HYDERABAD AIRPORT DEVELOPMENT AUTHORITY

LICENCING OF DEVELOPERS, BUILDERS, ENGINEERS, REAL ESTATE FIRMS & OTHER TECHNICAL PERSONNEL IN HADA AREA

(Under Regulation 33 of the HADA Development Promotion Regulations, 2003)

1.Application for Licence:

The Competent Authority shall issue licence for Developers, Builders, Town Planners, other Technical Personnel, and Real Estate Firms those who intend to practise/do business related to development of lands, properties, construction, etc. within the HADA area. The application for licence shall be made in Form No. 3 and enclosing all relevant documents and particulars. The Licence shall be valid for three years or part thereof and shall be renewable.

2.Revocation of LicenceThe Licence shall be liable to be revoked temporarily or permanently by the Competent Authority if the licenced person is found guilty of negligence or default in discharge of his/her responsibilities and duties or of any breach of any of the HADA Development Promotion Regulations, 2003,or their respective Code of Practice and conduct, besides taking other actions as per the provisions of Regulation 33 of the HADA Development promotion Regulations, 2003

Provided that he/she shall be given a show cause notice and reasonable opportunity of being heard by the Competent Authority for the purpose of these stipulations and the HADA Development Promotion Regulations, 2003.

3.Duties and ResponsibilitiesGeneral Duties and responsibilities applicable to all:

(a) It will be incumbent on every practicing Architect/ licensed Technical Personnel/Real Estate Firm, in all matters in which he/she may be professionally consulted or engaged, to assist and co-operate with the Competent Authority, HADA and other Officers in carrying our and enforcing the provisions of the Andhra Pradesh Urban Areas(Development) Act, 1975,the provisions of the Master Plan of HADA area, the provisions of the HADA Development Promotion Regulations, 2003 and of any rules/regulations and Government Orders for the time being in force.

(b) Every Architect/licensed Technical Personnel/Real Estate Firm/ other licenced personnel shall in every case in which he/she may be professionally consulted or engaged, be responsible, so far as his/her professional connection with such case extends, for due compliance with the provisions of the Andhra Pradesh Urban Areas(Development) Act, 1975,the provisions of the Master Plan of HADA area, the provisions of the HADA Development Promotion Regulations, 2003 and of any rules/regulations and Government Orders for the time being in force or such of them as may respectively be applicable to the circumstances of the particular case, and in particular it will be obligatory on him/her to satisfy himself/herself that a qualified and competent Supervisor/ Clerk of works is constantly employed and present on the work to supervise the execution of all works and to prevent the use of any defective material therein and the improper execution of any such work.

(c) In every case in which a practising Architect / Licensed Technical Personnel/Real Estate Firm /other licenced personnel is professionally concerned in connection with any building or work upon any premises, in respect of which a right to require a set-back has accrued or is about to accrue to the Competent Authority , HADA under the provisions of the said Act, or any of them, it will be incumbent on such practising Architect/ Licensed Technical Personnel/Real Estate Firm to ensure whether the regular line of the street/Building Line prescribed are complied with and whether any portion of the said premises is required for the street under the proposed road widening/Right of way are left, and shall be a party to any evasion or attempted evasion of the set-back / road widening/right of way that may be required.

(d) In every case in which a practising Architect/ Licensed Technical Personnel/Real Estate Firm/other licenced personnel is professionally concerned in connection with any layout/Land Pooling Scheme/Group Housing Scheme/building or work upon any premises designed or intended to be used or any purpose in respect of which the written permission or of the Competent Authority, HADA is prescribed by the said Act as a necessary condition to the establishment or use of such premises for such purpose, it shall be incumbent on such Architect/Licensed Technical Personnel/Real Estate Firm, so far as his/her professional connection with such case extends, to ensure valid approval/permission is obtained and that all conditions prescribed by the Andhra Pradesh Urban Areas(Development) Act, 1975,the provisions of the Master Plan of HADA area, the provisions of the HADA Development Promotion Regulations, 2003 and of any rules/regulations and Government Orders for the time being in force there under, in respect of premises designed or intended to be applied to such use, are duly fulfilled/complied or provided for.

(e) They shall submit plans, documents and details correctly and represent all the site conditions and comply with all requisitions/queries received from the Competent Authority, HADA in connection with the work under their charge promptly, expeditiously and fully at one-time. They shall immediately intimate to the owners the corrections and other changes they make on the plans and details as per the requisitions/queries from the Competent Authority.

f) They shall clearly indicate on every plan, document and submission, the details of their license number, its validity, and other details such as the Architect, the licenced engineer, structural engineer, landscape architect, etc with date, full name and address below the signature for identification.

