ThisActshallapplytopatentapplicationsmadeafterthecommencementofthisActandto

Section3.Interpretation.
InthisAct,unlessthecontextotherwiserequires–
“appointeddate”hasthesamemeaningasisassignedtothatexpressionintheIntellectual
PropertyCorporationofMalaysiaAct2002[Act617];
“AssistantRegistrar”meansthepersonappointedordeemedtohavebeenappointedtobe
anAssistantRegistrarundersubsection(2)or(3)ofsection8;
“authorizedofficer”meansanofficerauthorizedundersection68;
“Board”[Deleted];
“Corporation”means the IntellectualPropertyCorporationofMalaysiaestablishedunder

“Minister” means the Minister for the time being charged with the responsibility for

“ownerofthepatent”or“ownerofapatent”meansthepersonforthetimebeingrecorded
intheRegisterasthegranteeofapatent;
“patented invention” means an invention for which a patent is granted and “patented
process”shallbeconstruedaccordingly;
“patented product” means a product which is a patented invention or, in relation to a
patented process, a product obtained directly by means of the process or to which the
processhasbeenapplied;
“prescribed”meansprescribedbyregulationsmadeunderthisAct;

“prioritydate”meansthedateprescribedinsection27A;
“process”includesanartoramethod;
“product”means any thingwhich appears in tangible form, and includes any apparatus,
article,device,equipment,handicraft,implement,machine,substanceandcomposition;
“Register” means the Register of Patents and the Register for Certificates for Utility
InnovationskeptunderthisAct;
“Registrar”meanstheRegistrarofPatentsasdesignatedinsubsection(1)ofsection8;
“right”, in relation to anypatent applicationor patent, includes an interest in the patent
applicationorpatentand,withoutprejudicetotheforegoing,anyreferencetoarightina
patentincludesareferencetoashareinthepatent.

(1)TheDirectorGeneraloftheCorporationshallbetheRegistrarofPatents.

(2)TheCorporationmayappoint,onsuchtermsandconditionsasitmaydetermine,from
amongstpersonsintheemploymentoftheCorporation,suchnumberofDeputyRegistrars
ofPatents,AssistantRegistrarsofPatentsandotherofficersasmaybenecessary for the
proper administration of this Act, and may revoke the appointment of any person so

mayexerciseanyfunctionoftheRegistrarunderthisAct,andanythingbythisActappointed

PATENTABILITY
Section11.Patentableinventions.
An invention is patentable if it is new, involves an inventive step and is industrially
applicable.
Section12.Meaningof“invention”.
(1)Aninventionmeansanideaofaninventorwhichpermitsinpracticethesolutiontoa
specificprobleminthefieldoftechnology.

(2)Aninventionmaybeormayrelatetoaproductorprocess.
Section13.Non‐patentableinventions.
(1)Notwithstandingthefactthattheymaybeinventionswithinthemeaningofsection12,
thefollowingshallnotbepatentable:
(a)discoveries,scientifictheoriesandmathematicalmethods;
(b)plantoranimalvarietiesoressentiallybiologicalprocessesfortheproductionof
plants or animals, other than man‐made living micro‐organisms, micro‐biological
processesandtheproductsofsuchmicro‐organismprocesses;
(c)schemes,rulesormethodsfordoingbusiness,performingpurelymentalactsor
playinggames;
(d)methodsforthetreatmentofhumanoranimalbodybysurgeryortherapy,and
diagnosticmethodspractisedonthehumanoranimalbody:
Providedthatthisparagraphshallnotapplytoproductsusedinanysuchmethods.
(2)Forthepurposeofsubsection(1),intheeventofuncertaintyastowhethertheitems
specified therein shall be patentable or not, the Registrar may refer the matter to the
ExaminerforanopinionandtheRegistrarshallthereaftergiveadecisionastowhetherto
includeorexcludesuchitemasbeingpatentable,asthecasemaybe.
Section14.Novelty.
(1)Aninventionisnewifitisnotanticipatedbypriorart.
(2)Priorartshallconsistof–

(a) everythingdisclosedtothepublic,anywhereintheworld,bywrittenpublication,by
oraldisclosure,byuseorinanyotherway,priortotheprioritydateofthepatent
applicationclaimingtheinvention;
(b) thecontentsofadomesticpatentapplicationhavinganearlierprioritydatethanthe
patentapplicationreferredtoinparagraph(a)totheextentthatsuchcontentsare
includedinthepatentgrantedonthebasisofthesaiddomesticpatentapplication.
(3)Adisclosuremadeunderparagraph(2)(a)shallbedisregarded–
(a) if such disclosure occurred within one year preceding the date of the patent
applicationandifsuchdisclosurewasbyreasonorinconsequenceofactscommitted
bytheapplicantorhispredecessorintitle;
(b) if such disclosure occurred within one year preceding the date of the patent
applicationandifsuchdisclosurewasbyreasonorinconsequenceofanyabuseof
therightsoftheapplicantorhispredecessorintitle;
(c) if such disclosure is byway of a pending application to register the patent in the
UnitedKingdomPatentOfficeasatthedateofcomingintoforceofthisAct.
(4)Theprovisionsofsubsection(2)shallnotexcludethepatentabilityofanysubstanceor
composition, comprised in the prior art, for use in a method referred to in paragraph
13(1)(d),ifitsuseinanysuchmethodisnotcomprisedinthepriorart.
Section15.Inventivestep.
An invention shall be considered as involving an inventive step if, having regard to any
matterwhich forms part of the prior art under paragraph 14(2)(a), such inventive step
wouldnothavebeenobvioustoapersonhavingordinaryskillintheart.

Section16.Industrialapplication.
Aninventionshallbeconsideredindustriallyapplicableifitcanbemadeorusedinanykind
ofindustry.

UTILITYINNOVATIONS
Section17.Definition.
ForthepurposesofthisPartandanyregulationsmadeunderthisActinrelationtothisPart,
“utilityinnovation”meansanyinnovationwhichcreatesanewproductorprocess,orany
newimprovementofaknownproductorprocess,whichiscapableofindustrialapplication,
andincludesaninvention.
Section17A.Application.
(1) Except as otherwise provided in this Part, the provisions of this Act, subject to the
modificationsintheSecondSchedule,shallapplytoutilityinnovationsinthesamemanner
astheyapplytoinventions.
(2)Sections11,15,26,PartX,andsections89and90shallnotapplytoutilityinnovations.
Section17B.Conversion fromanapplication forapatent intoanapplication fora
certificateforautilityinnovation,andviceversa.
(1)Anapplicationforapatentmaybeconvertedintoanapplicationforacertificatefora
utilityinnovation.
(2) An application for a certificate for a utility innovation may be converted into an
applicationforapatent.

