A12 DISCIPLINARY CASES

At its meeting on 25 February 2016, the Kennel Club Disciplinary Sub-Committee considered the conviction of Mrs S Thomas of Pontypridd, from the Cardiff Crown Court for offences contrary to the Consumer Protection from Unfair Trading Regulations 2008 and breeding without a licence (Breeding of Dogs Act 1973).

The Committee imposed the following penalties:

1 To disqualify her from exhibiting at, taking part in, attending and/or having any connection with any event licensed by the Club. If any person disqualified under this sub-paragraph shall attend any canine event whilst disqualified the General Committee shall have the power to increase the period of disqualification [A11 j (4)]

2 To disqualify her from being or becoming a member of any canine club or society registered with or affiliated to the Kennel Club [A11 j (5)]

3 To disqualify her from acting as an Officer or serving on the committee of any canine society [A11 j (6)]

4 To disqualify her from taking part in the management of any event licensed by the club. [A11 j (7)]

5 To disqualify her from judging at any event licensed by the Club [A11 j (8)]

6 To disqualify her from effecting registrations of any or all dogs and/or progeny of such dogs which are owned and/or registered by her (whether or not jointly owned and/or whether or not owned and/or registered in the name of a nominee). [A11 j (9)]

The above listed disqualifications are to be for Life from 25 February 2016.

The Committee, following the imposition of these penalties, would draw the attention of the Respondent to the effect of Rule A11 sub-section n.

The above listed disqualifications are to be for Life from 25 February 2016.

The Committee, following the imposition of these penalties, would draw the attention of the Respondents to the effect of Rule A11 sub-section n.

The offences included; trading as a pet shop without a licence, causing unnecessary suffering to a Dobermann by failing to provide veterinary treatment, causing unnecessary suffering to a Dobermann by the ‘inappropriate splinting of cropped ears’.

The Court imposed suspended custodial sentences and considered the offences to be serious and that Mr T Baranyi and Mrs A Lodine-Gombkoto had engaged in a commercial venture and ‘sophisticated operation’ with evidence of ‘some planning and deliberate mistreatment’ of puppies’.

The Committee noted that association of Mr T Baranyi and Mrs A Lodine-Gombkoto with the Kennel Club was minimal with two litters registered in 2015.

The Committee noted that there had been no response or mitigation presented.

The Court imposed a disqualification order of ten years from keeping animals.

For the above reasons, the Committee considered that a Life ban from Kennel Club regulated activity was appropriate.

ORRECTIONS

The offences involved;

Keeping a breeding establishment without a license from the Council, contrary to the Breeding of Dogs Act 1973.

Engaging in a misleading commercial practice, contrary to the Consumer Protection from Unfair Trading Regulations 2008, namely making false statements about her name and address and contravening the same regulations by placing adverts and falsely implying she was not acting as a breeder.

The Court imposed a five year disqualification order to reduce the number of dogs kept by Mrs Thomas to four dogs.

No response or mitigation had been received from Mrs Thomas.

The Committee noted that Mrs Thomas was already subject to Kennel Club disqualifications for a four year period due to expire October 2016, following previous convictions under the Animal Welfare Act.

In all the circumstances the Committee considered that a Life ban from Kennel Club regulated activity was appropriate.

At its meeting on 25 February 2016, the Kennel Club Disciplinary Sub-Committee considered the conviction of Ms D Fuller of Manningtree, from the North Essex Magistrates Court for offences contrary to the Animal Welfare Act 2006.

The Committee noted the Court had imposed a five year disqualification from keeping dogs and also a confiscation order in respect of 26 dogs.

Ms Fuller offered the explanation that it was a car boot malfunction which caused the dog to be released from her car resulting in the ensuing injuries to the dog which had been the subject of the court prosecution and conviction.

In the absence of any further information the Committee followed the Court’s decision in imposing a five year disqualification.

In view of the confiscation order by the Court, before reinstatement, the Committee directed that Ms Fuller would need to reapply and give satisfactory written reassurances and undertakings to the General Committee that she had appropriate resources in place to meet the welfare requirements* of the dogs then in her care and control should she intend to resume any of the activities as listed above.

*It is worth expressly stating the needs of an animal which must be met to the extent required by good practice under the Animal Welfare Act 2006 are

(a) its need for a suitable environment,

(b) its need for a suitable diet,

(c) its need to be able to exhibit normal behaviour patterns,

(d) any need it has to be housed with, or apart from, other animals, and

(e) its need to be protected from pain, suffering, injury and disease.

At its meeting on 25 February 2016, the Kennel Club Disciplinary Sub-Committee considered the conviction of Mr T Baranyi and Mrs A Lodine-Gombkoto of Braintree, from the Chelmsford Magistrates Court for offences contrary to the Pet Animals Act 1951 and the Animal Welfare Act 2006.
