LOTTO ACT 1981 LOTTO RULES 1990

Made by the Lotteries Commission under section 4 (3).

PART 1—PRELIMINARY Citation 1. These rules may be cited as the Lotto Rules 1990.

Interpretation 2. In these rules, unless the contrary intention appears—

'agent" means a person appointed by the Commission to process entry coupons;

"claim period" means— (a) in respect of a weekend draw of lotto or of super 66, the period

of time from that weekend draw, or super 66 draw, to 4.00 p.m.— (i) on the second Friday after that draw; or

(ii) where the second Friday after that draw is a public holiday, on the preceding day on which an agency is open for business;

(b) in respect of a midweek draw of lotto, the period of time from that midweek draw to 4.00 p.m.— (i) on the second Thesday after that draw; or

(ii) where the second 'Tuesday after that draw is a public holiday, on the preceding day on which an agency is open for business;

"game" means— (a) in respect of a lotto draw, a single entry in which between 4

and 20 numbers inclusive out of 45 are selected, and which, individually, may constitute part, or all, of a lotto coupon;

(b) in respect of a super 66 draw, a single 6 digit number selected, of which one or more may be entered per entry coupon;

"lotto draw" means a draw of lotto, other than super 66, which involves the mechanical, equally random selection of 8 numbered balls selected from balls individually numbered from 1 to 45 inclusive, in a manner and using such equipment as the Commission determines to be adequate;

"midweek" means Wednesday evening; "receipted ticket" means a ticket that is produced and issued by an agent

either as a result of processing an entry coupon, or as a response to an oral request by a subscriber;

"selling period" means— (a) in respect of a weekend draw of lotto, the period of time

terminating at 4.00 p.m. on the Saturday on which that draw takes place;

(b) for a midweek draw of lotto, the period of time terminating at 4.00 p.m. on the Wednesday on which that draw takes place;

"super 66 draw" means a draw in accordance with rule 22; "supplementary number" in relation to a lotto draw, means one of the last 2

numbers drawn; "weekend" means Saturday evening; "winning number" means—

(a) in relation to a lotto draw, any one of the first 6 numbers drawn in any one lotto draw;

(b) in relation to a super 66 draw, the number made up by the 6 digits drawn in any one super 66 draw, in the order drawn.

PART 2—REQUIREMENTS FOR ENTRY Entry coupon 3. (1) The Commission shall ensure that an entry coupon for a draw of lotto—

(a) displays such details to facilitate entry into a draw of lotto as the Commission thinks necessary; and

(b) displays any instructions which the Commission may from time to time approve.

(2) An entry coupon may be rejected by the agent as an invalid entry, at the time of presentation by the subscriber, if—

(a) it has not been marked by hand in blue ball point pen in accordance with the conditions on that entry coupon; or

(b) it has been generated or marked by mechanical or electrical means.

Methods of entry 4. (1) A person may enter a lotto draw using any or all of the following methods—

(a) by filling out an entry coupon so as to select between 4 and 20 numbers from the numbers 1 to 45;

(b) by oral request for a selection of between 4 and 20 numbers from the numbers 1 to 45,

and by paying the appropriate entry fee set out in Schedule 1. (2) A lotto entry shall be specified to be—

(a) for a midweek or weekend draw, or draws, or both; (b) for 1 week or for 2, 5 or 10 consecutive weeks; and (c) with or without a supplementary entry or entries in a super 66 draw or

draws.

Super 66 entry 5. (1) A person wishing to enter a super 66 draw may only do so when—

(a) the minimum number of lotto games set out in rule 7 are also being entered in a lotto draw; or

(b) entered in conjunction with any type of "soccer football pools" allowed by the Act.

(2) Subject to subrule (1), a subscriber may enter either one, 2, 4, 8, or 10 super 66 games in a super 66 draw, in conjunction with a lotto entry—

(a) by marking the entry coupon in the appropriate box; or (b) by making an oral request for the number of super 66 games to be

entered in that draw, and paying $1.00 per super 66 game entered.

Super 66 receipted ticket 6. Where a super 66 draw or draws are entered in conjunction with—

(a) a midweek lotto entry only, a separate receipted ticket shall be generated for the super 66 games entered;

(b) a weekend lotto entry only, the super 66 games entered shall be marked on the receipted ticket for the weekend entry;

(c) a combination midweek and weekend lotto entry, the super 66 games entered shall be marked— (i) on the receipted ticket for the weekend entry; and

(ii) when further super 66 entries are requested as a supplement to the midweek lotto entry, on a separate receipted ticket;

(d) any "soccer football pools" allowed by the Act, a separate receipted ticket shall be generated for the super 66 games entered.