(3)Arequesttoconvertanapplicationforapatentintoanapplicationforacertificatefora
utilityinnovationortoconvertanapplicationforacertificateforautilityinnovationintoan
application for apatent shall be filedby the applicantand shall complywith regulations
madeunderthisAct.
(4)Arequestforconversionunderthissectionshallbefilednotlaterthansixmonthsfrom
thedatetheRegistrarmakesknowntotheapplicantthereportmadebytheExaminerin
accordancewithsubsection30(1)or(2).
(5)Arequestforconversionunderthissectionshallnotbeentertainedunlesstheprescribed
feehasbeenpaidtotheRegistrar.
(6)Anapplicationwhichhasbeenconvertedshallbedeemedtohavebeenfiledatthetime
theinitialapplicationwasfiled.
Section17C.Patentandcertificateforautilityinnovationcannotbothbegrantedfor
thesameinvention.
(1)Ifanapplicantforapatenthasalso‐
(a) madeanapplicationforacertificateforautilityinnovation;or
(b) beenissuedwithacertificateforautilityinnovation,
andthesubjectmatteroftheapplicationforapatentisthesameasthesubjectmatterofthe
applicationmentionedinparagraph(a)orofthecertificatementionedinparagraph(b),a
patent shall not be granted until the application mentioned in paragraph (a) has been
withdrawnorthecertificatementionedinparagraph(b)hasbeensurrendered.
(2)Ifanapplicantforacertificateforautilityinnovationhasalso‐
(a) madeanapplicationforapatent;or
(b) beengrantedapatent,

andthesubjectmatteroftheapplicationforacertificateforautilityinnovationisthesame
as the subject matter of the application mentioned in paragraph (a) or of the patent
mentionedinparagraph(b),acertificateforautilityinnovationshallnotbegranteduntil
theapplicationmentionedinparagraph(a)hasbeenwithdrawnorthepatentmentionedin
paragraph(b)hasbeensurrendered.

RIGHTSTOAPATENT
Section18.Righttoapatent.
(1)Anypersonmaymakeanapplicationforapatenteitheraloneorjointlywithanother.
(2)Subjecttosection19,therightstoapatentshallbelongtotheinventor.
(3)Wheretwoormorepersonshavejointlymadeaninvention,therightstoapatentshall
belongtothemjointly.
(4)Iftwoormorepersonshaveseparatelyandindependentlymadethesameinvention,and
eachofthemhasmadeanapplicationforapatent,therighttoapatentforthatinvention
shallbelongtothepersonwhoseapplicationhastheearliestprioritydate.
Section19.Judicialassignmentofpatentapplicationorpatent.
Wheretheessentialelementsoftheinventionclaimedinapatentapplicationorpatenthave
been unlawfully derived from an invention for which the right to the patent belongs to
anotherperson,suchotherpersonmayapplytotheCourtforanorderthatthesaidpatent
applicationorpatentbeassignedtohim:
ProvidedthattheCourtshallnotentertainanapplicationfortheassignmentofapatentafter
fiveyearsfromthedateofthegrantofthepatent.

Section20.Inventionsmadebyanemployeeorpursuanttoacommission.
(1)Intheabsenceofanyprovisionstothecontraryinanycontractofemploymentorforthe
executionofwork,therightstoapatentforaninventionmadeintheperformanceofsuch
contractofemploymentorintheexecutionofsuchworkshallbedeemedtoaccruetothe
employer,orthepersonwhocommissionedthework,asthecasemaybe:
Providedthatwheretheinventionacquiresaneconomicvaluemuchgreaterthanthe
partiescouldreasonablyhaveforeseenatthetimeofconcludingthecontractofemployment
orfortheexecutionofwork,asthecasemaybe,theinventorshallbeentitledtoequitable
remunerationwhichmaybe fixedby theCourt in theabsenceofagreementbetweenthe
parties.
(2)Whereanemployeewhosecontractofemploymentdoesnotrequirehimtoengagein
anyinventiveactivitymakes,inthefieldofactivitiesofhisemployer,aninventionusingdata
ormeansplacedathisdisposalbyhisemployer,therighttothepatentforsuchinvention
shallbedeemedtoaccruetotheemployerintheabsenceoranyprovisiontothecontraryin
thecontractofemployment:
Providedthattheemployeeshallbeentitledtoequitableremunerationwhich,inthe
absenceofagreementbetweentheparties,maybefixedbytheCourttakingintoaccounthis
emoluments, the economicvalueof the inventionandanybenefitderived from it by the
employer.
(3)Therightsconferredontheinventorundersubsections(1)and(2)shallnotberestricted
bycontract.
Section21.InventionsbyGovernmentemployee.
Notwithstanding the provisions of subsection 20(3), the provisions of that section shall
applytoaGovernmentemployeeoranemployeeofaGovernmentorganizationorenterprise

unless otherwise provided by rules or regulations of such Government organization or
enterprise.
Section22.Jointowners.
Wheretherighttoobtainapatentisownedjointly,thepatentmayonlybeappliedforjointly
byallthejointowners.

APPLICATION,PROCEDUREFORGRANTANDDURATION
Section23.Requirementsofapplication.
Every application for the grant of a patent shall complywith the regulations asmay be
prescribedbytheMinisterunderthisAct.
Section23A.ApplicationsbyresidentstobefiledinMalaysiafirst.
NopersonresidentinMalaysiashall,withoutwrittenauthoritygrantedbytheRegistrar,file
orcausetobefiledoutsideMalaysiaanapplicationforapatentforaninventionunless–
(a) an application for a patent for the same invention has been filed in the Patent
RegistrationOfficenotlessthantwomonthsbeforetheapplicationoutsideMalaysia;
and
(b) eithernodirectionshavebeenissuedbytheRegistrarundersection30Ainrelation
totheapplicationorallsuchdirectionshavebeenrevoked.
Section24.Applicationfee.
Anapplicationforthegrantofapatentshallnotbeentertainedunlesstheprescribedfeehas
beenpaidtotheRegistrar.

Section25.Withdrawalofapplication.
Anapplicantmaywithdrawnhisapplicationatanytimeduringitspendencybysubmitting
a declaration in the prescribed form to the Registrar, and such withdrawal may not be
revoked.
Section26.Unityofinvention.
Anapplicationshallrelatetooneinventiononlyortoagroupofinventionssolinkedasto
formasinglegeneralinventiveconcept.
Section26A.Amendmentofapplication.
Theapplicantmayamendtheapplication:
Providedthattheamendmentshallnotgobeyondthedisclosureintheinitialapplication.
Section26B.Divisionofapplication.
(1)Theapplicantmay,withintheprescribedtime,dividetheapplicationintotwoormore
applications(“divisionalapplications”):
Provided thateachdivisionalapplicationshallnotgobeyond thedisclosure in the initial
application.
(2)Eachdivisionalapplicationshallbeentitledtotheprioritydateoftheinitialapplication.
Section27.Rightofpriority.
(1) An application may contain a declaration claiming the priority, pursuant to any
internationaltreatyorConvention,ofoneormoreearliernational,regionalorinternational
applicationsfiled,duringtheperiodoftwelvemonthsimmediatelyprecedingthefilingdate

