Truancy Policy

TRUANCY POLICY
Compulsory School Attendance Law {22-12-1 NMSA 1978}:
Any parent/guardian having custody of a school-age person subject to the provisions of the Compulsory
School Attendance Law is responsible for the school attendance of that person.
The parent/guardian is responsible until that school-age person is at least eighteen years of age, has graduated from high school or received a General Educational Development (GED)
Certificate
Notification:
The school will notify the child’s parents/guardians of absences through phone calls or written
correspondence.
Excused Absence:
A student brings a signed note from his/her parent/guardian indicating the reason for the absence/s
A student brings a doctors slip indicating the reason for the absence/s
A parent/guardian calls the school and advises the school that their child/ren will be absent
Allowable reasons for being absent:
Illness or personal injury
Death in the family
Medical appointments that cannot be scheduled outside school hours
School sponsored activities (previously approved by school administration)
School bus that does not run
Leaving during the school day:
Students are required to be signed out through the school office
Make-Up Work:
For excused absences, students will have the same number of days as they are absent to make up work
The parent/guardian and student are responsible for getting and turning in the make-up work
Unexcused Absence:
An absence from school for which the student does not have an allowable excuse
The parent/guardian is required to send a note
An absence will be marked unexcused after 72 hours if the school has not received the documentation
Upon each third (3rd) or more consecutive absence, verification from a physician will be required
Truant:
A student who has accumulated five unexcused absences
Habitual Truant:
A student who has accumulated the equivalent of ten or more unexcused absences

The focus of Tier 1 is to provide early universal elementary attendance interventions. It allows
parents/guardians to become involved through awareness materials provided by the school, parent-
teacher conferences, correspondence and attendance progress monitoring. Tier 1 begins with:
Attendance Awareness: Each school district approves and distributes truancy procedures to students, parents, guardians and school staff.
1. Attendance is reinforced to students by classroom teachers and presentations, advising students that school attendance is mandatory and important for learning
2. Staff will learn about the truancy policy, protocols and procedures through staff meetings, collaboration and memorandums
3. Parents and guardians will learn of the truancy policy by memorandums sent home, correspondence disseminated at open house and through district web site
Compulsory School Attendance Law 12-12-1 to 9: Any parent, guardian or person having custody and control of a person subject to the provisions of the Compulsory School Attendance

1. Each school district shall initiate the enforcement of the Compulsory School Attendance Law
Absences, Make-up Work and Student Grading: When absences occur, immediate attention is to be given by the student, parent and teacher to work that has been missed by the student for
excused absences.
1. Students are required to be in school on a regular basis to receive instruction as required by law
2. Students will have the same number of days to make up work for excused absences 3. The parent/guardian and student are responsible for getting and turning in the make-up work
Reporting Student Absences: The parent or guardian is required to send a note signed by the parent or guardian stating the reason/s for the absence/s.
1. The absence will be marked unexcused after 72 hours if the school has not received the documentation from the parent or guardian
2. Upon each 3rd consecutive absence, verification from a physician will be required
Truancy Notification: If a student has been marked unexcused for 3 or more days during a month, parent or guardian will receive a notification letter from the District Elementary
Prevention Liaison.
1. The letter shall list the students name, date of birth, dates of absences and the school site 2. Elementary Prevention Liaison will contact parent or guardian via phone or may conduct a
home visit and inform them of the truancy and available resources
3. Teacher and Elementary Prevention Liaison may monitor student attendance for 30 days

The focus of Tier 2 is to provide moderate intervention for truant students. It allows the school,
parent/guardian and student an opportunity to become involved in developing interventions to improve
attendance and initiate attendance progress monitoring. Tier 2 begins with:
Subsequence Absences or Truant Behavior: The school district will notify the parent or guardian by certified mail or personal service when a student is truant.
1. The school district will initiate enforcement of the provisions of the Compulsory School Attendance Law [22-12-1].
2. Elementary truants may be referred to Children Youth and Families Department, (Central Intake, 1-800-797-3260) for non-compliance as Educational Neglect under the provisions of
the Children’s Code [32A-1-1 NMSA 1978].
Truant: A student who has accumulated five (5) unexcused absences within a twenty – day period.
1. All students that are enrolled are required to attend school. 2. It is the duty of the parent or guardian to monitor and require the student’s attendance.
Truancy Notification: Elementary Prevention Liaison contacts and schedules an appointment to meet with the parent/guardian to discuss truancy.
1. The parent/guardian and student will attend a meeting at the school to discuss the truancy 2. Principal and/or counselor will be invited to participate in meeting. 3. Truancy policy will be explained to parent/guardian 4. Parent/guardian will be afforded the opportunity to explain or give just cause for the student/s
truancy
5. Parent/guardian will attend scheduled meeting 6. Parent/guardian fails to attend scheduled meeting, Second Notice Letter of Non-Compliance
will be delivered by mail or person service

The focus of Tier 3 is to provide intensive interventions for a Habitual Truant. It allows the school to
submit a referral to the JPPO (Juvenile Probation and Parole Office) who establishes a Multi-disciplinary
Team that staffs the case within thirty (30) calendar days to determine a course of action. Tier 3 begins
with:
Habitual Truant: A student that accumulated more than ten (10) unexcused absences within a school year
1. A student must attend at least 90% of the school year 2. A student that attends fewer than 90% of the school year may be recommended for retention
unless the absences are the result of extenuating circumstances
3. If the student has not reported to school within ten (10) consecutive days and the school has been unable to make contact with the parents, the student must be disenrolled and the school
may make a referral to Children Youth and Families, (Central Intake, 1-800-797-3260) for
Educational Neglect under the provisions of the Children’s Code [32A-1-1 NMSA 1978]
3rd Notification Letter of Non-compliance with the School Attendance law: The school will notify the Parent/guardian by certified mail or personal service when the student has accumulated
ten (10) or more unexcused absences during the school year
1. Parent/guardian will be notified that the student has been identified as a habitual truant and is in violation with the Compulsory School Attendance Law 22-12-1
2. A meeting is scheduled with the parent/guardian to address the habitual truancy 3. An intensive attendance contract is initiated with actions/intervention implemented by the
school, parent/guardian and student to address attendance
4. Parent/guardian and student comply with the Intensive Attendance Contract 5. Parent/guardian and student fail to comply with the Intensive Attendance Contract 6. Parent/guardian refuse to sign Intensive Attendance Contract

1. Each school will be responsible to prepare the referral packet and submit it to the JPPO (Juvenile Probation/Parole Office)
2. The packet will include documentation of actions/interventions implemented at Tier1 and Tier2
3. A multi-disciplinary team will be established with representatives from the Juvenile Probation/parole Office, Children Youth and families Department and the West Las Vegas
School District
4. Habitual truancy cases will be staffed within thirty (30) calendar days to determine the best course of action for the case
5. The Multi-disciplinary team will advise the principal of the action that will be taken 6. The Multi-disciplinary team will identify a responsible entity to monitor the progress of the
case
7. The Multi-disciplinary team will recommend various actions steps taken prior to a referral to the Districts Attorney’s Office for filing of a criminal complaint