Completion of entry coupon 7. (1) To enter a lotto draw using an entry coupon, a subscriber shall—

(a) select 6 numbers out of the numbers 1 to 45 for each of at least— (i) 2 games on the entry coupon, if the entry is for a midweek draw;

(ii) 4 games on the entry coupon, if the entry is for a weekend draw; or (iii) 4 games on the entry coupon, if the entry is for both a midweek and

a weekend draw, commencing with the game marked "1"; or

(b) select between 4 and 20 numbers (other than 6 numbers) out of the numbers 1 to 45 in one or more games on the entry coupon, commencing with the game marked "1".

(2) For entry into a lotto draw and, if required, a super 66 draw or draws, the subscriber shall also mark in the appropriate boxes on the entry coupon—

(a) whether the entry is for a midweek or weekend draw or both; (b) how many, if any, super 66 games are to be entered using that entry

coupon; (c) how many, if any, consecutive weeks the entry coupon is to be entered;

and (d) whether the method of entry is a "systems" entry, being either a

systems 4-5 or a systems 7-20, depending on the number of numbers selected in each game,

and shall pay the fee calculated in accordance with Schedule 1 and $1.00 per super 66 game entered.

(3) Where between 4 and 20 numbers (other than 6 numbers) are selected out of the numbers 1 to 45 in the game marked "17—

(a) if 4, 5, 7, or 8 numbers are selected, then up to 11 further games be marked by selecting the same number of numbers as were selected in the game marked "1"; or

(b) if between 9 and 20 numbers are selected then up to 4 further games may be marked by selecting the same number of numbers as were selected in the game marked "1".

(4) After the subscriber has completed the requirements in this rule, the agent shall use that entry coupon to generate a receipted ticket.

Oral request for entry 8. (1) To enter a draw of lotto without an entry coupon, a subscriber shall make an oral request at the selling point and a receipted ticket shall be produced in accordance with the subscriber's instructions. • (2) A subscriber's oral request shall state—

(a) how many numbers are to be selected from the numbers 1 to 45; (b) how many times the subscriber wishes to select that number of numbers

using a single receipted ticket, with a limit of 12 times; (c) whether the entry is for a midweek draw or a weekend draw or both; (d) the week, or number of consecutive weeks, the entry is to be included; (e) whether the entry is to include a super 66 game and, if so, how many,

with a limit of 10 per receipted ticket. (3) A receipted ticket shall be given to the subscriber upon payment of the fee

calculated in accordance with Schedule 1 and payment of $1.00 per super 66 game entered.

No limit to number of entries 9. The Commission shall not place any limit on the number of entries which any person may make in any lotto draw or super 66 draw.

Accuracy of receipted ticket 10. (1) An agent who—

(a) processes an entry coupon, resulting in a receipted ticket; or

(b) produces a receipted ticket as a result of an oral request, is under no duty to ensure that the entry coupon or request is accurately processed or reproduced on the receipted ticket.

(2) Where a receipted ticket is produced which— (a) is not an accurate reproduction of the details on the entry coupon used

to generate the ticket; or (b) does not accurately reflect the oral request for an entry,

the subscriber may return the receipted ticket— (c) to the selling point at which it was purchased; (d) on the day on which it was purchased; and (e) prior to the close of the day's lotto business for that selling point.

(3) Upon returning the receipted ticket under subrule (2) the subscriber may surrender that receipted ticket in exchange for—

(a) a full refund of the subscription; or (b) a receipted ticket which accurately reflects the original entry request.

Validity of receipted ticket 11. A receipted ticket shall be regarded by the Commission as an acknowledg-ment that it has accepted that entry, as appearing on the ticket, in the numbered lotto draw or draws and, where applicable, in the numbered super 66 draw or draws unless—

(a) that receipted ticket has been surrendered in accordance with rule 10 (2) or rule 13;

(b) that receipted ticket has been found to be void, as a result of non-compliance with rule 3 (2), during the selling period prior to the relevant draw; or

(c) the receipted ticket is forged or altered.

Entry by mail 12. (1) Subject to subrule (2), the Commission shall produce a receipted ticket where an entry coupon is delivered by mail and completed in accordance with these rules, and accompanied by the correct payment.

(2) Where payment is tendered by cheque with an entry coupon delivered by mail, the Commission shall issue the receipted ticket after that cheque has been cleared.

(3) A receipted ticket under this rule shall be posted by the Commission to the return address accompanying the entry coupon using ordinary mail.

