Social Media Discovery Challenges: Authentication / Validation
What’s wrong with print screen?
• Not text searchable
• Does not get metadata
• Does not provide validation
• Not scalable and not efficient
- Stallings v. City of Johnston, 2014 WL 2061669 (S.D. Ill. May 19,
2014)
- Plaintiff’s counsel and a paralegal spent a full week printing out
the contents of Plaintiff’s Facebook account — which amounted
to over 500 printed pages
- A week of paralegal and lawyer time could easily run $25,000
• Case law says no!
Print Screen Does Not Hold Up In Court
• Moroccanoil vs. Marc Anthony Cosmetics, – F.Supp.3d – (2014)
federal district court explicitly ruled that Facebook screenshots were
inadmissible as the defendant in a trademark infringement action
merely offered the screenshots without supporting circumstantial
information
• United States vs. Vayner, 2014 WL 4942227 (C.A. 2 (N.Y.)) –
federal district court overturned a criminal conviction upon finding that
the lower court erroneously admitted a screenshot of the defendant’s
alleged social media profile due to improper authentication
• Other cases:
- Smith v. State, Supreme Court of Mississippi, April 17, 2014, 2014 WL
15113032.
- People v. Anderson, Court of Appeals, Michigan, April 08, 2014, 2014 WL
13833993.
- Randazza v. Cox, U.S. District Court, Nevada, April 10, 2014, 2014 WL
