MAINEBARADMISSIONRULES

I.SCOPEANDPURPOSE

RULE1.SCOPE

These rules govern the performance of the duties of the Board of BarExaminersandtheadministrationoftheexaminationsthattheBoardconducts.

RULE2.PURPOSE

These rules are intended to provide fair and efficient procedures andstandards for determining the qualifications to practice law of applicants foradmissiontothebar.

II.THEBOARDOFBAREXAMINERS

RULE3.COMPOSITIONANDAPPOINTMENT;TERM;OFFICERS

(a) Composition and Appointment. The Board of Bar Examiners shall

consistofsevenlawyersoftheState licensedtopractice lawinMaineandtworepresentatives of the public. The lawyer members of the Board shall beappointed by the Governor on the recommendation of the Supreme JudicialCourt. The public members shall be appointed by the Governor. Vacanciesoccurring fromdeath, resignation, removal, or inability to act shall be filled inlikemannerfortheunexpiredterm.Anincumbentmaycontinuetoserveuntilasuccessorisappointed.

(b)Term.EachmemberoftheBoardshallholdofficeforatermof5yearsbeginningonthefirstdayofJanuaryoftheyearofappointmentandendingonthelastdayofDecemberoftheyearofexpirationoftheappointment.

(c) Officers. The members of the Board shall annually elect from theirnumberachair,asecretary,andatreasurer.Thedutiesofthechairshallincludecallingandpresidingatmeetingsof theBoard, correspondingonbehalfof theBoardwith applicants and others, and representing theBoard in regional andnational organizations. The duties of the secretary shall include giving noticeand recording minutes of meetings. The duties of the treasurer shall include

receivingallfees,charges,andassessmentspayabletotheBoardandaccountingforandpayingoverthesameaccordingtolaw.

RULE4.TRANSACTIONOFBUSINESS

(a)TheBoardshallmeetfromtimetotimeatthecallofthechairmanoramajorityoftheirownnumberasnecessaryfortheperformanceofitsdutiesandtheconductofotherbusiness.Suchmeetingsshallbecalledonat least5days'writtennoticeunlessallmembersoftheBoardwaivesuchnotice.Meetingsmaybe held by telephone conference or similar means enabling all membersparticipating at the meeting to hear one another. Except as provided inSubsection 4(b), fivemembers of the Board shall constitute a quorum for thetransactionofbusiness.TheBoardmayactthroughtheconcurrenceorvoteofamajority of thosemembers present at ameeting called on sufficient notice orwaiverofnotice.

(b) TheChairmanmay, in his discretion, designate a panel consisting ofthree Board members, at least one of whom shall be a public member, totransacttheBoard'sbusinessandresponsibilitiesunderRule9(b),(c),and(d).

III.APPLICATIONFORADMISSIONTOTHEBAR

RULE5.APPLICATIONPROCEDUREANDFORMS

(a)ApplicationDeadlines.Anypersonwhoseeksadmissiontothebarof

Maineshall filetheapplicationprovidedinsubsection(b)ofthisrule,togetherwith the fee provided in Rule 6, with the Board within the following timeperiods:

(1)FortheFebruaryexamination,betweentheprecedingOctober15andtheprecedingDecember20.

(2) For the July examination, between the preceding March 15 and theprecedingMay20. (3)ForadmissionpursuanttoRule11A,atanytime.

(b)Application.Theapplication,onaformtobeprovidedbytheBoardinaccordancewithsubdivision(d)of thisrule, shall set forth thename,dateand

placeofbirth,socialsecuritynumber,permanentresidence,andcurrentaddressoftheapplicant;allsecondaryschools,undergraduatecolleges,andlawschoolsandothergraduateorprofessionalschoolsattended,togetherwiththedatesofattendanceanddegreereceived,orreasonforleaving;thenamesandaddressesof any employerswithin thepreceding5 years; thenames and addresses of 3persons to provide the references to the applicant’s character and fitness topracticelawrequiredbysubdivision(c)(4);anycriminalconvictions(otherthanminor traffic violations) in any jurisdiction and the circumstances thereof;whethertheapplicanthasbeenadmitted,ordeniedadmission,tothebarofanyjurisdiction, together with a statement of the circumstances of any denial ofadmission and a statementwhether the applicant is in good standing in eachjurisdictionwhereadmittedand,ifnot,anexplanationofthecircumstances;andastatementofanyspecialcircumstances,suchasaphysicalhandicap,forwhichthe applicant requests the establishment of special rules for taking theexaminationinaccordancewithRule10(f).

(c) AdditionalMaterials. The applicant shall cause to be filedwith theBoardwithhisorherapplication, the following itemsonformstobeprovidedbytheBoardinaccordancewithsubdivision(d)ofthisrule.

(1) The certificate of the registrar, or other appropriate official, of eachaccredited college or university from which the applicant graduated with abachelor'sdegree,ortheapplicantsuccessfullycompletedatleast2years'workasacandidateforthatdegree,togetherwiththedatesofattendanceandawardofthedegreeorcompletionofthework. (2)Thecertificateofthedeanofeachlawschoolattendedastothedatesof attendance, the reason for leaving if other than the award of a degree, anydegreeawardedandthedateofthedegree,andanycircumstancesrecordedintheapplicant'sfilethatreflectadverselyontheapplicant’scharacterandfitnesstopracticelaw.

(3)Thecertificateofanyattorneyinwhoseofficetheapplicantstudiedastothedatesofsuchstudyandthesuccessfulcompletionofthecourseofstudy.

(4) Completed reference questionnaires provided by the Board to theapplicantanddeliveredtotheBoarddirectlybythepersongivingthereference.It shall be the applicant's duty to ensure that the persons providing the

referencessubmitcompletedreferencequestionnairestotheBoardinatimelymanner.

(5)Acertificateofgoodstandingfromthebarofanyotherjurisdictioninwhichanapplicantiscurrentlyadmitted.

(6) Any other material requested by the Board pertaining to theapplicant’scharacterandfitnesstopracticelawortospecialcircumstancesforwhichtheapplicanthasrequestedtheestablishmentofspecialrules fortakingtheexaminationinaccordancewithRule10(f). (7)TheBoardmayexemptapplicantsforadmissionpursuanttoRule11Afrom filing the documents listed in paragraphs (1), (2), and (3) of thissubsection.

