TfNSW QA SPECIFICATION M1

GENERAL MAINTENANCE REQUIREMENTS

1 GENERAL

1.1 OVERVIEW

This Specification has been developed specifically for the maintenance of State Roads. It should not be used in any other type of contract without consideration of its suitability under the prevailing circumstances.

1.2 STRUCTURE OF THE SPECIFICATION

This Specification includes a series of annexures that detail additional requirements.

1.2.1 Road Network and Assets

The Assets to be maintained comprise a mature road network and generally include the constituent components of the Road Network. The Road Network is defined in Annexure M1/A.

The Assets included in the Services are generally located within the road corridor of the Road Network. In addition, specific assets defined in Annexure M1/A A4 are also included as part of the Assets. Some maintenance activities are only included in the Services if located within the Nominal Work Limits (NWLs). The NWLs are defined in Annexure M1/A A5 and A6.

1.2.2 Maintenance Activities

The Maintenance Activities related to the provision of the Services are defined in Annexure M1/B for Ordered Work and in TfNSW M3 Annexure M3/B for Routine Services. Payment for the Services is in accordance with the General Conditions.

1.2.3 Schedules of Identified Records

The records listed in Annexure M1/C are Identified Records for the purposes of TfNSW Q4M.

1.2.4 Planning Documents

The PROJECT QUALITY PLAN must include each of the documents and requirements listed in TfNSW QA Specification Q4M and must be implemented.

In all cases where this Specification refers to the manufacturer’s recommendations, these must be included in the PROJECT QUALITY PLAN.

1.2.5 Referenced Documents

Annexure M1/M lists the documents referenced in this Specification.

Unless otherwise specified, materials and workmanship must be in accordance with Specifications and drawings, and thereafter the Australian Standards. Standards, specifications and test methods are referred to in abbreviated form (e.g. AS 1234). Unless otherwise specified, the applicable issue of a

referenced document, other than a TfNSW Specification, is the issue current at the date one week before the closing date for tenders, or where no issue is current at that date, the most recent issue.

1.3 DEFINITIONS AND ACRONYMS

Some words and phrases have special meanings in this Specification. In some cases, the defined meaning is different from the meaning that the word or phrase might have in ordinary usage. In order to understand the Specification, the Service Provider needs to take these special meanings into account. Defined terms have the special meanings set out in this clause and the General Conditions. All defined terms are indicated by way of first letter capitalisation of words.

1.3.1 Definitions

For the purpose of this Specification, the following definitions apply:

“Assets” means the assets located on the Road Network and included in the Services as specified in Annexure M1/A A4 to A6.

“Built-up Area” means the length of road where there are buildings on the land next to the road or there are streetlights along the road with a spacing of 100 metres or less for a total length of at least 500 metres or if the road is shorter than 500 metres, for the whole length of the road, unless otherwise specified in Annexure M1/A A1.

“Classified Road” means a road defined by the Roads Act 1993 (NSW).

“Complaints Register” means the system to be implemented and maintained by the Service Provider the purpose of which is to record and track complaints and enquiries from the public, as more fully described in clause 2.4.

“Contract” means the Road Maintenance Council Contract, including its schedules, as amended from time to time, between TfNSW and the Service Provider in terms of which the Service Provider agrees to provide the Services to TfNSW in accordance with the terms and conditions set out thereunder.

“Contract Management System” means the systems and plans referred to Clause 2.2.

“Daily Work Record” means the daily record of work completed as detailed Clause 2.8.

“Formation NWL” means the lengths of road where the Nominal Work Limit has been designated as ‘Formation’ in Annexure M1/A A1. The Formation NWL is the area bounded by the following (whichever is wider) and the centre-line of the road carriageway: (a) back of table drain (i.e. the Hinge Point);

(b) kerb and/or gutter;

(c) Hinge Point for embankments.

Where the limits cannot be determined by the above definition, as is likely in very flat terrain, the limits are defined as 4.0 metres from the Travelled Way.

“Freeway NWL” means the lengths of road where the Nominal Work Limit has been designated as ‘Freeway’ in Annexure M1/A A1. The Freeway NWL is the area bounded by the boundary line of the road reserve and the centre-line of the road carriageway.

“Hazard” has the same meaning given to that term in TfNSW M3.

