This royalty will be charged to thebuyer on the hammer price and inaddition to the buyer’s premium. It willnot apply to works where the hammerprice is less than €1,000 (euros). Widely renowned for hisability to effectively conveyraw emotion, and his uniquefigurative style, PeterHowson’s works are instantlyrecognisable. Howsonstudied at the Glasgow Schoolof Art in the 1970s andquickly gained recognitionthroughout the art world witha series of commissions andexhibitions. In 1993, Howsonwas appointed by theImperial War Museum to theposition of British Official WarArtist during the Bosnian CivilWar. Howson himself hasdescribed this time in Bosniaas being ‘wrought withdifficulty’, as he struggled toconvey the horror of what hewitnessed in his works andmake them resonate with aBritish audience.

Included in this sale areHowson works from thisBosnian period previouslyexhibited by Flowers Galleryin London. ‘Mascotte’, ‘WhamBaam Maam 3!’, and ‘BoarHunt’, were all completed in1994 using pastel on paper.As is typical of Howson, themain focus within theseworks is upon the humansubjects depicted, indeed, theonly use of warm colour bythe artist in these works is tohighlight the subject’s faces.Not only does this limited useof colour serve to contrastwith the cool, blue tonedpaper and instantly draw theviewer’s eyes to the human

subjects, it serves to highlighta difference between theindividuals’ wretchedsurroundings, and thesubjects themselves. Othersubject matter included inthese works serve to conveyfurther the predominantfeeling of wartimemelancholy, particularly theinclusion of ammunitions,decapitated boar’s heads, andskulls and crossed bones.Howson was widely praisedfor his work as Official WarArtist, and all three of theseworks for sale are typicalexamples of his work fromthis formative and definingperiod of his career.

McFadyen’s work has had aseries of different focuspoints: moving from the wittyconjectures he made in ArtCollege, to the population ofLondon East End waifs andstrays of the 1980s before hestarted to produce lessfigurative work in the 1990sas the urban landscapebecame his predominantsubject.

Throughout his career, as wellas exhibiting prolifically,McFadyen has been involvedin a wide range of interestingcommissions andcollaborations. This beganwith his appointment as Artistin Residence at the NationalGallery in London in 1981,which was the catalyst of hismove to observed working, ofwhich the East End waifs andstrays were the result. In theearly 1990s he wascommissioned by the ImperialWar Museum to record eventsaround the dismantling of the

Berlin Wall before working onthe set and costumes forballet performances at theRoyal Opera House.

McFayen has claimed that hispainterly influences includeSickert, Whistler and Lowrybut for the most part he findshis inspiration in 1970s realistfilm and contemporary novelsand music rather than art. Asa result he has worked incollaboration with a range ofwriters including Iain Sinclair,Howard Jacobson and WillSelf. In 2005, he took hiscollaborative efforts a stepfurther by founding The GreyGallery, with his wife, themusician Susie Honeyman. It

is a nomadic entity whichworks with artists, writers andmusicians on a project basis,with the intention of workingacross disciplines and outsideof existing frameworksestablished by dealers andcurators.

McFadyen’s talent has beenconsistently recognised andcelebrated, through his high-profile commissions as well aswith the inclusion of his workin 30 public collections, aswell as private collectionsworldwide. He was elected aRoyal Academician in 2012,confirming his place withinthe British artisticestablishment.

In Japan, the country of hisbirth, Foujita is one the mostfamous artists. Yet his careerwas formed in the West, inMontparnasse, Paris duringthe early decades of thetwentieth century. At his peakhe was more successful thanhis good friend Picasso, andwas a formative influence onhis studio mate Modigliani.Fame and wealth cameswiftly and within a dozenyears of his arrival in Paris hehad received the Legion ofHonor, as well as the BelgianOrder of Léopold I. That hisname does not inspire thesame level of recognition ashis peers is in part due to thishigh level of early success.His work was and remainskeenly collected and as suchfew of our national

institutions hold a significantbody of his work, meaningthat apart from briefappearances on the openmarket, he remainssomewhat elusive to gallery-goers.

Foujita’s work was asidiosyncratic as the manhimself. The archetypicalbohemian, he adopted adistinctive aesthetic; a helmetof hair inspired by Egyptiansculpture, earrings, Grecianrobes and round rimmedglasses. Few have so successfullymanaged to embody theword ‘artist’ as wholly oruniquely as the polymathicDavid Bowie. Best known ofcourse as a singer/songwriter,Bowie’s entire career wasspent actively blurring thelines between the art formsof music, performance anddesign; the visual playing asbig a part as the aural.

Famously modest, the extentof Bowie’s skill as a painterand passion for collecting islittle known amongst thegeneral public. He, like somany of the influential bandsthat formed in the late 1960sand early 1970s, was aproduct of an art schooleducation. As well aspractising art, he also readwidely on the subject, evenbecoming well-regarded as acritic in the 1990s. His ownpersonal collection featuresmany Modern British artistsincluding Ben Nicholson,Stanley Spencer, DavidBomberg, Frank Auerbach,Patrick Caulfield and PeterLanyon, as well as DamienHirst and Scottish artist PeterHowson. He was particularlydrawn to figuration in all ofits 20th century guises, andhis own art is largely formedof abstracted head studies.His style references some ofthe bizarreness andesotericism of 1930s eraGerman Expressionist art,unsurprising given the dark

and atmospheric impact thatthe city of Berlin had on hismusical output.