(d) Forms andOther ApplicationMaterials. The Board shall prepare,and may revise from time to time, forms for the application required insubdivision (b)of this rule and the certificates andquestionnaires required inparagraphs (1) through (4) of subdivision (c) of this rule, as well as othernecessaryapplicationmaterials.ApplicantsmayobtainallnecessaryformsandothermaterialsuponrequesttotheBoard.

RULE6.FEES

(a)ApplicationFees.Eachapplication foradmission to thebar shallbeaccompaniedbytheappropriatefee.Paymentshallbemadebypersonalcheck,cashier's check, certified check, or money order payable to the Board of BarExaminers. (1)Applicantsadmittedinanotherjurisdictionforoneyearormore. Eachapplication foradmissiontothebarbyanapplicantwhohasbeenadmittedtopractice in any other jurisdiction for one year ormore shall be filedwith theBoard on forms prepared by the Board and shall be accompanied by a fee of$650plusanyapplicablelatefees.ApplicantsadmittedtopracticeinanyotherjurisdictionforoneyearormoreshallalsoauthorizetheNationalConferenceofBarExaminerstoprepareafullinvestigativereportandsupplyittotheBoardina timely manner and shall pay the fee the National Conference sets for thatservicedirectlytotheNCBE.

(2) Applicants never admitted in any jurisdiction or admitted in anotherjurisdictionforlessthanoneyear.Eachapplicationforadmissiontothebarbyanapplicantwhohasneverbeenadmittedtoanybar,orwhohasbeenadmittedtoanother bar for less than one year, shall be filed with the Board on formspreparedby itandshallbeaccompaniedbya feeof $600plusanyapplicablelatefees.

(3) Applicants seeking admission pursuant to Rule 11A and 11B. Each

application for admission to the bar uponmotion pursuant toRule 11A or bytransferredUniformBarExaminationscorepursuanttoRule11BshallbefiledwiththeBoardonformspreparedbytheBoardandshallbeaccompaniedbyafeeof$900. ApplicantsseekingadmissionunderRule11AshallalsoauthorizetheNCBE topreparea full investigative reportandsupply it to theBoard inatimelymannerandshallpaythefeetheNCBEsetsforthatservicedirectlytotheNCBE.

(b)LateFees.TheBoardmaydeterminetoacceptapplicationsafterthedeadlines set forth in Rule 5(a) if in the exercise of its discretion or in theopinionoftheCourtnounduehardshipwillresulttotheBoard'sadministrativeproceduresbysuchacceptances.TheBoardmaysetascheduleof latefeesif itdecidestoacceptsuchsubmissions.Anypolicyandassociatedscheduleof feessoadoptedshallbemadeavailabletoapplicantsonformsprovidedbytheBoardoronanyotherpubliclyavailableformofelectronictransmissionmaintainedbyit.

(c)AdditionalFeesandCosts.TheBoardofBarExaminersmayassessandcollectadditionalfeesequaltoanyactualoradministrativecostsitexpendsor incurs on an applicant's behalf, including but not limited to, copying costs,investigative costs, or costs for special accommodations. If the Board seeksreimbursement, payment may be made by personal check, cashier's check,certifiedcheck,ormoneyorderpayabletotheBoardofBarExaminers. (d)FeesNonrefundable.AllfeespaidtotheBoard,includingapplicationfees, formsandmaterials fees, and late feesarenonrefundable. If anapplicantdoesnottaketheexaminationforwhichapplicationisinitiallymade,theBoardshall credit the application fee paid toward any one of the next fouradministrationsoftheexaminationforwhichapplicationmaybemadeandshallassesssuchadditionalchargesasmaybenecessarytoupdatetheinformationinthe applicant’s file. If an applicant for reciprocal admission under M. Bar

Admission R. 11A withdraws that application, the Board shall credit theapplication fee paid toward any one of the next four administrations of theexaminationfromthedateofthewithdrawaloftheapplicationandshallassesssuch additional charges asmay be necessary to update the information in theapplicant’sfile.

(e) Use of Fees Paid. The fees collected pursuant to the foregoingsections, together with any other funds made available to the Board, shall,subject to theprovisionsofRule6A,beused topay thecostsofadministeringthese rules, to pay the costs of performing the responsibilities charged to theBoard,includingthereasonableexpensesofmembersandanyperdiemasmaybe fixed by the Court, and for such other purposes as the Board, with theapprovaloftheCourt,maydetermine.

(f) Audit. The Board shall annually obtain an independent audit by acertified public accountant of the maintenance and disposition of the fundsentrustedtoit.TheBoardshallfileacopyofsuchauditwiththeCourt.

RULE6A.FINANCIALRIGHTSANDRESPONSIBILITIES

TheBoardofBarExaminers:

(a)MayappointandcompensateadministrativeandsecretarialpersonnelasneededtoassisttheBoardintheperformanceofitsduties;

(b)May lease office space, acquire equipment and supplies, and makecontractsandarrangementsfortheperformanceofadministrative,professionaland other services required or appropriate in the performance of the Board'sduties;

(c)Mayinvestordirecttheinvestmentofthefeesoranyportionthereofreceived pursuant to these rules, may cause funds to be deposited in anyfederally insured bank or financial institution in this State, and may adoptprocedures for theorderlypaymentof chargesandexpensesas is requiredbythe Board's financial needs, provided, however, that the Board shall have noobligationtocausesuchfeesoranyportionofthemtobeinvested;

(d)ShallprepareandfilewiththeCourtforapprovalinMayofeachyearitsbudgetforthenextfiscalyear,includinganyrecommendationtoincreaseordecreasetheapplicationfee;

(e)ShalladoptthefiscalyearusedbytheJudicialDepartment;and (f)Shall,subjecttotheCourt'sapproval,adoptandconformtopersonnelandfinancialpoliciesandprocedures,includingaccountingcontrols,purchasing,expense vouchering and capital equipment inventories consistent with thoseusedbytheJudicialDepartment.

RULE7.DISCLOSUREOFINFORMATION

Except as a Justiceof the Supreme Judicial Court, for good cause shown,may order, the Board shall disclose to the applicant any information in theapplicant'sfile.Exceptasotherwiseprovidedintheserules,orasorderedbyaJustice of the Supreme Judicial Court for good cause shown, the Board maydetermine from time to timeas theneedarises the type, form, substance, andsubject of any other disclosures to applicants or the public of informationreceived,generated,ormaintainedbytheBoardor itsmembers inperformingtheirduties.