oftheapplicationcontainingthedeclaration,bytheapplicantorhispredecessorintitlein
orforanypartytothesaidinternationaltreatyorConvention.
(1A)Theperiodoftwelvemonthsmentionedinsubsection(1)maynotbeextendedunder
theprovisionsofsection82.
(2)Wheretheapplicationcontainsadeclarationundersubsection(1), theRegistrarmay
require that the applicant furnish, within the prescribed time, a copy of the earlier
application, certifiedas correctby theofficewithwhich itwas filedorwhere theearlier
application is an international application filed under any international treaty, by the
InternationalBureauoftheWorldIntellectualPropertyOrganization.
(3)Theeffectofthedeclarationreferredtoinsubsection(1)shallbeasprovidedinthetreaty
orConventionreferredtotherein.
(4)Whereanyoftherequirementsofthissectionoranyregulationspertainingtheretohave
notbeencompliedwith,thedeclarationreferredtoinsubsection(1)shallbedeemedtobe
invalid.
Section27A.Prioritydate.
(1)Subjecttosubsection(2),theprioritydateofanapplicationforapatentisthefilingdate
oftheapplication.
(2)Whereanapplicationcontainsthedeclarationmentionedinsection27,theprioritydate
oftheapplicationshallbethefilingdateoftheearliestapplicationwhosepriorityisclaimed
inthatdeclaration.
Section28.Filingdate.
(1)TheRegistrarshallrecordasthefilingdatethedateofreceiptoftheapplication:

Providedthattheapplicationcontains–
(a) thenameandaddressoftheapplicant;
(b) thenameandaddressoftheinventor;
(c) adescription;
(d) aclaimorclaims;and
(e) thatatthetimeofreceiptoftheapplicationtheprescribedfeehasbeenpaid.
(2)WheretheRegistrarfindsthat,atthetimeofreceiptoftheapplication,theprovisionsof
subsection(1)arenotfulfilled,heshallrequesttheapplicanttofiletherequiredcorrection.
(3)Wheretheapplicantcomplieswiththerequestreferredtoinsubsection(2),theRegistrar
shallrecordasthefilingdatethedateofreceiptoftherequiredcorrectionandwherethe
applicantdoesnotsocomply,theRegistrarshalltreattheapplicationasinvalid.
(4)Wheretheapplicationreferstodrawingswhichinfactarenotincludedintheapplication,
theRegistrarshallrequesttheapplicanttofurnishthemissingdrawings.
(5)Wheretheapplicantcomplieswiththerequestreferredtoinsubsection(4),theRegistrar
shall recordas the filingdate thedateof receiptof themissingdrawingsandwhere the
applicantdoesnotsocomply,theRegistrarshallrecordasthefilingdatethedateofreceipt
oftheapplicationandmakenoreferencetothesaiddrawings.
Section29.Preliminaryexamination.
(1)Whereanapplicationforapatenthasafilingdateandisnotwithdrawn,theRegistrar
shallexaminetheapplicationanddeterminewhetheritcomplieswiththerequirementsof

thisActandtheregulationsmadeunderthisActwhicharedesignatedbysuchregulations
asformalrequirementsforthepurposesofthisAct.
(2)IftheRegistrar,asaresultoftheexaminationundersubsection(1),findsthatnotallthe
formalrequirementsarecompliedwith,heshallgiveanopportunitytotheapplicanttomake
anyobservationonsuchfindingandtoamendtheapplicationwithintheprescribedperiod
soastocomplywiththoserequirements,andiftheapplicantfailstodosotheRegistrarmay
refusetheapplication.
Section 29A. Request for substantive examination or modified substantive
examination.
(1)Ifanapplicationforapatenthasbeenexaminedundersection29andisnotwithdrawn
orrefused,theapplicantshallfile,withintheprescribedperiod,arequestforasubstantive
examinationoftheapplication.
(2) If a patent or other title of industrial property protection has been granted to the
applicantorhispredecessor in title inaprescribed countryoutsideMalaysiaorunder a
prescribedtreatyorConventionforaninventionwhichisthesameoressentiallythesame
asthe inventionclaimedintheapplication, theapplicantmay, insteadofrequestingfora
substantiveexamination,requestforamodifiedsubstantiveexamination.
(3)Arequestforasubstantiveexaminationoramodifiedsubstantiveexaminationshallbe
madeintheprescribedformandshallnotbedeemedtohavebeenfileduntiltheprescribed
feehasbeenpaidtotheRegistrarandanyotherprescribedrequirementhasbeencomplied
with.
(4)TheRegistrarmayrequiretheapplicanttoprovide,atthetimeoffilingarequestfora
substantiveexamination‐
(a) anyprescribed informationorprescribedsupportingdocumentconcerning
thefilingofanyapplicationforapatentorothertitleofindustrialproperty

protectionfiledoutsideMalaysiabysuchapplicantorhispredecessorintitle
withanational,regionalorinternationalindustrialpropertyoffice;
(b) any prescribed information concerning the results of any search or
examination carriedoutbyan International SearchingAuthorityunder the
Patent Cooperation Treaty, relating to the same or essentially the same
invention as that claimed in the application for which the request for a
substantiveexaminationisbeingfiled.
(5)Iftheapplicant–
(a) failstofileeitherarequestundersubsection(1)forasubstantiveexamination
orarequestundersubsection(2)foramodifiedsubstantiveexamination;or
(b) failstoprovidetheinformationordocumentreferredtoinsubsection(4)as
requiredbytheRegistrar,
withintheprescribedperiod,theapplicationforapatentshall,subjecttosubsection(6),be
deemedtobewithdrawnattheendofthatperiod.
(6)Notwithstandingsubsection(5), theRegistrarmay,upontherequestof theapplicant,
grantadefermentofthefilingofarequestforexaminationreferredtoinsubsection(1)or
(2)oradefermentoftheprovisionoftheinformationordocumentreferredtoinsubsection
(4),andsuchdefermentmaybegrantedonlyonthegroundsthat‐
(a) thepatentortitlereferredtoinsubsection(2)hasnotbeengrantedorisnot
available;or
(b) the information or document referred to in subsection (4) would not be
available,

bytheexpirationoftheprescribedperiodforthefilingofarequestundersubsection(1)or
(2).
(7) No deferment shall be granted under subsection (6) unless the request for such
defermentisfiledbeforetheexpirationoftheprescribedperiodforthefilingofarequest
undersubsection(1)or(2)andnodefermentmaybesoughtnorgrantedforaperiodgreater
thanthatprescribedintheregulationsmadeunderthisAct.
(8) Without prejudice to the power of the Registrar to grant a deferment, the period
prescribed for thepurposesof this sectionmaynotbeextendedunder theprovisionsof
section82.
Section30.Substantiveexaminationandmodifiedsubstantiveexamination.
(1)Wherearequestforsubstantiveexaminationhasbeenfiledundersubsection29A(1),the
RegistrarshallrefertheapplicationtoanExaminerwhoshall‐
(a)determinewhethertheapplicationcomplieswiththoserequirementsofthisAct
andtheregulationsmadeunderthisActwhicharedesignatedbysuchregulationsas
substantiverequirementsforthepurposesofthisAct;and
(b)reporthisdeterminationtotheRegistrar.
(2)Wherearequestforamodifiedsubstantiveexaminationhasbeenfiledundersubsection
29A(2),theRegistrarshallrefertheapplicationtoanExaminerwhoshall–
(a) determinewhethertheapplicationcomplieswiththoserequirementsofthisActand
the regulationsmade under this Actwhich are designated by such regulations as
modifiedsubstantiverequirementsforthepurposesofthisAct;and
(b) reporthisdeterminationtotheRegistrar.

