Newsletter 2014-49 December 5, 2014 LEGISLATORS TO CAUCUS SUNDAY; STATE’S PREVAILING WAGE POSSIBLE SUBJECT OF DEBATE The West Virginia Senate and House of Delegates are to caucus Sunday, December 7, which will give a clearer picture to the future landscape of the West Virginia Legislature. The Republicans now control both houses after the November 4 election that saw the defeat of many Democrat senators and delegates. The presumptive leaders are Bill Cole, R-Mercer, Senate President, and Tim Armstead, R-Kanawha, Speaker of the House. Both veteran legislators have vowed to organize the committees and staff quickly so that legislation can be addressed early in the 60-day session. Judicial reform, burdensome bureaucracy and the state’s tax structure have been identified as issues the new Republican leadership wants to tackle quickly. Another issue that has received a lot of media coverage is the state’s prevailing wage law. Various legislators have publicly stated the state’s prevailing wage rate is too high and should be cut, if not completely repealed. Arguments have been made that the current wages are too high not truly prevailing and this adds to the cost of government construction contracts. One legislator has noted that billions could be saved on highway projects and the savings can be made available for additional highway construction and maintenance projects. However, most WVDOH projects have some federal funding and the federal Davis-Bacon rules would apply. Others have noted more schools could be constructed if the prevailing wage requirement was eliminated. Many CAWV members, union and non-union, have called the association office expressing concern over the outright repeal of the current law. Opinions expressed include, in no particular order: Members have noted that most of their employees do not work 2,000 hours in a year. Many construction workers are compensated on a 1,000 to 1,300 hour work year. If the wage rate is cut, would the industry continue to attract better-skilled, more productive workers into the construction industry? If wages are reduced, funding for the state’s sales tax, workers’ compensation premiums, and health care premiums would all be reduced. Others have noted that the majority of the project cost is materials. If labor is only a portion of the contract amount, and the wage rates are reduced, would there be any appreciable savings to the project? CAWV highway and bridge contractor members have expressed concern over having to compete against out of state contractors who may hire low-skilled labor, fudge their payroll taxes, take short cuts in safety requirements or other actions. Would this tilt the level playing field by making existing construction companies abiding by state and federal laws unable to compete against such contractors? CAWV Dan Flesher is going to host a conference call and ask all members who have an interest in this proposed legislation to participate. The CAWV will be called upon to weigh in on this issue and President Flesher would like to have members’ comments and recommendations. Some suggestions including raising the current $25,000 threshold before prevailing wage rates apply and looking at how the WV Division of Labor calculates the prevailing wage. A notice of the time and date for the conference call will be sent to members shortly.