Though painting and art wasa huge part of Bowie’s life, hiswork is extremely scarce tomarket, and Lyon & Turnbullare excited to offer this self-portrait by the artistic legend,its title ‘DHEAD’ being eerilyprescient given the timing ofits arrival at auction. The artwork was philanthropicallydonated by Bowie to a large

fund-raising exhibition called‘ARTAID ‘98’, held at the CityArt Centre in Edinburgh inthat year. Here his work washung alongside artistsincluding Craigie Aitchison,Howard Hodgkin, Gilbert andGeorge and Ken Currie.Bowie, perhaps aware thathis legacy as a musical geniuswas likely to foreverovershadow his output as avisual artist (or for thatmatter, as an actor), he

seldom exhibited his artworkand his last solo show was inthe 1990s. Examples of hisBerlin-era portraiture werefeatured in the 2013blockbuster exhibition ‘DavidBowie Is’ at the Victoria andAlbert Museum in London,where they received criticalacclaim in their own right.

The Scottish contemporary artscene is thriving, a fact longrecognised on theinternational stage. Glasgowwas recently named one ofthe top five centres forcontemporary art worldwideand has contributed no lessthan six winners to theprestigious Turner Prize andcountless nominees. Inacknowledgment, the cityhosted the 2015 awards.Edinburgh remains thecountry’s commercial centreand is of course also home tothe world’s largest artsfestival which takes place inAugust.

‘The New Glasgow Boys’ PeterHowson, Steven Campbelland Ken Currie claimed thespotlight in the 1980s andwere swiftly taken up byLondon and New York-basedcollectors. In the 1990s, thelikes of Douglas Gordon,David Shrigley and ChristineBorland influenced much ofthe artistic dialogue in the UK.This was largely off the backof the success of GlasgowSchool of Arts innovative andhighly regardedEnvironmental Art course, thefocus of which is to create artfor a public - be it urban orrural - environment, asopposed to a traditionalinstitutional space.

Turner prize nominated artistJames ‘Jim’ Lambie is one ofthe stalwarts of theburgeoning Scottish art sceneand a Glasgow man born and

bred. His work, perhaps moreso than any of hiscontemporaries, encapsulatesthe best features of theScottish art scene; it isinclusive, unpretentious,pleasurable and energetic. Herevels in the sensory andemotional impact of hisartworks as opposed toplaying intellectual games,and this makes his workpopulist (in the very bestsense of the word) andaccessible to all.

The piece represented herefor sale is emblematic of oneof Lambie’s core themes: hislove of music and his interestin conveying what he sees asthe symbiotic relationshipbetween both artisticmediums. Collage andembellishment play arecurrent role in his practiseand he takes pleasure inexposing the mechanics of hisprocess to his audience. Thework is part of a series whichjuxtaposes images of famous

rock stars with anachronistic,finely painted floral motifs inoils. Here we see themfiguratively blossoming out ofthe mouth of Sid Vicious, theill-fated punk musician of theSex Pistols. Iconoclastic butlight-hearted; it is a thing ofbeauty, black humour and asincere homage to a rock ’n’roll idol.

Sidney Nolan is Australia’smost honoured andinternationally acclaimedmodern painter. He was amajor figure in the modernistmovement and is consideredto have shapedcontemporary Australian art,through his involvement withthe Angry Penguins; acollection of painters whosought to modernise thecreative scene and challengeexisting traditions. Nolan firstattracted attention for hisseries of paintings inspiredby the life of the outlaw NedKelly, which remain a keygroup of works in theAustralian art oeuvre.

Nolan became a full-timepainter at 21, after attendingart night classes. For themost part, he foundtraditional art schooling dulland preferred to follow hisown nose at the local library,as a voracious reader. In hisyouth, he lived and workedwithin the vibrant artisticcommunity in Melbourneand was supported andencouraged by patrons andpublicists, Sunday and JohnReed, whose house becamea focus of many artisticcircles.

Travel became a hugelyimportant part of Nolan’s lifeand work. He travelledthroughout Australia,revelling in the rugged andextreme beauty of theinterior, which was to remainan inspiration throughout hiscareer and a place to whichhe always returned tomarvel. A move to London in1951, facilitated wide travel

throughout Europe, before atravelling scholarship tookhim to America at the end ofthat decade. He alsotravelled to China, Africa andAntarctica in his lifetime.

‘African Landscape withElephant and Antelope’ wasinspired by one such travelexperience to the Africancontinent and the animals heencountered there. In

keeping with Nolan’s spirit ofexperimentation, it waspainted using ripolin, abranded fast-drying, fluidcommercial enamel paint. Inthis case, the striking colourand distinctive textureconvey the extreme heat and light of the Africanlandscape - the elephant andantelope’s natural habitat.