“Hinge Point” means the cross-section of a road, the point at which the batter, if extended, would intersect the verge.

“Kerb NWL” means the lengths of road where the Nominal Work Limit has been designated as ‘Kerb’ in Annexure M1/A A1. The Kerb NWL is the area bounded by the line running along the back of kerb or gutter (i.e. includes the kerb and guttering) and the centre-line of the road carriageway.

“Lane NWL” means the lengths of road where the Nominal Work Limit has been designated as ‘Lane’ in Annexure M1/A A1. The Lane NWL is the area bounded by the outside edge of the Travelled Way and the centre-line of the road carriageway. For the purposes of the definition the width of a lane is defined as the outside edge of lane marking (if not measuring more than 5.5 metres) or if not marked or if the marking is wider than 5.5 metres, is taken as the narrower width defined by: (a) 3.5 metres measured from the centre line or adjacent lane line or central median; or

(b) the same width as the seal or abutting kerb/gutter.

“Maintenance Activity” means an activity defined in Annexure M1/B for Ordered Work and in TfNSW M3 Annexure M3/B for Routine Services.

“Maintenance Activity Code” means the code assigned to each Maintenance Activity.

“Maintenance Activity Group” means the grouping of Maintenance Activities as listed in Annexure M1/B for Ordered Work and in TfNSW M3 Annexure M3/B for Routine Services.

“Maintenance Clear Zone” has the same meaning given to that term in TfNSW M3.

“Nominal Work Limit” means the area defined by Lane NWL, Kerb NWL, Formation NWL, Freeway NWL and the diagrams in Annexure M1/A A6. The NWLs are used to define the scope of certain activities related to the maintenance of Assets.

“Normal Working Hours” means the hours of work agreed between the parties not extending beyond the hours 7am to 6pm Monday to Friday and 8am to 1pm Saturday (7am to 1pm Saturday for works that do not generate noise), subject to TfNSW G36.

“Noxious Weeds” means weed species listed by the relevant local government authority as noxious categories W1, W2, W3, or W4 under the Noxious Weeds Act 1993.

“Ordered Work” means those Maintenance Activities which are set out at Annexure M1/B as ordered in accordance with Clause 10 of the General Conditions.

“Private Access Road” means the road (including a driveway), for the exclusive use of adjoining private property owners, to gain access to and from their land and a classified road.

“Project Quality Plan” means the Service Provider’s plan for ensuring quality of the Services in accordance with TfNSW QA Specification Q4M.

“Restricted Access Road” means lengths of road designated as freeway, transitway or controlled access road.

“Road Category” means the lengths of road identified as either ‘H’ (higher trafficked roads), “M” (moderately trafficked roads) and “L” (lower trafficked roads) as nominated in Annexure M1/A A1.

“Roads Act” means the Roads Act 1993 (NSW).

“Road Network” means the roads listed in Annexure M1/A.

“Road Occupancy Licence” means a licence issued under TfNSW QA Specification G10M allowing the Service Provider or the Service Provider Personnel (as applicable) to restrict, close, interfere with or obstruct any lane or shoulder of a road or the free flow of traffic on any lane for the purposes of performing any Service.

“Routine Services” means those Maintenance Activities which are generally of a minor and cyclical nature, being each of the “Corrective Maintenance Activities”, “Amenity Maintenance Activities” and “Scheduled Maintenance Activities”. A comprehensive list of Maintenance Activities for Routine Services is provided in TfNSW M3 Annexure M3/B.

“Special Event” means a sporting, cultural or other event which causes an increase in traffic in the surrounding areas, reduces traffic speed or lowers the capacity of the road network and which, in the opinion of the Transport Management Centre or TfNSW, requires special traffic management arrangements.

“Specification” means all of the specifications incorporated into the Contract and includes any associated drawings.

“State Roads” means the administrative classification of road as defined in the document entitled NSW Road Management Arrangements available on the internet.

“State Road Traffic” means traffic travelling on a State Use Lane.

“State Use Lane” means the portion of the carriageway that is assigned to moving State Road Traffic.

“Subcontractor” means the Party that provides a service and/or product to the Service Provider.

“Traffic Management Plan” means a plan showing how traffic will be managed when construction works are being carried out, and is more fully described in TfNSW QA Specification G10M.