(3) If the Examiner reports, in accordance with subsection (1) or (2), that any of the
requirementsreferredtoinsubsection(1)or(2),asthecasemaybe,arenotcompliedwith,
theRegistrarshallgivetheapplicantanopportunitytomakeobservationsonthereportand
toamendtheapplicationsoastocomplywiththoserequirements,withintheprescribed
period,andiftheapplicantfailstosatisfytheRegistrarthatthoserequirementsarecomplied
with,ortoamendtheapplicationsoastocomplywiththem,theRegistrarmayrefusethe
application.
(4)TheRegistrarmaygrantanextensionoftheprescribedperiodreferredtoinsubsection
(3) but such extensionmay be granted only once and no subsequent extensionmay be
grantedundertheprovisionsofsection82.
(5)IftheExaminerreports,inaccordancewithsubsection(1)or(2),thattheapplication,
whetherasoriginally filedorasamended,complieswith therequirementsreferredto in
subsection(1)or(2),asthecasemaybe,theRegistrarshallnotifytheapplicantofthatfact
and,subjecttosubsection(6),shallprocesstheapplicationaccordingly.
(6)Wheretwoormoreapplications forapatent for thesameinventionhavingthesame
prioritydatearefiledbythesameapplicantorhissuccessorintitle,theRegistrarmayon
thatgroundrefusetograntapatentinpursuanceofmorethanoneoftheapplications.
(7)TheRegistrarmaywaive,ashedeemsfit,therequirementofreferringanapplicationor
anypartofitforsubstantiveexaminationundersubsection(1):
ProvidedthatheshallnotifyintheGazettehisintentiontowaivesuchrequirementandshall
allowanypartywhowouldbeaggrievedbysuchwaivertobeheardonthematter.

Section30A.Prohibitionofpublicationofinformationwhichmightbeprejudicialto
thenation.
(1)SubjecttoanydirectionoftheMinister,whereanapplicationforapatentisfiledoris
deemedtohavebeenfiledatthePatentRegistrationOfficeanditappearstotheRegistrar
thattheapplicationcontainsinformationthepublicationofwhichmightbeprejudicialtothe
interest or security of the nation, hemay issue directions prohibiting or restricting the
publicationofthat informationoritscommunicationwhethergenerallyortoaparticular
personorclassofpersons.
(2)SubjecttoanydirectionbytheMinister,theRegistrarmayrevokeanydirectionissued
byhimundersubsection(1)prohibitingorrestrictingthepublicationorcommunicationof
anyinformationcontainedinanapplicationforapatentifheissatisfiedthatsuchpublication
orcommunicationisnolongerprejudicialtotheinterestorsecurityofthenation.
(3)WheredirectionsissuedbytheRegistrarundersubsection(1)areinforceinrespectof
anapplication,theapplicationmayproceedtothestagewhereitisinorderforthegrantof
apatentbutnopatentshallbegrantedinpursuanceofsuchapplication.
(4)Nothinginthissectionpreventsthedisclosureofinformationconcerninganinventionto
aMinistryoraGovernmentdepartmentorauthorityforthepurposeofobtainingadviceas
towhetherdirectionsunderthissectionshouldbemade,amendedorrevoked.
Section31.Grantofpatent.
(1)Thegrantofapatentshallnotberefusedandapatentshallnotbeinvalidatedonthe
groundthattheperformanceofanyactinrespectoftheclaimedinventionisprohibitedby
anylaworregulation,exceptwheretheperformanceofthatactwouldbecontrarytopublic
orderormorality.
(2)WheretheRegistrarissatisfiedthattheapplicationcomplieswithsections23,29and
30,heshallgrantthepatentandshallforthwith‐

(a)issuetotheapplicantacertificateofgrantofthepatentandacopyofthepatent
togetherwithacopyoftheExaminer’sfinalreport;and
(b)recordthepatentintheRegister.
(2A) Where two or more persons have separately and independently made the same
inventionandeachofthemhasmadeanapplicationforapatenthavingthesamepriority
date,apatentmaybegrantedoneachapplication.
(3)AssoonaspossiblethereaftertheRegistrarshall‐
(a)causetobepublishedintheGazetteareferencetothegrantofthepatent;and
(b) make available to the public, on payment of the prescribed fee, copies of the
patent.
(4)ThepatentshallbedeemedtobegrantedonthedatethattheRegistrarperformstheacts
referredtoinsubsection(2).
Section32.RegisterofPatents.
(1)TheRegistrarshallkeepandmaintainaregistercalledtheRegisterofPatents.
(2)TheRegisterofPatentsshallcontainallsuchmattersandparticularsrelatingtopatents
asmaybeprescribed.
(3) The Register of Patents shall be kept in such form and on suchmedium asmay be
prescribed.

Section32A.Noticeofatrustnottoberegistered.
Noticeofatrust,express,impliedorconstructive,shallnotbeenteredintheRegisterorbe
acceptedbytheRegistrar.
Section33.ExaminationofRegisterandcertifiedcopies.
Any person may examine the Register and may obtain certified extracts therefrom on
paymentoftheprescribedfee.
Section33A.CertifiedcopiesoforextractsfromRegister,etc.admissibleasevidence
incourt.
(1)TheRegistershallbeprimafacieevidenceofallmattersrequiredorauthorizedbythis
Acttobeenteredtherein.
(2)CopiesoforextractsfromtheRegister,oroforfromanydocumentorpublicationinthe
PatentRegistrationOffice, if certifiedby theRegistrar inwritingunderhishand,shallbe
admissibleinevidenceinallcourtswithoutfurtherprooforproductionoftheoriginal.
Section33B.AmendmentstotheRegister.
(1)TheRegistrarmay,onrequestmadeintheprescribedmannerbytheownerofapatent,
amendtheRegister‐
(a)bycorrectinganyerrorinthenameoraddressoftheownerofthepatent;or
(b)byenteringanychangeinthenameoraddressoftheownerofthepatent.