(4) The Commission is not responsible for the security of a receipted ticket after it has been posted.

Surrender of receipted ticket 13. The holder of a receipted ticket may surrender that ticket, whether under the provisions of rule 10 (2) or for any other reason—

(a) to the selling point at which it was purchased; (b) on the day on which it was purchased; and (c) prior to the close of the day's lotto business for that selling point,

and shall be entitled to a full refund or a further receipted ticket in exchange for the surrendered ticket.

PART 3—DIVISION OF PRIZES—LOTTO DRAW Criteria for lotto prizes 14. (1) In a lotto draw, the holder of a receipted ticket wins—

(a) division 1, if 6 winning numbers are selected in one lotto game; (b) division 2, if any 5 of the 6 winning numbers and either one of the 2

supplementary numbers are selected in the one lotto game; (c) division 3, if any 5 of the 6 winning numbers are selected in the one

lotto game; (d) division 4 if any 4 of the 6 winning numbers are selected in the one lotto

game; and (e) division 5 if any 3 of the 6 winning numbers and either one of the 2

supplementary numbers are selected in the one lotto game. (2) An entry in which 6 numbers have been selected per game does not entitle

the holder of the receipted ticket to claim to have won in more than 1 division per game.

(3) An entry in which 4 to 20 numbers (other than 6 numbers) have been selected may entitle the holder of the receipted ticket to claim to have won in more than 1 division per game, as set out in Schedule 2.

Division of lotto prize pool 15. The Commission shall distribute the total prize pool for a lotto draw as follows—

(a) division 1—approximately 26.5% of the total prize pool and any jackpot or guaranteed amount;

(b) division 2-7.5% of the total prize pool; (c) division 3-13.5% of the total prize pool; (d) division 4-23.5% of the total prize pool; and (e) division 5-29.0% of the total prize pool;

which shall be divided among the holders of the receipted tickets who are entitled to a prize under the appropriate division, according to the number of winning games.

Rounding off 16. (1) The Commission may round off the individual entitlement for a prize in any division (other than division 1) to the nearest sum containing a 5 cent multiple.

(2) Where a rounding off process takes place under subrule (1), the Commis-sion may adjust the total prize money for division 1 to ensure that the total prize pool is distributed.

Variation of division 1 lotto prize pool 17. (1) Where less than 60% of the subscription money received for a lotto draw is allocated to the total prize pool for that draw, the Commission may add part or all of the undistributed balance of that 60% to a division 1 prize pool in an ensuing lotto draw (called a "Bonus" lotto draw).

(2) The Commission may from time to time fix a minimum guaranteed prize pool for division 1 in a "Bonus" lotto draw.

(3) Where a "Bonus" lotto draw is fixed under subrule (2), and a jackpot division 1 lotto prize coincides with that draw, the Commission may elect to reduce the undistributed balance set out in subrule (1) by the amount of the division 1 jackpot amount for that draw, and retain that part of the undistrib-uted balance for a future "Bonus" lotto draw.

Jackpot—lotto draw 18. (1) Subject to subrules (2) and (3) and rule 17, if there is no division 1 winner in a lotto draw, the Commission shall add the amount in a total prize pool allocated to division 1 in that draw, to the division 1 prize pool in the next draw.

(2) An undistributed midweek division 1 prize pool shall be added to a subsequent midweek division 1 prize pool, and an undistributed weekend division 1 prize pool shall be added to a subsequent weekend division 1 prize pool.

(3) Where there is no division 1 winner for 5 consecutive midweek, or 5 consecutive weekend, lotto draws, the Commission shall allocate the accumu-lated division 1 prize pool in the fifth draw to the prize pool for the division 2 winners in that draw.

Presentation of receipted ticket—lotto draw 19. Subject to rule 32, the Commission may refuse to pay any division 1 or division 2 prize entitlement to the holder of a receipted ticket which has won a division 1 or a division 2 prize in a lotto draw if the receipted ticket has not been presented at the Commissioner's head office within the relevant claim period under these rules.

Payment of division 1 or 2 prizes 20. Subject to these rules, the Commission shall pay any division 1 or division 2 lotto prizes—

(a) after the relevant claim period under these rules has passed; and (b) by cheque.

Payment of division 3, 4 and 5 prizes 21. (1) Subject to these rules, division 3, 4 or 5 lotto prizes may be collected in cash at any selling point upon presentation of the winning receipted ticket.

(2) Where any holder of a receipted ticket wins either a division 1 or division 2 prize and another division prize on the one ticket, the Commission shall not pay any of those prizes until the relevant claim period under these rules has passed.

