SPCA awarded custody of animals at Friday hearing By Betsy Blevins Managing Editor After nearly six grueling hours of testimony last Friday, the SPCA was awarded custody of the 75 animals seized from a Leonard property two weeks ago. Judge Alan Hale presided over the hearing, with Fannin County District Attorney Richard Glaser representing the state and Defendant James “Soaring Eagle” Vonda appearing pro-se. Testimony began with Glaser calling an assortment of witnesses to the stand - Investigator Amos Bryan with the Fannin County Sheriff’s Office, Investigator Christopher West with the Society of Prevention for Cruelty to Animals (SCPA), Tim Rawlings with the City of Ferris and Chief Investigator Colby Grady with the SPCA. Investigators Bryan and West were questioned first and both gave similar accounts as to the condition of the property when they arrived and what they saw and smelled. Vonda probed both men to see if either had smelled Odaban - trying to insinuate that the smell in the home could be from the deodorizer, not animal urine. West, however, had smelled the product and testified that the odor in the home did not smell like Odaban - but like animal urine. West also testified that he felt an urgency to do something with the animals. “I felt there was an immediate need to remove the animals,” he stated under oath. Bryan assisted with paperwork to make the seizure happen. West had previous knowledge of Vonda through a complaint at a shelter in the City of Ferris shelter, which was managed by DARESS, Vonda’s animal rescue organization. At the time of the complaint, it had been closed satisfactorily. When Vonda asked West to rate his property in comparison to other properties where seizures have occurred, West gave the property a 4-5, with 1 being the worst. Rawlings works for the City of Ferris as their Supervisor over Animal Control and previously worked with Vonda due to the contract between the City of Ferris and DARESS, Vonda’s organiziation. He testified Friday that after the animals had been seized from the Leonard location, he visited the SPCA in McKinney and positively identified 18 animals that had previously been at the Ferris shelter. After the animals went missing from Ferris, Vonda told authorities there that they had been taken to an Indian Reservation in Oklahoma and were in good condition. “Had the condition of the animals improved or worsened since you saw them last at the Ferris shelter?” asked Glaser. “Some were the same, some were severely underweight. Several had ribs and hips showing - that was not the case in Ferris,” Rawlings replied. The animals were transferred from the Ferris shelter around April 20. Grady, who oversees the rescue and investigations divisions for the SPCA, showed the court the documentation that is made on each seizure case, and the book of records for the seizure on Flanagan Road was entered into evidence as State Exhibit 1. Included in the record book was a statement by Dr. Ashley - the SPCA veterinarian who evaluated the animals once they had been seized. “Overall, these animals were getting minimal care for a rescue/shelter facility,” she stated. Grady reported that the SPCA was seeking custody of all of the animals, and restitution as well. “The cost for the seizure - vet care, anyone helping, fuel, vehicles, staff - was approximately $19,475.85, and we are seeking that in restitution,” Grady stated. Additionally, should Vonda file an appeal on the decision of the court, the SPCA would seek an additional $36,250 in restitution to cover the costs of caring for the animals during the 25-day appeal process. The SPCA also requested that the appeal bond be set at double the maintenance cost of $36,250 - which would be $72,500. The bond money would have to be paid in cash should Vonda file an appeal. Total additional costs should an appeal be filed would be $108,750. Testifying on Vonda’s behalf were his “volunteers” Colisa Vavrecka, Jessie Taylor, Yolanda Duke and Cody Sims. Out of those four, Duke was the only person carrying any type of certification to work with animals - and that was merely for dog grooming - and was the only one to work with animals previously aside from owning one. She had taught obedience classes previously as well. Vonda’s witnesses maintain that the disarray of the home was due to the move they were preparing to make to New Mexico and that the animals were thin due to the stress from the recent move from the Ferris shelter. When questioned further about the location in New Mexico, Sims reported that it was 20 acres, but there were no facilities to house the animals currently - he planned to build those once they arrived. Duke testified that she was in charge of the maintenance of the animals and was surprised when Glaser reported the veterinarians findings of 12 animals with heart worm and 52 with hookworm, whip or roundworm. Glaser also questioned whether the animals had the veterinarian certificate and rabies shots, as required for state-to-state transport - and Duke reported that they had not yet, but were reportedly going to take care of the shots the Saturday after they were seized. Glaser also entered Sims’ and Duke’s statements that they made at the time of the seizure as State’s Exhibits 2 and 3. Glaser firmly reminded each of them that leaving the state of Texas while criminal charges are pending against them is a crime itself. Sims and Duke reported that they understood. All of those with criminal charges pending were reminded at the beginning of the hearing that anything they said during the course of hearing “can and will be used against you.” After Sims’ witness, Judge Hale stated, “I see nothing that’s going to be accomplished if we continue,” and asked for the forfeiture order. Melinda Pappa, who was sworn in as a witness for Vonda, but never got the chance to testify, exclaimed, “Please!” as she realized things were not moving in their direction. Judge Hale rapped his gavel and stated, “Ma'am, I’ve listened to this all day. It’s my turn.” The Judge had used the gavel a few other times throughout the proceedings due to other minor outbursts from Vonda’s camp and to remind the Defendant that he was there to simply ask questions - not make comments, which he did consistently, and to keep him on track with proper lines of questioning. Judge Hale completed the hearing by signing the paperwork assigning SPCA custody of the animals and awarding the restitution amounts as requested by the SPCA. “I believe whole-heartedly that you became overwhelmed and it got too much for you,” Judge Hale said to Vonda. After the court adjourned, Ann Barnes, Senior Vice- President of Operations with the SPCA, stated, “We are happy with the outcome. We know where the dogs are going to be kept and how they are going to be cared for.” Graduation this Friday for Leonard seniors Ava Barlow staff photo The Leonard High School Class of 2010 will participate in commencement exercises this Friday, June 4, at 8 p.m. on Tiger Field. coke PartY for Miss JiMMie craBB