(e) They shall provide the information and undertaking for the work undertaken by him/her in the forms prescribed by the Competent Authority, HADA.

(f) When a practising architect/ licensed Technical Personnel ceases to be in the employment for the development work, he/she shall report the fact forthwith to the Competent Authority.

4. LICENCING CRITERIAPART A LICENCING OF OTHER PERSONNEL/FIRMS

I. LICENCING OF DEVELOPER

A)Qualification and Experience

(i) For proprietary firms having similar experience of developing layouts with all amenities and facilities of at least 2 ventures or having experience in town planning projects anywhere in India

(ii) For a firm under the Companies Act having similar experience of developing layouts/townships with all amenities and facilities of at least 2 ventures of 100 acres and above anywhere in India

(iii) For technical staff - possessing technical qualification in Civil Engineering/Structural Engineering/Architecture/Town Planning, including retired technical personnel at Asst. Planning Officer cadre onwards of HUDA/HADA/MCH/ Directorate of Town& Country Planning, other Authorities, etc.

Licencing of Developer shall be given in 4 categories

For Layouts

For Land Pooling Schemes

For Group Housing Schemes and Colony development

Comprehensive licence entitling and covering all the above 3 categories

Provided that two or more developers (with any one who has a valid licence for the said category) may jointly apply for a layout or Land Pooling Scheme or Group Housing Scheme and jointly undertake the same to meet the requirements of such a Scheme as per the HADA Development Promotion Regulations, 2003.

For Land Pooling Schemes:

Has to be done only through Licenced Development Company/Firms

For Licenced Development Companies:

Has to be a registered development firm under the Companies Act in similar development field with full-fledged Office with all support staff like town planning services, architectural and design services, engineering services, other allied technical services with a minimum experience of 5 years with a minimum annual turnover of Rs.5 Crore and above.

For Licenced Development Firms:

Has to be a registered development firm with the Registration Department/ Registrar of firms, with a full-fledged Office with all support staff like architectural services, engineering services, surveyors, etc and having a minimum annual turnover of Rs.50 lakhs and above.

For Layouts:

Through licenced development company/Firms/individual developers mentioned in (iii)

(a) For Licenced Development Company: same as above.

(b) For licenced development Firm: Has to be a registered development firm with the Registration Department/ Registrar of firms, with a full-fledged Office with all support staff like architectural services, engineering services, surveyors, etc and having a minimum annual turnover of Rs.50 lakhs and above.

(c) Licenced technical staff under (iii) above shall have a full-fledged Office and support staff like architecture, engineering services, surveyors, etc.

For Group Housing Schemes:

For Schemes below 1 acre: Requirements same as for Layouts mentioned above. Besides these, a licenced builder is also eligible to undertake such type of Schemes provided he/she conforms to requirements in (c) above.

For Schemes 1 acre and up to 10 acres -Has to be a registered development Firm/Company with the Registration Department /Registrar of Firms/Registered as Company, with full-fledged Office with all support staff like architectural services, engineering services, other allied technical services with a minimum experience of 3 years in similar field and with a minimum annual turnover of Rs.1 Crore and above.

For sites 10 acres and above- same as the requirements of Land Pooling Schemes

Duties and responsibilities

The licenced developer shall be responsible individually and jointly along with the architect, licenced builder, licenced engineer, licenced structural engineer, and site supervisor/clerk of works for making adequate arrangements to ensure not only that the layout development work is executed as per the approved plans. He shall be severally responsible to ensure in case of layout/Land Pooling Scheme/Group Housing Schemes with built units civil constructions with services and amenities are carried out as per specifications and standards , and also are in conformity with the stipulations of the National Building Code for safe and sound construction and non-hazardous functioning of the services incorporated in the development scheme and for making adequate provisions for services and equipment for protection from fire hazards, public safety aspects, disaster mitigation, etc.

The licenced developer shall undertake the total responsibility of the property and its development and of all the assets and liabilities of the property and the project and shall ensure the areas to be left for road right of way/ public open space/ area for HADA/EWS Housing/Common amenities are surrendered to the Competent Authority at the required time.

