Summary of concerns:
•The Promoter’s Response Document (PRD) has been carefully considered and whilstreassurance has been given on some of the points made in its petition, the GoverningBody has ongoing concerns.
•The PDR does not touch on the prospect or possible impact of displaced/divertedtraffic (from the A413) as referred to in the petition. We are concerned about theimplications of this possibility on a) the health and safety of parents, pupils, staff andother visitors to the school in terms of access to and from the school particularly atpeak times but also during the school day and b) the school’s statutory duties in termsof the effective delivery of the curriculum if pupils/staff are delayed getting to school.
•The information papers and other documents referred to in the PRD mainly concernthemselves with businesses and residents in terms of future consultation. Regardingday to day practicalities, reference is made to schools that lie immediately adjacent tothe construction routes, not those slightly further away but still close enough to beaffected. Schools involve large communities of local people and should be specificallyincluded as consultees on health and safety matters.

About the school:
•The school lies c. 3k from the HS2 line as the crow flies and c. 1.35 k from the A413 viaDeep Mill Lane.
•It is a local authority school, rated by Ofsted as outstanding in 2011.
• The school operates on a split site and this is pertinent to the school’s concerns.
•NOR is 227 pupils including 18 children aged 3 - 4 in the separate nursery rising to 30in January 2016.
•There are 36 F/T and P/T members of staff including cleaning staff and mid daysupervisors.
•Getting to and from school, Cross Country club, cycling proficiency and many otherkey activities including the Forest Schools initiative involve crossing or using WindsorLane – many times per day.
•Most pupils live outside the catchment or cannot walk to school safely. Schoolgenerated traffic is already a safety issue.

•115 live outside the catchment mainly travelling from Amersham, Little Missenden,Hazelmere, Holmer Green, Great Kingshill and High Wycombe.
•School is open from 7am with breakfast club from 7.30am. After school club ends at5.15pm.
•The school has measures in place to reduce the traffic it generates including an up todate travel plan, travel tracker, walk to school weeks etc. but the majority travel by car.
•Children are taught from nursery onwards about the dangers of Windsor Lane.
•The school has a team of JRSOs.

Health and Safety:•Main school not on pavement side of Windsor Lane, only one safe supervised crossingpoint. No streetlights. Single lane traffic twice/day.
•Crossing before, during and after the school day – normal arrivals and departures -nursery children, Forest Schools, Cross Country club and others.
•Related risk assessment reviews. Potential for displaced traffic of great concern to theschool in terms of the day to day business of keeping pupils safe and maintainingnormal school activity.
•Existing regular grid lock situations in am peak and pm at drop off/pick up times –possible extended risk for specific activities – hot meal deliveries, swimming bus,parents’ evenings, social events, pupils’ performances etc.
Statutory Duties:
•Lessons start at 8.45am. Core subjects taught first. Implications for the effectiveconduct of lessons if lateness becomes an issue.
•Deadline for hot lunch orders is 9.15 am.
•Out of 4 members of the Senior Management Team, 2 have to use the A413 to get towork.
Potential Specific Impacts

•The PRD notes that works planning will take into consideration ‘the affectedresidential, commercial, industrial and farming premises and specifically theirrequirements for access and servicing’ - no mention of schools. This should be rectified.
•HS2 information paper E13 requires contractors to communicate regularly withaffected parties – again businesses and residents are listed but not schools. This shouldbe rectified.
•No mention of the impact of displaced or diverted traffic on those parts of thehighway network directly connected to the A413 in the CoCP or the PRD. This shouldbe given more focussed attention.
•Not reasonable to require LPAs to adopt technology on their own behalf, such as CCTV,to monitor compliance with planning conditions associated with the CoCP assuggested. As a minimum, the promoters should put suitable measures in place andpreferably provide resources for independent monitoring and reporting.
•The PRD states that additional controls on delivery hours etc. are unnecessary inrespect of school drop off and pick up times although paragraph 27 indicates there maybe scope for flexibility in this respect. A flexible approach is desirable.

•Collection of baseline traffic data in Windsor Lane and environs early on for effective monitoringpurposes.
•Temporary reduction of speed limit in the vicinity of the school if necessary.
•Placement of automatic speed indicators in Windsor Lane if necessary.
•‘No access for construction traffic’ signs. Suggested at the junction of Deep Mill Lane and theA413; at the junction of Nags Head Lane and London Road; at the junction of Hare Lane andWindsor Lane and at the junction of Heath End Road with Copes Road and Stag Lane.
•Soft verge protection measures to be put in place by agreement with BCC before damage is done.
•Framework Travel Plan to be monitored (preferably independently) and reviewed more thanannually.
•Construction Workforce Travel Plans should not only focus on ‘workforce trip generation’ but alsothe routes likely to be used by workers getting to and from work and should be reviewed morethan annually.
•The nominated undertaker should require its contractors to communicate regularly with allaffected parties. Schools and/or education authorities should be included in this process so that,for example, parents/carers can be advised of any travel issues accordingly and in a timely manner,as per well established ‘snow day ‘ procedures.
•The nominated undertaker should engage with schools as well as residents and businesses whenLEMPs are developed.

Following our conversation, I can offer you some information on a few of the issues you raise, although there are some issues that I cannot comment on.
1. Bacombe Lane You stated that Bacombe Lane is a private lane owned in trust by the residents, and not maintained by Buckinghamshire County Council. You raised concerns that, for example, during the winter months when the residents shovel snow and ice off the road and pavement there will be fewer residents to help out with this. You also mentioned that where repairs are needed, this cost is split between the residents. Having spoken to our Land & Property team, I can inform you that where the Promoter acquires a property in Bacombe Lane, the Promoter will be responsible for any associated costs and responsibilities in accordance with the terms of the conveyance. You also raised concerns about the security of the properties that the Promoter owns now and will own in the future. The Promoter has a responsibility to ensure that its properties are secure, and if a property is not rented out it will be secured and alarmed. However, the rent rate for acquired properties is 85%, so it is likely that tenants will be found for these properties.
2. Compensation You raised concerns about the discretionary compensation schemes ending one year after the railway is in operation. At this point the statutory regime of Part 1 of Land Compensation Act 1973 applies in respect of properties where there is a depreciation in value due to ‘physical factors’ resulting from the use of public works (i.e. the operational stage of the development). I have attached the Department for Communities and Local Government’s Compulsory Purchase and Compensation booklet which may give more information on this topic. You asked how long the Residents’ Commissioner will be in post for. At the moment, the role will be in place until the compensation schemes have expired. The role of the Residents’ Commissioner is not to determine compensation but to ensure that the schemes in place are operated fairly. I have attached a copy of the HS2 Residents’ Charter, which sets out the role of the Residents’ Commissioner.
3. Re-selling vacant properties You asked about VAT exemption for improvements to homes that have been vacant for 10 years, in line with national policy. If it was the case that properties that the Promoter acquired were left empty for 10 years, then it is likely that they would be subject to the VAT exemption if that policy
