1. OVERVIEW
Brazil holds both a worldwide and with the EU bilateral trade deficits in the electrical machinery and
equipment (See United Nations International Trade Statistics Database - UN Comtrade database).
According to Aliceweb, in 2016, the electronic and electric Brazilian industry generated a trade deficit
of around US$ 14 billion, decreasing 18 percent in comparison with the previous year. In addition,
Brazilian exports of electrical goods in 2016 were 11 percent lower than the previous year.
1.1. Main characteristics
Electrical sector comprises all goods and their parts powered by eletricity within three categories:
major appliances or white goods; small appliances; and consumer goods or brown goods. The
Harmonized System Classification1 divided this sector into over 70 HS 4-digit subheadings.
Majors appliances include refrigeration equipment such as freezers, refrigerators and water coolers;
cooking equipments such as cookers (stoves, ovens, cooking plates and cooktops) and microwave
ovens; washing and drying equipment such as washing machines, clothes dryers and drying cabinets,
and dishwashers; and air conditioners, air heaters, and water filters.
Small appliances include lighbulbs and light fixtures, fans (table, ceiling and others), portable
wineries, water jet washers, sewing machines, drills, vacuum cleaners, blenders, mixers, juice
centrifuges, food processors, floor waxers, shaving appliances, hair cutting machine, depilatory
devices, electric heating appliances, electric iron, grills, coffee or tea makers, toasters, deep fryers and
other household equipment.
Consumer goods, small appliances or home eletronics are electonic or digital equipments for daily use.
They are entertainment goods such as musical instruments, flatscreen TVs, DVD players, DVD
movies, iPods, video games and consoles, remote control cars, radio and audio devices, home theaters,
cameras; communication and telecommunication goods as telephones, cell phones, smartphones,
tablets, e-mail-capable devices and laptops; and home and office goods such as laptops, desktop
comupters, printers, scanners, paper shredders. Home automation equipment is also included in
consumer goods.

2. MAIN REGULATION AND AUTHORITIES
In Brazil Federal government, several ministries and numerous agencies have jurisdiction for
establishing regulations to this sector, ensuring safety of goods, energy efficiency and regulating
imports of such goods. The Ministry of Mines and Energy (MME), Ministry of Science, Technology
and Innovation (MCTI), and Ministry of Industry, Trade and Services (MDIC), through its
interministerial committee, the Energy Efficiency Indicators Management Committee (CGIEE),
regulate the National Policy on Conservation and Rational Use of Energy. The Ministry of Labor and
Employment (MTE) regulates safety in labor environment and production, as well as sectorial
agreements between labor associations of a specific product or section and its employees. The
National Institute of Metrology, Quality and Technology (INMETRO) and the National Agency of
Telecommunication (ANATEL) are the primary regulators of electrical goods. In any case, the
Brazilian Law requires all regulatory documents to be available online.
2.1. Brazilian Notifications to the WTO/TBT Committee
A brief analysis of the profile of technical regulations notified by the Brazilian government to the
WTO Committee on Technical Barriers to Trade (TBT) may give an idea of the big picture of electro-
electronic sectorial regulation in Brazil. Projects of technical regulations that impact international
trade have to be notified to the WTO. In addition to INMETRO, the national enquiry point to the
WTO/TBT, other entities also notify under the WTO/TBT Agreement, mainly ANATEL and Ministry
of Mines and Energy. From 1 January 1995 until 30 March 2017, there were 50 notifications from
Brazil, concerning the eletrical machinery and equipment Sector, on TBT.

INMETRO has been the main body having technical regulations notified to the WTO, but ANATEL
and MME have also notified relevant regulations.

Figure 2 above shows that the main objectives of the technical regulation notified to the TBT
Committee are safety issues, telecommunication/radio communication, metrology, noise pollution,
labeling, human health and environment.