Licencing Fees:

For Layouts Rs. 5000 for 3 years or part thereof

For Land Pooling Schemes (100 acres & above) Rs 20,000 for 3 years or part thereof

For Group Housing Schemes In sites below 1 acre Rs 10,000 for 3 years or part thereof

In sites 1 acre and above & up to 10 acres Rs. 15,000 for 3 years or part thereof

In sites 10 acres & above Rs. 20,000 for 3 years or part thereof

Comprehensive licence Fee (covering all the above categories) Rs. 25,000 for 3 years or part thereof

In addition to the licence fee, publication charge of Rs. 500 has to be paid

II. LICENSING OF BUILDER:

Experience (General):

For proprietary firms having similar experience of building constructions with all amenities and facilities of at least 2 ventures

For an Engineering /Development Firm registered under the Companies Act having similar experience of building constructions/townships with all amenities and facilities of at least 6 ventures anywhere in India

Licencing of Builder shall be given in 2 categories

For proprietary firms - up to 5 storeyed structures

For Registered Engineering/Development Companies - all types including multi-storeyed structures

Licence Fees:

For proprietary Firms Rs. 10,000 for 3 years or part thereof

For Registered Engineering Companies Rs. 20,000 for 3 years or part thereof

III.REAL ESTATE FIRM/CONSULTANTHas to be a firm registered with the Registrar of Firms with full-fledged Office with all support staff with a minimum experience of 2 years with a minimum annual turnover of Rs.50 lakhs and above.

(A)Scope of work and competence

Sales and transactions of property and for this purpose advertising, employing sales persons, brokers, etc.

Property management

Soliciting and advising on sale/purchase of property

Real Estate Project management

(C)Duties and Responsibilities

(i)While advertising /disposing of plots/lands/properties or soliciting property transactions they shall clearly state the status and category of the approved layout/land Pooling Scheme, their licence number, the details of approval date and number , licence number of the licenced developer together with the permit number and its validity for information of public/prospective buyers.

(ii)They shall guide the property owners/ land owners about the provisions and mandatory requirements of valid HADA approval before undertaking development and disposing the properties and lands for building sites, etc.

(D)Licence Fees

Rs. 3000 for 3 years or part thereof

IV.LICENCED REAL ESTATE VALUER

A)Qualifications and Experience

Diploma in Civil Engineering/Architecture/Planning with atleast one year experience in valuation

Graduate with atleast five years experience in valuation.

(B)Scope of work and competence

Valuation of properties/ buildings/lands/developed sites

Preparation of Estimates

(C)Licence Fees

Rs. 1500 for 3 years or part thereof

PART B- LICENCING OF TECHNICAL PERSONNEL:

V.ARCHITECT

The licencing of architect is optional. In such a case, the license fees shall be similar to that of a licenced engineer.

The minimum qualifications for an architect shall be the qualifications as provided for in the Architects Act, 1972 and shall be registered with the Council Of Architecture.

The services of a registered architect shall be mandatory in respect of all Group Housing Schemes, buildings on plots/sites above 300 sq m. and height above 10 m or 3 floors.

In addition to the Code of Conduct under the said Act, all registered architects practicing in HADA area shall be subject to the duties and responsibilities mentioned in Clause 3 above.

They shall be required to submit a copy of valid Registration Certificate with the Council of Architecture duly attested in all applications for building permissions for which they are associated with.

A)Scope of work and competence

The registered architect shall be competent to carry out the work relate to buildings as given below:

(a) Preparation of all building plans and information connected with building except engineering services

(b) Undertaking supervisions of the building complex and ensuring the construction/ site development are as per approved plans and issuing certificate of supervision and completion of all buildings pertaining to architectural aspects

(c) Preparation of Group Housing Scheme plans and building designs.

B)Duties and Responsibilities

(i) The registered architect shall be responsible individually and jointly along with the licenced builder, licenced engineer, licenced structural engineer, and site supervisor/clerk of works for making adequate arrangements to ensure not only that the building work is executed as per the approved plans but also is in conformity with the stipulations of the National Building Code for ensuring safe and sound construction, environmental safeguards, and non-hazardous functioning of the services incorporated in the building and for making adequate provisions for services and equipment for protection from fire hazards, structural safety aspects, etc.

(ii) To undertake overall supervision of the building Complex/Group Housing Complex/Township and issue certificate of supervisions and completion to the Competent Authority.

(iii)To certify the completion of overall works and site development of the building and submission of Certificate to this effect to the Competent Authority for consideration of issue of Fit-for-Occupation Certificate.

VI.TOWN PLANNER

A) Qualifications and Experience

A Post Graduate degree or Diploma in Town Planning from a recognized institute. In case of bachelor degree in Planning, a minimum experience of 2 years in professional work is essential.

(B)Scope of work and competence

(i)Preparation of Land Pooling Schemes/Township Schemes/ Special Development Projects (except the building design details and its plans) and preparation of all plans and related information connected with development of Land Pooling Schemes/ Township Schemes/ Special Development Projects and undertaking site planning (site zoning and circulation aspects, etc.) for these.