(2)WheretheRegisterhasbeenamendedunderthissection,theRegistrarmayrequirethe
certificateofgrantofthepatenttobesubmittedtohim,andmay‐
(a)revokethecertificateofgrantofthepatentandissueanewcertificateofgrantof
thepatent;or
(b)makeanyconsequentialamendmentsinthecertificateofgrantofthepatentas
arerenderednecessarybytheamendmentoftheRegister.
(3)NotwithstandinganyotherprovisionofthisActortheregulationsmadeunderthisAct,
nofeeshallbepayablebytheownerofapatentinrespectofarequesttocorrectanyerror
inthenameoraddressofsuchownerunlesssucherroriscausedorcontributedtobysuch
owner.
Section33C.CourtmayorderrectificationoftheRegister.
(1)TheCourtmay,ontheapplicationofanyaggrievedperson,ordertherectificationofthe
Registerbydirecting‐
(a)themakingofanyentrywronglyomittedfromtheRegister;
(b)theexpungingoramendmentofanyentrywronglymadeinorremaininginthe
Register;or
(c)thecorrectingofanyerrorordefectintheRegister.
(2)NoticeofeveryapplicationunderthissectionshallbeservedontheRegistrarwhoshall
havetherighttoappearandbeheard,andwhoshallappearifsodirectedbytheCourt.
(3)Unlessotherwisedirectedby theCourt, theRegistrar, in lieuof appearing andbeing
heard,maysubmittotheCourtastatementinwritingsignedbyhim‐
(a)givingparticularsinrelationtothematterinissue;

(b)ofthegroundsofanydecisiongivenbyhimaffectingthematterinissue;
(c)ofthepracticeofthePatentRegistrationOfficeinlikecases;or
(d)ofsuchothermattersrelevanttotheissuesandwithinhisknowledgeasRegistrar,

andsuchstatementshallbedeemedtoformpartoftheevidenceinCourt.
(4)AsealedcopyofanorderunderthissectionshallbeservedontheRegistrarwhoshall,
uponreceiptoftheorder,takesuchstepsasarenecessarytogiveeffecttotheorder.
Section34.Publicinspection
(1)TheRegistrarshallmakeavailableforpublicinspectionaftereighteenmonthsfromthe
prioritydateorfilingdateofapatentapplicationanduponpaymentoftheprescribedfee‐
(a)thename,addressanddescriptionoftheapplicantandthenameandaddressof
hisagent,ifany;
(b)theapplicationnumber;
(c)thefilingdateoftheapplicationand,ifpriorityisclaimed,theprioritydate,the
number of the earlier application and the name of the State inwhich the earlier
applicationwasfiledorwheretheearlierapplicationisaregionaloraninternational
application,thenameofthecountryorcountriesforwhichandtheofficeatwhichit
wasfiled;
(d) the particulars of the application including the description, claim or claims,
drawingordrawings,ifany,andtheabstractandanyamendmentstotheapplication,
ifany;and

(e)anychangeinownershipoftheapplicationandanyreferencetoalicencecontract
appearinginthefilerelatingtotheapplication.
(2) Notwithstanding subsection (1) a patent application shall not bemade available for
publicinspectionif‐
(a) thepatentapplication iswithdrawnorrefusedordeemedtobewithdrawnor
refusedbeforetheexpiryoftheperiodofeighteenmonthsfromtheprioritydateor
filingdateofthepatentapplication;or
(b) it appears to the Registrar that the application contains information which
contravenespublicorderormorality.
(3) Information relating to a patent applicationmay be inspected onlywith thewritten
permissionofthepatentapplicantiftheinformationisrequestedwithineighteenmonths
fromtheprioritydateorfilingdateofthepatentapplication.
(4)Acertifiedextractoftheinformationmaybeobtaineduponpaymentoftheprescribed
fee.
(5)Afteranapplicationismadeavailableforpublicinspection,anapplicantmayinwriting
warn a personwho has commercially or industriallyworked the inventionwhich is the
subjectmatteroftheapplicationthatapatentapplicationfortheinventionhasbeenfiled.
(6)Anapplicantmaydemandthatapersonwhohascommerciallyorindustriallyworked
theinventionpayascompensationtotheapplicantinrespectoftheinvention‐
(a)fromthetimethepersonisgiventhewarningundersubsection(5);or
(b)intheabsenceofawarning,afterthepatentapplicationinrespectoftheinvention
hasbeenmadeavailableforpublicinspection,

an amount equivalent to what he would have normally received for the working of the
inventiontothetimeofthegrantofthepatent.
(7)Therighttodemandcompensationasprovidedforinsubsection(6)shallbeexercised
onlyafterthegrantofthepatent.
(8)Theexerciseoftherighttodemandcompensationundersubsection(6)shallnotprevent
theapplicantfromexercisinghisrightsastheownerofthepatentinrespectoftheinvention
afterthegrantofthepatent.
(9) Where a patent application is withdrawn or refused after the application is made
availableforpublicinspection,therightundersubsection(6)shallbedeemednevertohave
existed.
Section35.Durationofpatent.
(1)Subjecttosubsections(1B)and(1C),thedurationofapatentshallbetwentyyearsfrom
thefilingdateoftheapplication.
(1A)Withoutprejudicetosubsection(1)andsubjecttotheotherprovisionsofthis
Act, a patent shall be deemed to be granted and shall take effect on the date the
certificateofgrantofthepatentisissued.
(1B)Whereapatentapplicationwasfiledbefore1August2001,andwaspendingon
thatdate,thedurationofthepatentgrantedonthatapplicationshallbetwentyyears
fromthedateoffilingorfifteenyearsfromthedateofgrant,whicheveristhelonger.
(1C)Thedurationofapatentgrantedbefore1August2001andstillinforceonthat
dateshallbetwentyyearsfromthedateoffilingorfifteenyearsfromthedateofgrant
whicheveristhelonger.

(2)Whereapatenteeintendsattheexpirationofthesecondyearfromthedateofgrantof
thepatenttokeepthesameinforceheshall,twelvemonthsbeforethedateofexpirationof
thesecondandeachsucceedingyearduringthetermofthepatent,paytheprescribedannual
fee:
Provided,however,thataperiodofgraceofsixmonthsshallbeallowedafterthedateofsuch
expiration,uponpaymentofsuchsurchargeasmaybeprescribed.
(3)Iftheprescribedannualfeeisnotpaidinaccordancewithsubsection(2),thepatentshall
lapse,andanoticeofthelapsingofthepatentfornon‐paymentofanyannualfeeshallbe
publishedintheGazette.
Section35A.Reinstatementofalapsedpatent.
(1)Withintwoyearsfromthedateonwhichanoticeofthelapsingofapatentispublished
intheGazette‐
(a)theownerofthepatentorhissuccessorintitle;or
(b)anyotherpersonwhowould,ifthepatenthadnotlapsed,havebeenentitledto
thepatent,
mayapplytotheRegistrarintheprescribedformtohavethepatentreinstated.
(2)TheRegistrarmayreinstateapatentonanapplicationmadeundersubsection(1)‐
(a) upon payment of all annual fees due and of a prescribed surcharge for
reinstatement;and
(b)uponbeingsatisfied that thenon‐paymentofannual feeswasdue toaccident,
mistakeorotherunforeseeablecircumstances.