“Transport Management Centre (TMC)” means the centre that is responsible for the efficient operation and free flow of traffic including the issuing of Road Occupancy Licences where applicable and in field management of traffic around major unplanned incidents. The TMC has the power to have obstructions to traffic removed and to direct the Service Provider in the circumstances stated in the Contract.

“Travelled Way” means the portion of the carriageway that is assigned to moving State Road Traffic. Specifically it means one traffic lane for each direction of travel plus the following additional lanes or areas: (a) adjacent lanes signposted as clearway or having other parking restrictions imposed to provide

traffic or passing opportunity for peak hour demands; (b) adjacent lanes catering predominantly for State Road Traffic (not local traffic) appropriate for

the traffic volumes. (c) turning and acceleration/deceleration lanes essential to preserve traffic flow;

(d) adjacent overtaking lanes.

The Travelled Way explicitly excludes 24 hour parking lanes and unsealed or sealed road shoulders.

“Work Area” means the area on a road or bridge or other Asset and any adjoining land or premises where a Service is being carried out or, depending on the context, the area where a Service may be required to be carried out.

“Worksite” means the whole of the area of a road or bridge or other Asset on which a Service Provider is carrying out a Service, including the Work Area and any additional length of road or other

land or premises required for traffic control such as signs and tapers (or, in the case of Services being carried out off-road, any additional space required to install or operate safety measures associated with the work). Depending on the context, a Worksite may also refer to a potential Worksite (a site where Services are not currently being carried out but may be required to be carried out at a future time).

1.3.2 Acronyms

The acronyms used throughout this Specification include:

2 MANAGEMENT REQUIREMENTS

2.1 DESCRIPTION OF THE SERVICES

The requirements identified in this Specification must be carried out diligently. The Services are defined in Clause 5 of the General Conditions. The physical works undertaken as part of the Services comprise: (a) Routine Services, which includes Corrective Maintenance, Amenity Maintenance and

Scheduled Maintenance as detailed in TfNSW M3; and (b) Ordered Work, which consists of specific maintenance activities as listed in Annexure M1/B

and ordered in accordance with Clause 10 of the General Conditions.

2.2 CONTRACT MANAGEMENT SYSTEM

All Services must be managed and carried out in accordance with an approved Contract Management System in accordance with TfNSW QA Specification Q4M which integrates all the tasks and activities required to carry out the Services in a safe and effective manner. The purpose of the Contract Management System is to develop and implement an integrated system which will: (a) Encompass the Fundamental Principles outlined in Clause 2 of the General Conditions.

(b) Assure TfNSW that all the obligations under the Contract will be met.

(c) Identify roles and responsibilities within the Service Provider’s organisation in respect to the Services.

(d) Ensure continuous improvement to operational plans, procedures and/or instructions.

(i) The Contract Management System will include a suite of Management Plans such as: (ii) The Project Quality Plan (refer to TfNSW QA Specification Q4M).

(iii) Work health and safety (refer to TfNSW G22).

(iv) Environmental management (refer to TfNSW G36).

(v) Traffic management including management of road access and occupancy (refer to Clause 3.2).

The suite of plans listed is not a comprehensive list and depending on the Services provided, TfNSW may request additional Management Plans. The quality and performance of the Services must be managed and controlled in accordance with the Contract Management System.

2.3 JOINT PLANNING ASSESSMENT

A Joint Planning Assessment (JPA) of the Road Network must be carried out on an annual basis and involves a joint inspection by both TfNSW and the Service Provider. The timing of this will be determined by TfNSW but will generally be around March each year. The purpose and typical supporting information provided is detailed in Table M1.1.

2.4 MANAGEMENT OF COMPLAINTS AND ENQUIRIES

The Services include certain public relation functions such as dealing with complaints and enquiries relating to the Road Network. A system to record and track complaints and enquiries from the public must be implemented. A 24 hour telephone service must also be provided to ensure prompt response to Hazards. A Complaints Register containing records of all public complaints and enquiries must be maintained at all times and produced to TfNSW on request. The Complaints Register must be such that it is suitable to track all representations. The Complaints Register, as a minimum, must include the following information: (a) date, time and nature of complaint/enquiry;

(b) how the complaint was made e.g. by telephone, letter, meeting;

(c) details/nature of the complaint/enquiry; (d) contact details of person making complaint/enquiry;

(e) proposed action (by whom and by when);

(f) close-out date and any monitoring that was carried out to confirm that the complaint has been satisfactorily resolved.