We are delighted to offer a collection of prints that were produced for the exhibition‘Fourteen Big Prints’, organised by Bernard Jacobson and held in his gallery in 1972.

Jacobson had decided to invite a variety of contemporary artists who he had knownfor a long time, and whose work he thought would look good on a large scale. Hisintention was that the exhibition would draw a new audience to contemporary art, inthe hope that ‘perhaps one day the general public will realise that art didn’t in factend with Van Gogh.’

The catalogue included comments and correspondence from each of the artists ortheir peers on their artistic process and included works.

DEFINITIONSIn these Conditions of Sale (Sellers): “Auctioneer” means Lyon & Turnbull Ltd or itsauthorised auctioneer, as appropriate; “Buyer“ is the person who makes the highest possiblebid or offer accepted by the auctioneer, and/or suchperson’s principal where bidding as agent; “Buyer‘s Premium” is the commission payable by theBuyer on the Hammer Price at the rates set out in theSale Catalogue Guide to Prospective Buyers and anamount in respect of applicable VAT; “Hammer Price” is the highest bid accepted by theauctioneer by the fall of the hammer or in the case of apost-auction sale, the agreed sale price; “Item” means each and every item consigned for salefollowing express written agreement between Lyon &Turnbull and the Seller; “Lot“ means each Item offered for sale by Lyon &Turnbull; “Lower Estimate” means the low estimate provided byLyon & Turnbull to the Seller in relation to each Item, orin relation to any Item which Lyon & Turnbull holds onbehalf of the Seller; “Lyon & Turnbull” means the company which has itsregistered office at 33 Broughton Place, Edinburgh, EHI3RR registered in Scotland No. 191166 “Net Sale Proceeds” are the Hammer Price, lesscommissions and other charges, of the Lot sold, to theextent received by Lyon & Turnbull in cleared funds; “Proposed Sale” means the intended sale through whichthe items will be sold on “Purchase Price” is the Hammer Price and applicableBuyer‘s Premium; “Reserve” means the lowest price below which an itemcannot be sold; “Upper Estimate” means the high estimate provided byLyon & Turnbull to the Seller in relation to each Item, orin relation to any Item which Lyon & Turnbull holds onbehalf of the Seller; “Terms of consignment” means the stipulated terms andrates of commission on which the Auctioneer acceptsinstructions from Sellers or their agents; “You”, “Your” means the seller. The Seller means you arethe owner of the lot or, if you are not the owner of thelot (whether or not you have notified us that you areacting as an agent for a principal), you are dulyauthorised by the owner of the lot to sell it.“Without reserve” where there is no minimum price atwhich a lot may be sold (whether at auction or byprivate treaty).“Us”, “Our”, “We” etc refers to Lyon & Turnbull LtdThe singular includes the plural and vice versa asappropriate.

2. WARRANTY OF TITLE AND AVAILABILITY

The Seller warrants:-(a) that you are the true owner of the propertyconsigned or are properly authorised by the true ownerto consign it for sale and are able to transfer good andmarketable title to the property free from any third partyclaims.(b) that all requirements have been complied with, legalor otherwise, relating to any export or import of theproperty consigned, all duties and taxes in respect ofthe export or import of the lot have (unless agreed inwriting with us) been paid and, so far as you and anyprincipal for whom they are acting in relation to the lotare aware, all third parties have complied with suchrequirements in the past.(c) that you have provided Lyon & Turnbull with anyand all information concerning the item’s provenanceor any concerns expressed by third parties concerningits ownership, condition, authenticity, attribution, andexport or import history; and(d) Unless the Seller advises Lyon & Turnbull in writingto the contrary on delivery of the item to Lyon &Turnbull, there are no restrictions on Lyon & Turnbullrights to reproduce photographs or other images of theitem in connection with the sale or any other marketingwhich will be done in accordance with good taste anddecency.

3. PREPARATION FOR SALE(a) Lyon & Turnbull shall decide the way in which a lotmay be included in the sale, how any lot is describedand illustrated in the catalogue or any report, and themarketing, promotion, date, place and conduct of thesale. (b) Lyon & Turnbull will instruct, consult with, and relyon, any outside experts or restorers, agents or otherthird parties, and carry out such other due diligence,inquiries, research or tests in relation to the propertyor its provenance, either before the Proposed Sale as itmay deem appropriate in its reasonable discretion.(c) Any oral or written estimate or evaluation or reportprovided by Lyon & Turnbull is a genuinely heldopinion only. It may not be relied on as a prediction ofthe selling price or value of the Item, and may in Lyon &Turnbull’s absolute discretion be revised at any time.(d) The Seller acknowledges that attribution of Items is amatter of opinion and not of fact, and is dependentupon (amongst other things) information provided bythe Seller, the condition of the property, the degree ofresearch, examination or testing that is possible orpractical in the circumstances, and the status ofgenerally accepted expert opinion at the time ofcataloguing

4. TERMS OF SALEThe Seller acknowledges that lots are sold subject tothese Conditions and on the Terms of Consignment asnotified to the consignor at the time of the entry of thelot.

