Pursuant to a vote of the United States District Judges of this Court, Southern District of

Florida, it is hereb y

ORDERED that this Order supersedes all previous Orders establishing, in the Southern

District of Florida, a plan known as the Forfeiture of Collateral System for the National Park Service .

From the date of this Order, all forfeiture of collateral on covered offenses shall be handled in

accordance with General Local Rule 88 .4 and the schedule attached to this Order .

Under the plan, collateral may be posted in lieu of the personal appearance of a person

charged with certain covered offenses under the laws or regulations of the United States . The posting

of collateral shall signify that the person accused does not wish to appear nor request a hearing .

Collateral so posted shall be forfeited to the United States and the proceedings shall be terminated .

Collateral may not be posted for any covered offense if the alleged violator has previously been

convicted of any such ottense .

If a person charged with a covered offense for which collateral is required fails to post and

forfeit collateral any punishment, including fine, imprisonment or probation may be imposed within

the limits established by law upon conviction by plea or after trial . No person shall he detained for

failure to post collateral for a covered offense for which collateral may be posted unless the person

Nothing herein shall prohibit a law enforcement officer from arresting an alleged violator for

the commission of any offense, including those for which collateral may be posted or mandatory

appearance required, and forthwith notifying a United States Magistrate Judge for the purpose of

appearance or setting bail .

Offenses for which collateral may be posted in lieu of appearances and the amount of said

collateral shall be as shown on the Collateral Schedule attached hereto .

Pursuant to a vote of the United States District Judges of this Court, Southern District of

Florida, it is hereby

ORDERED that this Order supersedes all previous Orders establishing in the Southern

District of Florida, plans known as the Forfeiture of Collateral Schedules for the National Park

Service and National Wildlife Refuges . From the date of this Order, all forfeiture of collateral on

covered offenses shall be handled in accordance with General Local Rule 88 .4 and the schedules

attached to this Order .

Under the plan, collateral may be posted in lieu of the personal appearance of a person

charged with certain covered offenses under the laws or regulations of the United States . The posting

of collateral shall signi y that the person accused does not wish to appear nor request a hearing .

Collateral so posted shall be forfeited to the United States and the proceedings shall be terminated .

Collateral may not be posted for any covered offense if the alleged violator has previously been

convicted of any such offense .

If a person charged with a covered offense for which collateral is required fails to post and

forfeit collateral any punislu-nent, including fine, imprisonment or probation may he imposed within

the limits established by law upon conviction by plea or after trial . No person shall be detained for

appearance required , and fo rthwith notifying a United States Magistrate Judge for the purpose of

appearance or setting bail .

Offenses for which collateral may be posted in lieu of appearances and the amount of said

collateral shall be as shown on the Collateral Schedules attached hereto .

Unless otherwise specifically ordered by a United States Court, any wildlife or property which has been seized underthe authority of the Migratory Bird Treaty Act, 16 USC 703-711 ; the National Wildlife Refuge SystemsAdministration Act, 16 USC 668dd-668ee; the Upper Mississippi River Wildlife and Fish Refuge Act, 16 USC 721-731 ; the Eagle Protection Act, 16 USC 668-668e; The Endangered Species Act, 16 USC 1531-1542 ; The MigratoryWaterfowl Hunting Stamp Act, 16 USC 718-718i ; The Airborne Hunting Act, 16 USC 742j-1 ; The Marine MammalProtection Act, 16 USC 1361-1407 ; the Lacey Act, 18 USC 42; The Lacey Act Amendments of 1981, 16 USC 3371-3378; the American Antiquities Act, 16 USC 433, the Wild Bird Conservation Act, 16 USC 4901, or the AfricanElephant Conservation Act, 16 USC 4201-4245, where the final disposition of the case has been made by eitherpayment of a forfeiture of collateral or a judgment by the Court on behalf of the government and where so authorizedby statute, such wildlife or property shall be forfeited to the U .S. government and disposed of by the U .S. Fish &Wildlife Service in the manner prescribed by Title 50, Code of Federal Regulations, Part 12 .
