first duly sworn, on information and belief, states that:

Count 1: ARSON OF PROPERTY OTHER THAN BUILDING

The above-named defendant on Wednesday, December 18, 2013, in the City ofWhitewater, Walworth County, Wisconsin, by means of fire, did intentionally damage theproperty (other than a building) of Wal-Mart, valued at $100 or more, without that person'sconsent, contrary to sec. 943.03 Wis. Stats., a Class I Felony, and upon conviction may befined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than three(3) years and six (6) months, or both.

PROBABLE CAUSE:

1) Your complainant makes this complaint based upon the following, all of which yourcomplainant believes to be reliable. The information in this complaint does not exhaustyour complainant's knowledge of this incident.

2) Complainant has reviewed the reports of the City of Whitewater Police Departmentwhich reflect that on December 18,2013, at approximately 5:16 a.m., Officer JohnKleinfeldt was dispatched to Wal-Mart, located at 1362 West Main Street, in the City ofWhitewater, Walworth County, Wisconsin , for a report of fires in the Wal-Mart store.

3) Officer Kleinfeldt reports that when he responded to Wal-Mart he spoke to anemployee, Sheen Marsh, hereinafter the defendant, who was working as a third shift shelfstocker. Officer Kleinfeldt reports the defendant and other employees said there had beentwo fires in aisle seven and a third fire in aisle six, next to the cooler in aisle six. OfficerKleinfeldt reports he saw damaged plastic packages of food on one of the shelves. Thedefendant and other employees said they did not know how the fire started. OfficerKleinfeldt reports he spoke to the fire department investigator who said the fires seemedsuspicious because there were no nearby sources of ignition in the coolers.

4) Officer Kleinfeldt reports he spoke to Ashley Karrmann who said the defendant wasgoing to be fired later in the day because he had previously stolen from Wal-Mart. Officer

Kleinfeldt reporls he viewed video surveillance from Wal-Mart which showed the defendant

open the cooler door and then light an item on fire on one of the top shelves and then

showed the fire spread. Officer Kleinfeldt reports the defendant later admitted he started

all three fires. The defendant said he was upset that Wal-Mart gave him an absent day

when he went to the hospital for kidney stones and that he thought he might get fired for

using too many. The defendant said he started the fires for "getting revenge" and because

they were "screwing him".

5) Officer Kleinfeldt reports the value of items damaged from the fire was $2,132.60.