Figure 3 above demonstrates that 62 percent of all notified regulation is based on standards issued by
ABNT, without explicitly endorsing any international standard. Remaining 38 percent is divided into
ASTM, UL, ISO, IEC, ISO-IEC, CISPR, CIE and general rules.
2.2. The Free Zones
During the 1960s and the 1970s, Brazil Economic Plans established the production on what was
defined as electrical white goods2 through industrialization plans on free zones. According to The
Brazilian Development Bank (BNDES), the white goods industry experienced a moderate expansion
during the 1960s, accentuated growth during the 1970s and estagnation during the 1980s and first half
of the 1990s3. The Decree n. 228/1967 created the Manaus Free Zone, which played an important role
in fostering the electrical industry in Brazil. All production processes in Free Zone must have a

interministerial decree establishing a Basic Productive Processes (PPBs, in Portuguese) for each good.
With the promulgation, in 1988, of the current Constitution of the Federative Republic of Brazil, Free
Zones are now under the administration of MDIC Secretary of Development and Industrial
Competitiviness through the General-Coordination of Eetric and Electronic Complexes
(Coordenação-Geral do Complexo Eletro-eletrônico (CGEL), in Portuguese)4. Each of those PPBs is
composed by a set of technical descriptions for all phases for the good production and tax exemptions
for exports. There are currently 778 interministerial decrees and ordinances that apply to electric-
eletronics. The production poles of brown goods are also concentrated at the Manaus Free Zone
(MFZ). Such goods benefit from the tax incentives, although not the drawback system5. PPBs for
televisions and monitors (Interministerial Ordinance n. 290/2013 and respective amendments and
updates), apart from tax extemptions, determines mandatory percentage of local content on aggregate
value and local components. Generally, PPBs currently in force focus on small appliances such as
cellphones and smartphones supply chains produced at MFZ.
2.3 Labor and safety of goods and workers6
The first regulatory issue on employment rights affecting the sector is the Labor Rights Decree n.
5,452/1943, or the Consolidation of the Labor Laws (CLT). CLT regulates the minimium level of
protection guaranteed by the State on safety and occupational health. Specific rulemaking governing
professions and regional councils also set dispositives regarding safety for goods and workers that
affect the electro-electronic sector. Federal Law 5,194/1966, Resolution n. 218/1973 and Resolution n.
336/1989 of Federal Council of Engineering and Agronomy (CONFEA) regulate the engeneering
profession and create the engeneering regional councils. Federal Law 6,496/1977 creates the
Technical Liability Annotation. The Ordinance SIT 3,214/1978 establishes the Regulatory Norms
(Normas Regulamentadoras – NR), as defined on Chapter V, Tittle II, of the CLT, on safety and
occupational health and hazards. There are six NRs setting rules to this sector. NR-09, last updated in
2016, regulates Programs on Environmental Risk Prevention. It establishes a program and a comission
for accident prevention (CIPA7– CLT Art. 163 and NR-5), that have annual planning and registry,
accountability, risk evaluation and management, implementation of measures and risk expositure
monitoring. The sector Specialized Service in Safety Engineering and Occupational Medicine must
implement all norms agreed (SESMT8, CLT Art. 162 and NR-04). NR-10 regulates safety in electric
instalations and services. It establishes the minimum requirements and conditions for the
implementation of control measures and preventive systems in order to protect the safety and health of
workers who directly or indirectly interact in electric-electronic installations and services with
electricity. This NR calls upon international standards to fill in gaps in internal regulation.
Furthermore, risk analysis rules are similar to NR-9 provisions, with measures towards colective and
individual protection. NR-14 regulates safety in ovens and stoves. NR-26 regulates safety signs
determining colors used in workplaces to identify safety equipment. It must integrate labeling
requirements and it follows the international criteria of Globally Harmonized System of Classification
and Labeling of Chemicals (GHS) of the United Nations. NR-12 and NR-28 regulate labor safety, and
supervision and penalties, respectively, and they apply to all Brazilian production. NR-12 and NR-28
were scrutinized in Machinery Sector report.

