Lower Platte North NRCS/NRD Report for December 2013

Cover crops are established during the non-crop period, usually after the crop is harvested, but can be interseeded into a crop before harvest by aerial application or direct seeding. The growing cover protects the soil surface and improves infiltration reducing runoff and soil erosion which can eliminate or minimize ephemeral gully erosion and prevent offsite damage from sedimentation. Cover crops also improve soil aggregation making the soil more resistant to soil erosion processes.

CONSERVATION STEWARDSHIP PROGRAM SIGN-UP

CURRENTLY UNDERWAY.

Nebraska Farm, ranch and forestland operators are encouraged to apply

by Jan. 17, 2014 for the Conservation Stewardship Program (CSP) at

their local USDA Natural Resources Conservation Service (NRCS) office.

CSP is a voluntary program that provides financial and technical

assistance to help farmers and ranchers conserve and enhance soil,

water, air, and related natural resources on their agricultural and

forestry land.

Applications received by the Jan. 17 cutoff date will be considered for the

current ranking and funding period.

CSP participants will receive an annual land use payment for the

environmental benefits they produce on their operations. Under CSP,

participants are paid for conservation performance - the higher the

operational performance, the higher their payment.

Personal changes in the LPNNRD/NRCS Area:

Brach Johnson, Resource Conservationist (RC) and Bryan Euse, Resource

Conservationist (RC) have both been reassigned.

Starting December 1, 2013; Brach Johnson will be the RC in the Schuyler

Field Office and Bryan Euse, RC in the David city Field office.

Projects

Much discussion is occurring in Washington on the final version of the WRDA 2013 bill. It appears that

Senator Fischer’s amendment will be included in the final version although nothing is a lock until the bill is

signed. Passage of the amendment would allow completion of the Western Sarpy/Clear Creek.

The agreement with Kobza Auctioneering from Bellwood was completed which has them providing auction

services to us for selling the Wirka tract. The sale is scheduled for February 7 at the Church Hall in Prague.

Water

The draft Rules and Regulations for changes to our Groundwater Management Plan are being forwarded from

the Water Committee to the full board later tonight. If approved by the board the draft rules will be presented at

a public hearing prior to our next board meeting and move on to the board for final approval.

Our proposed Voluntary Integrated Management (IMP) takes a big step tonight when the board will be asked

to begin advertising for consultants to assist with preparation of the plan. The timeline has completion of the

plan for June of 2015.

The Lower Platte River Basin Coalition Board met in Norfolk on December 3 to complete the first draft of

our Goals and Objectives. The Management Committee has been tasked with preparation of a draft request for

proposals (RFP) prior to our next meeting, which will be January 28 during the NARD Legislative Conference.

The largest current water issue in the state is the final report from the Water Funding Taskforce, which met

last Friday. Clint will no doubt have a full report on this item.

Meetings

The annual State Surfacewater/Groundwater Committee meeting was held November 19 in Lincoln. The

committee’s purpose is to share information on new data and events. The most interesting discussion was

reports on floodwaters coming from Colorado. Fear of wide spread pollution from failed sewage plants,

industrial sites and petroleum facilities was closely monitored in Nebraska. Much to everyone’s surprise, no

spikes in pollution discharge were recorded. Seems Mother Nature took care of herself, “The solution, to

pollution, is dilution.”

Items of Interest

NARD is organizing the first annual NARD 5k Fun run and is planning to use Lake Wanahoo as the site. We

have met with NARD staff to begin planning.

Senator Dubas is introducing a bill that makes changes to the eminent domain laws. These changes will place

additional requirements on government boards when we must use eminent domain for purchase of property.

The bill also excludes common carrier pipelines from being able to use eminent domain.

Construction began on the Wahoo By-Pass in November. The cut for the trail culvert has been made so County

Road M over the dam is closed until late spring.

EPA has asked to revoke a two-year-old 404 permit, which has created quite a stir nationally. It appears the

case is headed for the Supreme Count. The fall-out from this could impact all 404 permit holders if EPA is

given the right to revoke permits on completed projects. With this change EPA could revoke the permit for any

of our flood control reservoirs and order that the dam be removed. In the past a 404 permit was considered

permanent unless you were not following the specifics with-in the permit.

Bob Wolf from Olsson Associates retired on November 21. Bob has been with Olsson’s for more than 45

years. He was the lead engineer on the Central Butler project that was one of LPNNRDs first major projects

and the lead engineer on our Lake Wanahoo Dam

November 14, 2013 The regular monthly meeting of the Lower Platte North NRD Board of Directors was called to order at 6:00 p.m. at Newman Grove Community Center, Newman Grove, NE on Thursday, November 14, 2013.