Complaints must be dealt with promptly. Where a complaint cannot be dealt with as part of Routine Services, details of the complaint must be provided to TfNSW within 24 hours. This must be accompanied with any recommended actions (where appropriate) for dealing with the complaint.

All enquiries from the media (press, radio, television or internet) must be logged and where necessary referred to TfNSW. No statements, interviews, or release of non-published documents are permitted without the written consent of TfNSW and are subject to the provisions of Clause 12.12 of the Contract. Consent by TfNSW regarding comment to the media may be provisional and subject to conditions. If required, and without seeking TfNSW’s consent, the following information may be provided: (i) details of the Specification such as intervention and response time requirements; (ii) inspection frequencies; and

(iii) factual job specific information relating to approved work, including anticipated duration of the Services.

2.5 MEETINGS

The Service Provider’s authorised representative must attend all meetings specified below: (a) Joint Planning Assessment Inspection - Once per year (refer to Clause 2.3).

(b) Peer Exchange Group - At least once per year (refer to Clause 18 of the General Conditions).

(c) Leadership Team meetings in accordance with Clause 19 of the General Conditions.

(d) Management Team meetings in accordance with Clause 20 of the General Conditions.

2.6 DEFENDING LEGAL ACTION

When requested by TfNSW, in circumstances where a claim or legal action has been commenced against TfNSW, (except where the Service Provider is instigating an action against TfNSW), the Service Provider must submit a full report based on the Service Provider's knowledge of any relevant matter within the stipulated time.

2.7 REPORTING

2.7.1 Overview

The requirements in this clause are additional to the requirements set out in Clause 7.2 of the General Conditions.

The reporting requirements specified in this clause cover both Routine Services and Ordered Work. The Maintenance Activity Codes and Maintenance Activity Groups are listed in Annexure M1/B for Ordered Work and TfNSW M3 Annexure M3/B for Routine Services.

All reports must be submitted to TfNSW in a timely manner. A list of reports and their required frequency of submission are specified in the Table M1.2. Reports must: (a) include a unique contract number to identify the contract for which the report relates;

(b) be dispatched by post and/or e-mail to be received by TfNSW promptly and by the dates nominated; and

(c) if dispatched by post, they must also be lodged in electronic spreadsheet form.

Accomplishment reports must include work accomplishment at the Maintenance Activity level. Unless otherwise agreed, accomplishment data when considered on an annual basis, must be accurate to within ± 10% for the Routine Services. TfNSW expects that accomplishment data for Ordered Work is accurate as practicable.

The simple accomplishment report includes the following details:

(a) Maintenance Activity Code;

(b) Maintenance activity description; (c) Units of measurements;

(d) Accomplishment for each quarter;

(e) Year to date - Work completed; and

(f) Year to date - Person hours spent on each activity.

The detailed accomplishment report includes the following details: (i) Maintenance Activity Code;

(ii) Maintenance activity description;

(iii) Units of measurements;

(iv) Road number as specified in Annexure M1/A A1;

(v) Local Government Area; (vi) Location reference and road segments as provided by TfNSW;

(vii) Year to date - Work completed;

(viii) Year to date - Person hours spent on each activity.

2.7.3 Cost Report

Cost reports must be provided at the Maintenance Activity Group level. As a minimum, financial data must be provided for the quarter just completed (e.g. the report in the 2nd quarter must contain cost information for the 1st quarter).

The cost report includes the following details:

(a) Maintenance Activity Code;

2.7.4 Maintenance Defects Register Report

The maintenance defects register report must include the following details: (a) Road number;

(b) Location;

(c) Defect number;

(d) Defect code, which is a combination of the Maintenance Activity Code and intervention standard (Defect) referenced in Clause 6 of TfNSW M3 (e.g. C-201a – for a Pothole or delamination > 300 mm diameter);

(e) Date defect identified;

(f) Defect due date; (g) Defect completion date;

(h) Estimated extent of defect.