A Coke party at the home of Miss Jane Stapp Friday, May 27, honored Miss Jimmie Sue Crab, bride-elect

of George Alexander of Wolfe City. Co-hostesses were Mrs. Jerry Moats and Mrs. Pat Bowen. Guests were girl members of the 1959 graduating class of Leonard High School.

Note:

Mrs. Opal Hull returned Tuesday to employment at Leonard National Bank after an illness of a week at Risesr Hospital in Bonham.

A 35-year-old Leonard •woman and a 22-year-old Leonard woman contacted police on May 24 at 12:10 a.m. to report a harassment and terroristic threat incident. Reports show that the 16-year-old brother of the 22-year-old woman was sending threatening text messages to the other woman’s cell phone, allegedly stating he was going to beat the two women up and take the baby belonging to the 22-year-old. The officer contacted the father of the suspect and he advised he would take care of the problem.

An officer was contacted •by a resident on May 25 at 11:32 a.m. advising that they heard what they believed to be gunshots. The officer located an off-duty officer who lived in the area and advised that an animal had gotten into a transformer nearby and made it blow. The officer notified the electric company of the problem.

A resident on Houston •Street contacted police on May 26 at 4:30 p.m. after discovering that his residence had been burglarized. The man told officers that he was away from his home for the weekend and when he returned, he found several things missing from his residence and the back door had been forcibly opened. The complainant implicated several people who could be responsible. Missing were a Sony car stereo, two Kenwood speakers, 1 Panasonic video recorder and 30 Play Station video games - estimated to be worth approximately $3,000 total.

An officer on routine •patrol observed a vehicle

parked at a convenience store after hours on May 26. The vehicle was found to be unoccupied and registered to a man residing on Mulberry Street. The vehicle was gone the following afternoon.

Officers responded to •a major vehicle accident on May 28 at 3:18 p.m. at the intersection of U.S. Highway 69 and Houston Street. See related photo on this page for incident details.

A Leonard officer assisted •Trenton Police Department with serving arrest warrants at an address on 2nd Street in Trenton. The arrest was made without incident.

While on patrol, an •officer was dispatched to an apartment on Pecan Street after a disturbance and alleged burglary had occurred. Reports show that a 21-year-old resident went to the apartment of a 23-year-old resident, demanding to speak to a man who was believed to be at the apartment. An altercation reportedly broke out between the two women that involved shouting and pulling hair. As the 21-year-old was leaving, the apartment tenant noticed her camera was missing and called police. When she went outside to tell the suspect that she had called police, the woman reportedly tossed the camera out the window, causing damage. The complainant found her batteries and memory card were missing from the camera. When police interviewed the suspect, her story about the altercation was similar to the complainant’s, except she did not mention taking the camera.