IV.QUALIFICATIONSFORADMISSIONTOTHEBAR

RULE8.CERTIFICATEOFQUALIFICATION

(a) The Board shall issue a certificate of qualification stating that theapplicant is a person of good character, is fit to practice law, and possessessufficient learning in the law to practice as an attorney in this State to eachapplicantwho:

(1) produces satisfactory evidence of good character and fitness topracticelawasprovidedinRule9;

(2) attains a passing grade on theMultistate Professional ResponsibilityExaminationasprovidedinRule11;and

(3)A.attainsapassinggradeonthebarexaminationasprovidedinRule10;

B. completes the requirements for admission by motion as provided in

Rule11A;orC.qualifiesforadmissionbytransferredUniformBarExaminationscoreas

providedinRule11B. (b)Anapplicantwhohasbeendisbarredoriscurrentlyundersuspensionfrom the practice of law in any jurisdiction shall not be eligible to receive acertificateofqualification,provided,however,thatanadministrativesuspensionfromthepracticeoflawinajurisdictionotherthantheStateofMaine,forfailureto comply with that jurisdiction’s registration, dues, or continuing legaleducation requirements, shall not preclude the issuance of a certificate ofqualification if theBoarddetermines that theapplicanthasdemonstrated thatrequiring the applicant to return to good standing in, or resign from, thejurisdictionthatimposedtheadministrativesuspensionwouldimposeanunduehardshipon theapplicantand theapplicant is ingoodstanding inat leastoneotherstate.

RULE9.GOODCHARACTERANDFITNESSTOPRACTICELAW

(a) General Requirement. Each applicant shall produce to the Boardsatisfactoryevidenceofgoodcharacterandfitnesstopracticelaw.Thisburdenis initially met by establishing in the completed application and additionalmaterials required by Rule 5 the absence of any information adverse to theapplicant’scharacterandfitnesstopracticelaw.Ifanysuchadverseinformationisprovidedintheapplicationandadditionalmaterials,orotherwisereceivedbytheBoard,theapplicanthastheburdenofproducingfurtherevidencetoexplainorrebutsuchinformationsufficientlytosatisfytheBoardthattheapplicantisofgoodcharacterandisfittopracticelaw.Theattributesofcharacterandfitnesstopracticelawthatarerelevanttothisdeterminationarethosepertinenttothetrustplaced in lawyersby thepublicandclientsaswellas to therequirementthatlawyersinthisstatecomplywiththeMaineBarRulesandtheMaineRulesofProfessionalConduct.

(b) BoardReview of Character and Fitness. The Boardmay verify allinformation that it receives by any appropriatemeans, including the use of a

three-memberreviewpaneldesignatedbytheChairpursuanttoRule4(b).TheBoard shallpublish the listof applicants as soonaspossible afterMay20andDecember 20 of each year with a request that anyone having adverseinformationbearingonthecharacterandfitnesstopracticelawofanyapplicantcommunicateittotheBoard.

(c)ReviewandAdditionalInvestigation.

(1)Determination of Need for Three-Member Panel. Notwithstanding the

provisions of (2) herein, if the Chair, based upon the application, certificates,references, unsolicited communications, or other information received,determinesthatahearingpursuanttoRule9(d)(5)isnecessarytoresolvedoubtregarding the applicant’s good character and fitness to practice law, then theChairmayforegothedesignationofathree-memberreviewpanel,anddirectthematterbesetforhearing.

(2) Additional Investigation and Recommendations. If the application,certificates, references, unsolicited communications, or other informationreceivedbytheBoardcausetheBoardtodoubtthegoodcharacterandfitnesstopractice law of an applicant, the Chair, if it has not already done so, shalldesignate a three-member review panel pursuant to Rule 4(b) to conduct aninvestigationonbehalfoftheBoard.ThereviewpanelmayrequestthatCounselfortheBoardassistinconductingtheinvestigation.Thereviewpanelor,atitsrequest, Counsel for the Board shall notify the applicant of the nature of theinvestigationandthat the investigation isgoing forwardandshallrequest thatthe applicant furnish explanations and further information concerning thematterormatters inquestion. Foreach investigation,a separate investigativefileshallbemaintainedandshallbeavailable to thereviewpanelandCounselfor the Board. The investigative file shall contain all records and otherinformationpertinenttotheinvestigation,includingallinformationreceivedbythe review panel or Counsel for the Board. If the investigation has beenconducted by Counsel for the Board, at the conclusion of the investigationCounselfortheBoardshallmakearecommendationtothereviewpanel,eitherthat theBoard find theapplicant tobeapersonofgoodcharacterand is fit topractice law, or that the Board conduct a hearing to resolve any doubt thatremains concerning the applicant's good character and fitness to practice law.Counsel for theBoardshallsummarizewith therecommendationtheevidenceuponwhichitisbased.

(d)HearingonApplicant’sCharacterandFitness.

(1)DeterminationofNeed.Ifthereviewpanel,onthebasisofallmaterialproducedbytheapplicantorotherwiseacquiredbythereviewpanelorCounselfortheBoardpursuanttosubdivisions(a),(b),and(c)ofthisruleandinlightofanyrecommendationofCounsel for theBoard,determines thatdoubt remainsconcerningtheapplicant’sgoodcharacterandfitnesstopracticelaw,theBoardshallconductahearingtodeterminewhethertheapplicantisapersonofgoodcharacterandisfittopracticelaw.

(2)HearingPanel. Thematter shall beheardbyapanel consistingof allmembers of the Board except the members of the review panel. The hearingpanel shall exercise all powersof the fullBoard in the conductof thehearing,and thedeterminationof thepanel afterhearing shallbe thedeterminationofthefullBoard.Fourmembersofthehearingpanel,includingonepublicmember,shallconstituteaquorumforallactionsanddecisions.

(3)Representation by Counsel for the Board. Counsel for the Board shallprepare and present the case against the applicant at the hearing underparagraph(5)of thissubdivisionandshallrepresenttheBoardbeforeasinglejustice of the Supreme Judicial Court or the Law Court on petition underparagraph(6)ofthissubdivision.

(4)TimeofNotificationandHearing.TheBoardshallnotifytheapplicantand Counsel for the Board of the time, place, and purpose of the hearingimmediately after the review panel has decided that a hearing is required.Unlessthatdecisionismadeafterthebarexamination,suchnotificationshallbegiven to the applicant prior to the bar examination. The applicant shall bepermitted to sit for the examination if the hearing cannot be held before thattimeoriftheBoardhasnotreacheditsdecision.