2.8 RECORD KEEPING

Records relating to work performed must be created on a daily basis and must contain: (a) a record of the work done measured in accordance with the activity codes and units of

measurement specified for each Maintenance Activity; (b) If relevant, the defect code;

(c) Date and time (commencement and completion) and hours worked;

(d) Location of the work; (e) Certification by the crew leader that the work recorded has been conducted in accordance with

the relevant quality, work health and safety and environmental requirements.

All records produced in the implementation of the Contract Management System must be retained and made available electronically to TfNSW as required. Identified Records are listed in each relevant specification and includes the records listed in Annexure M1/C C2.

3 OPERATIONAL REQUIREMENTS

3.1 SERVICE PROVIDER’S FACILITIES

The Service Provider’s facilities must:

(a) Include all necessary buildings, workshops, services, equipment and storage areas for the satisfactory performance of the Services.

(b) Be serviced and maintained safely and properly in accordance with all relevant legal requirements and the requirements of good modern business practice.

(c) Ensure secure and safe parking of plant and equipment.

(d) Provide a compound for impounding abandoned vehicles in accordance with TfNSW M3.

The camping of employees on TfNSW’s premises is not permitted without obtaining prior written consent from TfNSW.

3.2 TRAFFIC MANAGEMENT

Traffic management at Worksites must be carried out in accordance with TfNSW QA Specification G10 or TfNSW QA Specification G10M as appropriate. Where necessary, effective traffic management must be provided, by: (a) maintaining a safe operation for the Road Network; (b) maximising the availability of the Road Network;

(c) minimising disruption to the network and to residential or business property accesses;

(d) restoring the Road Network capacity as soon as possible.

The Service Provider must not undertake any Service (except to attend to emergencies or rectify Defects that are Hazardous or potentially Hazardous) which has the effect of restricting, closing, interfering with or obstructing the free flow of traffic on any lane or shoulder of a road without considering the road access restrictions which are defined in Annexure M1/A A3..

The Road Occupancy License (ROL) requirements are specified in TfNSW QA Specification G10M. Road access restrictions may apply under specific circumstances and where they are applicable the work must be carried out in accordance with

The Traffic Management Centre (TMC) is responsible for maintaining the road traffic operations at maximum efficiency at all times. The TMC monitors and manages the transport on the NSW road network 24 hours a day and has local representatives in each region. The role of the TMC includes, but is not limited to, consenting to all planned restrictions of traffic flow on the network through the issuing of Road Occupancy Licenses where required, managing tidal flow operations and coordination of incidents on the network which have an impact on traffic flow. In supporting the TMC to maintain traffic operations at maximum efficiency the Service Provider must nominate a person who will be responsible for the traffic management of the road network. As a minimum, the nominee will be responsible for the following: (i) liaison with TfNSW’s personnel, including the TMC’s local representative, to facilitate

processing of applications for Road Occupancy Licences where required as efficiently as possible;

(ii) development of the Traffic Management Plan;

(iii) coordinating traffic management activities on the network;

(iv) traffic management planning and reporting;

(v) attendance at traffic management meetings as required.

The permitted working time for emergencies is unrestricted, subject to compliance with the Contract. If requested (by TfNSW, TMC or the Police), all emergencies, regardless of whether they occur within or outside of working hours, must be attended.

3.3 PROTECTION OF TRAFFIC MANAGEMENT ASSETS

All suitable precaution must be taken to ensure that no damage occurs to the following assets or related infrastructure: (a) speed cameras and red light cameras;

(b) permanent or temporary traffic counters;

(c) traffic loops.

The Traffic Services Section or Camera Enforcement Section must be notified prior to any work commencing in the vicinity of the assets listed above. A contact list of personnel who are to be contacted for works near or affecting the Assets is provided in Annexure M1/E.

The Service Provider must liaise directly with parties responsible for reinstating traffic signal loops, traffic facilities loops and camera loops and sensors made inoperable as a result of the performance of the Services, to ensure they are correctly and promptly reinstated. The cost of reinstatement of loops, sensors and counters damaged or removed due to the performance of the Services will only be borne by TfNSW if the damage to the loops and counters is not due to the Service Provider's negligence.