An officer was dispatched •

to a major accident on FM 896 on May 29 at 12:48 a.m. Reports show that when the officer arrived on scene he observed a vehicle turned upside down on the east side of the road, just south of County Road 4680. All four occupants - a 23-year-old Leonard man, 16-year-old Bonham man, 19-year-old Bonham woman and 23-year-old Bailey man - were injured and needed medical attention. Two were taken by air ambulance from the LHS baseball field to Parkland Hospital and two were taken to Red River Regional Hospital by ambulance - with one of those later being flown to Parkland as well. The occupant not flown from Red River Regional Hospital was treated and released.

Whitewright Police •Department requested a Leonard officer’s assistance on May 29 at 8:40 p.m. after a shooting had reportedly taken place in their city, and the victim was a Leonard resident. The officer requested for Leonard to be on the look-out for the victim’s vehicle. That vehicle was located at the victim’s residence on College Street and he was found to be okay.

A Leonard woman •contacted police on May 30 at 1:30 p.m. after discovering that a water hose and reel belonging to her mother had been taken during the night.

Officers were dispatched •to a location on Houston Street on May 31 at 7 a.m. after a reported disturbance involving the same individuals from the May 24 terroristic threat/harassment report.

Major accident on 69 last Friday

Ava Barlow staff photoLeonard Police Department, Leonard VFD First Responders, Trenton Police Department and Bonham Fire Department EMS responded to this major accident at the intersection of U.S. Highway 69 and Houston Street in Leonard last Friday, May 28, at 3:15 p.m. Reports show that a 2001 green Hyundai Elantra traveling northbound on Highway 69 and a 2004 Honda Shadow motorcycle traveling southbound on Highway 69 collided as the Elantra attempted to turn onto Houston Street. The driver of the motorcycle was transported to an area hospital.

Responding to the President’s announcement to send 1,200 National Guard troops to the border to enhance border protection, Rep. Ralph Hall (TX/4) noted that the President’s action represents a “fraction of what is needed” to help secure the U.S. – Mexico border and help bring stability to the region.

“I have been a longtime advocate of deploying our National Guard troops to secure our border. This is long overdue, and I urge the President to commit to

deploying as many troops as needed to stabilize this area,” Hall said. “This is a first step in developing a strategy of border protection that will work.” To that end, today Hall signed a letter to the President along with members of the Texas Congressional Delegation. Excerpts from the letter follow. We write to you as members of the Texas delegation about an issue that is extremely important to the safety and security of our state. As you know, violence on the U.S./Mexico border has been increasing in both severity and scope. This increase in violence has put Americans in danger. Our Border Patrol are overwhelmed and under constant attack. Last year

alone, there were 1,073 assaults against Border Patrol agents on the border. While we welcome your announcement that you plan to send 1,200 National Guard troops to the border and spend $500 million for “enhanced border protection and law enforcement,” we have serious concerns that 1,200 troops will not be enough to cover the 1,969 mile long U.S.-Mexico border. While this announcement is a step in the right direction, we feel it is insufficient to deal with the severity of the threat we currently face on our border. With such a small number of additional troops, we believe that it is imperative that these troops be sent to the most violent areas of the border, many of which are in Texas... [We]strongly believe that any additional troops that are sent to the border should not be delegated to a support role, and should be deployed to the actual border. These troops should be armed, given clear rules of engagement, and be able to defend themselves if fired upon. Controlling the U.S.-Mexico border is going to take a significant long-term sustained effort. While any help is welcome, we feel that 1,200 additional troops are not significant enough of a number to provide the safety and security that our constituents in Texas demand.

Hall calls for more troops on the border5-29-10: Deputy Meuller •

responded to the Multi-Purpose Complex located on SH 56 regarding the location of a possible stolen firearm. Deputy Mueller met with the complainant who told him that he had seen a pistol for sale at the gun show that was being held at the Multi-Purpose Complex that he had reported stolen in November 2009. The complainant told the responding deputy that he saw a .22 caliber handgun that he thought was his located at one of the vendor booths. At this point the complainant left the show and went home to retrieve the serial number he had recorded prior to the pistol having been stolen. The complainant returned to the same vendor booth

and compared the serial number and verified that this pistol was his. The vendor contacted his employer in Greenville, advised him of the circumstances. A property receipt was given to the vendor and the pistol returned to the owner of the weapon. Case is under investigation.