5. STANDARD SELLER FEES AND CHARGES (Subject to VAT)(1) Commission: 15% is charged on the selling price ofeach lot, (subject to a minimum charge of £30). Whenorganised on the Seller’s behalf the provision oftransport will be contracted to third parties. Fees fortransport will be deducted at the initial settlement. (3) Illustrations: The cost of any illustrations will beborne by the Seller , unless agreed otherwise prior. Thecopyright in respect of such illustrations shall be theproperty of us, the auctioneers, as is the text of thecatalogue.

6. RESERVES(a) You are entitled to place, prior to the auction, areserve on any lot consigned, being the minimumhammer price at which that lot may be sold. Reservesmust be reasonable and we may decline to offer goodswhich in our opinion would be subject to anunreasonably high reserve. The lot will be sold withoutreserve unless a reserve has been agreed.(b) Firm reserves may be no greater than lower pre-saleestimate level.(c) A reserve once set cannot be changed except withour agreement.(d) You may not bid or instruct or permit any otherperson to bid on your behalf on your own property. Ifthe Seller breaches this prohibition, Lyon & Turnbullmay treat the Seller as bound as Seller and as Buyerbut without the benefit of Lyon & TurnbullAuthenticity Guarantee or the reserve, and/or pursueother remedies.(e) We may sell lots below the reserve provided weaccount to you for the same sale proceeds as you wouldhave received had the hammer price been the reserve.

7. LOSS & DAMAGE WARRANTY(a) Subject to condition 7(c) below Lyon & Turnbull willassume liability for loss or damage to an item,commencing at the time that item is taken into physicalcontrol and possession by Lyon & Turnbull and ceasingon the earliest date of; (i) when risk passes to the Buyer of the lot following itssale; (ii) for unsold lots, when the lot is released to the Seller,or, within 3 months of the sale;or (iii) 6 months from the date of delivery to Lyon &

Turnbull for items still in the possession of Lyon &Turnbull but not consigned for sale (unless part of along-term storage agreement).(b) Lyon & Turnbull shall charge a loss and damagewarranty fee of 1.5% of the hammer price, plus VAT. (c) If any loss or damage should occur to the lot duringthe period identified in paragraphs (a) above, Lyon &Turnbull’s liability to compensate the Seller in respect ofthat loss shall be restricted to a maximum of the upperestimate, or actual loss incurred, whichever is lower.This compensation will be subject to a deduction of a1.5% loss & warranty fee (subject to VAT).

8. UNSOLD ITEMS(1) If an item is unsold it may, with your consent, be re-offered at a future sale. Where in our opinion an item isnot suitable for a future sale we may either request (a)you collect such items from the saleroom promptly onbeing so informed. We shall be entitled to charge youfor storage costs, charges shall be made at a reasonabledaily rate;or (b) suggest that the item be transferred to asecondary saleroom for sale without reserve. Alltransferred lots will be sold for the best price on theday, this may not bear any reflection on the item’soriginal estimate. Lyon & Turnbull are not liable for anyitems (whether it be selling price or loss & damage)when transferred. (2) Aftersales: We reserve the right to accept an after-auction offer on a lot on behalf of the seller, at theagreed reserve price or above, for up to 48 hours afterthe original auction. In which case the same charges willbe payable as if such lots had been sold at auction andso far as appropriate these Conditions apply.

9. LOT WITHDRAWAL If a Seller wishes to withdraw a lot organised for sale, awithdrawal fee will apply; (a) if withdrawn over 28 working days prior to the sale,this will be charged at 10% of the mid estimate alongwith any ancillary charges incurred (such asphotography), all subject to VAT at the current rate.(b) if withdrawn within 28 working days of the sale, thiswill be charged at 20% of the mid estimate along withany ancillary charges incurred (such as photography), allsubject to VAT at the current rate.(c) Lyon & Turnbull may withdraw a lot from theproposed sale without any liability if: (i) Lyon & Turnbull reasonably believes that there is anydoubt as to the lot‘s authenticity or attribution; or (ii) it reasonably doubts the accuracy of any of theSeller’s warranties; or (iii) the Seller breaches any provisions of the Conditionsof Sale in any material respect; or (iv) the lot suffers from loss or damage so that it is not inthe state in which it was when Lyon & Turnbull tookdelivery of it. (d) if an item is withdrawn from sale under Condition9(c) (i), or (iv), the Seller shall not be charged awithdrawal fee and the item shall be returned to theSeller or dealt with pursuant to Clause 8, as the Sellerdecides.

10. AUTHORITY TO DEDUCT COMMISSION ANDEXPENSES AND RETAIN PREMIUM AND INTEREST.The Seller authorises us to deduct commission at thestated rate, and all expenses incurred for your accountfrom the hammer price, and consents to our right toretain beneficially the premium paid by the Buyer inaccordance with these Conditions of Sale and anyinterest earned on the sale proceeds until the date ofsettlement.

11. NON-PAYMENT BY THE BUYER(a) Lyon & Turnbull will, where it considers appropriate,take reasonable steps to investigate the ability ofbidders to pay for lots and will use reasonableendeavours, in consultation with the Seller, to enforcepayment of the Hammer Price by any Buyer.(b) Lyon & Turnbull, in consultation with the Seller, willdecide whether to pursue any of the remedies availableto it, including those set out in Condition 10 of theCondition of Sale (Buyers) including the right to cancel thesale and return the property to the Seller. Lyon &Turnbull will inform the Seller of any action which itcontemplates taking against the Buyer.

