Dear Secretary Barton:

On behalf of Suniva, Inc. ("Suniva"), we hereby respectfully submit that the letter filed

today by Solar Energy Industries Association ("SEIA'') in the above-referenced investigation be

rejected as untimely. Suniva understands that the record in the injury phase of this investigation

is now closed.

As a final matter, in addition to the fact that (as admitted to by SEIA) adjustment plans

are not required under U.S. law, the fact of the matter is that Suniva is in Chapter 11 (due to a

massive surge of unfairly-traded imports), and thus any such plan will be part of its court-

approved restructuring plan. With an affirmative vote on injury from the Commission, Suniva

fully intends to complete its restructuring, and with an effective remedy in place, will resume

manufacturing operations.