05-30-10: Deputy •Watson was dispatched to a location on SH Hwy 78 regarding an assault in progress. When the deputy arrived at the location the alleged suspect was gone. The complainant told the deputy that his brother had hit him in the face with his fist. According to the assault victim he and his brother had been arguing about their mother’s car. The victim

refused any assistance and told the responding deputy that he only called 911 so his brother would not bother any of the other family members who were at the residence. The victim refused to provide the deputy with a written statement.

05-31-10: Deputy •Williams met with a complainant at the Sheriff’s Office regarding a burglary report. The complainant told Deputy Williams there had been three individuals at her residence earlier in the day and after they left she found that her iPod was missing. Two of the individuals she knew, but was not able to provide the name of the 3rd party. Case is under investigation.

will not be closed until after the Memorial Day holiday. The contract is anticipated to be complete by August 31, 2010. The traveling public is requested to observe signs and to be aware of lane closures and potential temporary detours. Caution and reduced speed is imperative when approaching these work zones due to the magnitude of the volume of traffic. Please remember that it is against the law to cut across on to unpaved surfaces and that traffic fines double in work zones when workers are present.

The First Baptist Church of Bailey has some exciting changes underway. Although a small church, they understand how to make a big difference, and with that idea in mind they have adopted a sister church in Kenya, Africa. The sister church is in an extremely rural area of Kenya where poverty is extreme. Last week, the first shipment of support was sent to them. FBC Bailey is committed to being a good steward with what they have been given. The Sunday School material that is quickly discarded here in the states will get new life in Kenya. The church is sending Sunday School quarterlies, pastor study guides and more. Next week some of the leadership of FBC Bailey will be attending a special program - a Pastor's Institute at the

Billy Graham Training Center in Asheville, N.C. Although this intensive training session is only a day long, the impact should be wonderful. Chip Ingram will be the primary instructor for this event. FBC Bailey has established a relationship with the Billy Graham organization and will be attending more special events and educational events at the Billy Graham Training Center and Billy Graham Library in the future. The First Baptist Church of Bailey has a history of service since 1888. As FBC continues to grow and develop the community can expect the level of dedication to service and the level of training for the leadership will likewise continue to grow.

Boost Your Savings and Investments during “Empty Nest” Years

You’ve finished paying your children’s college bills. Maybe you’ve even paid off your mortgage. So now that you’re in your “empty nest” years, you don’t have to worry about where the money is going, right? In reality, you may be caring for aging parents and possibly even dealing with “boomerang” kids returning home. Nonetheless, at this stage of your life, you need to focus your efforts on saving and investing for the retirement lifestyle you’ve envisioned. If you’re concerned about whether you’ll be able to afford retirement, you aren’t alone. Consider the following figures from the 2009 Retirement Confidence Survey, published by the Employee Benefit Research Institute: • Just 13% of theworkers surveyed said they are very confident about having enough money for a comfortable retirement. This represents the lowest level since the Retirement

Confidence Survey began in 1993. • Seventy-two percentof workers — up from 66%in 2007 - are planning to supplement their income in retirement by working for pay. These figures are probably driven, in part, by the recent recession, but they also reflect a general uneasiness among workers about how well they’ve saved and invested for retirement. As you know, it’s not easy to save for retirement and pay for your kids’ college and make your mortgage payments. Like many people, you might have just done the best you could for all these years. But if you’ve finished paying off some major expenses, you might have more chances to boost your retirement savings. Here are a few suggestions: • I nc r ea se you rcontributions to your employer-sponsored retirement plan. In 2010, you can put up to $16,500 into your 401(k),

