Amendments 1 of 2009 Amendments to the City Centre Locality, Reconfiguration of a Lot Code, High Impact Areas, Use Codes, Introduction, Assessment Tables, two zone maps and one information map.

Details of the amendments of the Planning Scheme are show in the following attachments:

The following summarises the proposed individual amendments covered by Planning Scheme Amendments 1 of 2009:

1. Introduction

• Amend Part 1, Division 3 1.11(7) to include a trigger for code assessable applications for certain extractive industries.

2. Mackay City Centre Locality

• Delete reference to Mackay Convention Centre Complex and replace with Bluewater Quay.

3. Multiple Dwelling Units, Accommodation Units and Dual Occupancy Code

• Amendment to table 9-15 to include a note referring to calculating densities for Multiple Dwelling Units.

4. Assessment Tables (Part 5 and Part 6)

• Amendment to remove trigger for dwelling houses on lots less than 450m2 being code assessable.

5. Reconfiguration of a Lot Code

• Relocation of the specific outcomes regarding minimum lot sizes and dimensions for land zoned Industry (Low Impact) and Industry (High Impact), to Acceptable/Probable solutions and inclusion of an explanatory note regarding vehicle manoeuvring.

6. Various Zonings

• Amendment to zoning of Lot 13 on RP891640 from City Residential zone to Commercial Centre zone.

• Amendment to zoning of Lot 2 on SP209449 from split zoning (Industry (High Impact) and Sport and Recreation zone) to Industry (High Impact).

7. High Impact Activity Areas (Part 9, Division 9)

• Inclusion of a new specific outcome to acknowledge the Mackay Sugar Waste Water Ponds as a High Impact Activity with a buffer distance of 1km.

• Amendment to High Impact Activity Areas Information Map to include the Mackay Sugar Waste Water Ponds.

1 CITY CENTRE LOCALITY

Part 4 – Division 15 – Special Activities (City)

Zone

• Overall outcome (2) (a) for the Special Activities (City) Zone refers to the Mackay Convention Centre, which has now been constructed in the Civic Precinct. The reference to the Mackay Convention Centre is to be replaced with reference to the Bluewater Quay (Q150 legacy infrastructure project).

• Amend the wording of Division 15 Special Activities (City) Zone – Overall Outcomes (2) (a) – by deleting reference to “Mackay Convention Centre complex” and replacing with “Bluewater Quay”.

• Additional amendments are required for Specific Outcome P3 of Division 15 Special Activities (City) Zone – to remove reference to the Mackay Convention Centre, as follows: “The development of a hotel and convention centre is encouraged, with direct pedestrian links to and which complements and supports the multi-purpose facility”.

• Amend P2 Table 9-18.1, by removing Industry (Low Impact) and Industry (High Impact) from the table under Specific Outcomes and inserting into Acceptable / Probable Solutions.

Part 9 Division 9 Environment and

Infrastructure Code & High Impact Activity Information Map and

• Amendments required to reflect recent land use changes to High Impact Areas and provide consistency in approach to HIA buffer area requirements.

• The Mackay Sugar Wastewater Ponds at Bakers Creek are not included in the High Impact Activity Mapping for Mackay City. The inclusion of a 1km buffer around the ponds would provide protection and be consistent with mapping which incorporates the Racecourse Mill site.

• Amend Table 9-8.5 to include the Mackay Sugar Wastewater Ponds in Table 9-8.5, including the High Impact Activity Information Maps.

• The lot in question (83 Farrellys Road, Paget) was previously used for Sport and Recreational purposes. The former activity that took place there (Mackay Motordome) is now defunct.

• Lot 2 on SP209449 – Retain the northern portion of the lot in the Industry (High Impact) Zone and rezone the southern portion of the lot from the Sport and Recreation zone to the Industry (High Impact) zone.

• The northern portion of the subject site is zoned for Industry (High Impact) uses and is bordered to the north, south and west by land which is also zoned for Industry (High Impact) uses.

• Rezoning the whole parcel to be included in the Industry (High Impact) zone is considered to be the most efficient and appropriate use of the subject site.

• Amendment required to the current Code where referring to Multiple Dwelling Units in the Higher Density Residential zone in order to provide greater flexibility for density variation.

• Amend Table 9-15 (Specific Outcomes and Acceptable & Probable Solutions for the Multiple Dwellings, Accommodation Units and Dual Occupancy Code) for Building Density to include a notation referring to the calculation of building densities in the Higher Density Residential zone.

• Amendment of the wording of Specific Outcome P1.1 for Building Densities to insert a notation after “Multiple Dwelling Units, Accommodations Units or Dual Occupancy have the following maximum densities, unless otherwise provided in the relevant Locality Code:

(iii). Where in the Higher Density Residential Zone;

“Note: For the purpose of calculating densities for Multiple Dwelling Units, a 1 bedroom unit shall be taken to equal 0.50 of a dwelling unit, units with 2 bedrooms shall be taken to equal 0.75 of a dwelling unit and units with 3 or more bedrooms shall be taken to equal 1 dwelling unit”.

1.11(7) – Determining if development is

assessable or self-assessable under the

planning scheme

• Section 1.11 (6) (a) of the planning scheme exempts roadworks conducted by or on behalf of a government entity from assessment.

• Furthermore, Section 1.11 (7) states that where associated with the purposes referred to in Section 1.11 (6) the following activities are also exempt development: (i). excavating, crushing, screening and

taking road building material from land (whether road or not).

• An amendment is required to ensure activities associated with roadworks conducted on behalf of a government entity are adequately controlled.

Amend 1.11 (7) – “where associated with the purposes referred to in Section 1.11 (6) the following activities are also exempt development” after:- “(i) excavating, crushing, screening and taking road building material from land (whether road or not)” add the following:- “except where the above exceeds 5,000 tonnes per annum at an individual site, which is Code Assessable”.

These amendments to the Assessment Category Tables relate to when a “Dwelling House” is self-assessable or code assessable. The intent of removing the requirements for a Code Assessable Application for a Material Change of Use for a