(c) lf the Seller elects to take action against any Buyer onits own behalf Lyon & Turnbull will provide the Sellerwith such assistance as may be reasonably necessary topursue that action.(d) The Seller hereby agrees to inform Lyon & Turnbullof any action which it chooses to take against the Buyerto enforce payment of the amount due to the Seller.(e) In the event that a Buyer fails to pay for a lot inaccordance with the Conditions of Sale for Buyers, thatlot will be treated in the same way as an unsold orcollected lot.

12. SETTLEMENT PAYMENTSSubject to full payment by the Buyer, payment of the netproceeds of sale due to you will be made over to you 28working days following a sale. Provided we have receivedcleared funds. Payment will be made by cheque orBACS (if requested).

13. SALE BY PRIVATE TREATY(a) The same Conditions of Sale (Sellers) shall apply tosales by private treaty. (b) Private treaty sales made under these Conditions aredeemed to be sales by auction and subject to ouragreed charges for Sellers and Buyers. (c) Lyon & Turnbull undertakes to inform the Seller ofany offers it receives in relation to an item prior to anyProposed Sale, excluding the normal method ofcommission bids.(d) For the purposes of a private treaty sale, if a lot issold in any other currency than Sterling, the exchangerate is to be taken on the date of sale.

14. THIRD PARTY LIABILITYAll members of the public on our premises are there attheir own risk and must note the lay-out of theaccommodation and security arrangements. Accordinglyneither the auctioneer nor our employees or agentsshall incur liability for death or personal injury (except asrequired by law by reason of our negligence) or similarlyfor the safety of the property of persons visiting prior toor at a sale.

15. GENERAL(a) We shall have the right at our discretion, to refuseadmission to our premises or attendance at ourauctions by any person.(b) Any notice to any Buyer, Seller, bidder or viewer maybe given by email, or if not available then first class mail,in which case it shall be deemed to have been receivedby the addressee 48 hours after posting.(c) Notices to Lyon & Turnbull should be in writing andaddressed to Nick Curnow at 33 Broughton Place,Edinburgh EH1 3RR, quoting the reference numberspecified at the beginning of the sale catalogue.(d) Should any provision of these Conditions of Sale beheld unenforceable for any reason, the remainingprovisions shall remain in full force and effect.(e) These Conditions of Sale are not assignable by eitherparty without the other’s prior written consent, but arebinding on the seller’s successor and representatives.No act, omission or delay by Lyon & Turnbull shall bedeemed a waiver or release of any of its rights.(f) The contract between the parties may be varied bythe parties by agreement and in writing.

16. AGENCY Lyon & Turnbull acts as agent solely for and in theinterests of the Seller.  We do not act for Buyers in thisrole and does not give advice to Buyers.  When Lyon &Turnbull make a statement about a lot it is doing so onbehalf of the Seller of the lot.  The Auctioneer normally acts as agent only anddisclaims any responsibility for default by Sellers orBuyers.

17. 18. LAW AND JURISDICTION(a) Governing Law: These Conditions of Sale and allaspects of all matters, transactions or disputes to whichthey relate or apply shall be governed by, andinterpreted in accordance with, Scots law (b) Jurisdiction: The Seller agrees that the Courts ofScotland are to have exclusive jurisdiction to settle alldisputes arising in connection with all aspects of allmatters or transactions to which these Conditions ofSale relate or apply.

BUYERS

The Auctioneer carries on business with bidders, Buyersand all those present in the auction room prior to, or inconnection with, a sale on the following GeneralConditions and on such other terms, conditions andnotices as may be referred to herein..

1. DEFINITIONS In these Conditions of Sale (Buyers): "Auctioneer" means Lyon & Turnbull Ltd or itsauthorised auctioneer, as appropriate; "Hammer price" means the level of bidding reached (ator above any reserve) when the Auctioneer brings downthe hammer; "Lot" means each Item offered for sale by Lyon &Turnbull; "Purchase Price" is the Hammer Price and applicableBuyer's Premium; "Reserve" means the lowest price below which an itemcannot be sold; "Total amount due" means the hammer price in respectof the lot sold together with any premium, Value AddedTax or other taxes chargeable and any additionalcharges payable by a defaulting Buyer under theseConditions; “You”, “Your” means the Buyer“Us”, “Our”, “We” etc. refers to Lyon & Turnbull LtdThe singular includes the plural and vice versa asappropriate.

2. AGENCYLyon & Turnbull acts as agent solely for and in theinterests of the Seller. We do not act for Buyers in thisrole and does not give advice to Buyers. When Lyon &Turnbull make a statement about a lot it is doing so onbehalf of the Seller of the lot.

The Auctioneer normally acts as agent only anddisclaims any responsibility for default by Sellers orBuyers.