The delineation of the roadway must not be compromised as a result of pavement markings or reflective raised pavement markers being removed or damaged as a result of undertaking the Services. Any appropriate signposting and temporary measures must be implemented and maintained until permanent reinstatement is undertaken. All costs relating to temporary reinstatement, maintenance and removal, and permanent reinstatement are to be borne as part of the Services.

3.4 INTERFACE MANAGEMENT

3.4.1 Community Announcements, Advertisements or Letterbox Drops

Notification to the public through newspaper advertisements, radio announcements or letterbox drops will generally be required where the Services result in significant traffic disruption, require artificial light, generate noise, vibration or any other such potential public annoyance or inconvenience. Other mediums of communication may also be needed.

When directed by TfNSW or as required by this clause but subject always to Clause 12.12 of the General Conditions to the extent applicable, relevant sections of the community and the transport industry must be notified with regards to the timing and nature of the Services. Reference to the nature of the potential inconvenience or annoyance must be mentioned in any public notification. All advertisements and other public notifications are subject to prior written consent by TfNSW and must be provided in a draft form, at least 3 weeks prior to their proposed placement or issue date, unless TfNSW specifies otherwise, or has previously consented to the format and typical content of advertisements / public notifications.

Unless otherwise specified or directed by TfNSW, all advertisements and radio announcements must be placed or be aired (as the case may be) during the week prior to commencing the work. The newspaper advertisement must be placed in a prominent position in the newspaper. Radio announcements must be aired during weekday breakfast or drive time programs.

Letterbox drops are required for services undertaken at night in Built-up Areas, and Services where there is an inconvenience or annoyance for either residential or business properties.

The affected residents and businesses must be notified by a hand delivered letter detailing the dates, times and nature and impact of the Services and relevant contact details, at least seven calendar days

prior to the proposed date. Negotiations with affected residents and businesses may be required in order to resolve any conflicts with the proposed access restriction arrangements.

Information signs about the Ordered Work must be provided if specified in the Work Order. The signs must be provided on each approach and are to be located not less than 750 metres and no greater than 2 kilometres, prior to the transition area of the Worksite. As a minimum, information signs must indicate the location of work (road name and work location), start and finish dates, working days and hours of work, and contact phone number for enquiries. The information signs must be installed a minimum of 1 week prior to the start date and removed at the completion of the works to which they relate. The signs must be maintained in good condition for the full period of the display.

3.4.2 Private Properties

Where the existing access to a private property is interfered as a result of the Services, a suitable access must be restored as part of the Services. The formation and pavement of the entrance must be reinstated equally in width, depth and quality to that previously existing.

3.4.3 Work by Others

The Service Provider or the Service Provider’s Personnel (as applicable) shall work amicably with others undertaking work within the Road Network in accordance with requirements of Clause 3.3 of the General Conditions. The presence of other contractors does not relieve the Service Provider of an obligation to respond to Hazards as required. In the event of an incident or emergency, immediate action must be taken to ensure that the safety of the network or TfNSW’ interests is not compromised. Any issues relating to work by others should be reported to TfNSW.

Inspections of the Assets impacted by the work of others will be carried out jointly by TfNSW, the Service Provider and the other contractor on practical completion and at the end of the defects liability period. The purpose of these joint inspections is to identify any outstanding maintenance issues or omissions.

3.4.4 Rail and Public Utilities

When working near or encroaching onto rail tracks the Service Provider must liaise with the relevant authority or corporation. Track clearances and restrictions as imposed must be followed. All Services must be conducted so as to minimise the interference with work on public utility adjustments by the public utility Authority or its contractors. TfNSW reserves the right to permit public utility Authorities and others to work on or near any of the Assets. The Service Provider must comply with the terms and conditions of agreements between TfNSW and any other public utility Authority in regards to the installation and maintenance of utilities in roads. TfNSW will provide copies of any such agreements as required.

3.5 MATERIAL STORAGE AREAS

Material storage sites owned by TfNSW may be available for use by the Service Provider and the Service Provider’s Personnel (as applicable). These sites, where available, will be solely for the purpose of storing material to be incorporated in the Services.

Prior consent from TfNSW must be obtained if any temporary stockpile site is established. All issues, such as, visual impact, accessibility, stormwater and erosion, flora and fauna, residential amenity, heritage, sustainability and security, must be addressed. Sweepings, litter, detritus or debris must not be allowed to remain on a temporary site outside of Normal Working Hours, unless specifically approved by TfNSW.