City of David City Well Permit Well Permit application has been received from the City of David City to drill a well to irrigate 41.65 acres of turf grass in the Public Golf Course. These acres were previously irrigated with city water then with effluent water from the David City Water Treatment plant. This application was received November 1st, two days after the Water Committee meeting. Test hole information and supporting material has also been received. This irrigation well would be used solely to irrigate these 41.65 acres. Birkel made the motion, seconded by Pollard, to table the City of David City Well Permit until our 180 day “Temporary Stay” is lifted and then the request can be considered with all other permit applications. Annual Audit Payment The billing for our annual audit has been received and is $3,380 less than budget due to a federal single audit not being required. An appropriate motion would be – to approve renewal of the “Line of Credit” with Union Bank with a $400,000 cap and approve the attached resolution for this transaction and authorize the General Manager and/or any Board Officer to sign all necessary paperwork required by Union Bank for the renewal. The current balance on the LOC is $253,133.10. The LOC will be repaid with proceeds from sale of the Wirka tract.

f. Union Bank Interest Payments - Attachment Page 26-27Interest payments are due on our two Wanahoo loans at Union Bank on December 15th. e. Tractor and Mower Rental Rates

Staff suggest an increase to our tractor and mower rental rates. Currently the District charges $60/tractor hour, we’ve been at that rate since 2006. Staff would recommend a bump to $70. It was recommended (by Olson) seconded (by Hagerbaumer) to increase the tractor/mower rental rate to $70/tractor hour. Recommendation Carried.*

f. Vehicle ReplacementStaff would recommend replacing the 2007 Ford Escape which has 96,450 miles. Replacement vehicles being considered are an extended cab Ford or Chevy pickup off of the State Contract. It was recommended (by Hagerbaumer) seconded (by Olson) to advertise and sell the 2007 Ford Escape and propose the purchase of a vehicle off of the State Contract at the next Committee meeting. g. Tree Program Staff has an initial order of 10,825 trees and shrub from four nurseries.

h. Arbor Day Foundation TreesIn the past the District has ordered 1,000 trees for Conservation Sensation Day, Fremont Eco-Fair and schools to recognize conservation and Arbor Day. Staff would like to order 800 - 1,000 trees for next Spring. Last year the cost was $1.01/tree. It was recommended (by Olson) seconded (by Hagerbaumer) to purchase 1,000 trees from the Arbor Day Foundation for educational purposes at the approximate cost of $1.01/tree. Recommendation Carried.*

i. Lower Platte Weed ManagementPapio-Missouri NRD has submitted a bill for $20,000, this is for the cost-share program developed for landowners on the Platte River to control noxious weeds. It was recommended (by Hagerbaumer) seconded (by Olson) to pay the Papio-Missouri NRD $20,000 as our share of the Noxious Weed cost-share program on the Platte River. Recommendation Carried.

2. County Government DayThompson and Sousek attended Butler County Government Day on November 20 to talk to students about how the NRD operates.

2. Rural Water AppThe rural water app was updated to include engineering overlays for the water lines, showing valves/meters/etc on the map.

6. RURAL WATER SYSTEMSa. Bruno / David City Rural Water SystemColiform samples will be taken on November 25th and results should be received by board meeting.

Farmsteads closer to Bruno have been calling about having shortages of water. Staff has sent out a survey in a six mile perimeter around the Village of Bruno to all residents living in the area. This survey was an attempt to gauge interest in connecting to the RW system. Staff met with JEO and has prepared an estimate of various scenarios using this survey result data. See attached map and estimates.

b. Colon / Wahoo Rural Water System Coliform samples will be taken on November 25th and results should be received by board meeting.

Six Colon customers have been sent disconnection notices and staff will be visiting these people closer to the 10th of the month.

Staff has received a request from Robert (Toby) Malousek to connect on to the Colon RW line. Toby has a lot west of the NRD Wanahoo property and will soon be building a house. The materials ordered for the Wanahoo shed job will be used for this connection and the Wanahoo shed connection may be delayed until spring.

c. Cedar Bluffs JEO is currently working on updating the 2006 feasibility study. Estimate of completion is late winter.

d. Brainard and DwightThe planning grant for Brainard has been approved. All entities have agreed to contribute $1,000 to the study which will cover the local match for the SRF planning grant.

e. OtherStaff will be helping a local landowner deal with the COE and help him walk through this painful experience.