(3) The Commission may specify a limit in the amount of cash lotto prize which may be collected at any specified selling point.

PART 4—DIVISION OF PRIZES—SUPER 66 DRAW Method of drawing super 66 numbers 22. (1) For every super 66 draw, there shall be 6 digits selected, each between 0 and 9, using an equally random method of selection for each digit, at a location and on weekends determined by the Commission.

(2) The 6 digits drawn under subrule (1) make up the winning super 66 number for that draw.

Criteria for super 66 prizes 23. (1) In a super 66 draw the holder of a receipted ticket wins—

(a) division 1, if 6 digits in one super 66 game match the value, position and order of the 6 digits drawn;

(b) division 2, if digits in one super 66 game match the value, position and order of— (i) the first, second, third, fourth and fifth digits; or

(ii) the second, third, fourth, fifth and sixth digits, of the 6 digits drawn;

(c) division 3, if 4 digits in the one super 66 game match the value, position and order of— (i) the first, second, third and fourth digits; or

(ii) the third, fourth, fifth and sixth digits, of the 6 digits drawn;

(d) division 4, if 3 digits in the one super 66 game match the value, position and order of— (i) the first, second and third digits;

or (ii) the fourth, fifth and sixth digits, of the 6 digits drawn;

(e) division 5, if 2 digits in the one super 66 game match the value position and order of— (i) the first and second digits; or

(ii) the fifth and sixth digits, of the 6 digits drawn. (2) A maximum of one prize per super 66 game entered will be paid to the

receipted ticket holder by the Commission and, where the criteria for more than one division or prize is satisfied in one super 66 game, the highest prize only will be paid.

Distribution of super 66 prize pool 24. (1) Subject to subrule (3) and rule 25, the Commission shall distribute the total prize pool for each super 66 draw as follows—

(a) division 1—the balance of the total prize pool after payment of prizes referred to in paragraphs (b), (c), (d) and (e);

(b) division 2—$6 666.00 per winning super 66 game in that division; (c) division 3—$666.00 per winning super 66 game in that division; (d) division 4—$66.00 per winning super 66 game in that division; and (e) division 5—$6.60 per winning super 66 game in that division.

(2) For the purposes of determining the distribution of prizes in division 1, 2 and 3 under this rule, division 4 and division 5 prizes shall be calculated before division 1, 2, and 3.

(3) Where after calculating the amount remaining after distribution of division 4 and division 5 prize amounts, the Commission finds that the amount remaining to be distributed to division 1, 2 and 3 prize winners is insufficient to pay—

(a) $16 666.00 for each super 66 game entitled to a division 1 prize; (b) $6 666.00 for each super 66 game entitled to a division 2 prize; and (c) $666.00 for each super 66 game entitled to a division 3 prize,

the remaining amount of the total prize pool shall be distributed by the Commission so that the amounts of a division 1, division 2 and division 3 prize are in the ratio of 16 666: 6 666: 666.

Variation of division I super 66 pool 25. (1) The Commission may allocate a percentage of the subscription money normally included in the total prize pool for a super 66 draw to a division 1 prize pool in an ensuing super 66 draw (called a "Bonus" super 66 draw) and the total prize pool for that initial week shall be reduced accordingly.

(2) The Commission may from time to time fix a minimum guaranteed prize pool for division 1 in a "Bonus" super 66 draw.

(3) Where a "Bonus" super 66 draw is fixed under subrule (2) and a jackpot division 1 super 66 prize coincides with that draw, the Commission may elect to reduce the total of funds allocated in accordance with subrule (1) by the amount of the division 1 jackpot amount for that draw, and retain that part of the total of funds allocated, for a future "Bonus" super 66 draw.

Jackpot—super 66 draw 26. (1) Subject to rule 25, where, in any super 66 draw, no super 66 entry matches all 6 digits, the Commission shall add the amount remaining after the distribution of division 2, 3, 4 and 5 prizes to the total division 1 prize amount in the next super 66 draw.

(2) Where, after 5 consecutive super 66 draws, there has been no division 1 winner in any of those 5 super 66 draws, and where the total division 1 prize amount in that fifth super 66 draw, other than the amount accrued under subrule (1)—

(a) is sufficient to pay $6 666.00 per winning super 66 game in division 2 and $666.00 per winning super 66 game in division 3, then the amount accrued under subrule (1) shall be divided amongst the super 66 games entitled to a division 2 prize in that fifth super 66 draw;

(b) is not sufficient to pay $6 666 per winning super 66 game in division 2, and $666 per winning super 66 game in division 3, then the amount accrued under subrule (1) shall be applied towards payment of prizes in division 2 and 3 until—

(i) completely distributed without making up the shortfall; or (ii) the shortfall is made up, after which the remaining amount shall be

divided amongst the super 66 games entitled to a division 2 prize, in that fifth super 66 draw.