403(b) or 457(b) plan, or $22,000 if you’re 50 or older. Your contributions are typically made with pretax dollars, so the more you contribute, the lower your taxable income. Plus, your earnings can grow on a tax-deferred basis. • Increase your IRAcontributions. Even if you have a 401(k) or other employer-sponsored retirement plan, you may still be eligible to contribute to a traditional or Roth IRA. In 2010, you can put $5,000 into an IRA, or $6,000 if you’re 60 or older. A traditional IRA grows tax deferred, while a Roth IRA can grow tax free, provided you’ve held your account at least five years and you don’t start taking withdrawals until you’re age 59½. • Rebalance yourinves tment por t fo l io . Maintaining the right mix of investments can be a balancing act. On one hand, you’ll need to own a reasonable percentage of growth-oriented vehicles

to potentially boost your retirement savings. On the other hand, if you are within, say, five years of retirement, you may also want to reduce the effects of volatility on your portfolio, which means you’ll need some income-producing investments that carry a relatively lower level of investment risk. There’s no magic formula for achieving the correct balance, so you’ll want to work with a professional financial advisor — someone who knows your goals, risk tolerance and time horizon, and who has the expertise and experience necessary to help you make the right choices. Becoming an empty nester may provide you with opportunities to do things you haven’t done before — such as concentrate your resources on building the type of retirement you deserve. Members of Terry Phifer's Life Science class at Leonard High School got a "life lesson" the last

few weeks of school in growing and hatching chicken eggs. The class had forty fertilized

eggs donated by a student's family, which they allowed to sit in an incubator for forty days. During this time many students "adopted"

certain eggs and named them and watched them "cook." The first egg hatched on the 38th day

and the hatching process continued for a 48-hour period. Out of the forty eggs donated, 27 hatched.

Top left, eggs that have not hatched yet remain in the incubator. Top right, newly-hatched chicks

socialize among each other under a heat lamp. At left, Travis Gilbert, T. R. Hodnett, Zackary

Martin, Marissa Bearden, and Tammy Siciliano show off the chicks that hatched.

On Monday, May 24, the Texas Business Women of Bonham, Fannin County, Texas (TBW) formerly known as BPW, welcomed their speaker, Bonham State Park Manager Lee Ellis. Ellis gave a descriptive presentation of how the Bonham State Park is a huge tourist attraction for the area. The 261-acre park contains a beautiful and tranquil 65-acre lake which provides the perfect setting for camping, picnicking, mountain biking, boating, canoe rentals and a newly sanded beach for swimming. This scenic lake offers largemouth bass, channel catfish, crappie, bluegill and there is not a requirement to purchase a fishing license to fish at the lake in Bonham State Park. Additionally, Ellis

educated everyone on GeoCaching, which is a technologically advanced treasure hunting game for adventure seekers equipped with GPS devices that people all over the world play. The park has 13 GeoCaches throughout and the public is invited to play by logging in at http://www.geocaching.com The park facilities include restrooms with and without showers; picnic sites, campsites with water and electricity; a group camp with barracks and a dining hall, which accommodates approximately 94 people (the facility is only rented as a single unit, not separately). For more information on cost of group camping, campsites, canoe rentals etc. call 903-

583-5022. Texas Business Women of Bonham, Fannin County, Texas would like to invite anyone interested in becoming a member to attend their monthly meetings held the 2nd and 4th Monday of each month at the American Bank of Bonham, Elizabeth May Room from 12 noon to 1 p.m. For more information about joining, you may contact Tammy Rich, TBW President Elect at 903-583-7486, Monday through Friday. Build a legacy for future generations; discover leadership potential; exercise non-partisan political clout; develop a personal image; network with movers and shakers; and strengthen marketable skills. This is what the TBW is about.

