1. Resubmission: case was placed before CAC dated 08/01/2013; wherein it was decided to keep the case in abeyance and call details from RO pune regarding previous consent applications made and whether EC is obtained.
II. Gross C.I. of the project is 1031.95 Cr. Now applied for Consent tos 1st operate for Plot 1 in part for C.I. 95.82 Crores.
III. RO/SRO reports that; a) Board has granted Consent to Applicant on 25/01/2001 which is valid upto 31/1/2003.
However copy is not submitted. b) Applicant has also applied on 19/09/2009 AND 12/5/2010, jointly for phase-I & II,
but applicant has not received the consent. However applied details are not furnished
c) The project proponent has showed C.I. in the year 2009 of Rs. 875.08 crores the consent fees of Rs. 8,75,080/- is submitted, further the project proponent has paid fees in the year 2010 for same capital investment along with fees with excess consent fees of Rs.19,38,969/- & Rs.1,61,228/-
d) Now they have applied for renewal of consent with expansion by showing C.I. of Rs. 1031.95 Cr hence issued a letter to industry for clarification of increased in CI form 875.08 Cr to 1031.95 crores and payment of additional fees of Rs. 10,90,271/-. In this regard the industry has replied vide letter dtd 29.11.2012, that the capital investment of Rs. 1031.95 Cr is for two phases i.e. Plot No. 01 (Phase-I)& Plot No. 24(Phase-II).
e) The C.I. of the said project for plot No. 1 is Rs. 95.82 crores (Now Applied)for which they have paid consent fees as per revised fee structure of Rs. 1,25,000/- & 100/-.
f) Separate consent is granted for No. 24 for Phase-II which is valid upto 31/8/2014 for
Total plot area of 4,61,264.00 Sq mtrs Total Construction BUA 4,04,897.00.Sq mtrs V. Water Consumption- 225.00 M3. Sewage Generation- 192.00 M3. STP provided - 230.00 M3. (Analysis results not furnished) VI. The case was discussed in CAC meeting held on 19.3.2013 and it was decided to grant amendment in consent on following conditions:
1. Industry shall obtain amendment to the EC for activities which are not cover in EC dated 1.8.2007.
2. Not to operate Pilot plant/R&D till EC amendment is obtain. To ensure the compliance of same, industry shall submit the Bank Guarantee of Rs. 10 Lakhs
3. Industry shall submit Board Resolution towards increase in C.I., construction of new R & D facility storage yard and pilot plant without prior permission of the MPC Board by 15.4.2013 and also submit the Bank Guarantee of Rs. 2 Lakhs for compliance of this conditions.
After going through Minutes of Meeting of CAC dtd. 19/03/2013 the industry has made representation. The industry claims that, as per EC dtd. 1st August 2007, they have granted permission to manufacture Speciality chemicals and intermediates for 50 MTA, which is nothing but for the small volume / pilot plant products. R & D
activity is already included in EC dtd. 1.8.2007. Hence condition no. 1 & 2 above in
MOM of CAC dtd. 19.3.2013 shall be waived. The representation made by industry
with respect to point no. 1 & 2 seems to be in order. Hence we may consider the industries request. If the request made by the industry is considered by the CAC, then needs to amend the minutes of meeting accordingly.