1. REGULATORYA. GROUND WATER MANAGEMENT AREA1. Variance Requests in the Normal Development Area (NDA) The current number of requested acres in the NDA is 2,607.09 acres.

b. Ranking Criteria used for Variance RequestsThe ranking criteria uses information from the landowner on number of acres, new or existing well, and type of irrigation system that will be used, soils information from NRCS, and geology information from the Subarea Delineation Study done by Olsson Associates. Test hole information provided by the landowner is used to see if an adequate formation exists to supply the needed ground water, however this does not indicate if the formation is saturated with water or not. Larry Hynek addressed the Committee on our ranking criteria, augmentation, and appeal process.

c. Riecken Sub-irrigation Variance RequestHarlan and Mervin Riecken have submitted new well variance applications to replace their sub-irrigation in section 24-T14N-R9E in the Wann subarea in Saunders County in part due to the proximity to the MUD well field. The proposed irrigation systems will cover approximately 120 acres on Mervin Riecken’s ground, and 135 acres on Harlan Riecken’s ground. The crop insurance records show an average of 146 bu/ac of corn, and 45 bu/ac of soybeans over an eight year period from 2004 to 2012 on Mervin Riecken’s ground. In 2012 the corn yielded 59 bu/ac and the soybeans yielded 29 bu/ac. Harlan Riecken’s crop insurance records show an average of 128 bu/ac of corn, and 45 bu/ac of soybeans over a nine year period from 2001 to 2011. There wasn’t any corn planted in 2012, but Harlan Riecken reported to the NRD that the corn yielded 75 bu/ac in 2013, and the beans yielded 7 bu/ac in 2012. Attached is a hydrograph of MUD monitoring well 94-4 and LPNNRD well PV-40 showing summer drawdowns. Both wells are near the MUD well field. It was recommended by Birkel, seconded by Pollard, to table the Riecken requests to drill irrigation wells to replace potential loss of sub-irrigation until the District imposed Stay is lifted. b. Delores Maly NDA Well PermitIn December 2012 Delores Maly had a well permit approved in the NDA for 75 acres (on an 80 acre tract). The tract is currently in CRP thru 2017. She is prepared to drill the well prior to the end of 2013 as outlined in the permit, however she was under the impression that due to the CRP she would not need to irrigate this tract until the CRP expires. Attached is a copy of Rule E.5 as well as a letter from Delores Maly. This rule was put in place so a producer does not ‘sit’ on their approval for a later time. She is asking that the district “grant an exception for good cause” as allowed in the same rule and that installation of the equipment and irrigation be delayed until the 2018 season due to the CRP contract. It was recommended by Johannes, seconded by Pollard, to deny the request for “good cause shown”. Recommendation Carried.

c. John Wotipka ExpansionJohn Wotipka farms and irrigates two tracts. The original well permits were granted in 2005. In 2013 Wotipka piped water under the county road and put up a pivot and irrigated an additional 28 acres without a variance permit. After harvest this fall Wotipka has trenched under the county road from the second well, cleared a farmstead and is in the process of erecting a second pivot, again without a variance permit. Wotipka and members of his family were present at the Water Committee meeting and stated that when the wells were originally registered additional acres were allotted to each permit to allow for this future expansion (these numbers are to be updated by the landowner within six months of registering the well to the actual number of acres being irrigated, which was not done). It was explained that since 2008 a variance is needed in LPNNRD to allow for any additional acres of new irrigation. In addition this expansion has occurred in the restricted development area where no additional acres have been approved. We have received two requests in this neighborhood for additional irrigated acres (Ken Pestal and Joe Houska) which have not been approved. The committee wish to have additional information and asked that this topic be discussed at the January Water Committee meeting (December 30 at 5:00 p.m.). See attached airphoto.

4. Update of Ground Water Management Area Rules and Regulations (GWMA)● Attached is a draft copy of the updated GWMA Rules and Regulations reviewed by the

Water Committee. Need motion to approve for the December Board meeting if Water Committee members wish to do rule change in less than 180 days. Rule change also lists the boundaries of

5. Lower Platte River Basin Water Management Plan Coalition (LPRBWMPC)The Managers meeting for the Lower Platte Basin Plan Coalition was held on October 28, 2013 in Ord NE at LLNRD. The main topic was development of Goals and Objectives for the basin. The next meeting of the Board is scheduled for Tuesday December 3, 2013 in Norfolk starting at 11:00 am.

6. Voluntary Integrated Water Management Plan - LENRD and LPNNRDStaff of LENRD and LPNNRD have been developing ‘requests for proposals’ (RFP) from consulting firms to help coordinate, develop and draft a Voluntary Integrated Water Management Plan (V-IMP). The attached RFP outlines four tasks:

● Draft copy of the V-IMP for each District by June 1, 2015.● Plan Coordination meetings between NRD’s, DNR, and consulting firm● Stakeholders committee for each individual NRD.● Water balance study for each individual District.