(ii) Preparation of layouts & Group Housing Schemes (except the building design details and its plans)

(iii) Preparation of Draft Project Feasibility reports/ EIA Reports for Township Projects/Special Development Projects, etc

(iv)Issuing Certificate of supervision for development of land of all areas

(C)Duties and Responsibilities

(i)The licenced town planner shall be responsible individually and jointly along with the licenced developer, architect, licenced builder, licenced structural engineer, and site supervisor/clerk of works for making adequate arrangements to ensure not only that the building and development work in the Land Pooling Scheme/Group Housing Scheme/Special Development Project is executed as per the approved plans but also is in conformity with the stipulations of the National Building Code ensuring for safe and sound construction, environmental safeguards, and non-hazardous functioning of the services incorporated in the building and for making adequate provisions for services and equipment for protection from fire hazards, structural safety aspects, etc.

(ii)To undertake overall supervision of the Land Pooling Scheme/Layout/Group Housing Complex/Township and issue certificate of supervisions with regard to site development requirements and completion to the Competent Authority.

(D)Licence Fees

Rs. 1500 for 3 years or part thereof

VII.ENGINEER

A) Qualifications and Experience

A degree in Civil Engineering recognized by or equivalent qualification by AICTE. If a Diploma Holder in Civil Engineer, should have at least 5 years experience in professional work.

(B)Scope of work and competence

(i)Preparation and planning of all types of layouts (except land pooling schemes) and submission drawings and to submit certificate of supervision and completion for all types of layouts/Land Pooling Schemes/Group Housing Schemes and all types of buildings.

(ii)Preparation of building plans for individual residential buildings up to 10 m or 3 floors

(iii)Overall supervision and excavation of construction work, layout /Land Pooling Scheme development work

(C)Duties and Responsibilities

(i)The licenced engineer shall be responsible individually and jointly along with the licenced builder, architect, licenced structural engineer, and site supervisor/clerk of works for making adequate arrangements to ensure not only that the building work is executed as per the approved plans but also is in conformity with the stipulations of the National Building Code for safe and sound construction and non-hazardous functioning of the services incorporated in the building and for making adequate provisions for services and equipment for protection from fire hazards, structural safety aspects, etc.

(ii)Supervisions and excavation of construction work as per specifications and drawings prepared by licenced structural engineer.

(iii) Overall supervisions of the individual elements of the building construction/blocks/Complex and all building services like plumbing, drainage, water supply, electricity facilities, etc. and ensuring that the works are being carried out as per standards and specifications.

(D)Licence Fees

Rs. 1500 for 3 years or part thereof

VIII.STRUCTURAL ENGINEER:

A) Qualifications and Experience

A degree in Civil Engineering recognized by or equivalent qualification by AICTE with a PG degree in structural engineering from a recognized institute. Should have at least 2 years experience in structural design and supervision of building works.

(B)Scope of work and competence

(i)To prepare and submit structural details and reports for-

All types of buildings

Multi-storeyed buildings and special structures

(C)Duties and Responsibilities

(i)The licenced structural engineer shall be responsible individually and jointly along with the licenced builder, licenced engineer, architect, and site supervisor/Clerk of Works for making adequate arrangements to ensure not only that the building work is executed as per the approved plans but also is in conformity with the stipulations of the National Building Code for safe and sound construction and non-hazardous functioning of the services incorporated in the building and for making adequate provisions for services and equipment for protection from fire hazards, structural safety aspects, etc.

(ii)To inspect the works at all important stages and certify that the work being executed is up to the satisfaction of his as well as the licenced engineer.

(iii)To certify the structural safety and overall structural soundness of the building and submission of Certificate to this effect to the Competent Authority

(D)Licence Fees

Rs. 1500 for 3 years or part thereof

IX.LANDSCAPE ARCHITECT

A) Qualification:

A Post Graduate degree or Diploma in Landscape Planning from a recognized institute. In case of degree in Landscape architecture , a minimum experience of 2 years in professional work is essential.

An architect with 2 years experience in landscaping of projects.

A horticulturist with 5 years experience in landscape planning of projects.

(B)Scope of work and competence

(i) Preparation of landscape plans and drawings and related information connected with landscape development of Layouts , Group Housing Schemes and Pooling Schemes

(ii) Preparation of Lake Development Plans and Recreational development plans and all related works of landscaping of lakes foreshores, recreational belts, etc.

(iii) Preparation of EIA for above Projects

(iv) Preparation of Schemes for water Conservation, Water harvesting etc. as part of site planning of large projects

(C)Duties and Responsibilities

(i) To undertake overall supervision of the landscape aspects of the building Complex/Group Housing Complex/Township/Layout/Land Pooling Scheme/ Special development Projects and above mentioned Projects

(ii) To undertake supervisions of Water harvesting structures/water Conservation measures, Greenery measures in layouts/Land Pooling Schemes/Group Housing Schemes, Special Projects, etc.