3. BIDDING PROCEDURES AND THE BUYER (a) Bidders are required to register their particularsbefore bidding and to satisfy any security and creditreferences or arrangements before entering the auctionroom to view or bid; (b) The maker of the highest bid accepted by theAuctioneer conducting the sale shall be the Buyer andany dispute shall be settled at the Auctioneer's absolutediscretion.

(c) Once made, no bid may be withdrawn. (d) Our right to bid on behalf of Sellers is expresslyreserved up to the amount of any reserve. (e) The right to refuse any bid is also reserved.(f) Commission Bids: While prospective Buyers arestrongly advised to attend the auction and are alwaysresponsible for any decision to bid for a particular lotand shall be assumed to have carefully inspected andsatisfied themselves as to its condition we shall, if soinstructed, clearly and in writing execute bids on theirbehalf. Neither the Auctioneer nor our employees noragents shall be responsible for any failure to do so.Where two or more commission bids at the same levelare recorded we reserve the right in our absolutediscretion to prefer the first bid so made.

(g) Telephone Bids: If a prospective Buyer makesarrangements with us prior to the commencement ofthe sale we will use reasonable efforts to contact themto enable them to participate in bidding by telephone.We do not accept liability for failure to do so or forerrors and omissions in connections.

(h) Online Bidding: We will use reasonable efforts tocarry out online bids and do not accept liability forequipment failure, inability to access the internet orsoftware malfunctions related to execution of onlinebids/ live bidding.

4. INCREMENTSBidding increments shall be at the Auctioneer's solediscretion.

5. THE PURCHASE PRICE For each lot purchased a Buyer's Premium of 25% ispayable on the first £50,000 of the hammer price, 20%thereafter. VAT at the appropriate rate is charged on theBuyer's Premium. No VAT is payable on the hammerprice or premium for printed books or unframed mapsbought at auction.Live online bidding is subject to an additional 3%premium (charged by the live bidding service providerInvaluable). This additional premium is subject to VAT atthe appropriate rate as above. 6. VALUE ADDED TAX Value Added Tax is charged at the appropriate rateprevailing by law at the date of sale and is payable byBuyers of relevant lots. (1) Lots affixed with (†): Value Added Tax on thehammer price is imposed by law on all items affixed with

a dagger (†). This imposition of VAT maybe because theSeller is registered for VAT within the European Unionand is not operating under a Margin Scheme. (2) Lots affixed with (*): A reduced rate of Value AddedTax on the hammer price of 5% is payable. Thisindicates that a lot has been imported from outwith theEuropean Union. This reduced rate is applicable toAntique items. (3) Lots affixed with [Ω]: Standard rate of Value AddedTax on the hammer price and premium is payable. Thisapplies to items that have been imported from outwiththe European Union and do not fall within the reducedrate category outlined above.

7. DROIT de SUITEThis symbol § indicates works which may be subject tothe Droit de Suite or Artist's Resale Right, which tookeffect in the United Kingdom on 14th February 2006.We are required to collect a royalty payment for allqualifying works of art. Under new legislation whichcame into effect on 1st January 2012 this applies toliving artists and artists who have died in the last 70years. This royalty will be charged to the Buyer on thehammer price and in addition to the Buyer’s premium. Itwill not apply to works where the hammer price is lessthan €1,000 (euros). The charge for works of art sold atand above €1,000 (euros) and below €50,000 (euros) is4%. For items selling above €50,000 (euros), charges arecalculated on a sliding scale. All royalty charges are paidto the Design and Artists Copyright Society (‘DACS’) andno handling costs or additional fees are retained by theauctioneer. Resale royalties are not subject to VAT.Please note that the royalty payment is calculated onthe rate of exchange at the European Central Bank onthe date of the sale. 8. PAYMENT (1) Within 7 days of a lot being sold you will: (a) Pay to us the total amount due in cash or by suchother method as is agreed by us. We accept cash, banktransfer (details on request), debit cards and Visa orMasterCard credit cards. We do not accept AmericanExpress.(b) Please note there is a surcharge of 2% when usingcredit cards. (c) Please note that under The Money LaunderingRegulations 2007 we cannot accept cash payments over€15,000 (euros). (2) Any payments by you to us may be applied by us

towards any sums owing by you to us howsoeverincurred and without agreement by you or your agent,whether express or implied..

9. TITLE AND COLLECTION OF PURCHASES (1) The ownership of any lots purchased shall not passto you until you have made payment in full to us of thetotal amount due. (2) You shall at your own risk and expense take away anylots that you have purchased and paid for not later than7 working days following the day of the auction or uponthe clearance of any cheque used for paymentwhichever is later. We can provide you with a list ofshippers. However, we will not be responsible for theacts or omissions of carriers or packers whether or notrecommended by us. (3) No purchase can be claimed or removed until it hasbeen paid for. (4) It is the Buyer’s responsibility to ascertain collectionprocedures, particularly if the sale is not being held atour main sale room and the potential storage chargesfor lots not collected by the appropriate time.(5) Export of goods: Buyers intending to export goodsshould ascertain (a) whether an export licence isrequired and (b) whether there is any specificprohibition on importing goods of that character, e.g.items that may contain prohibited materials such asivory or rhino horn. It is the buyer’s sole responsibilityto obtain any relevant export or import licence. Thedenial of any licence or any delay in obtaining licencesshall neither justify the recession of any sale not anydelay in making full payment for the lot.