Qualifications/Proposals are due in the office of the LENRD and LPNNRD by 9:00 am on January 8, 2014. A joint Board meeting will be held on February 5, 2014 in Columbus Nebraska to hear presentations from selected consulting firms. The winning contract will be selected at the February 10, 2014 LPNNRD Board meeting and the February 20, 2014 LENRD Board meeting. The same contractor will be selected to work on each District’s V-IMP. Work should commence on this project by March 3, 2014. It was recommended by Johannes, seconded by Pollard, to request proposals from consulting firms to develop a draft copy of a voluntary integrated water management plan for LENRD and LPNNRD, conduct Plan Coordination meetings, develop and facilitate at Stakeholders Committees and conduct a water balance study as listed in the Request for Proposals. B. LOWER PLATTE NORTH NRD GROUND WATER STUDIES1. Elkhorn Loup Model (ELM)The webinar on the ELM model originally postponed due to Federal Government shutdown was held on November 20, 2013. The focus was on stream depletion factors over a 50 year time period of 2006 to 2055. The sandhills have high infiltration rates and ground water dominated stream flows with very little runoff during precipitation events. Four ELM reports have been done so far by USGS.

C. GROUND WATER ENERGY LEVELSStaff began collection of the fall groundwater energy levels October 23rd and finished them November 8th. Ground Water Level Summary Comparison of Fall 2012 to Fall 2013 was presented to the Board at the November Board meeting in Newman Grove on November 14, 2013 (copy of this summary is attached). Keep in mind that in the Fall of 2012 almost all the wells showed a sharp decline from the Spring 2012 readings. For the Fall of 2013, 56% of the 167 sites the water level was worse (decreased) than the Fall 2012 readings. Another 16% were “unchanged”, in the range of + or - 0.3 feet. Most of the wells that showed an increase were in the Platte Valley aquifer and these wells probably benefitted

from the floodwater that resulted from the downpour in Colorado in September.

D. FORMER ORDNANCE PLANT NEAR MEADThe latest quarterly Public Availability meeting was held on November 20, 2013 at the Yutan County Club.

● The main topic was on the containment evaluation looking at chemical data and ground water levels from monitoring wells, perimeter wells, and extraction wells to determine if the contaminant plumes are still in containment. Using 2012 sampling data indicates the system is operating satisfactorily with the adjustment of pumping near MW-116.

● MW-116 had a detection for TCE above the cleanup goals during the August 2012 sampling event but during the March, May, and November 2012 sampling events TCE was below the cleanup goals. This also happened in 2011 and the likely cause was heavy pumping of a nearby irrigation well. The COE has adjusted their pumping rate of a containment well to compensate. MW-116 is at the lower end of the Atlas Missile Area Plume (LL-4 plume).

●A new contractor has been hired by the USACE to work on the cleanup efforts. HydroGeologic (HGL) will replace the current contractor of Environmental Chemical Corporation (ECC) who have worked 10 years at the site.

E. JOINT MEETING ON NEBRASKA GROUND WATER & SURFACE WATER MONITORING AGENCIESThe annual meeting of Nebraska State and Federal Agencies that monitor ground water and surface water in the State was held on November 19, 2013 in Lincoln. One of the main topics at the meeting was water quality and water quantity during the recent flooding events in Nebraska caused by heavy precipitation in the Colorado Rockies. In Colorado some sewage treatment plants and fuel storage facilities were inundated by flood waters so water quality also became a concern as this water flowed into Nebraska. Stream gauging and water quality monitoring was done by USGS until the Government shutdown in early October. Nebraska DEQ and the City of Lincoln continued monitoring in the lower portions of the Platte River (see attached sheet for bacteria results).

F. ACRE CERTIFICATIONStaff have been busy inputting Colfax and Platte County Certifications in an attempt to get caught up and begin the process of requesting Cease and Desist letters for Landowners who have ignored all attempts to certify their acres as irrigated. Colfax County is nearing completion. Colfax County has a total of 816 fields to certify, staff have entered or are actively working with producers on all but 82 fields. The list could be held until next Committee or be ready for additional action items pending direction from the Water Committee. The Water Committee preferred to have these for the next Board meeting on December 9, 2013.