SPRP/SPCC DEADLINE AND SUBMISSION INFORMATION The submission date for spill prevention response plans (SPRP) was Wednesday, Dec. 3. This applies also to submission of spill prevention control and countermeasure (SPSS) plans for each registered aboveground storage tank in accordance with the Aboveground Storage Tank (AST) Act and the interpretive rule. For AST owners with the capability to do so, you are instructed by the DEP to submit your SPRP or SPCC plan to the DEP electronically through the Electronic Submission System used to register tanks. If you have the capability to scan and submit your plan(s) electronically, please do so. For those AST owners without the current capability to scan and file your SPRP or SPCC plan electronically, the DEP has agreed to accept physical copies of plan(s). The WVDEP asks that Ruth Porter be contacted at (304) 926-0499 (ext. 1007) to advise the DEP of mail or hand delivered copies of the SPRP or SPCC. The DEP is required to review the plans submitted for compliance and may request additional information if the plan submitted is not adequate. This procedure should assure that any plan deficiencies are reported by the DEP to the AST owner or operator thereby providing an opportunity to remedy any deficiencies so noted. AGC SURVEY MEMBERS ON ANNUAL OUTLOOK Each year around this time, AGC asks its members to predict what next year will be like for their business. Questions focus on expectations for market performance, hiring, labor market conditions, plans to acquire equipment, etc. Please take a moment to complete the survey here. The AGC will spend the better part of December asking members to complete the survey. After completion, AGC’s chief economist Ken Simonson will analyze the results, which will be released in early January to the media and members. As in the past, the AGC will also prepare state-specific outlooks for every state where we have a sufficiently robust response. at 10:00 a.m. at the CAWV Headquarters. The joint committee meeting is designed to bring ideas forward to promote the CAWV and develop ways to better recruit and retain members. Committee members will discuss the new CAWV license plates as well as ways to recruit new members. Committee members will evaluate the effectiveness of past strategies and discuss the association’s upcoming promotional efforts. Membership Committee members have been involved with the Public Relations Committee in helping plan and develop these initiatives. All Membership and Public Relations Committee members are encouraged to attend. CONTRACTORS “CAN” HELP THIS HOLIDAY SEASON Monday, December 15, radio station WQBE, in conjunction with Kroger and other partners, will be launching the annual WQBE/Kroger Food Drive to help eradicate hunger this holiday season. The Union Mission has a goal to collect 10,000 food boxes for as many as 40,000 needy people ahead of the Christmas holiday. Food will be collected through Friday, December 19, at area Kroger Stores and at the parking lot of the Dunbar Kroger. The food collected will be distributed by Union Mission on Saturday, December 20, as they stage a massive food distribution across 38 outreach sites in 19 counties. Food boxes with enough food to last several days will be handed out to families at a time when thousands of West Virginians are struggling. In previous years, long-time supporter Fred Clark, IVS Group, Inc. has helped raise hundreds of thousands of pounds of potatoes. This year, Fred’s challenge to area businesses and CAWV members is to help collect 10,000 ten pound bags of potatoes to help with the holiday food distribution. HOUSE SENDS ONE-YEAR EXTENSION OF EXPIRED POLICIES TO SENATE On Wednesday, the House approved H.R. 5771, the “Tax Increase Prevention Act of 2014,” by a 378 – 46 vote. The $41.6 billion tax extenders legislation restored approximately 52 expired tax provisions for fiscal year 2014, including nine AGC tax priorities (i.e. 179 expensing, bonus depreciation, R&D). The Senate is expected to address the bill by the middle of next week. Opposition from the White House and Democratic Senators dashed the prospect of a two-year plan in late November, which led House Republican leadership to the vote on the one-year package. On Nov. 19, AGC sent a letter to members of Congress laying out the provisions critical to the construction industry. AGC will continue to press for permanency of the provisions during the tax debate in the coming months of the new 114th Congress. Learn the locations of fire extinguishers and first aid kits, and make sure you know how to use them. Learn and understand emergency procedures and evacuation routes for the jobsite. Be prepared for the unexpected and media coverage. Do not let a situation get worst by not being trained in how to effectively communicate with the press and the public. HIGHWAY GAS TAX REVENUES DOWN THROUGH FIVE MONTHS OF FISCAL YEAR State road revenues from July through November total $294.4 million, or 7.82 percent above the governor’s estimate of $273 million. However, collections for the first five months of the fiscal year are down about 1 percent from FY2014 actual collections. Through November 2014, the State Road Fund had received $296.2 million. Motor Fuel Tax collections total $170 million for the first five months of the state’s fiscal year, which is 6.22 percent above the governor’s estimate of $160 million. A disturbing point is that Motor Fuel revenues are $8.3 million, or about 5 percent less than last year’s actual revenues. The Privilege Tax generated $87.6 million, 13 percent more than the governor’s estimate of $77.6 million and about $3 million ahead of last year’s total. Registration fees also are above the governor’s estimates. Through November 30, registration fees totaled $38.3 million or 4.6 percent over the estimate of $34.7 million and $3.6 million above FY2014 actual collections. The wholesale gas tax will decrease 1.1 cents per gallon January 2, 2015 which will result in about $15 million less gas tax revenue next year. See article below for details. WHOLESALE GAS TAX DROPS 1.1 CENTS JANUARY 1 The gas tax for conventional motor fuels, which includes gasoline, kerosene and diesel, will decrease by 1.1 cents on Jan. 1, according to an administrative notice the department released Tuesday. The decrease will cost the WV Divisions of Highways $15 million. Conversely, the annual savings to the average motorist is only $9. The state and federal government charge per-gallon taxes on fuel, which in turn generates revenue for state and federal highway funds. The state Tax Department is required by law to recalculate the average wholesale price of fuel in the state each year. As a result of this year’s recalculation, consumers in West Virginia will go from paying 35.7 cents per gallon to 34.6 cents next year. In addition, officials determined the new state average wholesale price was $2.819 per gallon. Last year it was $3.049 per gallon. The motor fuel tax is composed of a flat rate of $0.205 per gallon plus a variable component of 5 percent for the average wholesale price of fuel. The state’s variable component for 2015 is 14.1 cents per gallon, a decrease compared to last year’s 15.2 cents per gallon. The decrease will save West Virginia drivers $15.7 million in 2015 compared to what they paid this year, says Deputy Revenue Secretary Mark Muchow. “That’s good news to consumers, but a bit of a reduction to the state’s road fund,” he said. The state’s road fund collections are estimated to be $701 million this fiscal year, with $431 million deriving from the motor fuel tax. Muchow said the reduction in motor fuel tax will net an annual savings of nearly $9 for someone who drives 20,000 miles each year in a car that gets 25 mpg.

DITCHES, STORMWATER BMPS AND POTHOLES ARE NOT WATERS OF THE U.S., AGC ARGUES AGC of America has presented a powerful case for why the U.S. Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (Corps) should withdraw their proposal to redefine “waters of the United States,” concluding that it is simply too flawed to repair. AGC filed a comprehensive 21-page letter on Nov. 13 that identifies practical problems with the proposal for the construction industry, based on input from AGC’s members. AGC also submitted nearly 200 pages of additional comments through partnership work with the U.S. Chamber of Commerce, the Waters Advocacy Coalition and several other nationally-based associations. Those supplemental comment letters enhanced the construction industry’s advocacy and outreach efforts by coordinating AGC’s message with key stakeholders in the real estate, farming, home building, mining, manufacturing and many other business sectors. On the whole, AGC provided an exhaustive analysis of the legal, scientific, economic and procedural deficiencies associated with the WOTUS rulemaking – including how the proposal would assert federal control over waters that are currently under the sole jurisdiction of the states, including roadside ditches, stormwater control basins and ponds, isolated waters and other wet features. Under the proposal, more projects will have to comply with federal permitting and other environmental requirements, increasing the time and cost of performing construction services.

The agencies’ proposal expansively defines waters – claiming traditionally navigable waters, interstate/territorial waters, tributaries (including ditches), impoundments, adjacent waters (including waters in the floodplain or riparian areas), and “other waters” all as federally jurisdictional. The requirements are expensive, cumbersome, and time-consuming to meet, and leave the construction community vulnerable to penalties and citizen suits. What is more, a lot of land might not be buildable at all. AGC is also extremely concerned with the process used to draft the proposal. The economic analysis conducted by EPA seriously underestimates impacted acreage and completely ignores impacts to non-404 programs. EPA also chose to not wait for a final peer review of their Connectivity Report, touted as the basis of the proposed rule, by the EPA’s own Science Advisory Board. Recognizing that state and local governments are managing water resources not under federal control, it is unclear why the agencies rushed through these important procedural steps designed to ensure that construction companies are protected. AGC noted in its letter that the agencies are not under a deadline to promulgate this rule so there’s ample time to start over and write a rule that is legally defensible.