(5)ConductofHearing. A.At least15daysbeforethetimesetforhearing,Counsel fortheBoardshall mail to the applicant and file with the Board a written statementsummarizing the evidence that reflects adversely on the applicant’s characterandfitnesstopracticelaw,andstatingthatallmaterialintheinvestigativefile,other than Counsel for the Board’s work product, will be available to theapplicant at Counsel for the Board’s office during usual office hours for

inspection and copying at the applicant’s expense. At least 15 days before thetimesetforthehearing,CounselfortheBoardandtheapplicantorCounselfortheapplicant,as thecasemaybe, shallexchangewitnessandexhibit lists,andeach shall provide the Board seven (7) copies of each exhibit intended to beintroducedatthehearingbysuchparty.

B. The hearing shall be open to the public, except that to protect theinterests of an applicant, witness, or third party, the Board may, uponapplicationand forgoodcauseshownoron itsownmotion, issueaprotectiveorderprohibitingthedisclosureofspecific informationotherwiseprivilegedorconfidential and direct that the proceedings be conducted so as to implementthat order. The deliberations of the Board following any hearing under thissubdivisionshallnotbeopentothepublic.ThedecisionoftheBoardfollowinganyhearingunderthissubdivisionshallbemadeavailabletothepublic.

C. Evidence shall be admitted at the hearing if it is the kind of evidenceuponwhichreasonablepersonsareaccustomedtorelyintheconductofseriousaffairs. The Boardmay exclude irrelevant or unduly repetitious evidence andshallobservetherulesofprivilegerecognizedbylaw.

D. The applicant may be represented by counsel and may presentevidence.TheapplicantandCounselfortheBoardmaycall,examine,andcross-examinewitnesses.

E. The Chair of the Board, or themember of the Board presiding at thehearingintheabsenceoftheChair,shallhavethepowertoadministeroaths.

F. The Board shall cause all hearings to be stenographically orelectronicallyrecordedinaformthatwillreadilypermittranscription.

G.Subpoena.Awitnessortheapplicantmaybesummonedbysubpoenatogive evidence or appear before the Board at the hearing. Anymember of theBoard,anotarypublic,oranyclerkoftheSuperiororDistrictCourtmayissuesuchsubpoenasaswellassubpoenasducestecumtocompeltheproductionofbooks, papers, and photographs or other documents or tangible things at orbefore the hearing. At or before the time specified in the subpoena forcompliance therewith, the Board may quash or modify any subpoena issuedunder this rule if it is determined that the subpoena is unreasonable oroppressive.WitnessfeesinallproceedingsbeforetheBoardshallbethesameas

forwitnesses in a civil action in the Superior Court.When awitnesswho hasbeen subpoenaed fails to appear without reasonable excuse, the SupremeJudicialCourtoranyjusticethereof,ortheSuperiorCourtoranyjusticethereof,or the District Court or any judge thereof, may, on application of the Board,invoketheprovisionsofRule45(f)oftheMaineRulesofCivilProcedureforsuchfailure.

H. The Board shall render a written decision within 30 days after theconclusion of the hearing, determining either that the applicant is a person ofgoodcharacterandisfittopracticelaworthattheapplicanthasnotsatisfiedtheBoardthattheapplicantisapersonofgoodcharacterandisfittopracticelaw.Attheapplicant’srequest,orinthediscretionoftheBoard,adecisionadversetothe applicant shall include specific findings sufficient to support the Board’sdetermination.AcopyoftheBoard’swrittendecisionandfindings,ifany,shallbepromptlymailedtotheapplicantortheapplicant’scounselandtoCounselfortheBoard.

(6)ProceedingsFollowingBoardDetermination.

A.Within30daysafterreceiptoftheBoard’swrittenadversedecision,anapplicant may file with the Executive Clerk of the Supreme Judicial Court apetitionforadmissiontothebarseekingadeterminationthattheapplicantisaperson of good character and is fit to practice law. At the time of filing, theapplicantshallserveacopyofthepetitionuponCounselfortheBoardandtheBoardbyordinarymail.

B.Within15daysafterreceiptbytheBoardofthepetition,CounselfortheBoardshallfilearesponseonbehalfoftheBoard.

C.Proceedingsuponthepetitionshallbeahearingdenovobeforeasinglejustice of the Supreme Judicial Court assigned by the Chief Justice to hear thematter. In thisparagraph (6), theword “court” shallmean thesingle justiceofthe Supreme Judicial Court assigned to hear the proceeding. The followingproceduresshallapply:

(i)TheapplicantshallbetreatedasplaintiffandtheBoardasdefendant,and the proceeding shall be captioned “[name of applicant] v. Board of BarExaminers.”

(ii) Counsel for the Board shall furnish to the applicant, within areasonable time after the filing of the Board’s response, at the applicant’sexpense, copiesof all information in theapplicant'sBoard fileandCounsel fortheBoard’sinvestigativefilenotpreviouslydisclosed,otherthanCounselfortheBoard’s work product, and copies of any exhibits presented at the Board’shearingnotpreviously furnished. Thestenographicorelectronicrecordof thehearingmadeinaccordancewithRule9(d)(5)FandanyothermatterwithinthepossessionorcontrolofCounselfortheBoardortheBoardthatisdiscoverableunderRule26oftheMaineRulesofCivilProcedureshallbemadeavailabletothe applicant at Counsel for the Board’s office during usual office hours forinspectionandcopyingattheapplicant’sexpense.

(iii)The courtmayorder furtherproductionof documents, ormay limitproduction,onmotionandashowingofgoodcause.

(iv) The court may in its discretion hold a prehearing conference withCounselfortheBoardandtheapplicant,ortheapplicant’sattorney,toconsidersuchmattersasmayaidinthedispositionoftheproceeding.Thecourtmaybywrittenorderlimittheissuestobeheard.

(v)Atthehearing,evidenceshallbeadmittedif it isthekindofevidenceuponwhichreasonablepersonsareaccustomedtorelyintheconductofseriousaffairs. The court may exclude irrelevant or unduly repetitious evidence andshallobservetherulesofprivilegerecognizedbylaw.

D.Atalltimes,theapplicantretainstheburdenofproducingtothecourtsatisfactory evidence of good character and fitness to practice law and ofpersuadingthecourtthattheapplicantisapersonofgoodcharacterandisfittopracticelaw.