Presentation of receipted ticket—super 66 draw 27. (1) Each holder of a receipted ticket with a winning super 66 game in division 1 or division 2 must present that receipted ticket to the Commission's head office during the relevant claim period for the prize to be paid.

(2) Subject to subrule (1), the Commission shall pay— (a) each super 66 division 1 prize by cheque, after the relevant claim period

under these rules has passed; and (b) each super 66 division 2 prize by cheque.

(3) Subject to this rule and rules 21(2), 28, 29, and 32, a receipted ticket with a winning super 66 game in division 3, 4, or 5, may be exchanged for the relevant prize, in cash, at any selling point.

PART 5—MISCELLANEOUS Identification of receipted ticket holder 28. (1) The Commission may refuse to pay any division 1 or division 2 lotto or super 66 prize in relation to a receipted ticket which is presented at a selling point until the name and address of at least one person is sufficiently set out to identify a prize winner, in the space provided on the receipted ticket.

(2) where a receipted ticket under subrule (1) is received by the Commission or its agent, and a name and address is not sufficiently set out to—

(a) establish the prize winner's identify; or (b) indicate who of the names and addresses is to be paid,

the Commission, or the agent, as the case may be, may— (c) reject a claim in respect of that ticket; (d) where multiple names and addresses appear on the ticket, forward the

prize to the name and address first appearing; or (e) request a statutory declaration containing such information as to the

identity of the prize recipient as the Commission may require.

Commission may require a statutory declaration 29. The Commission may require the holder of a receipted ticket to complete a statutory declaration, upon the payment of any lotto or super 66 prize to that person, stating that the person has not, or is not to his knowledge part of a syndicate which has, acted in a manner contrary to the Act or these rules in relation to a receipted ticket.

Publication of results 30. The Commission shall publish—

(a) the winning and supplementary numbers; (b) the prize pool for each division; (c) the amount allocated per winning entry in each division; and (d) the claim period under these rules,

for each lotto draw and each super 66 draw in a daily newspaper, after the draw.

Publication of names and addresses of prize winners 31. The Commission may publish the name and address of any prize recipient except where the back of the winning receipted ticket is marked to indicate that the name and address on the ticket is not for publication.

Player Registration Service 32. (1) A subscriber may, at any selling point, request a 'Player Registration Service" (PRS) number, which may be used to identify a receipted ticket as being held by the subscriber.

(2) The Commission shall issue the PRS number upon receipt of the subscriber's name and address, and the requisite fee of $2.50, and the PRS number shall be valid for 2 years from the date of issue.

(3) notwithstanding these rules, where a receipted ticket is endorsed with a PRS number, and the holder of that receipted ticket has won a lotto prize or super 66 prize, the Commission shall—

(a) pay that prize upon presentation of the ticket in the manner set out in these rules, for the allowed period after the relevant draw; or

(b) forward the prize to the subscriber's address in the form of a cheque, if the prize is not claimed under paragraph (a), following the allowed period.

(4) For the purposes of subrule (3), the "allowed period"— (a) in relation to a draw prior to 24 February 1991, is 13 weeks; or (b) in relation to a draw on or after 24 February 1991, is 5 weeks.

(5) The payment by the Commission of any prize payable in respect of a receipted ticket bearing a PRS number to the subscriber whose name corre-sponds to that PRS number, discharges the Commission from any further obligation in relation to that prize, not withstanding any conflicting information that the Commission may have received in relation to that prize.

Instructions 33. (1) The subscriber and any other person claiming a prize in respect of a receipted ticket should follow the instructions on any entry coupon used, and on the back of the receipted ticket.

(2) In the event of any inconsistency arising between the instructions on an entry coupon or receipted ticket and these rules, these rules prevail to the extent of the inconsistency.

Rules to be made available 34. (1) A copy of these rules shall be kept at every selling point and shall be made available for public inspection upon request.

(2) In addition to the requirement in subrule (1), the Commission may publicize the rules, or any amendment to the rules, in any other manner that it thinks fit.

Decisions of Commission final 35. A decision or determination of the Commission in relation to a lotto draw or a super 66 draw is final and binding upon the holders of receipted tickets and any other persons claiming prizes in respect of the lotto draw or super 66 draw.

Repeal

36. The Lotto Rules 1988* are repealed.