(D)Licence Fees

Rs. 1500 for 3 years or part thereof

X.CLERK OF WORKS/SITE SUPERVISOR

A) Qualifications and Experience

A degree in Civil Engineering recognized by or equivalent qualification by AICTE or a degree or diploma in Architecture or a degree with specialized training in building construction and technology. If a Diploma Holder in Civil Engineering/ Building Construction Technology/Architecture, should have at least 2 years experience in professional work.

(B)Scope of work and competence

Execution of all framed structure, multi-storeyed structures, public buildings, buildings with basement/cellar, and irrespective of above type of construction/buildings in all building units having built up are of 1000 sq m and above.

(C)Duties and Responsibilities

(i) To adhere strictly to the structural drawing specifications and written instructions of the licenced structural engineer/licenced engineer/architect.

(ii) To follow the standards and specifications with regard to materials, components, quality control during the process of construction.

(iii) To provide for safety of workers and others during excavation, construction and erection.

(iv) To provide safe and adequate temporary structure required for construction and erection.

(v) To bring to the notice of the licence engineer/licenced structural engineer any situation or circumstances which in his opinion are liable to endanger the safety of the structure.

(vi) He shall be in charge

(D)Licence Fees

Rs. 1500 for 3 years or part thereof

XI. SURVEYOR.

Qualifications : (i) diploma in Civil Engineering/Architecture with two years experience

(ii) draftsman in Civil Engineering/Architecture from I.T.I. with five years experience under architect /engineer.

Competence:

(i) Carry out survey of any land or site for building purpose/layout purpose/ Group Housing Scheme/ Land Pooling Scheme and preparation of Surveyed Plans

(ii) certificate of supervision of layouts/Land Pooling Schemes

(D)Licence Fees

Rs. 1500 for 3 years or part thereof

XII. PLANNING CONSULTANT:

(A) Requirements:

Has to be a firm registered with the Registrar of Firms/Companies. The principal personnel need to be urban planners who are technically qualified in the field of urban planning/urban design/urban infrastructure/urban management/ housing/ transportation/ urban analysis/ financial analysis, etc. The firm has to have done at least two projects in the above related field.

(B) Competence:

Area Planning, preparation of Draft Project Reports for Township Schemes or any other related urban projects/Schemes; EIA Reports/ Preparation of Planning Policy guidelines and briefs/ Project costing and analysis/ Transportation Plans/ Studies relating to urban development/ urban environmental projects/ heritage conservation projects, urban design projects, and any development projects assigned by HADA, etc.

Preparation of Land Pooling Schemes, layouts and circulation plans.

(C)Licence Fees

Rs. 1500 for 3 years or part thereof

XIII. DEVELOPMENT MANAGEMENT CONSULTANT:

(A) Requirements& Competence:

Has to be a firm registered with the Registrar of Firms/Companies. The principal personnel need to be a team of architect planners and engineer planners who are technically qualified in the field of urban infrastructure development projects with management experts, financial experts and other personnel capable of undertaking area level development projects/infrastructure development projects and execution of any urban development related projects which may be assigned by hada . The firm has to have done at least two projects in the above related field. (C)Licence Fees

Rs. 1500 for 3 years or part thereof

5. RATING AND ACCREDITATION OF LICENCED DEVELOPERS, BUILDERS & REAL ESTATE FIRMS

Those Licenced developers, builders and Real Estate Firms who are desirous of the accreditation and rating shall have to apply in the prescribed Form and remit a fee of Rs. 1000 per application.

The HADA may constitute an Accreditation and Rating Committee with the following members:

(i)Vice-Chairman, HADA

(ii)Chief Engineer, HADA

(iii) Chief Planning Officer, HADA

(iv) An urban management expert to be appointed by the HADA Board

(v) An architect to be appointed by the HADA Board

(vi) A town planner to be appointed by the HADA Board

The Accreditation and Rating Committee shall prepare the guidelines, parameters for giving the accreditation and rating. The Accreditation and rating shall be valid for one year.

The accreditation and rating in the first instance, shall be considered after 3 years of license and at least 3 ventures/Projects are completed by the Licenced developers, builders and Real Estate Firms.

6. Publication of Directory:

A Directory on Licenced Technical and other personnel would be brought out by the end of January and updated every year. For this Publication Charges of Rs. 500 /- per licencee would be charged at the time of applying for licence. VICE CHAIRMAN, HADA