E. If the court is not satisfied that the applicant is a person of goodcharacter,orifthecourtisnotsatisfiedthattheapplicantisfittopracticelaw,thecourtshallenterjudgmentaccordingly.Ifthecourtfindsthattheapplicantisapersonofgoodcharacterand is fit topractice law, it shall enter judgmentaccordinglyandshall remandtheproceeding to theBoardwith instructions toissue a certificate of qualification to the applicant, provided that therequirementsofRule8(2)andRule8(3)aremet.

F. The applicant or the Boardmay appeal to the Law Court as in a civilactionwithin10daysfromtheentryofthejudgmentofthesinglejustice.

G.Whenthecourtentersajudgmentagainsttheapplicant,ifitdeterminesthat thegroundsof thepetitionwere frivolous, itmayrequire theapplicant topaythereasonableexpensesincurredbytheBoardandCounselfortheBoardintheinvestigationofthematterorintheconductofhearingsbeforetheBoardorbefore thesingle justiceor theLawCourt.Thecourtmaymakesuchordersasarejustconcerningthepaymentofsuchexpenses.

RULE9A.CONDITIONALADMISSION

(a) Conditional Admission. Following a determination that anapplicanthasnotproducedsatisfactoryevidenceofgoodcharacterand fitnesstopracticelawpursuanttoRule9anduponfindingsthat:

(1) the conditions that led to thedetermination that the applicanthasnotproducedsatisfactoryevidenceofgoodcharacterandfitnesstopracticelawareinthepastandarenotlikelytorecur;

(2) theapplicanthasmadeandismakingagoodfaithefforttocureoravoidtheconditionsthatledtothedetermination;and

(3) theapplicanthas inplaceasupportsystem, includingan identified

responsible individual, tomonitorandassist theapplicant inmaintaininggoodandethicalconductandtoregularlyreportontheapplicant’sprogressandanyproblemstotheBoardofOverseersoftheBar;

the Board, with the written consent of the applicant, may recommend to theCourtthattheapplicantbeadmittedonaconditionalbasis.Provided,however,thatalawyerwhohasbeendisbarredorsuspendedfromthepracticeoflaworhasresignedfromthepracticeof lawinanother jurisdiction,andhasnotbeenreinstatedtothepracticeof lawinthatotherjurisdictionshallbeineligibleforconditionaladmissionpursuanttotheseRules. (b) CircumstancesWarranting Conditional Admission. The Board,having made the findings stated in subdivision (a), may allow an applicantwhoserecordshows(1)ahistoryofactsoromissionsconstitutingalackofgoodcharacterandfitnesstopracticelaw,and(2)evidenceofrehabilitationfromtheconditions that caused the acts or omissions to current good and trustworthy

conduct, to be conditionally admitted to the practice of law, subject to certainterms and conditions set forth in a written conditional admission consentagreement.OnlyanapplicantwhoserecordofconductatthetimeoftheRule9determination evidences a commitment to continued rehabilitation and anability to meet the essential eligibility requirements for admission to thepractice of law under these Rules may be considered for a Boardrecommendationofconditionaladmission.

(c) ConsentAgreement.Thewrittenconsentagreementshall(1)statethetermsandconditionsofconditionaladmission;(2)besignedbytheChairoftheBoardofBarExaminers or his or herdesignee, by the applicant, andby adesignated representative of each individual, agency, or entity agreeing tosupervise the conditionally-admitted lawyer during the conditional admissionperiod; and (3) be placed in the conditionally-admitted lawyer’s permanentapplicationfile. (d) DisclosureandConfidentiality.

(1) Except as otherwise provided hereinwith respect to disclosure to

theBoardofOverseersoftheBar,andsubjecttotheprovisionsoftheBarRules,theRulesofProfessionalConduct,andRule7oftheseBarAdmissionRules,orasmay be ordered by the Supreme Judicial Court, the fact that an individual isconditionally admitted and the terms of a conditional admission consentagreement shall be confidential; provided, however, that (i) an applicant shalldisclose the factand termsofanyconditionaladmissionconsentagreement tothebaradmissionauthorityinanyjurisdictionwheretheapplicantisadmittedorappliesforadmissiontopracticelaw;and(ii)theBoardofBarExaminersisauthorizedtodisclose the factandtermsofanyconditionaladmissionconsentagreementandthe factand termsofanymodificationorrevocation to thebaradmissionauthorityinanyjurisdictionwheretheapplicantpracticesorappliesforadmissiontopractice lawandtotheNationalConferenceofBarExaminersanditsdesignatedagents,investigators,administrators,andrepresentatives.

(2) In addition to maintaining the confidentiality of the fact that an

individual is conditionally admitted and the terms of a conditional admissionconsent agreement in the recordsmaintained by the Board of Bar Examinerspursuant to this Rule, the Board shall structure the terms, conditions, andmonitoringorsupervisionofconditionaladmissionsuchthattheydonotposeasignificantrisktothemaintenanceofconfidentiality. NothinginthisRuleshall

requirethatrecordsordocumentsthatarepublicrecordsinMaineoranyotherjurisdictionshallbeconfidential if thoserecordsordocumentsbecomepartoftheBoardofBarExaminersfile.

(3) This subdivision shall not prohibit or restrict the applicant from

disclosing to third parties that the applicant has been conditionally admittedunderthisRule.

(4) Thissubdivisionshallnotprohibitorrestricttheauthorityorability

oftheBoardofBarExaminersortheBoardofOverseersoftheBartodiscloseanapplicant’srecordofcomplianceornoncompliancewithaconditionaladmissionconsentagreementtobaradmissionauthoritiesinotherjurisdictionswheretheconditionally-admittedlawyerpracticesorappliesforadmissiontopracticelawand to theNational Conference of Bar Examiners and their designated agents,investigators,administrators,andrepresentatives. (e) TransmittalofConsentAgreementtotheBoardofOverseersoftheBarandtoConditionalAdmissionSupervisors. AcopyofeachexecutedconsentagreementconditionallyadmittinganindividualtotheMaineBarshallbetransmitted,uponitsexecution,totheapplicant,totheBoardofOverseersoftheBar,andtoadesignatedrepresentativeofeachindividual,agency,orentityagreeingtosupervise theconditionally-admitted lawyerduring theconditionaladmission period. In the event a complaint of professional misconduct or aviolationoftheconsentagreementisfiledwiththeBoardofOverseersoftheBaragainst a conditionally-admitted lawyer during the conditional admissionperiod,acopyofthelawyer’sBoardofBarExaminersbaradmissionapplicationfileshallbetransmittedtotheBoardofOverseersoftheBarupontherequestofthatoffice. (f) LengthofConditionalAdmissionPeriod.Theinitialdurationofaconditional admissionperiod shall be established in the conditional admissionconsent agreement but shall not exceed sixty (60) months unless, prior tocompletionof theconditionaladmissionperiod,acomplaintofviolationof theconsentagreementoracomplaintofprofessionalmisconductorviolationoftheBar Rules or the Rules of Professional Conduct is filed with the Board ofOverseersoftheBar.Thefilingofanysuchcomplaintshallautomaticallyextendtheconditionaladmissionperioduntilfinaldispositionofthecomplaintandanyresultingappeals.