In 1994, Brazil ratified International Labour Organization (ILO) Convention 119 on Machinery
Protection, alongside with 7 out of 8 fundamental conventions and 86 out of 177 technical
conventions. A parallel can be traced between updates on NRs and on negotiations at CIPAs with
Brazil advances in signing ILO conventions, and recommendations. Finally, in general terms, Brazil
has followed international standards as a basis for its labor safety rules.
2.4 Energy Efficiency
Energy efficiency in Brazil is a public policy regulated by the aforementioned CGIEE interministerial
committee. The National Policy on Conservation and Rational Use of Energy is based on Federal Law
10,295/2001 and it regulates electric energy consumption bands and goals, as well as water usage and
gas consumption. It has registry requirements, and two mandatory governmental labels for gas
consuption (PROCEL) and energy consumption (CONPET), in which the listed equipments are to be
classified from A to E levels of efficiency in energy consumption. Both PROCEL and CONPET are
under IMNETRO, and all producers and importers shall file for registry at INMETRO.
The same law also establishes that government procurement and acquisitions must only acquire “A-
rated” effiency products. All CGIEE ordinances were submitted to the WTO for consultations. The
products subject to CGIEE and the PNE are: electric motors (Decree 4,508/2002 and Ordinance PI
553/2005); and electric motors based on ABNT NBR 7,094/2000; fuorescent compact lamps
(Ordinances 132/2006 and 1,008/2010); refrigetators and freezers (Ordinance 362/2007); gas ovens
and stoves (Ordinance 363/2007); air conditioning (Ordinance 364/2007); water heaters (Ordinance
298/2008); electromagnetic reactors for lamps (Ordinance 959/2010); incandescent lamps (Ordinance
1,007/2010); and Distribution Transformers (Ordinance 104/2013).
3. STANDARDS AND SUPPORTING STANDARDS
ABNT9 issued about 1181 standards for electronic products or parts. The Committee on Electricity
(ABNT/CB-003) has 936 norms, while the Committee on Computers and Data Processors
(ABNT/CB21) has 51 norms. Committee on Air Refrigerators and Heaters (ABNT/CB55) has 42
norms, the Comission on Digital Television (ABNT/CEE-85) has 146 norms. Comission on Energy
Management (ABNT/CEE-116), has 5 norms all of them ISO-based, and the Comission for Mitigation
of Electric Interferences (ABNT/CEE-212) has only one standard. The following graphic illustrates
the different types of ABNT standards on electrical equipment.

supporting standards, usually issued by ABNT, a private body. There are different kind of supporting standards
issued by ABNT that goes from a fully original standard developed under its Standardizing Committees (CB) to
those based on international standards, mainly ISO and IEC. Usually, (i) If it is a standard identical to an
international standard, it will appear, for example, as ABNT NBR ISO nº XXX; (ii) If it is based on an
international standard, a reference to this international standard will be in the preamble of the standard; and (iii)
If it is an original standard, it will appear as ABNT NBR nº XXX. ABNT does not provide a list of all
international standards adopted in full or modified by any of its committees. The search tool available requires a
keyword search that goes from product to product at ABNT’s website. ABNT Catalog with all searching tools is
available here. In the same way as CEN, CENELEC, ASTM and other standardizing bodies, the interested party
have to pay a fee in order to have granted full access to the content of standards issued by ABNT. The costs vary
depending on the standard.

INMETRO10, CGIEE and ANATEL are the most active federal regulatory agencies and/or public
bodies to issue regulations on the electrical machinery and equipment sector. The National
Telecommunications Agency (ANATEL) was created by the general telecommunications act (Federal
Law 9,472/1997) and governed by Decree 2,338/1997. The agency has some degree of administrative
autonomy and discretion to issue regulations as well as a specific annual budget. ANATEL also holds
powers of granting, regulating and supervising telecommunications in Brazil -- with technical
expertise and all material assets needed – and only a court ruling can repeal one of its decisions.
INMETRO, through Ordinance 121/2015, regulates and determines deadlines for companies to
comply with all technical regulations defined by INMETRO Ordinance 371/2009, which approves the
Conformity Assessment Requirements for Household Appliances and Similar Goods, and establishes,
under the Brazilian System of Conformity Assessment (SBAC), compulsory certification for most
electric devices. It lists 199 electric devices that shall comply with Inmetro’s compulsory certification
conformity assessment procedures. All 199 different products and their similars shall be in conformity
with 79 different standards based on IEC standards (see table in the appendix).

