involves visiting a person’s home and or negotiating the work to be performed, this could trigger the HIS rules and require you to be registered with one or more of these licensed contractors. If you have any further questions, I would suggest contacting the CSLB and asking them for a second opinion. You’ll want to tell the Board exactly what you intend on doing to gather these leads and how you will be compensated for locating them. Good luck in your endeavor.
Q: You helped me get my Nevada license about a year ago. I’m not sure if you remember but I had some difficulty with the applica-tion process specifically because I was a new start-up company with little financial strength and as you know, Nevada has very strict financial requirements. I was able to get the license with a mini-mal bid limit, but I have had a difficult first year financially. My problem is that the Nevada Contractors Board sent me a request to review my financial information again even though I’m not up for renewal until next year. Is this normal? Will they pull my license if my financials aren’t as strong as they were a year ago when I originally applied?
A: You are not alone in having difficulty with the financial require-ment in Nevada, we hear from contractors every day in the same predicament! Nevada requires that all residential contractors in which the qualifying party has been a qualifier for less than two years in Nevada provide financial information on an annual basis. If your financial statement and bank forms do not support the bid limit you currently have, you have the option to lower your bid limit or possibly have a financial review hearing. The financial review hearing officer will give you some other options such as indemnification, or he/she may even just accept your information as it stands. Good luck!

Flagging Safety 101As a very important part of the construction crew, flaggers ensure that other workers can get the job done by diverting traffic away from the job site. They are required on construction sites where barricades and signs cannot successfully divert traffic. This position can be extremely dangerous in high speed areas or in the presence of aggressive drivers. There are several safety tips that will ensure a safe working environment on the roadside. Flagger Dos:
1. Attend safety training on directing traffic, understanding work zone layouts and responding to emergency vehicles.
2. Ask your supervisor how to handle situations with particularly aggressive drivers.
3. Wear a vest, shirt or jacket with highly visible colors: fluorescent orange, yellow or green.
a. In the evening, wear reflective clothing so drivers can see you from 1,000 feet away.
b. Wear a hard hat, long-sleeved shirt and long pants to protect against flying debris.
4. Stay alert to your surroundings at all times.
5. Stand on the shoulder visible to oncoming traffic – do not stand in the traffic lane.
6. Establish a communication system with other flaggers and the rest of the crew to use in an emergency.
7. Be courteous to motorists as you encounter them. Do not respond to angry drivers; instead call law enforcement if necessary.
Flagger Don’ts:
1. Avoid standing in areas where you may be crushed.
2. Avoid standing in the shade, around a curve or over the crest of a hill, as drivers may not see you.
3. Wait for a co-worker to relieve you before leaving your post.
4. Avoid distracting activities such as reading, day dreaming or talking with co-workers.
5. Do not listen to music.
6. Never turn your back to oncoming traffic.
7. Stay a safe distance away from construction equipment.
Flaggers are the barrier between a construction site and traffic. Stay alert and keep your guard up!

Señalización de seguridad 101Como una parte muy importante de la cuadrilla de construcción, los señalizadores aseguran que los trabajadores puedan realizar el trabajo desviando el tránsito del lugar de trabajo. Se requieren en los lugares en construcción donde las barreras y las señales no pueden desviar el tránsito con éxito. Esta posición puede ser extremadamente peligrosa en las zonas de alta velocidad o en la presencia de conductores agresivos.