(g) MonitoringandViolations.(1) Duringanyconditionaladmissionperiod,theconditionally-admitted

lawyer’scompliancewiththetermsoftheconsentagreementshallbeenforcedby the Board of Overseers of the Bar or one of its Commissions, which isauthorizedtoconductsuch investigationsandtakesuchactionasnecessarytomonitor and determine compliance with the terms of the consent agreement,including but not limited to requiring the conditionally-admitted lawyer to (i)submitwrittenverificationof compliancewithall conditionsof admission; (ii)appearbeforetheBoardofOverseersoftheBaroroneofitsCommissions;and(iii)respondtoanyrequestforevidenceconcerningcompliance.

(2) AnydeterminationbytheBoardofOverseersoftheBaroroneofits

Commissionsofaviolationofaconditionaladmissionconsentagreementshallstateinwritingthebasisforfindingthataconditionorconditionsofadmissionestablished pursuant to the consent agreement have been violated. Writtennotice of a determination of a violation of a conditional admission consentagreement and the basis for such finding shall be provided by the Board ofOverseers of the Bar to the conditionally-admitted lawyer, Bar Counsel, theBoard of Bar Examiners and the designated representative of each individual,agency,orentityagreeingtosupervisetheconditionally-admittedlawyerduringtheconditionaladmissionperiod.

(3) Violationofa conditionaladmissionconsentagreementmayresult

in modification of the conditional admission consent agreement. Suchmodificationmayinclude,butshallnotbelimitedto,extensionoftheperiodofconditionaladmissionforanadditionalspecifiedperiodoftime.

(4) Upon the determinationby theBoard ofOverseers of theBar that

theconditionsofaconditionaladmissionconsentagreementhavebeenviolated,theBoardmaypetitiontheSupremeJudicialCourtforanordersuspendingtheconditionally-admitted lawyer from the practice of law, in which case theconditionally-admitted lawyer shall have twenty-one (21) calendar days fromthedateofthefilingwiththeCourttofileawrittenresponsewiththeCourt.Ifnotimelyresponseisfiled,thelawyer’sconditionaladmissionlicensetopracticelaw in the State of Maine shall be suspended upon expiration of the periodallowedforresponse. If the lawyerfilesatimelyresponse, themattershallbeaddressed as the Court directs, including but not limited to an order ofsuspension.

(5) UnlessterminatedearlierbytheCourt,asuspensionforaviolation

of a conditional admission consent agreement shall remain in effect until finaldispositionofalldisciplineand/orgrievanceprocedures, includingreviewofafinding of a violation of conditions of admission, commenced against theconditionally-admittedlawyer.Afinaldispositionmayinclude,butshallnotbelimitedto,revocationofthelawyer’sconditionaladmissionlicense.

(6) Nothing in this Rule shall prohibit or restrict in any way the

investigation and discipline under theMaine Bar Rules or theMaine Rules ofProfessionalConductofaconditionally-admittedlawyerbyBarCounselandtheBoardofOverseersoftheBarforconductviolatingtheBarRulesortheRulesofProfessionalConduct.

(h) Reapplication After Revocation of Conditional Admission. AlawyerwhoseconditionaladmissionlicensehasbeenrevokedisprohibitedfromapplyingforreinstatementpursuanttoMaineBarRule7.3(j), forfive(5)yearsafterthedateoftherevocation. (i) Costs of Conditional Admission. The applicant shall beresponsible for all conditional admission costs, including but not limited toapplicationfeesandexpensesofinvestigation,testing,monitoring,enforcement,andprosecutionincurredbytheBoardofBarExaminers,theBoardofOverseersof the Bar, or by any individual, agency, or entity agreeing to supervise orsupervising such applicant during the conditional admission period and anyextensionthereof. (j) Expiration of Condition. Unless the conditional admission ismodified,revoked,orextendedasprovidedherein, includinganyextensionforthe period required to resolve a complaint of a violation of the consentagreement, the Maine Bar Rules, or the Maine Rules of Professional Conduct,uponcompletionofaperiodofconditionaladmissiontheconditionsimposedbya conditional admission consent agreement shall expire. A conditionally-admitted lawyer whose conditions of admission have expired shall be timelynotifiedbytheBoardofOverseersoftheBar. (k) UltimateAuthority.Nothinghereinshalldiminishtheauthorityofthe Supreme Judicial Court with respect to any applicant’s admission to thepracticeoflawinMaine.Nothinghereinshalldiminishinanywaytheabilityor

authorityoftheBoardofOverseersoftheBar,BarCounsel,oranycourtintheStateofMainetodisciplineorseekdisciplineofaconditionally-admittedlawyerforviolationoftheBarRulesortheRulesofProfessionalConduct.

RULE10.ADMISSIONBYEXAMINATION

(a) General Requirements. Each applicant for admission to the MainebarmustdemonstratesufficientlearninginthelawtopracticeasanattorneyinthisStatebyobtainingapassinggradeonthebarexaminationprovidedinthisrule.AnyindividualwhocompletestheapplicationandpaysthefeesrequiredbyRule 6 and produces satisfactory evidence of the educational qualificationsrequiredbysubdivision(c)ofthisruleiseligibletotaketheexamination.

(b)EducationalQualifications.Before takingthebarexamination,eachapplicantshallproducetotheBoardsatisfactoryevidencethattheapplicant.