10. REMEDIES FOR NON·PAYMENT OR FAILURE TOCOLLECT PURCHASES (1) If any lot is not paid for in full and taken away inaccordance with these Conditions or if there is anyother breach of these Conditions, we, as agent for theSellers and on their behalf, shall at our absolutediscretion and without prejudice to any other rights wemay have, be entitled to exercise one or more of thefollowing rights and remedies: (a) to proceed against you for damages for breach ofcontract; (b) to rescind the contract for sale of that lot and/or anyother lots sold by us to you; (c) to resell the lot (by auction or private treaty) in whichcase you shall be responsible for any resulting deficiencyin the total amount due (after crediting any partpayment and adding any resale costs). (d) to remove, store and insure the lot in the case ofstorage, either at our premises or elsewhere and torecover from you all costs incurred in respect thereof; (e) to charge interest at a rate not exceeding 1.5% permonth above the current base rate on all sumsoutstanding for more than 7 working days after the sale;(f) to retain that or any other lot sold to you until youpay the total amount due; (g) to reject or ignore bids from you or your agent atfuture auctions or to impose conditions before any suchbids shall be accepted; (h) to apply any proceeds of sale of other lots due orwhich become due to you towards the settlement of thetotal amount due by you and to exercise a lien over anyof your property in our possession for any purpose untilthe debt due is satisfied.satisfied.

11. DESCRIPTIONS AND CONDITION(1) Whilst we seek to describe lots accurately, it may beimpractical for us to carry out exhaustive due diligenceon each lot. Prospective Buyers are given ampleopportunities to view and inspect before any sale andthey (and any independent experts on their behalf) mustsatisfy themselves as to the accuracy of any descriptionapplied to a lot. Prospective Buyers also bid on theunderstanding that, inevitably, representations orstatements by us as to authorship, genuineness, origin,date, age, provenance, condition or estimated sellingprice involve matters of opinion. We undertake that anysuch opinion shall be honestly and reasonably held andonly accept liability for opinions given negligently orfraudulently. Subject to the foregoing neither we theauctioneer or our employees or agents accept liabilityfor the correctness of such opinions and no warranties,whether relating to description, condition or quality oflots, express, implied or statutory, are given. Please notethat photographs/images provided may not be fullyrepresentative of the condition of the lot and should notbe relied upon as indicative of the overall condition ofthe lot.

(2) Condition reports: Condition reports are providedon our website or upon request. The absence of areport does not imply that a lot is without imperfections.Large numbers of such requests are received shortlybefore each sale and department specialists andadministration will endeavor to respond to all requestsalthough we offer no guarantee. Any statement inrelation to the lot is merely an expression of opinion ofthe Seller or Lyon & Turnbull and should not be reliedupon as an inducement to bid on the lot. Lots areavailable for inspection prior to the sale and you arestrongly advised to examine any lot in which you areinterested prior to the sale. Our condition reports arenot prepared by professional conservators, restorers orengineers. Our condition report does not form anycontract between Lyon & Turnbull and the Buyer. TheCondition Reports do not affect the Seller’s obligationsin any way. (3) Estimates: Estimates are placed on each lot to helpBuyers gauge the sums involved for the purchase of aparticular lot. Estimates do not include the Buyer’sPremium or VAT. Estimates are a matter of opinion andprepared in advance. Estimates may be subject tochange and are for guidance only and should not berelied upon.(4) Catalogue Alterations: Lot descriptions andestimates are prepared in advance of the sale and maybe subject to change. Any alterations will be announcedon the catalogue alteration sheet, made available priorto the sale. It is the responsibility of the Buyer to makethemselves aware to any alterations which may haveoccurred.(5) Electrical Goods: are sold as “works of art” only andif bought for use must be checked over for compliancewith safety regulations by a qualified electrician first. Useof such goods is entirely at the risk of the Buyer and nowarranties as to safety of the goods are given.(6) Upholstered items: are sold as “works of art” onlyand if bought for use must be checked over forcompliance with current safety regulation. Use of suchgoods is entirely at the risk of the Buyer and nowarranties as to safety of the goods are given. Lyon &Turnbull provide no guarantee as to the originality ofany wood/material contained within the item. (7) Special terms may be used in catalogue descriptionsof particular classes of items (Books, Jewellery, Paintings,Guns, Firearms etc.) in which case the descriptions mustbe interpreted in accordance with any glossaryappearing in the catalogue. These notices and terms willalso form part of our terms and conditions of sales.

