Published in The Times February 20, 2020 ORDINANCE # 574 AN ORDINANCE REGULATING THE PARKING AND OPERATION OF VEHICLES UPON STREETS DESIGNATED AS EMERGENCY SNOW ROUTES WHEN SNOW REMOVAL OPERATIONS ARE NECESSARY, AUTHORIZING THE CITY OF WESTMORELAND TO DECLARE A TRAFFIC EMERGEN- TY AND PRESCRIBING A PENALTY. SECTION 1. TITLE This Ordinance shall be known as and may be cited as the “Snow Route Ordinance” of the CITY OF WESTMORELAND, KANSAS. SECTION 2. FINDINGS OF GOVERNING BODY The Governing Body finds that parking and operation of vehicles on certain streets covered by a heavy accumulation of snow is a matter affecting the health, safety and welfare of the citizens of Westmoreland for the reason that parked and stalled vehicles impede snow removal operations and cause serious traffic congestion and hazard to the safety of the citizens of Westmoreland. SECTION 3. DECLARATION OF PARKING EMERGENCY Whenever snow has accumulated, or sleet or freezing rains make motor vehicle travel treacherous, a snow emergency is in effect. Parking on designated city streets is prohibited or restricted for snowplowing or other purposes until such operations are completed. SECTION 4. DECLARATION OF PARKING EMERGENCY, TERMINATION After snow accumulation, or sleet or freezing rain has ended and snow removal or the treatment of streets and parking areas has been completed, the snow emergency shall no longer be in effect. SECTION 5. STALLED VEHICLES ON EMERGENCY ROUTE Whenever a vehicle becomes stalled for any reason, whether or not in violation of this ordinance, or any part of a snow emergency route on which there is a covering of snow, sleet, or ice, or on which parking prohibition is in effect, the person operating such vehicle shall take immediate ac- tion to have the vehicle towed or pushed off the roadway of such snow emergency route onto the first cross street which is not a snow emergency route. No person shall abandon or leave their vehicle in the roadway of a snow emergency route. SECTION 6. REMOVAL OF PARKED VEHICLES All vehicles parked on emergency snow routes must be removed within two (2) hours after dec- laration of a parking emergency has been put into effect. All stranded or abandoned vehicles impeding snow removal operations or causing traffic congestion, may be removed or caused to be removed by law enforcement to another place of safety and the vehicle may not be recovered until the towing and storage charges are paid by the owner of the vehicle. SECTION 7. PENALTY It shall be unlawful for any person to interfere with this ordinance. Any person violating this ordi- nance shall be deemed guilty of a class “C” misdemeanor and may be sentenced to a term of no more than one (1) month jail time or a fine of five hundred dollars ($500.00). SECTION 8. EMERGENCY SNOW ROTES; ESTABLISHMENT; SIGNS Upon declaration that the Snow Route Ordinance is “in effect”, the streets listed in this section shall be designated and marked with “Emergency Snow Route” signs. The emergency snow routes are as follows: SECTION 9. ALL HAZARD EMERGENCY SNOW ROUTE This ordinance is designated primarily as a snow removal ordinance; however, it can also be used as an All Hazard Emergency Route in the event of any other emergency conditions. SECTION 10. REPEAL OF CONFLICTING ORDINANCES All ordinances and parts of ordinances in conflict herewith are hereby repealed. This Ordinance shall be in full force and effect from and after its adoption and publication in the official city newspaper. AN ORDINANCE REGULATING THE PARKING AND OPERATION OF VEHICLES UPON STREETS DESIGNATED AS EMERGENCY SNOW ROUTES WHEN SNOW REMOVAL OPERATIONS ARE NECESSARY, AUTHORIZING THE CITY OF WESTMORELAND TO DECLARE A TRAFFIC EMERGEN-TY AND PRESCRIBING A PENALTY.SECTION 1. TITLEThis Ordinance shall be known as and may be cited as the “Snow Route Ordinance” of the CITY OF WESTMORELAND, KANSAS.SECTION 2. FINDINGS OF GOVERNING BODYThe Governing Body finds that parking and operation of vehicles on certain streets covered by a heavy accumulation of snow is a matter affecting the health, safety and welfare of the citizens of Westmoreland for the reason that parked and stalled vehicles impede snow removal operations and cause serious traffic congestion and hazard to the safety of the citizens of Westmoreland.SECTION 3. DECLARATION OF PARKING EMERGENCYWhenever snow has accumulated, or sleet or freezing rains make motor vehicle travel treacherous, a snow emergency is in effect. Parking on designated city streets is prohibited or restricted for snowplowing or other purposes until such operations are completed.SECTION 4. DECLARATION OF PARKING EMERGENCY, TERMINATIONAfter snow accumulation, or sleet or freezing rain has ended and snow removal or the treatment of streets and parking areas has been completed, the snow emergency shall no longer be in effect.SECTION 5. STALLED VEHICLES ON EMERGENCY ROUTEWhenever a vehicle becomes stalled for any reason, whether or not in violation of this ordinance, or any part of a snow emergency route on which there is a covering of snow, sleet, or ice, or on which parking prohibition is in effect, the person operating such vehicle shall take immediate ac-tion to have the vehicle towed or pushed off the roadway of such snow emergency route onto the first cross street which is not a snow emergency route. No person shall abandon or leave their vehicle in the roadway of a snow emergency route.SECTION 6. REMOVAL OF PARKED VEHICLESAll vehicles parked on emergency snow routes must be removed within two (2) hours after dec-laration of a parking emergency has been put into effect. All stranded or abandoned vehicles impeding snow removal operations or causing traffic congestion, may be removed or caused to be removed by law enforcement to another place of safety and the vehicle may not be recovered until the towing and storage charges are paid by the owner of the vehicle.SECTION 7. PENALTYIt shall be unlawful for any person to interfere with this ordinance. Any person violating this ordi-nance shall be deemed guilty of a class “C” misdemeanor and may be sentenced to a term of no more than one (1) month jail time or a fine of five hundred dollars ($500.00).SECTION 8. EMERGENCY SNOW ROTES; ESTABLISHMENT; SIGNSUpon declaration that the Snow Route Ordinance is “in effect”, the streets listed in this section shall be designated and marked with “Emergency Snow Route” signs. The emergency snow routes are as follows:

ALL HAZARD EMERGENCY SNOW ROUTEThis ordinance is designated primarily as a snow removal ordinance; however, it can also be used as an All Hazard Emergency Route in the event of any other emergency conditions.SECTION 10. REPEAL OF CONFLICTING ORDINANCESAll ordinances and parts of ordinances in conflict herewith are hereby repealed.This Ordinance shall be in full force and effect from and after its adoption and publication in the official city newspaper.ADOPTED AND APPROVED by the Governing Body, this 13th day of February, 2020.
