1 New Program will be a min. of 50% SLBE overall with specific minimums set per project; New Contractors’ Rotation Program (Sheltered Market) for SLBEs “pre-qualified” for listing on a roster
based on City Council removal of low bid requirement.
2 Guarantee is to firm who is considered a “good” risk in being able to complete the project without the needed collateral (need reviewed or audited financial statement, put in funds control (1%
payment to funds control agent who reviews, monitors, and process invoices) which goes into pot where claims are paid prior to paying the contractor use of assistance providers to mitigate (reduce the
risk). Less than a .2% ($200K) default rate out $350M in bonds) compared to industry average is over 30% for M&W since 1995. Letter of Credit Fee (1% of the Bond Amount) goes to the Bank.
Ala. Co. pays the 1% to the funds control plus the 1% for the Letter of Credit of Fee plus Merriweather & Williams administrative fee.
3 Agencies with overall PLAs are Oakland Unified School District and Port of Oakland; Peralta - for projects over $1M;
