WHEREAS, you have been granted Conditional Common Consent and Authorizationunder the provisions of the Water (P&CP) Act, 1974 and the Air (P&CP) Act, 1981 and theHazardous Waste (Management Handling & Transboundary Movement) Rules, 2008.

AND WHEREAS, it was obligatory on your part to provide adequate and suitabletreatment & disposal arrangements as well as air pollution control devices, so as to achievethe standards prescribed in the consent order and to dispose off.it in accordance with thecondition laid down for disposal in the consent.

AND WHEREAS, it has been observed that you are discharging untreated/undertreated effluent, not conforming to the standards prescribed in the consent order andthereby disturbing the function of CETP.

THEREFORE, you are hereby directed to show cause as to why legal actionshall not be initiated against you under Water (Prevention & Control of Pollution) Act, 1974.Your reply to this notice, shall reach this office within period of 7 days from the date ofreceipt of this letter, failing which , it will be presumed that you have no say to offer andtherefore appropriate legal action as may deemed fit will be initiated against you, which mayplease be noted.

MPCB has prosecuted TEPS CETP at the Ho'nble CJM Court at Thane vide RCC- 388/10 due to noncompliance of consented discharge standards. Thereafter TEPS CETP has started their up gradationwork. The up gradation work which was planned by TEPS is now at final stage of completion stage.The brief up gradation work carried out by TEPS-CETP is as below.

^1. Old & partial working diffused Aeration System of aeration tank -1 was replaced with ninenumbers of Aspirators in march-2011 & same were at work.

2. Old & partial working diffused Aeration System of Aeration Tank -2 was replaced with ninenumbers of Aspirators in july-2011 & same were at work.

3. Old & partial working diffused Aeration System of aeration tank -3 was now replaced with ninenumbers of Aspirators. It's start up & commissioning activity was going on. As informed byTEPS it will be commissioned within next 15 days. The cost incurred for above upgradntion toaspirators was Rs. 2.93 Crore.

4. TEPS CETP has informed t that the partial broken .air grid rectification work of aeration tank -4will be taken in hand after commissioning of aspirator installation of Aeration Tank-C.^

replacement of its said bottorr. valve. Now entire load diverted to second clarifier. As informed

by TEPS the work will be completed within 10 days.

From the above analysis report it is observed that the TEPS CETP is still not achieving the results asthe up gradation work is under stabilization stage, an

TEPS CETP is receiving more effluent over & above its capacity. The only alternative is to provide

additional CETP. TEPS CETP has received plot from MIDC admeasuring 85000 sq. mtr. The trees

have been removed. Tenders has been received & also opened. But the physical progress is very slow.

WHEREAS Hon'ble High Court of Judicature of Mumbai in writ petition No. 17/201 Ifilecby Nicholas Almedia V/s. State of Maharashtra & others, is monitoring the performance of CETFand industries attached to II in the State of Maharashtra. Hon'ble Hiah Court has directed tcinitiate proper action against the defaulting highly polluting units and CETP.

AND-WHEREAS, Board has granted consent to your unit with certain terms &conditions. AND WHEREAS, it is obligatory on your part to operate your effluent treatmentplant properly so as tc achieve standards prescribed by the Board in its consent.

AMD WHEREAS, Sub Regional Officer (S.R.O.), Tarapur-l, has communicated analysisresults oi treated effluent collected from the final outlet of your ETP on 19/04/2012. On scrutinyof the same, it is noted that the analysis results are exceeding the prescribed standards by morethan 100% which clearly shows that you are not operating your ETP properly and aredischarging sub-standard effluent to the CETP, thereby disturbing its performance.

NOW, THEREFORE, in accordance with the Board's letter und::r reference No.2, youare hereby directed to voluntarily stop your manufacturing activities and submit Bank Guarantee(B.C.) of Rs.1,00,000/-.

Your compliance report, in this regard, shall be submitted to this office within 7 days onreceipt of these directions or else further legal action wi I be initiated which may result indisconnection of electric & water supply of your unit which please note.

State of Maharashtra & others, is monitoring the performance of CETPand industries attached to it in the State of Maharashtra. Hon'ble High Court has directed toinitiate proper action against the defaulting highly polluting units and CETP.

AND WHEREAS, Board has granted consent to your unit with certain terms &conditions. AND WHEREAS, it is obligatory on your part to operate your effluent treatmentplant properly so as to achieve standards prescribed by the Board in its consent.

AND WHEREAS, Sub Regional Officer (S.R.O.), Tarapur-i, has communicated analysisresults of treated effluent collected from the final outlet of your ETP on 09/05/2012. On scrutinyof the same, it is noted that the analysis results are exceeding the prescribed standards by morethan 100% which clearly shows that you are not operating your ETP properly and aredischarging sub-standard effluent to the CETP, thereby disturbing its performance

NOW, THEREFORE, in accordance with the Board's letter under reference No 2, youare hereby directed to Voluntarily stop your manufacturing activities and submit Bank Guarantee(B.G.)ofRs.25,000/-.

Your compliance report in this regard, shall be submitted to this office within 7 days onreceipt of these directions or else further legal action will be initiated which may result indisconnection of electric & water supply of your unit which please note.

discharge standards as per MPCB consent within one month period.

2. You shall not discharge sub-standard high COD effluent to CETP, in order not to disturb

performance of the CETP.

3. You shall operate and maintain full-fledged upgraded Effluent Treatment Plant so as to

achieve the standards laid down under the provisions of the Environment (Protection)