(3)WheretheRegistrarreinstatesalapsedpatent,heshallcausenoticeofthereinstatement
tobepublishedintheGazette.
(4)The reinstatementof a lapsedpatent shall notprejudice the rights acquiredby third
partiesafteritisnotifiedintheGazettethatthepatenthaslapsedandbeforeitisnotifiedin
theGazettethatthepatenthasbeenreinstated.
(5)TheMinistermaymakeregulations toprovide for theprotectionorcompensationof
personswhohaveexploitedortakendefinitesteps,bycontractorotherwise,toexploita
patentafteritisnotifiedintheGazettethatthepatenthaslapsedandbeforeitisnotifiedin
theGazette that thepatenthasbeenreinstated,butanysuchprotectionshallnotextend
beyondsuchexploitationofthelapsedpatentassuchpersonshaveavailedthemselvesofor
havetakendefinitestepstoavailthemselvesof.
(6)Noproceedingsshallbetakeninrespectofaninfringementofapatentcommittedafter
itisnotifiedintheGazettethatthepatenthaslapsedandbeforeitisnotifiedintheGazette
thatthepatenthasbeenreinstated.
35B.ApplicantorPatentRegistrationOfficemayrequestforinternationalsearch
(1)Anyapplicantwhofilesanapplication,otherthananinternationalapplication,forthe
grantofapatentwiththePatentRegistrationOfficemayrequestthataninternationalsearch
be carried out on such application by the International Searching Authority which is
specifiedundersubsection78L(1).
(2)ThePatentRegistrationOfficemaysubjectanapplication,otherthananinternational
application,forthegrantofapatentfiledwithittoaninternationalsearchtobecarriedout
by the International Searching Authority which is specified under subsection 78L(1).
(3)Whereasearchiscarriedoutonanapplicationpursuanttosubsection(1)or(2),the
description and claims contained in the application shall be presented in the languages

specifiedbytheInternationalSearchingAuthorityandthesearchfeesasspecifiedbythe
InternationalSearchingAuthorityshallbepaidbytheapplicanteithertotheInternational
SearchingAuthoritydirectlyorviathePatentRegistrationOffice.
PARTVII
RIGHTSOFOWNEROFPATENT
Section36.Rightsofownerofpatent.
(1)SubjectandwithoutprejudicetotheotherprovisionsofthisPart,theownerofapatent
shallhavethefollowingexclusiverightsinrelationtothepatent:
(a)toexploitthepatentedinvention;
(b)toassignortransmitthepatent;
(c)toconcludelicencecontacts.
(2)Nopersonshalldoanyoftheactsreferredtoinsubsection(1)withouttheconsentofthe
ownerofthepatent.
(3)ForthepurposesofthisPart,“exploitation”ofapatentedinventionmeansanyofthe
followingactsinrelationtoapatent:
(a)whenthepatenthasbeengrantedinrespectofaproduct:
(i)making,importing,offeringforsale,sellingorusingtheproduct;
(ii)stockingsuchproductforthepurposeofofferingforsale,sellingorusing;
(b)whenthepatenthasbeengrantedinrespectofaprocess:

(i)usingtheprocess;
(ii)doinganyoftheactsreferredtoinparagraph(a),inrespectofaproduct
obtaineddirectlybymeansoftheprocess.
(4)Forthepurposesofthissection,ifthepatenthasbeengrantedinrespectofaprocessfor
obtainingaproduct,thesameproductproducedbyapersonotherthantheownerofthe
patentorhis licenseeshall,unlessthecontraryisproved,betakeninanyproceedingsto
havebeenobtainedbythatprocess.
Section37.Limitationofrights.
(1)Therightsunderthepatentshallextendonlytoactsdoneforindustrialorcommercial
purposesandinparticularnottoactsdoneonlyforscientificresearch.
(1A)Therightsunderthepatentshallnotextendtoactsdonetomake,use,offertosellor
sell a patented invention solely for uses reasonably related to the development and
submissionofinformationtotherelevantauthoritywhichregulatesthemanufacture,useor
saleofdrugs.
(2)Withoutprejudicetosection58A,therightsunderthepatentshallnotextendtoactsin
respectofproductswhichhavebeenputonthemarket–
(i)bytheownerofthepatent;
(ii)byapersonhavingtherightreferredtoinsection38;
(iii)byapersonhavingtherightreferredtoinsection43;
(iv)bythebeneficiaryofacompulsorylicencewithinthemeaningofsection48.

(3)Therightsunderthepatentshallnotextendtotheuseofthepatentedinventiononany
foreignvessel,aircraft,spacecraftorlandvehicletemporarilyinMalaysia.
(4)Therightsunderthepatentshallbelimitedindurationasprovidedforinsection35.
(5)The rightsunder thepatent shall be limitedby theprovisionsof section35A,by the

(1)Whereapersonattheprioritydateofthepatentapplication‐
(a)wasingoodfaithinMalaysiamakingtheproductorusingtheprocesswhichisthe
subjectoftheinventionclaimedintheapplication;
(b)hadingoodfaithinMalaysiamadeseriouspreparationstowardsthemakingof
theproductorusingtheprocessreferredtoinparagraph(a),
heshallhavetheright,despitethegrantofthepatent,toexploitthepatentedinvention:
Providedthattheproductinquestionismade,ortheprocessinquestionisused,by
thesaidpersoninMalaysia:
Provided further that he can prove, if the invention was disclosed under the
circumstances referred to in paragraphs 14(3)(a), (b) or (c) that his knowledge of the
inventionwasnotaresultofsuchdisclosure.
(2)Therightreferredtoinsubsection(1)shallnotbeassignedortransmittedexceptaspart
ofthebusinessofthepersonconcerned.

Section39.Assignmentandtransmissionofpatentapplicationsandpatents.
(1)Apatentapplicationorpatentmaybeassignedortransmitted.
(2)Anypersonbecomingentitledbyassignmentortransmissiontoapatentapplicationor
patentmay apply to theRegistrar in the prescribedmanner to have such assignment or
transmissionrecordedintheRegister.
(3)NosuchassignmentortransmissionshallberecordedintheRegisterunless‐
(a)theprescribedfeehasbeenpaidtotheRegistrar;
(b) in the case of an assignment, it is in writing signed by or on behalf of the
contractingparties.
(4) No such assignment or transmission shall have effect against third parties unless so
recordedintheRegister.
Section40.Jointownershipofpatentapplicationsorpatents.
Intheabsenceofanyagreementtothecontrarybetweentheparties,jointownersofapatent
applicationorpatentmay,separately,assignortransmittheirrightsinthepatentapplication
orpatent,exploitthepatentedinventionandtakeactionagainstanypersonexploitingthe
patented invention without their consent, but may only jointly withdraw the patent
application,surrenderthepatentorconcludealicencecontract.

LICENCECONTRACTS
Section41.Meaningoflicencecontract.
(1)ForthepurposesofthisPart,a“licencecontract”meansanycontractbywhichtheowner
ofapatent(the“licensor”)grantstoanotherpersonorenterprise(the“licensee”)alicence
todoanyoralloftheactsreferredtoinparagraph(1)(a),andsubsection36(3).
(2)Alicencecontractshallbeinwritingsignedbyoronbehalfofthecontractingparties.
Section42.EntryintheRegister.
(1)AlicensormayinaccordancewiththeregulationsasprescribedbytheMinisterapplyto
theRegistrarforanentrytobemadeintheRegistertotheeffectthatanypersonmayobtain
alicence.
(2)AtanytimeafteranentryhasbeenmadeintheRegister,anypersonmayapplytothe
licensorthroughtheRegistrarforalicence.
(3)Wherealicencecontractisconcludedbetweentheparties,thecontractingpartiesshall
informtheRegistraraccordinglyandtheRegistrarshallrecordsuchfactintheRegister.
(4)Uponarequestinwritingsignedbyoronbehalfofthecontractingparties,theRegistrar
shall,onpaymentoftheprescribedfee,recordintheRegistersuchparticularsrelatingtothe
contractasthepartiestheretomightwishtohaverecorded:
Provided that the parties shall not be required to disclose or have recorded any other
particularsrelatingtothesaidcontract.
(5)Wherealicencecontractisterminated,thecontractingpartiesshallinformtheRegistrar
oftheterminationandtheRegistrarshallrecordsuchterminationintheRegister.

