We h ave gone through the St!'· (August, 2004) Report of
CorrunlssionersS/Shri Dr.N.C.Saxena and N.R. Sankaran. First of i.1
we wish to place on record our compliments and appreciation for

"l"JOnn'='llS work done by the learned Commissioners and presenting t::\
[{E.' par t:. under considera tion.
The Report is in three parts. Firat part is divided into
l~ sections covering different schemes. Under Section 1, Integrated
Child Development Services (IeDS) has been considered. Part II sets
out summary of findi,pgs and Part III sets out recormuendations. We
IIlould first consider the aspect of IeDS. In order to fully
appreciate the problem, it ..,ould be useful to notice the background
briefly.
IeDS, as noticed in the Order dated 29. '1.2004 is perhaps
the largest. of all the food and supplementa tion programmes in the
w orLd that. was initiat.ed in the year 1975 wit.h the following
obJections as per the document prepared by Planning Commission:
1.'1'0 improve the health and nutrition s t tus of children 0-6 years byproviding supplementary food and by coordinating with state healthdepar t.ment.s to ensure dellve.ry of requi.red heal th inputs;
2.To provide conditions necessary for pre-school children'spsycholgical and social development through early sti~iuldtion andeducation;
3.'1'0 provide pregnant and lactating wonEn with food supplements;
4.To enhance the mot.her v s ability to provide proper child carethrough health and nutrition educaitoni

5. Te' achieve effective coordination of policy and implementationamong the various departments to promote child development.

The scheme intends to cover a Ll, the children under a<J
group of 0-6 years. The food is supplied to the children t.hr ou.,
Anganwadi Centres (For short, 'AWCS'). The norms of Government·(;
India provide for one Centre for a population of one thousand (7C
in case of tribal area). It is not in serious dispute, ~
contended by Mr. Mohan Parasaran, learned Additional Solicit,
General that according to norms, there should be approxomately
lakhs ACWS. Admittedly, nearly 6 lakh Centres have be,
sanctioned. Man.y of the sanctioned Centres are also not operati-on.
as is evident from the Report under consideration. The probl·
s e ems to be more acute in;
States 'Ilike Bihar, Uttar Pradesh
Jharkhand. It deserves to be noticed that the directions
respect of reDS were issued as far back in 28.11.2001.

The result was that a large number of children between the
group of 0-6 years were malnourished. That Order also noticed t.
the position was alarming in the aforesaid three States as well
the State of Uttaranchal. By Order dated 29.4.2004, the Governr
of India was directed to file within three months an a f f Ld..
stating the period withitY which it proposed to sanc t.Lon
remaininq number of AWCS. The Government of India was i;.
directed to consider the revi~ion of norms of supply of nutritl
food worth rupee one to every child in the Centres as norm of rl

ori-, was fixed way back in the yea:c 1991 and lncorpora te
., suggestion in the affidavit..
It is most unfortunate that instead of three months,
nearly six months have expLred; the Government of India has still
not filed the affidavit and instead an oral application has been
made by learned Addi tional Solici tor General for grant of further
time to file an affidavit in terms of the Order dated 29.4.2004.
We are shocked at t.he attitude of the Central Government which is
i.n respect of 'giving nutritious food to all children though in
practice it. concerns those unfortunate section of the society who
can ill-afford to provide nutritious food to the children of the
a f ore sa Ld age group. In absence of the affidavit, we could have
straightway issued directions for the sanction of the remaining
AWCSand for increase of norm of r upe-e one t.O rupees two but having
regard to the totality of the cLrcuns t.ance s , we grant one final
opportuni ty to the Central Government to file af fidavi t wi thin ;:
period of two weeks whereafter we would consider these two a3pects,
namely, (i) sanction of 14 lakh AWCS; (ii) Lncr eaae of norm o J
rupt'.."€one to rupees two.
We make it clear that if the affidavit is not filed, thi:
Court will be left with no -~ption but to issue directions fOJ
implementation of the two aspects.
Now, we would deal wi t.h the aspect of sanctioned AWCSan"

<: t.!leir working. In t.he Order dat.ed 29.4.2004, it. was direct.ed t.haL
t.he sanct.ioned Awes shall be made fully operational by 30tbJun~,
2004. Furt.her direct.ion issued was t.hat. the sanct.ioned Awes shall
supply nutritious food/supplement. to t.he children, adolescent. girls
and to pregnant. and lactat.ing women under the scheme for 300 days
in a year. The Report. present.s a glooraing picture bot.h in regard
to the operation of the sanctioned AWCSin some of the Stat.es like,Uttar Pradesh, Bihar and Jharkhand and the position in those which
are operational. Inst.ances have been given in the Report where for
- .~months the sup~lies were not made t.o t.he children. For example. in
th~ State of Jharkhand, t.he sanct.iq,ned AWCSwere not working froml"t
May to December, 2003. No satisfact.ory reply is forthcoming from
that State. Further, there are material discrepancies in two
affidavits f i Led by the said State one in ~;eptember and t.he one
handed over io the Cour t today. In the Sept.ember affidavit., it. was
deposed on oat.h that. 16689 Awes were operational. In the affidavit
filed t.oday, the figure of operat.ional Awes .is st.ated to be 7429.
According to t.he Report, on an average, 42 paisa as against t.he
-;-. norm of rupee one was being allocated per bene f iciary per day by
the Stat.e of Jharkhand. The position in Bdha r and Ut.tar Pradesh i:~
also no belter. Out of 394 sanct.ioned reDS projects, only 24~ wer~
. operational in' the State of Bihar. As per t.he affidavit. dat.ed 30t
September, 2004, all t.he pro.~ct.s were being made operat.ional f r on
4th Oct.ober, 2004. Whet.her that has happened or not, Mr. B.B.
Singh, learned counsel appearing for t.he State is unable to s t.a t.c
for want. of inst.ruct.ions. Be that. as it made, if all have not. bee:

made operational since 4th October, 200~ has already pass>,
we direct that the same shall be made operational in l'

In the State of Uttar Pradesh, though percentag