(1)graduatedwithabachelor'sdegreefromacollegeoruniversity;and

(2)graduatedwithajurisdoctororabacheloroflawsfromalawschoolthat had received its provisional or final accreditation from the American BarAssociationbythetimeoftheapplicant’sgraduation;or

(3) graduated from a law school accredited by the United Statesjurisdiction in which it is located and has been admitted to practice byexaminationinoneormorejurisdictionswithintheUnitedStatesandhasbeeninactivepracticethereforatleast3years;or

(4)graduatedfromaforeignlawschoolwithalegaleducationthat,intheBoard'sopinionpursuanttoregulationsadoptedbytheBoard, isequivalenttothatprovided inthose lawschoolsaccreditedbytheAmericanBarAssociationandhasbeenadmitted topractice in thatcountryorbyexamination inoneormorejurisdictionswithintheUnitedStatesandhasbeeninactivepracticeinajurisdictioninwhichtheapplicantislicensedforatleast3years;or

(5)successfullycompletedtwo-thirdsoftherequirementsforgraduationfroma law school that had received its provisional or final accreditation fromtheAmericanBarAssociationbythetimeoftheapplicant'scompletionofthoserequirementsandthenwithin12monthsfollowingsuchsuccessfulcompletionpursuedthestudyoflawinthelawofficeofanattorneyintheactivepracticeof

lawintheStateofMainecontinuouslyonafull-timebasisforatleastoneyear;provided that the attorney must, in advance, present the proposed course ofstudytotheBoardforitsapprovaland,atitsconclusion,certifythatthecourse,asapproved,wascompleted.

(c) The Bar Examination. The Maine bar examination shall be theUniform Bar Examination prepared by the National Conference of BarExaminers,which consists of theMultistate Essay Examination, theMultistatePerformanceTest(s),andtheMultistateBarExamination. (1)AdministrationoftheBarExamination.TheBoardshalladministertheMainebarexaminationtwiceayear,inFebruaryonthelastWednesdayandthepreceding Tuesday, and in July on the last Wednesday and the precedingTuesday. ThehoursandplacesatwhichtheexaminationistobeadministeredshallbeannouncedbytheBoardinapublicnoticetobepublishednotlaterthanApril 1 for that year’s July administration andNovember1 for thenext year’sFebruaryadministration.EachapplicantshallproducesuchidentificationattheexaminationastheBoardshallrequire. (2)Grading.TheBoardoritsdesigneesshallgradeandassignrawscoresto the Multistate Essay Examination and Multistate Performance Tests. TheBoardshallprovidetherawscorestotheNationalConferenceofBarExaminers,which then scales the raw scores to the Multistate Bar Examination for adeterminationofoverallscaledscoreforeachapplicant. (3) Passing Score. Prior to the administration of each examination, theBoard shall set the passing scaled score that it determines will demonstratesufficientlearninginthelawtopracticeasanattorneyinthisState. (4) Finality of Scores. An applicant’s score on the Uniform BarExamination,ascertifiedbytheNationalConferenceofBarExaminers,isfinal.

(d) Special Examination Circumstances. Upon appropriate writtenrequestbyanapplicantintheapplication,theBoardmay,inordertoprovideforspecialcircumstancessuchasaphysicalhandicap,establishspecialrulesforthetaking of the examination by the applicant and may provide for an oralexaminationtosupplementthewrittenexamination.

(e)NotificationofResults.TheBoardshallcomplete thegradingof theexaminationsandnotify all applicantsof the resultsby regularmailwithin75daysafterthefinaldayofanexamination.Threedaysaftertheresultshavebeenmailed to individual applicants, the Board shall release for general publicdistributionandpublicationalistofsuccessfulapplicants.

(f)Reexamination.

Any applicant who fails to pass an examination may reapply to take asubsequent examination upon payment of the same fee then required of anoriginalapplicant.

(g) ExtensionofTimeforAdmissiontotheBar.Anymotiontoenlargethetimeforadmissiontothebarsubmittedpursuantto4M.R.S.§805-A(3)shallbe filed with the Executive Clerk of the Supreme Judicial Court prior to theexpiration of the one-year deadline established by the statute. The applicantshallserveacopyofthemotionupontheBoardbyelectronicmailandbyregularmailsentonorbeforethedateoffiling.AnyresponsebytheBoardshallbefiledwithin14daysaftertheapplicant’sfilingofthemotiontoenlarge.

RULE11.THEMULTISTATEPROFESSIONALRESPONSIBILITYEXAMINATION

(a) General Requirement. Each person who is admitted after July 1,

1987, shall have obtained a passing grade on the Multistate ProfessionalResponsibilityExamination(MPRE)preparedandadministeredbytheNationalConferenceofBarExaminers.TheMPREmaybetakenatanytimeandplacethatis offeredby theNational Conference ofBarExaminers,within orwithout theStateofMaine.

(b)EducationalQualifications.TheMPREmaybetakenatanytimeafteranapplicanthasenteredlawschool.

(c) Passing Score. A scale score of 80 as established by the NationalConference of Bar Examiners shall be the passing score in this State for theMPRE, except that an MPRE scale score of 75 as established by the NationalConference of Bar Examiners for anMPRE taken before July 1, 2006, shall beacceptedfromanyapplicantwhoisnotadmittedinanyotherjurisdiction.

(d) Applicants for Admission by Examination. An applicant foradmissionbyexaminationmusthavetakenandobtainedapassingscoreontheMPREwithin15yearspriortothedateonwhichtheapplicationisfiled.

(e)ApplicantsforAdmissionbyMotion.Anapplicantforadmissionby

motionmust either (1)have takenandobtainedapassing scoreon theMPREwithin15yearspriortothedateonwhichtheapplicationisfiledor(2)ifrelyingonapassingscoreontheMPREthatismorethan15yearsold,demonstratetotheBoardthattheapplicantinthepastwasadmittedtopracticelawinanotherUnited States jurisdiction that, at the time of the applicant’s admission in thatjurisdiction,requiredapassingscoreontheMPREthatwasequaltoorgreaterthanthepassingscoreinthisState.

(f) Applicants for Admission by Transferred Uniform Bar

Examination Score. An applicant for admission by transferred Uniform BarExaminationscoremusthavetakenandobtainedapassingscoreontheMPREwithin15yearspriortothedateonwhichtheapplicationisfiled.

