The Maryland Board of Physicians (“the Board”) met Wednesday, May 23, 2012 at 9:00 a.m. and

CHAIRMAN’S REPORT

Noting a quorum of the Board present, Dr. Elder, Chair called the meeting to order at 9:13 a.m.

Dr. Elder introduced Dr. Laura Herrera, DHMH, Chief Medical Officer, to address the Board

regarding the selection process of the Board Chairman. She stated based on feedback from Board

members there were multiple qualities and criteria which a Board chairman should meet. Some of

the responsibilities of the Board Chair include: testimony, attendance at the Board and

subcommittee meetings, and annual FSMB meeting, receiving calls, and management of political

issues. The qualities needed range from time commitment, workload, good public speaking, and

previous experience with chairing a committee, leadership, personnel, writing ability and

flexibility. Dr. Herrara stated she will continue to accept additional feedback from Board members

to assist in this process.

Dr. Elder stated that he, Ms. Contee, Ms, Harrison, Dr. Gupta and John Papavasiliou attended the

Federation of State Medical Boards centennial meeting held in Fort Worth, Texas. Dr. Elder

reported one of the highlights presented during the meeting was information that the most popular

prescription drug being abused is Oxycontin. He stated many of these prescriptions are being

written by Maryland physicians. He reported there was a proposal made for a “platinum

certification of licensure” which would authorize a physician to practice in multiple states. He

informed the Board there was also discussion that the Federation would present a national plan for

licensure in all states to the legislature. Dr. Elder encouraged Board members to attend the

Federation’s annual meeting next year.

Dr. Elder presented Ms. Catalfo with a plaque from the 100th

Meeting of the Federation of State

Medical Boards.

EXECUTIVE REPORT

7. OPERATIONS UPDATE

Letter from Dr. Perman (MOU Consulting Services)- Mr. Papavasiliou reported the Board has a

copy of the Memorandum Of Understanding for $57,844 for consulting services paid through the

University of Maryland to Dr. Perman’s team. The memorandum outlines various costs in terms

of transportation, personnel and includes mandatory language from the state procurement system.

It also lists the specific duties of the team and the communication requirements between their

group and members of our Board. Mr. Papavasiliou stated he will email a copy of the

Memorandum Of Understanding to the Board members.


Independent Review- Ms. Catalfo welcomed two members of Dr. Perman’s review team, Barbara

Klein and Diane Hoffman.

Ms. Catalfo reported that the Division of Drug control and MBP worked in collaboration to set

forth the closure of Healthy Life Medical Group.

Personnel- Ms. Catalfo reported the vacancy for the Medical consultant position is open and has

been submitted for posting. Board members were encouraged to refer colleagues interested in

applying to submit applications. She thanked Dr. Sharfstein for his assistance in moving the

exemption forward.

Board Training -Ms. Catalfo stated Dr. Koya, Ms. Jackson, Ms. Walker, and Mr. Papavasiliou

are working on developing Board member training. An outline will be provided next month with

implementation to begin in August. Board members will receive additional training illustrating the

licensure and complaint processes and procedures.

Newsletter- The Spring Newsletter will be coming out shortly. Copies will be provided to Board

members via email and/or regular mail.

Workgroups- Ms. Catalfo stated she will be meeting with the Dashboard committee on May 30 to

provide workgroup updates and receive input regarding the action plan for the sunset

recommendations.

Backlog- Since the end of February, the Backlog committee and analyst have reviewed more than

300 cases. Sixty cases have been transmitted to peer review, 70 cases have been presented before

the Board, and more than 100 cases have been closed through the IRP committee and board action.

Public Citizens Ranking- Ms. Catalfo reported this year Maryland’s Public Citizen Ranking is

27th

among state medical boards. This projects a twelve point increase from last year when the

ranking positioned Maryland as 39th

out of 51.

8. POLICY

Athletic Trainer Regulations and Sanctioning Guidelines

On a motion made by Ms. Baker, and seconded by Dr. O’Herlihy, the Board voted

unanimously to APPROVE the Athletic Trainer Regulations and Sanctioning Guidelines.

Committee Appointments- Respiratory Care Professional Standards Committee

On a motion made by Dr. Strahan, and seconded by Dr. Handel, the Board voted

unanimously to APPROVE the Reappointment of Kylie O’Harver, to serve a second term

on the Respiratory Care Professional Standards Committee.

On a motion made by Dr. Strahan, and seconded by Dr. Handel, the Board voted

unanimously to APPROVE the Reappointment of Richard T. Peret, Jr., PT to the Athletic

Trainers Advisory Committee.

On a motion made by Dr. Knipp, and seconded by Dr.Walker, the Board voted

11-0-4 to APPROVE the April 25, 2012 meeting minutes.

BOARD VOTE TO CLOSE SESSION CLOSED SESSION: “Pursuant to Maryland State Government Annotated §10-501 et. seq., on a motion made by Ms. Contee, and seconded by Mr. Rose, the Board unanimously voted to close its meeting on May 23, 2012 at 9:40 AM, in rooms 108/109 for the purpose of complying with the Maryland Medical Practice Act that prevents public disclosures about particular proceedings or matters. Pursuant to Md. Hth. Occ. Ann. 14-411 (a) and (b), the Board is prohibited from disclosing any information contained in a proceeding record or file of the Board”______________________________________________________________________ Lunch Break began 2:00 p.m. Lunch Break ended 2:25 p.m.

charge and summarily suspend. There was one case for return to Board. There were two cases

for notice of intent to deny. There was one case for Board vote to issue an order to show cause.

There was one case for petition for termination of suspension. There was one case for petition for

reinstatement. There was one case before the board for consideration of a cease and desist order.

There were three cases for ratification of consent orders. There was one case for ratification of

letter of permanent surrender. There was one case for board vote for summary suspension. There

were three exceptions hearings. There was one post deprivation hearing. The April Board

Meeting minutes were approved. The May CRC Meeting minutes were approved.
