PORT CHARLOTTE, FL– After nearly six years of ef-fort, culminating in a yearlongbattle with Charlotte County’szoning board, LutheranChurch of the Cross will nowbe able to build a 60-foot mon-ument cross on its 11-acreproperty. Last week, the Char-lotte County Board of Com-missioners voted 4-0 toinstruct zoning staff to re-ex-amine whether the monumentcross should be classified as a“sign” or as a “structure” and“work of art.”
In March 2012, the zoningboard denied the church’s re-quest because the board mis-classified the freestandingcross as a “sign.” The cross ex-ceeded the acceptable specifi-cations under the inapplicablesign ordinance: 40 feet high
and 150 square feet maximumarea. The cross as designed is60 feet high with 2400 squarefeet of area.
“Charlotte County’s in-transigent classification ofthe church’s monument crossas a ‘sign’ after expressingconcerns about what non-Christians might think of thechurch’s monument cross ex-poses the County to liability,”Liberty Counsel wrote in aletter to the Charlotte CountyBoard of Commissioners. “Ata minimum, the County’smisclassification and contin-ued delay is a violation of thechurch’s rights underFlorida’s Religious FreedomRestoration Act, the church’sFirst Amendment rights, andits rights under the ReligiousLand Use and Institutional-
ized Persons Act.”“The Religious Land Use
and Institutionalized PersonsAct of 2000 has made clearthat when evaluating restric-tions on the free exercise ofreligion, only those restric-tions that are the least restric-tive have the chance ofpassing constitutionalmuster,” said Mat Staver,Founder and Chairman ofLiberty Counsel.
“When the zoning boardclassified the cross as a ‘sign’on the basis that it might of-fend someone, it imposed anunconstitutional restriction,”Staver said.
“I am thankful that theCharlotte County Commis-sioners acknowledged that thecross was not a ‘sign,’ but a‘structure’ as well as a ‘work
of art,’ thereby enabling thecounty to issue LutheranChurch of the Cross a permitto erect a cross on their prop-erty. This classification is con-sistent with other works of artlocated throughout CharlotteCounty. I am pleased that theCharlotte County Commis-sioners made the right deci-sion,” Staver concluded.
