1. Resubmission: case was placed before CAC dated 08/01/2013; wherein it was decided to keep the case in abeyance and call details from RO pune regarding previous consent applications made and whether EC is obtained.

II. Gross C.I. of the project is 1031.95 Cr. Now applied for Consent tos 1st operate for Plot 1 in part for C.I. 95.82 Crores.

III. RO/SRO reports that; a) Board has granted Consent to Applicant on 25/01/2001 which is valid upto 31/1/2003.

However copy is not submitted. b) Applicant has also applied on 19/09/2009 AND 12/5/2010, jointly for phase-I & II,

but applicant has not received the consent. However applied details are not furnished

c) The project proponent has showed C.I. in the year 2009 of Rs. 875.08 crores the consent fees of Rs. 8,75,080/- is submitted, further the project proponent has paid fees in the year 2010 for same capital investment along with fees with excess consent fees of Rs.19,38,969/- & Rs.1,61,228/-

d) Now they have applied for renewal of consent with expansion by showing C.I. of Rs. 1031.95 Cr hence issued a letter to industry for clarification of increased in CI form 875.08 Cr to 1031.95 crores and payment of additional fees of Rs. 10,90,271/-. In this regard the industry has replied vide letter dtd 29.11.2012, that the capital investment of Rs. 1031.95 Cr is for two phases i.e. Plot No. 01 (Phase-I)& Plot No. 24(Phase-II).

e) The C.I. of the said project for plot No. 1 is Rs. 95.82 crores (Now Applied)for which they have paid consent fees as per revised fee structure of Rs. 1,25,000/- & 100/-.

f) Separate consent is granted for No. 24 for Phase-II which is valid upto 31/8/2014 for

communicated that SRO has been asked on 01.01.13 to submit point wise CREP compliance.

• RO reported that as recommended by SRO we may consider Consent to operate with bank guarantee of Rs 5.0 lack & 2.0 lacs towards O & M of ETP & compliance of CREP guidelines.

4. They have shown effluent Nil in the application form and submitted that due to

starving of Natural gas, plant is running seldom and hence no effluent is

generated.

5. SRO/RO’s recommended that Consent may be renewed for one year.

6. We may consider the case for plain renewal of consent by imposing condition

towards provision of STP within six months with B.G of 5 lakh.

4. SRO vide letter dtd. 21/03/13 forwarded industry’s submission dtd. 12/03/13. 5. Firm has proposed to provide ETP consisting of primary, secondary & tertiary

treatment for the treatment of industrial effluent. After treatment, treated sewage will be applied on land for gardening.

6. Site of proposed industry is located at a distance of 3.75 Km from high flood level

(H.F.L.) of Darna Dam, it attracts the provisions of the RRZ Policy dtd. 13/07/2009 and amendments thereof.

7. As per EIA Notification 2006-clause No. 5(d), EC is applicable to “Manmade fibres

mfg.”. Hence, industry’s proposal of microfibre nonwoven fabrics attracts the provision of EIA Notification 2006.

8. SRO/RO have recommended that grant Consent to Establish. 9. Firm has paid CtE fee of Rs. 8,22,000/- as per Env. Dept.’s revised Consent fee

G.R. dtd. 25/08/2011. 10. Consent to Establish may be granted under “Red” Category by imposing condition

towards obtaining of NOC from RRZ Committee, Environmental Clearance from the Competent Authority and submission of B.G. of Rs. 10.0 Lakhs towards compliance of the same within 15 days from issue of the Consent.

7. CI of the unit is increased from Rs. 65.48 Crore to Rs. 92.37 Crore. It is new entry to CAC.

In view of above, we may consider the case for renewal by imposing condition towards provision of STP within one year with BGT of Rs. 5 lakh. The condition about requirement of APC for the furnaces shall be confirmed after receipt of reply from RO/SRO.

Consent to Establish granted on 28/08/2012 CI for expansion is Rs. 94 Crore. Total CI is Rs. 182.50 Crore.

5. Existing ETP consisting of Primary, secondary & tertiary treatment i.e. Reverse Osmosis, Evaporation & spray dryer. RO permeate utilize for cooling tower & RO reject is recycled for making mixed polymer to achieve the zero discharge. From expansion 30 m3/d effluent generated (20 m3/d from process, 10 m3 from domestic) & same is treated in existing ETP. Analysis results are with in consented limits.

6. Industry vide their letter dtd. 26.02.2013 informed that they have completed the work of installation of plant and machinery and ready to start up. SRO Chiplun has visited the industry on 08.03.2013 and verified that plant is ready for commissioning. SRO Chiplun has also submitted the compliance of C to E conditions. Since the industry is complying with the C to E conditions and ready for commissioning, we may consider the case for grant of 1st consent to operate except additional boiler for expansion with amalgamation of Existing consent.

Reverse Osmosis plant provided. Treated effluent is recycled 100%. Industry achieved Zero Discharge. JVS analysis results are within consented limits.

5. Industry has provided Dust collectors and Scrubbers to control air emissions from Boiler as well as process. Industry proposes to provide additional dust collector and wet scrubber.

6. Industry has submitted self assessment of pollution load in Boards prescribed format.

7. CI will be increased by Rs. 14.20 Crore. Total CI after proposed changes will be Rs. 89.87 Crore.

In view of above, we may consider the case for amendment in consent for rearranging production Quantities.

Interim Directions issued on 22.11.2011.

The case was discussed in CAC meeting held on 19.3.2013 and it was decided to grant amendment in consent on following conditions:

1. Industry shall obtain amendment to the EC for activities which are not cover in EC dated 1.8.2007.

2. Not to operate Pilot plant/R&D till EC amendment is obtain. To ensure the compliance of same, industry shall submit the Bank Guarantee of Rs. 10 Lakhs

3. Industry shall submit Board Resolution towards increase in C.I., construction of new R & D facility storage yard and pilot plant without prior permission of the MPC Board by 15.4.2013 and also submit the Bank Guarantee of Rs. 2 Lakhs for compliance of this conditions.

After going through Minutes of Meeting of CAC dtd. 19/03/2013 the industry has made representation. The industry claims that, as per EC dtd. 1st August 2007, they have granted permission to manufacture Speciality chemicals and intermediates for 50 MTA, which is nothing but for the small volume / pilot plant products. R & D

activity is already included in EC dtd. 1.8.2007. Hence condition no. 1 & 2 above in

MOM of CAC dtd. 19.3.2013 shall be waived. The representation made by industry

with respect to point no. 1 & 2 seems to be in order. Hence we may consider the industries request. If the request made by the industry is considered by the CAC, then needs to amend the minutes of meeting accordingly.