Master Gardeners explain the growth of Ferns in

TexasSubmitted by Barbara Wilson, Fannin Master Gardener

Ever wondered what makes ferns different from other plants? And just what are Lycophytes any way? The Texas species thrive in some of the most extreme conditions—in crevices on huge exposed granite outcrops, underwater on the bottoms of ponds or lakes, in deserts, and in cave entrances. One Texas species has leaves reaching nearly 13 feet in length. Another is a tiny floating aquatic often less than ½ inch in total size. Many Texas species occur nowhere else in the entire United States. For those familiar with grasses and wildflowers this program will explore a whole different flora of Texas, examine surprising aspects of ferns and lycophyes, and explain why Texas is such a special place for these ancient groups of plants. Dr. Diggs, a professor of Biology at Austin College in Sherman, will discuss the plants that are the focus of his upcoming book titled Ferns and Lycophytes of Texas (co-authored with Barney Lipscomb). He is also co-author of the Illustrated Flora of North Central Texas and Illustrated Flora of EastTexas. George M. Diggs, Jr. received his Ph.D. from the University of Wisconsin-Madison in 1981. He has been a faculty member in the Biology Department of Austin College, Sherman since 1981. His research interests include the plants of Texas, the taxonomy of the Ericaceae (Blueberry Family), evolution as it relates to human health, and biogeography. In his research he has traveled to all seven continents. He co-authored the Illustrated Flora of North Central Texas (1999) and the Illustrated Flora of East Texas (2006) and is currently writing a book on the ferns of Texas. Diggs has taken numerous groups of undergraduates on tropical natural history field courses to Latin America and Africa in an effort to increase knowledge of tropical ecosystems and to raise awareness of current ecological problems. He is active in Austin College’s Center for Environmental Studies. Dr. Diggs will be the speaker at the Fannin County Master Gardener’s meeting on June 7, 2010. Our new meeting place is at the First Presbyterian Church in the Williams Building located at the corner of Center and 9th Street. For more information please call 903-583-7453.

Dedication of Fannin County Court at Law next Wednesday

A dedication ceremony and Open House for the new Fannin County Court at Law will be held next Wednesday, June 9, at 10 a.m. in the Fannin County

South Annex Courthouse in Bonham. All area residents are invited to attend this historical event.

Memorial Day celebrated at Gates Cemetery Gates Hill Cemetery conducted a Memorial Celebration Monday, May 31, 2010 at 11 a.m. The Honor Guard, Chaplain David Jones, O.H. Hubbard and Claude Wilson presented and held

a salute while the attendees sang the Star Spangled Banner. Mr. Palmer Rayford gave the invocation. Bonham City Manager, Corby Alexander extended his appreciation to the curators

of the Gates Hill Cemetery as well as to those in attendance who chose to honor our military for their dedication and for many who gave the ultimate sacrifice. Mayor Roy Floyd also extended his gratitude to those who worked so hard to prepare Gates Hill Cemetery and keep it in beautiful condition and to those in attendance. Rev. Cecil Jones read from the 23rd Psalms and then read the roll call of those lives that had been lost in service to our great country. David Coleman then presented Certificates of Appreciation and gift certificates from Shumardii’s Steakhouse to Daryl Hall, Lisa Ayers and Deborah Roberts for their tireless efforts in service to the Gates Hills Cemetery. A warm reception was held afterwards with hot dogs, chips, cold soda and old friends. It was a blessed time of sharing and kindling of new friendships.

The George Blakey Chapter Daughters of the American Revolution May meeting was held at Parker Place Lodge in Bonham. The Citizen of the Year Award was presented to Vikki Coronado. Thursday evening, June 10 at 7 pm, Fannin County residents will have a tremendous treat when the GCC Jazz Combo comes to town. Led by the GCC Music Program Director, James Dering, the GCC Jazz Combo is one of the premier jazz groups in the area. Expect to enjoy a cross-section of jazz, from jazz standards to contemporary pieces, with an emphasis on improvisation, including Swing, Bebop, Blues, Latin, Funk, and Ballads. The Jazz Combo includes horns, vocalists, keyboard, bass, guitar, and drums. The GCC Jazz Combo began in the fall of 2007 with just one bass player in the group. Three years later, it’s a high quality, sought after ensemble. Dering, a professional jazz pianist, studied jazz under Ellis Marsalis and played for several years in the French Quarter of New Orleans. He has merged his jazz insights with the continued development of a strong classical program at the

college, to the benefit of music majors and hobbyists alike. The mention of GCC Music is turning heads more and more these days, with the recent construction of their new facilities, including a recording studio, keyboard and computer lab, choir room, band hall, and twelve practice rooms. The program continues to grow, with new classes and new faces appearing frequently. Those interested in learning more can visit www.grayson.edu/music, or contact Dering at [email protected]. Music in the Garden will close the 2010 concert series Thursday night, June 17, with the high energy Gospel and Contemporary Christian music group from Sherman, X-alt, from Faith Church. Complimentary lemonade and cookies will be served. A $5 family donation or $2 individual donation at the gate is appreciated. The CAC is located at 200 W Fifth Street, Bonham. For more information, call 903-640-2196.