(6)ThelicensormayinaccordancewiththeregulationsasprescribedbytheMinisterapply
totheRegistrarforthecancellationoftheentrymadeundersubsection(1).
Section43.Rightsofthelicensee.
(1)Intheabsenceofanyprovisiontothecontraryinthelicencecontract,thelicenseeshall
beentitledtodoanyoralloftheactsreferredtoinparagraph1(a),andsubsection36(3),
withinthewholegeographicalareaofMalaysiawithoutlimitationastotimeandthrough
anyapplicationoftheinvention.
(2)Intheabsenceofanyprovisiontothecontraryinthelicencecontract,thelicenseemay
notgivetoathirdpersonhisagreementtoperforminMalaysiainrespectoftheinvention
anyoftheactsreferredtoinparagraph1(a),andsubsection36(3).
Section44.Rightsofthelicensor.
(1)Intheabsenceofanyprovisiontothecontraryinthelicencecontract,thelicensormay
grantafurtherlicencetoathirdpersoninrespectofthesamepatentorhimselfdoanyorall
oftheactsreferredtoinparagraph1(a),andsubsection36(3).
(2)Wherethelicencecontractprovidesthatthelicenceisexclusiveandunlessitisexpressly
providedotherwiseinsuchcontract,thelicensorshallnotgrantafurtherlicencetoathird
personinrespectofthesamepatentorhimselfdoanyoftheactsreferredtoinparagraph
1(a),andsubsection36(3).
Section45.Invalidclausesinlicencecontracts.
Anyclauseorconditioninalicencecontractshallbeinvalidinsofarasitimposesuponthe
licensee, in the industrial or commercial field, restrictions not derived from the rights
conferredbythisPartontheownerofthepatent,orunnecessaryforthesafeguardingof
suchrights:

Providedthat‐
(a) restrictions concerning the scope, extent or duration of exploitation of the
patented invention, or the geographical area in, or the quality or quantity of the
productsinconnectionwith,whichthepatentedinventionmaybeexploited;and
(b) obligations imposed upon the licensee to abstain from all acts capable of
prejudicing the validity of the patent, shall not be deemed to constitute such
restrictions.
Section46.Effectofpatentapplicationnotbeinggrantedorpatentbeingdeclared
invalid.
Where,before theexpirationof the licencecontract,anyof the followingeventsoccur in
respectofthepatentapplicationorpatentreferredtoinsuchcontract:
(a)thepatentapplicationiswithdrawn;
(b)thepatentapplicationisfinallyrejected;
(c)thepatentissurrendered;
(d)thepatentisdeclaredinvalid;
(e)thelicencecontractisinvalidated,
the licensee shall no longer be required tomake anypayment to the licensor under the
licencecontract,andshallbeentitledtorepaymentofthepaymentalreadymade:
Providedthatthelicensorshallnotberequiredtomakeanyrepayment,orshallbe
required tomake repayment only in part, to the extent that he can prove that any such

repaymentwouldbeinequitableunderallthecircumstances,inparticularifthelicenseehas
effectivelyprofitedfromthelicence.
Section47.Expiry,terminationorinvalidationoflicencecontract.
TheRegistrarshall–
(a)ifheissatisfiedthatarecordedlicencecontracthasexpiredorbeenterminated,
recordthatfactintheRegisteruponarequestinwritingtothateffectsignedbyoron
behalfofthepartiesthereto;
(b)recordintheRegistertheexpiry,terminationorinvalidationofalicencecontract
underanyprovisionofthisPart.

COMPULSORYLICENCE
Section48.Definition.
ForthepurposeofthisPart–
“beneficiaryofthecompulsorylicence”meansthepersontowhomacompulsorylicencehas
beengrantedinaccordancewiththisPart;and
“compulsorylicence”meanstheauthorizationtoperforminMalaysiawithouttheagreement
oftheownerofthepatentinrespectofthepatentedinventionanyoftheactsreferredtoin
paragraph1(a),andsubsection36(3).

Section49.Applicationforcompulsorylicences.
(1)Atanytimeaftertheexpirationofthreeyearsfromthegrantofapatent,orfouryears
fromthefilingdateofthepatentapplication,whicheveristhelater,anypersonmayapplyto
theRegistrarforacompulsorylicenceunderanyofthefollowingcircumstances:
(a) where there is no production of the patented product or application of the
patentedprocessinMalaysiawithoutanylegitimatereason;
(b)wherethereisnoproductproducedinMalaysiaunderthepatentforsaleinany
domesticmarket,ortherearesomebuttheyaresoldatunreasonablyhighpricesor
donotmeetpublicdemandwithoutanylegitimatereason.
(2)Acompulsorylicenceshallnotbeappliedforunlessthepersonmakingtheapplication
has made efforts to obtain authorization from the owner of the patent on reasonable
commercial terms and conditions but such efforts have not been successful within a
reasonableperiodoftime.
(3)Theapplicationforacompulsorylicenceshallbeincompliancewithsuchregulationsas
maybeprescribedbytheMinister.
Section49A.Applicationforcompulsorylicencebasedoninterdependenceofpatents.
(1)Iftheinventionclaimedinapatent(“laterpatent”)cannotbeworkedinMalaysiawithout
infringingapatentgrantedonthebasisofanapplicationbenefitingfromanearlierpriority
date (“earlierpatent”), and if the inventionclaimed in the laterpatent constitutes, in the
opinion of the Corporation, an important technical advance of considerable economic
significanceinrelationtotheinventionclaimedintheearlierpatent,theCorporation,upon
therequestoftheownerofthelaterpatent,thelicenseeofalicencecontractunderthelater
patent or the beneficiary of a compulsory licence under the later patent, may grant a
compulsorylicencetotheextentnecessarytoavoidinfringementoftheearlierpatent.