Where other stockpile sites or facilities are used, the service provider is responsible for locating, gaining legal entry to, gaining consent for, establishing, maintaining access and drainage, and for reinstating the site or facility after use.

Stray animals within corridor

The Police or owner of the animal may remove stray animals from the road corridor. Council may also exercise this authority where they have an appointed impounding officer (refer Impounding Act 1993). The Service Provider will take all action necessary, including erecting warning signs, regulating traffic, and notifying the Police, to ensure the free flow and safety of traffic. TfNSW does not have the authority to impound stray animals.

Graffiti removal general

Removal of graffiti from all assets that are the responsibility of TfNSW (except grade-separated structures and noise walls). The term “Graffiti” includes posters and stickers. See Diagram A.8.

Removal of graffiti from grade-separated structures and noise walls which are visible by motorists traveling on the Road Network. Grade-separated structures are structures such as bridges, pedestrian tunnels, retaining walls etc.

Removal of abandoned, illegally parked, unattended vehicles or articles that: Obstruct traffic.

Are considered dangerous.

Are located within the NWLs within Built-up Areas or within the Maintenance Clear Zone on other areas.

Removal of abandoned articles other than vehicles. TfNSW can only legally remove an abandoned article if the article constitutes a danger or obstruction to traffic.

Removal of fixed objects such as drainage structures, steep slopes and other obstructions that may expose the road user to a hazardous situation.

Incident response

Provision of resources to assist in the management of, or restoration of damage resulting from an accident or natural disaster, within the Road Network or if the incident adversely affects the free flow of traffic on the Road Network.

Noxious or environmental weeds

Control of Noxious Weeds within the road reserve for Freeway NWL designated roads. Control of Noxious Weeds on other roads. Note: The local control authority for land within the unincorporated area is the Western Lands Commissioner. The local control authority for land within a local government area is the relevant Council.

Landscaped areas

Maintenance of designated landscaped areas (see Clause A4.3.) or landscaped areas within traffic islands and medians included in the Assets. Maintenance includes watering, weeding, minor tree surgery as required, and such other action as is necessary to ensure that the areas will be neat and attractive.

Maintenance of enhanced landscaping schemes (e.g. on approach to a township) implemented by Council.

Bushfire control

Maintenance of designated fire breaks (see Clause A4.4). Roadside growth adjacent to State Forests

Maintenance of roadside growth adjacent to State Forests. Note: Before removing trees consult with the Forestry Commission. The Forestry Commission is responsible for the management of roadside growth within the corridors of roads where they pass through or alongside a State Forest.

Boundary fencing

Maintenance of boundary fencing, including gates, cattlegrids or other apparatus necessary for the operation of the fence, for purpose of containing animals and people within the owners’ land. Refer to Animals Act 1977 and Dividing Fences Act 1991 for the owners’ legal obligations relating to boundary fencing and liability for damage by animals. Note: The Services include temporary repairs to boundary fencing necessary to ensure road user safety.

Maintenance of boundary fencing on restricted access roads where an existing agreement with the landowner states that TfNSW has a contractual obligation to maintain boundary fencing.

Maintenance of fences for the purpose of preventing stock straying onto railway lines.

Pedestrian grab rails and fences

Maintenance of pedestrian grab rails and/or exclusion fencing within medians and traffic islands that form part of the Assets. Pedestrian fences at the top of retaining walls or adjacent to service roads. See Diagram A.13.

Noise walls Maintenance of noise walls located within the road corridor. The function of noise walls is to ameliorate traffic noise, except noise walls located on private land.

Repair of cut/fill batters and retaining walls to ensure structural integrity necessary to support the width of carriageway needed by traffic using the road. Note: Council is responsible for additional slope stability works required to support local access roads, footways/footpaths, parking bays and other council land.

Rock falls and slips

Repair of unstable slopes in order to prevent rock falls and slips. Only includes slopes where debris likely to fall within the NWLs or where stability of road impacted.

A catch drain is an open channel constructed along the high side of a road cutting or embankment, outside the batter to intercept and redirect surface water. A diversion drain leads water away from the road formation. See Diagram A.15.