RULE 11A. ADMISSION BY MOTION. (a)AnapplicantwhoisanattorneyadmittedtopracticelawinastateorterritoryoftheUnitedStatesortheDistrictofColumbiaandmeetsthefollowingrequirementsmay, uponmotion, be admitted to the practice of law in MainewithouttakingandpassingtheMainebarexaminationrequiredbyRule10.Theapplicantshallpresentevidencethattheapplicant: (1) Is admitted to practice law in, and is an active member in goodstanding of the bar of, another state or territory of the United States (or theDistrictofColumbia);

(2) Hasbeenprimarily engaged in the activepracticeof law inoneormoreUnitedStatesjurisdictions(whichmayincludetheactivepracticeoflawintheStateofMainetotheextentpermittedbyRule5.5(d)oftheMaineRulesofProfessionalConduct)foratleastthreeofthefiveyearsimmediatelyprecedingthedateuponwhichtheapplicationisfiled. ForthepurposesofthisRule,the“activepracticeoflaw”shallincludethefollowingactivities,eitherseparatelyorintheaggregate,whenperformedonafulltimebasis:

A.Representationofoneormoreclientsintheprivatepracticeoflaw;B. Service as a lawyer with a local, state, territorial or federal agencyincludingmilitaryservice;C.TeachinglawatalawschoolapprovedbytheAmericanBarAssociation;D.Serviceasajudgeinafederal,state,orlocalcourtofrecord;E.Serviceasajudiciallawclerk;orF. Service as in house counsel providing legal services to the lawyer’semployer.

The“activepracticeoflaw”shallnotincludeworkundertakenduringanyperiod inwhich theapplicant isnotanactivemember ingoodstandingof thebarofaUnitedStatesjurisdictionandshallnotincludeworkthat,asundertaken,constitutedtheunauthorizedpracticeof lawinthe jurisdiction inwhich itwasperformedorinthejurisdictioninwhichtheclientsreceivingtheunauthorizedserviceswerelocated. (3) Hasgraduatedwithajurisdoctororbacheloroflawsdegreefromalaw school approved by the American Bar Association (A) having a three (3)school year course of study and requiring students to devote substantially alltheirworkingtimetostudy,calledafull-timelawschool;or(B)havingacourseofstudyofnotlessthanfour(4)schoolyears,equivalentinthenumberofcredithourstoathree(3)schoolyearcourseofstudyinafull-timelawschoolandinwhichstudentsdevoteonlypartoftheirworkingtimetotheirstudies,calledapart-timelawschool;or(C)hasgraduatedfromaforeignlawschoolwithalegaleducation that, in the Board’s opinion pursuant to regulations adopted by theBoard, is equivalent to that provided in those law schools accredited by theAmericanBarAssociation.Acombinationofstudyinfull-timeandpart-timelawschoolswillbeacceptedonlyifsuchlawschoolsmeettheaboverequirements,andtheapplicantshallhavegraduatedfromoneortheother.Studyinanylawschool that conducts its courses by correspondence or does not requireattendance of its students at its lectures or classes shall not constitutecompliancewiththisRule;

(4)HassatisfactorilycompletedtheMultistateProfessionalResponsibilityExamination in accordance with Rule 11, prior to the date on which theapplicationisfiled; (5)[Deleted] (6)Isnotcurrentlysubjecttolawyerdisciplineorthesubjectofapendingdisciplinarymatterinanyjurisdiction; (7) Possesses good character and is fit to practice law in the State ofMaine; (8) Hascompletedat least fifteenhoursofcontinuing legaleducation inMaine practice and procedure in courses approved by the Maine Board ofOverseersoftheBarwithinoneyearimmediatelyprecedingthedateonwhichtheapplicantiscertifiedforadmission;and (9)Ifdomiciledinormaintainingaprincipalofficeinanotherjurisdiction,will, upon admission to the bar of the State of Maine, designate the Board ofOverseers of theBar as the agent to receive service of process if the attorneycannot,withduediligence,beservedwithprocessinanyactionarisingoutoforrelatedtothepracticeoflaw. (b) An applicant who has failed the Maine bar examination within fiveyearsofthedateoffilinganapplicationforadmissionwithoutexaminationshallnotbeeligibleforadmissiononmotion. (c) Any applicant for admission by motion shall comply with theapplicationandgoodcharacterand fitnessrequirementsofRules5,6and9oftheMaineBarAdmissionRules. (d)AnyapplicantadmittedtopracticeintheStateofMaineinaccordancewiththisRuleshallregisterasrequiredbyRule6(a)(1)oftheMaineBarRulesandpay theannual fees requiredbyRule10of theMaineBarRules,andshallotherwisecomplywiththerequirementsoftheMaineBarRulesandtheMaineRules of Professional Conduct in the same manner as any other attorneyadmittedtoactivepracticeintheStateofMaine.

RULE 11B. ADMISSION BY TRANSFERRED UNIFORM BAR EXAMINATION SCORE

(a) General Requirements. An applicant for admission to theMaine

bar may transfer a Uniform Bar Examination score earned in anotherjurisdictionuponfilingofanapplicationandpaymentofthefeesrequiredbyRule6.

(b) Qualifying Scores. A Uniform Bar Examination score qualifies fortransfer if it meets the most recent passing score for the Maine barexaminationsetbytheBoardpursuanttoRule10(c)(3)andwasearnedinanadministrationof theUniformBarExamination thatoccurredwithin3yearsbeforetheapplicant’sapplicationforadmissiontotheMainebar.

(c) Educational Qualifications. Before transferring any Uniform BarExamination score, each applicant shall produce to the Board satisfactoryevidence that the applicant meets the educational qualifications required foradmissiontotheMainebarbyexamination.

V.GENERALPROVISIONS

RULE12.IMMUNITY

Thedutiesandresponsibilitiesofmembersof theBoardand itsstaffareduties and responsibilitiesowed to theCourt and thepublic in general, not toany individual applicant or other person. Nothing in these rules shall beconstruedascreatingacivilcauseofactionorrightofsuit,andmembersoftheBoardandmembersof itsstaff shall inanyeventbe immune from liability foranyomissionorconductinthecourseoftheirofficialdutiesrelatingdirectlyorindirectlytotheiradministeringorinterpretingtheserulesorfulfillingorfailingtofulfilltheirdutiesandresponsibilitiesundertheserulesorunderstatute.

RULE13.PRACTICESANDREGULATIONS

The Board is empowered to adopt and employ such practices andregulations as are reasonably necessary to administer its duties under theserules;provided,however, that suchpracticesand regulations shallnot conflictwiththeserules.

RULE14.EFFECTIVEDATE;AMENDMENT

(a)EffectiveDate.Rules5(c)(4)and9(a)shallbecomeeffectiveApril10,1988.TheserulesshallotherwisebecomeeffectiveJanuary1,1988,andshallbefirstappliedintheadministrationofthebarexaminationinFebruary,1988.

(b)Amendment.TheserulesmaybeamendedfromtimetotimebytheSupreme JudicialCourt.Anyamendment shall takeeffecton thedate specifiedtherein.
