FOR IMMEDIATE RELEASE CONTACT: Jim Bray March 10, 2016 217-494-5532 Lawsuit Alleges St. Clair County Sheriff’s Officers Refused to Care for Suicidal Man Causing his Death EAST ST. LOUIS, Ill. – St. Clair County Sheriff’s Department officers exposed a man living with mental illness to filthy, overcrowded living conditions; held him in isolation; beat him; and ignored and laughed at his suicide threats – practices that led to the 2014 death of Joshua Jurcich by suicide, according to a lawsuit filed Thursday in the U.S. District Court for the Southern District of Illinois. Naming St. Clair County Sheriff Richard Watson; Major Phillip McLaurin; 20 St. Clair County Sheriff’s Department officials; Wexford Health Sources, the county’s jail mental health provider; and various medical and mental health professionals as defendants, the complaint alleges that the officials violated Jurcich’s rights under the constitution by using excessive force against him and refusing to protect him from the risk of suicide. The complaint also includes claims under the Americans with Disabilities Act and alleges that the county officials and contractors are liable for Jurcich’s wrongful death. Jurcich’s estate is represented by Vanessa del Valle, Sheila A. Bedi, Locke Bowman, and David Shapiro, attorneys with the Roderick and Solange MacArthur Justice Center, a public interest law firm that is part of Northwestern Pritzker School of Law’s Bluhm Legal Clinic in Chicago. Belleville attorney Latoya Berry also represents Jurcich’s estate in the case. The complaint describes Jurcich as a devoted father and loving son who lived with both addiction and mental illness. He was booked into the St. Clair County Jail on March 6, 2014, on charges of possession of a controlled substance. Officials immediately placed him in segregation. On March 11, 2014, jail staff beat Jurcich because he refused to return to a segregation cell. Immediately after the beating, jail staff moved Jurcich to a maximum security cell. While housed there, Jurcich actively voiced his intent to commit suicide. - more -

Page2March10,2016ThelawsuitstatesthatuponbeingmadeawareofJurcich’ssuicidalideation,onesheriff’sdeputyresponded,“He’sjustgoingtobeanotherdeadmotherf***erthen.”Jailstafffailedtotakeanyeffortstoprotectorappropriatelysupervise.Jurcich.Lessthaneighthoursafterthebeating,jailstafffoundJurcichhanginginhiscell.Jurcichwastransportedtothehospitalwherehediedtwodayslater.ArecentstudyfromtheU.S.DepartmentofJusticeBureauofJusticeStatisticsfoundthatsuicidehasbeentheleadingcauseofdeathinjailseveryyearsince2000.Inaddition,a2010studypublishedbytheU.S.DepartmentofJusticeNationalInstituteofCorrectionsreportedthat47percentofjailsuicidesweredetaineeswhohadahistoryofsubstanceabuse,38percentofjailsuicidesweredetaineeswhohadahistoryofmentalillness,and50percentofjailsuicidesoccurredwithin14daysofconfinement.Jurcichexhibitedseveralofthesuicideriskfactors—hewasayoungmalewithahistoryofmentalhealthissuesandsubstanceabuseproblems.Yet,asallegedinthecomplaint,“inthehoursleadinguptoMr.Jurcich’ssuicide,theofficersfailedtoadequatelyconductregularlyscheduledcellchecks.TheofficersneverconductedasafetycheckonMr.Jurcichafterhewasmovedtothemaximumsecuritycell.TheDefendantsknewMr.Jurcichwasasuicideriskandtheyfailedtotakemeasurestomonitorandprotecthim—theyfailedtoprovidehimadequatementalhealthservices,theyfailedtoplacehiminasuicide-proofcell,andtheyfailedtoconductregularchecksonhimwhilehewasinhiscell.Bytheiractions,theDefendantsintentionallydisregardedtheknownandsubstantialriskthatMr.Jurcichwouldharmhimselfwhileintheircustody.”ThecomplaintseeksunspecifiedmoneydamagesonbehalfofJurcich’sestate.PDFofthelawsuitishere:http://www.law.northwestern.edu/legalclinic/macarthur/projects/treatment/other.html