4. CONFORMITY ASSESSMENT AND CERTIFICATION
Before a electronic product can be placed on the Brazilian market, it shall be registered with
INMETRO and receive a registration number which shall be placed on the label of the product.
Therefore, INMETRO is responsible for the compliance and registration of any electronic processing
facility established in Brazil. Brazil does not have any policy for pre-market notification process. Each
company registration or authorization to sell is the first step to have access to INMETRO services.
There are, then, two registry and conformity assessment paths. The first is the Brazilian Labeling
Program (Programa Brasileiro de Etiquetagem - PBE). PBE relates to energy efficiency and is part of
the implementation of the National Plan for Energy Efficiency (Plano Nacional de Eficiência
Energética (PNEf)), as regulated by the CGIEE. The current National Energy Plan (PNE2030) sets
goals and establishes the PBE new requirements. All products at free zones establishments where
electro- electronics are manufactured and packaged are under the PBE program. The second path is
through Ordinance 371/2009, which establishes basic compulsory standards for all electronic products
that does not fall under Inmetro’s PBEs.
The conformity assessment procedure is compulsory for various electrical and electronic products. In
certain cases, certification may be replaced by a supplier's declaration. Conformity assessment
procedures are determined in INMETRO ordinances. These procedures often adopt international
standards, especially those issued by the IEC, which is frequently mentioned in Brazilian technical
regulations. The following table summarizes by products the conformity assessment mechanism, the
issuing regulatory agency, the ordinance number and standards and other regulation mentioned. In
total, 28 percent of all Brazilian Technical Regulation are Brazilian standards, while 72 percent are
based on international standards.
Moreover, the Good Manufacturing Practices (GMPs) include a set of measures that should be
adopted by the electro-electronic companies, in order to ensure the quality of the products. Each type
of product has its own specifications, but all shall comply with the Ministry of Labor regulations. The
certification procedure consists of official certification bodies, or officially recognized certification
bodies ensure, recognizing that the electro-eletronic products or parts, or their control systems, are in
conformity with the requirements of a standard. Where possible, alternative measures are considered
for certification, such as, special inspection systems or equivalent requirements of trade partners are
alternative measures considered when possible.

Bilateral or multilateral agreements such as mutual recognition agreements may be stipulated.
INMETRO, the only acredutation body in Brazil, usually negotiates such agrrements. The Conformity

Assessment Brazilian System (SBAC) and Conformity Assessment Brazilian Committee (CBAC) are
regulated by CONMETRO Resolution 4/2002. Importers and like producers of electro-electronic
goods under the compulsory list shall register their products and pay fees, which vary according to the
type of product and the size of the company. The competent public body for dealing with imports and
their conformity with domestic regulations is the Department for Foreing Trade Operations
(Departamento de Operações de Comércio Exterior – DECEX). All products shall have an Import
Lincense (Licença de Importação – LI) previous to its shipping at the Integrated System of Foreing
Trade (Sistema Integrado de Comércio Exterior – SISCOMEX). If it is a good exclusive for industrial
use, or if it is a like product to those listed at Ordinance 371/2009 of INMETRO or even if they are

5. MERCOSUR REGULATION
Mercosur has adopted few regulations on the electrical machinery and equipment and parts thereof. A
relevant number of adopted norms creates technical regulations for specific products and specified
tariff lines. The SGT nº 3 - Technical Regulations and Conformity Assessment and its Safety
Committee for Electrical Products approved work plans in the past, information documents and
working documents for the integration of the sector regulation as the Table below shows:

In 2000, MERCOSUR Association for Standardization (AMN) and the European Committee for
Electrotechnical Standardization (CENELEC) reached an agreement with the objective of improving
the mutual understanding of each organization.
The main actions agreed by the parties are the following:
Training of AMN officers in matters related to job/tasks performed in regional organizations
by CENELEC;
Conduction by CENELEC, through its national standardization bodies (NSBs), of seminars
about the basic values of European Standardization and the European New Approach related
to the electrotechnical sector and exchange of information on electrotechnical standardization.
The implementation of the protocol occurs through specific projects in which each party define
responsibilities, financial conditions and achieving goals. In total, 25 percent of all Mercosur
Technical Regulations refer to standards, while 75 percent are based on tax incentives and exceptions.
6. MAIN GOVERNMENTAL AND PRIVATE ACTORS IN THE SECTOR
Main government actors involved with the electrical machinery and appliances sector are: (1) Ministry
of Industry, Foreign Trade and Services (MDIC), more specifically Secretary of Foreign Trade
(SECEX) and Secretary of Development and Industrial Competitiveness (SDCI); (2) Ministry of
Science, Technology and Innovation (MCTI), (3) The Ministry of Labor and Employment (MTE) ; (4)
the National Agency of Telecommunication (ANATEL); (5) the National Institute of Metrology,
Quality and Technology (INMETRO); and (5) National Health Surveillance Agency (ANVISA).
Main private actor involved with the electrical machinery and appliances is the Brazilian Association
of the Electro-Electronic Industry (ABINEE).