12. BOOKS, CLOCKS & WATCHES(1) Books-Collation: If on collation any NAMED item inthe sale catalogue proves defective, in text or illustrationthe Buyer may reject the lot provided he returns itwithin 21 days of the sale stating the defect in writing.This, however, shall not apply in the case of unnameditems, periodicals, autographed letters, music M.M.S.,maps, drawings NOR in respect of damage to bindings,stains, foxing, marginal worm holes or other defects notaffecting the completeness of the text NOR in respect ofDefects mentioned in the catalogue, or at the time ofsale, NOR in respect of lots sold for less than £300. (2) Clocks & Watches: All lots are sold “as seen”, andthe absence of any reference to the condition of a clockor watch does not imply the lot is in good condition andwithout defects, repairs or restorations. Most clocks andwatches will have been repaired during their normallifetime and may now incorporate additional/newerparts. Furthermore, Lyon & Turnbull makes norepresentation or warranty that any clock or watch is inworking order. As clocks and watches often contain fineand complex mechanisms, Buyers should be aware thata general service, change of battery or further repairwork, for which the Buyer is solely responsible, may benecessary. Buyers should also be aware that Lyon &Turnbull cannot guarantee a watch will remainwaterproof if the back is removed. Buyers should beaware that the importing watches such as Rolex, FrankMuller and Corum into the United States is highlyrestricted. These watches cannot be shipped to the USAand only imported personally.

13. CITESPlease be aware that all lots marked with the symbol Yare subject to CITES regulations when exporting theseitems outside the EU. These regulations may be foundat http://www.defra.gov.uk/ahvla-en/ imports-exports/cites/ Lyon & Turnbull accepts no liability for any lots whichmay be subject to CITES but have not be identified assuch.

Lyon & Turnbull will give priorwritten notice of the release of any such details to theSeller of the Seller’s solicitor.

18. FORCE MAJEURELyon & Turnbull shall be under no liability if they shall beunable to carry out any provision of the Contract of Salefor any reason beyond their control including (withoutlimiting the foregoing) an act of God, legislation, war, fire,flood, drought, failure of power supply, lock-out, strike orother action taken by employees in contemplation orfurtherance of a dispute or owing to any inability toprocure materials required for the performance of thecontract.

RegistrationAll potential buyers must register priorto placing a bid. Registrationinformation may be submitted in personat our registration desk, by email, by faxor on our website. Please note that allfirst time bidders at Lyon & Turnbull willbe asked to supply the followingdocuments in order to facilitateregistration:

1 – Government issued photo ID(Passport/ Driving licence)

2 – Proof of address (utility bill/ bankstatement).

We may, at our option, also ask you toprovide a bank reference and/ ordeposit.

By registering for the sale, the buyeracknowledges that he or she has read,understood and accepted ourConditions of Sale.

BiddingAt the Sale Registered bidders will beassigned a bidder number and given apaddle for use at the sale. Once the firstbid has been placed, the auctioneer asksfor higher bids in incrementsdetermined by the auctioneer. To placeyour bid, simply raise your paddle untilthe auctioneer acknowledges you.Please ensure that the auctioneerrepeats your bidder number correctlywhen confirming the sale. If there is anydoubt at this stage as to the hammerprice or buyer it must be brought to theauctioneer’s attention immediately. Alllots will be invoiced to the name andaddress given on your registration form,which is non-transferable.

By phone A limited number oftelephone lines are available for biddingby phone through a Lyon & Turnbullrepresentative. Phone lines must bereserved in advance. All bid requestsmust be received an hour before thesale. All telephone bids must beconfirmed in writing, listing the relevantlots and appropriate number to becalled. We recommend that a coveringbid is also left in the event that we areunable to make the call. We cannotguarantee that lines will be available, orthat we will be able to call you on theday, but will endeavor to undertake suchbids to the best of our abilities. Thisservice is available entirely at ourdiscretion and at the bidder’s risk.

In writing Bid forms are available at thesale and/or the back of the catalogue.These should be submitted in person, bypost, or by fax as soon as possible priorto the sale and we will bid on yourbehalf up to the limit indicated. In theevent of receiving two identical bids thefirst one received will take precedence.All bids must be received an hour beforethe sale. This service is entirely at thebidder’s risk.

On the internet A fully-illustratedcatalogue is available on our website.Registered bidders may leave absenteebids through the website and willreceive email confirmation of their bid.Live online bidding (powered byInvaluable) is also available, accessibleeither through our website or atwww.invaluable.com. Please note thatan additional 3% premium is charged byInvaluable for this live online service.

PaymentPayment is due within seven (7) days ofthe sale. Lots purchased will not bereleased until full payment has beenreceived. Payment may be made by thefollowing methods:

Bank Transfer Account details areincluded on any invoices we issue orupon request from our accountsdepartment.

Credit or Debit Cards Payment can bemade by Visa Debit, Maestro,Mastercard or Visa Credit cards. Pleasenote there is a 2% surcharge on creditcard payments and we do not acceptAmex.

Online Card Payments We no longeraccept card payments by phone. Pleaseuse our online payment service(provided by Cardstream/Credorax. Youwill find a link to this service in any emailinvoice issued or you can visit thepayments section of our website.

Cheque Cheques should be madepayable to Lyon and Turnbull Ltd. Wereserve the right to wait until chequeshave been cleared by our bankersbefore releasing bought goods. Chequescan be cleared prior to sale on request.Cheques drawn by third parties cannotbe accepted. If paying by post pleaseinclude the slip from your invoice.

Cash Cash payments can be made atthe accounts desk during or after a sale.Cash payments limited to €15,000(euros).