G. MONITORING WELL BIDMap showing current monitoring wells or potential irrigation wells with gravel pack tube to install a datalogger is attached. Staff would like to seek monitoring well bids from area well drillers with a May deadline to install 5 monitoring wells. Last time only one bid was received from Sargent Irrigation totaling $57,644.89, which was for six wells. It was recommended by Taylor, seconded by Pollard, to go to bids to install 5 monitoring wells within the Lower Platte North NRD with the deadline to submit

He is requesting a 60 day extension so the well driller can get the work done. 2. WATERSHEDSa. Wahoo Creek - 319 Grant Approval (attachment) Pg. 6 NDEQ has approved our 319 grant application for $250,000 for moving forward with the Wahoo Creek Plan Phase II which proposed completing a detailed stream assessment and suggest areas for wet detention basins (dams) and in-stream grade control structure. We also applied for additional $125,000 assistance through the Environmental Trust Fund who will decide on that application early next year. We will meet with NDEQ on December 18 to discuss this and our other grants in

the Wahoo Creek Watershed.

b. Shell Creek - Watershed Plan (attachment) Pg. 7-9The first Shell Creek Plan Steering committee meeting was held on November 19th at Klub 81 near Humphrey. EA and Interflu discussed their inspection and evaluation of the watershed and their approach for completing the plan. The steering committee had a long discussion on past conservation efforts and gave direction as the planning process begins.

3. LOWER PLATTE RIVER CORRIDOR ALLIANCE - Meghan Sittler

a. LPRCA Monthly Report No report was given at this time, but an update may be included with the minutes by Board Meeting.

4. OTHER

a. Army COE 205 Projects1. Fremont 205 A partner meeting is planned for January.

2. Schuyler 205 The contractor, TJC, hired to construct the Shell Creek levee, plans to clear and grub in early December. The last landowner easement has been obtained and the Army COE is still working toward agreement with the U.P. Railroad for easement. The City of Schuyler is moving toward allowing the Army COE to use the city’s and COE’s funds to obtain more data to help decide final location for the Platte River levee and complete the design.

b. LPNNRD District-wide All Hazard Mitigation Plan (HMP) - Attachment Page 10-11We have received a HMP progress report and invoice from JEO for work completed. An appropriate motion would be – to approve payment to JEO in the amount of $1,079.60 for work completed on the Hazard Mitigation Plan Update as attached to the Projects Committee Minutes. We are presently setting up meetings on; January 21 (Planning Committee @ 2:00 p.m. & Participant Meeting @ 7:00 p.m. at LPNNRD) January 22 (Fremont City Chambers @ 2:00 p.m.) & January 23 (David City Library @ 7:00 p.m.) to initiate this process with participating entities.

c. Projects Financial Statement Review (attachment) Pg. 12The committee reviewed the October 31, 2013 financial statement that shows 9.2% of the Projects budget being spent.

5. SAND CREEK ENVIRONMENTAL RESTORATION PROJECT REPORT - Mike Murrena. Lake Wanahoo

● The road over the top of the Wanahoo Dam was closed on November 25 so that work could begin on the Wahoo Bypass project.

● Very successful youth hunting occurred on the Wanahoo PATH areas during deer season. Three large mounting size bucks were harvested.

● Potential sale of the Pheasants Forever Wetland Property was discussed with no recommendation for change from the committee.

● Updates were given on the Martinez and CCEI lawsuits.

b. Upstream Structures Kobza Auction and Realty has been hired to sell the Wirka Tract. The sale will be held on February 7, 2014 beginning at 1:30 p.m. at the Church Hall in Prague. Closing is to be within 45 days of the sale.

6. WESTERN SARPY/CLEAR CREEK LEVEE REPORT WRDA 2013 has passed both the House and Senate and is now in the hands of the Conference Committee. Senator Fisher is working to keep her amendment as part of the final bill. A letter from the Nebraska Delegation is being sent to the Committee Chairmen supporting this language and the importance it has to the Western Sarpy/Clear Creek Project.

ADDITIONAL ACTION ITEMS 7a. Purchase Data Logger Cables - Attachment Data loggers and cables were approved for purchase at the 6/10/2013 Board meeting. The three data loggers have been purchased. The length of three cables has been determined: 350 feet, 350 feet, and 220 feet. A Sales Quote from In-Situ Inc has been received for the cables. The shipping cost is expected to be about $55.00 which would be in addition to the Sales Quote total of $4,727.70. Each of the three cables are eligible for a 10% discount as I will be sending in three miniTroll cables (trade-in program, for outmoded equipment). Recommend to approve the purchase of three data logger cables for monitoring well sites at producer irrigation wells: two 350’ cables and one 220’ cable (see attached Sales Quote). In-Situ has estimated the shipping cost to be $55.00 for these cables using FedEx Ground which is their shipping carrier. 4,727.70 + 55.00 = $ 4,782.80.