(2) If a compulsory licence is granted under subsection (1), the Corporation, upon the
requestoftheowneroftheearlierpatent,thelicenseeofalicencecontractundertheearlier
patent or the beneficiary of a compulsory licence under the earlier patent, may grant a
compulsorylicenceunderthelaterpatent.
Section50.Requestforgrantofcompulsorylicence.
(1)Inanapplicationforacompulsorylicenceundersection49orsection49A,theapplicant
shallsetforththeamountofroyalty,theconditionsoftheexploitationofthepatentandthe
restrictionsoftherightsofthelicensororthelicensee,asthecasemaybe,andarequestfor
thesaidlicence.
(2)Whereanapplicationforacompulsorylicenceisfiledpursuanttosection49orsection
49A,andthissection,theRegistrarshallnotifytheapplicant,thelicensororthelicensee,as
thecasemaybe,ofthedatetheapplicationshallbeconsideredbytheCorporation.
(3)Thelicensororthelicensee,asthecasemaybe,shallbefurnishedwithacopyofthe
applicationasmentionedinsubsection(1).
Section51.DecisionbytheCorporation.
(1)Inconsideringtheapplicationforacompulsorylicenceundersection49orsection49A,
theCorporationmayrequiretheapplicant,thelicensororthelicensee,asthecasemaybe,
toappearbeforetheCorporationtogiveastatementortohandtotheCorporationany
documentoranyotheritem.
(2)WhentheapplicationhasbeenconsideredbytheCorporationandadecisionhasbeen
made,theapplicant,thelicensororthelicensee,asthecasemaybe,shallbenotifiedofthe
decision.

Section52.Scopeofcompulsorylicence.
UponthegrantingofthecompulsorylicencetotheapplicanttheCorporationshallfix–
(a)thescopeofthelicencespecifyinginparticulartheperiodforwhichthelicenceis
granted;
(b)thetimelimitwithinwhichthebeneficiaryofthecompulsorylicenceshallbegin
toworkthepatentedinventioninMalaysia;and
(c) the amount and conditions of the royalty due from the beneficiary of the
compulsorylicencetotheownerofthepatent.
Section53.Limitationofcompulsorylicence.
(1)AcompulsorylicencegrantedbytheCorporation‐
(a)shallnotbeassignedotherwisethaninconnectionwiththegoodwillorbusiness
orthatpartofthegoodwillorbusinessinwhichthepatentedinventionisused;
(b)shallbelimitedtothesupplyofthepatentedinventionpredominantlyinMalaysia.
(2)Thebeneficiaryofthecompulsorylicenceshallnotconcludelicencecontractswiththird
personsunderthepatentinrespectofwhichthecompulsorylicencewasgranted.
Section54.Amendment,cancellationandsurrenderofcompulsorylicence.
(1)Upon the requestof theownerof thepatent or of thebeneficiaryof the compulsory
licence, the corporationmay amend the decision granting the compulsory licence to the
extentthatnewfactsjustifysuchamendment.

(2)Upontherequestoftheownerofthepatent,theCorporationshallcancelthecompulsory
licence‐
(a)ifthegroundforthegrantofthecompulsorylicencenolongerexists;
(b)ifthebeneficiaryofthecompulsorylicencehas,withinthetimelimitfixedinthe
decisiongrantingthelicence,neitherbeguntheworkingofthepatentedinventionin
Malaysianormadeseriouspreparationstowardssuchworking;
(c) if the beneficiary of the compulsory licence does not respect the scope of the
licenceasfixedinthedecisiongrantingthelicence;
(d) if the beneficiary of the compulsory licence is in arrears of the payment due,
accordingtothedecisiongrantingthelicence.
(3) The beneficiary of the compulsory licence may surrender the licence by a written
declaration submitted to the Registrar who shall record the surrender in the Register,
publishit,andnotifytheownerofthepatent.
(4)ThesurrendershalltakeeffectfromthedatethePatentRegistrationOfficereceivesthe
declarationofthesurrender.
PARTXI
SURRENDERANDINVALIDATIONOFPATENT
Section55.Surrenderofpatent.
(1)Theownerofthepatentmaysurrenderthepatentbyawrittendeclarationsubmittedto
theRegistrar.
(2)Thesurrendermaybelimitedtooneormoreclaimsofthepatent.

(3)WherealicencecontractinrespectofapatentisrecordedintheRegister,theRegistrar
shallnot,intheabsenceofanyprovisiontothecontraryinthelicencecontract,acceptor
record the said surrender except upon receipt of a signed declaration by which every
licenseeorsub‐licenseeonrecordconsentstothesaidsurrenderunlesstherequirementof
hisconsentisexpresslywaivedinthelicencecontract.
(3A)Whereacompulsorylicencehasbeengrantedinrespectofapatent,theRegistrarshall
notacceptorrecordthesaidsurrenderexceptuponreceiptofasigneddeclarationbywhich
thebeneficiaryofthecompulsorylicenceconsentstothesaidsurrender.[Ins.ActA648:s.29]
(4)TheRegistrarshallrecordthesurrenderintheRegisterandcauseittobepublishedin
theGazette.
(5)ThesurrendershalltakeeffectfromthedatetheRegistrarreceivesthedeclaration.
Section56.Invalidationofpatent.
(1)AnyaggrievedpersonmayinstituteCourtproceedingsagainsttheownerofthepatent
fortheinvalidationofthepatent.
(2)TheCourtshallinvalidatethepatentifthepersonrequestingtheinvalidationproves‐
(a)thatwhatisclaimedasaninventioninthepatentisnotaninventionwithinthe
meaningofsection12orisexcludedfromprotectionundersection13orsubsection
31(1) or is not patentable because it does not comply with the requirements of
sections11,14,15and16;
(b)thatthedescriptionortheclaimdoesnotcomplywiththerequirementsofsection
23;

(c) that any drawings which are necessary for the understanding of the claimed
inventionhavenotbeenfurnished;
(d)thattherighttothepatentdoesnotbelongtothepersontowhomthepatentwas
granted;or
(e)thatincompleteorincorrectinformationhasbeendeliberatelyprovidedorcaused
tobeprovidedtotheRegistrarundersubsection29A(4)bythepersontowhomthe
patentwasgrantedorbyhisagent.
(2A)Notwithstandingsubsection(2),theCourtshallnotinvalidatethepatentontheground
mentionedinparagraph(2)(d)ifthepatenthasbeenassignedtothepersontowhomthe
righttothepatentbelongs.
(3)Wheretheprovisionsofsubsection(1)applyononlysomeoftheclaimsorsomeparts
of a claim, such claimsorparts of a claimmaybedeclared invalidby theCourt and the
invalidityofpartofaclaimshallbedeclaredintheformofacorrespondinglimitationofthe
claiminquestion.
Section57.Dateandeffectofinvalidation.
(1)Anyinvalidatedpatentorclaimorpartofaclaimshallberegardedasnullandvoidfrom
thedateofthegrantofthepatent.
(2)WhenthedecisionoftheCourtbecomesfinal,theRegistraroftheCourtshallnotifythe
RegistrarwhoshallrecordthesaiddeclarationintheRegisterandcauseittobepublished
intheGazette.

INFRINGEMENT
Section58.Actsdeemedtobeinfringement.
Subjecttosubsections37(1),(2)and(3)andsection38,aninfringementofapatentshall
consistoftheperformanceofanyactreferredtoinsubsection36(3)inMalaysiabyaperson
otherthantheownerofthepatentandwithouttheagreementofthelatterinrelationtoa
productoraprocessfallingwithinthescopeofprotectionofthepatent.
Section58A.Actsdeemedtobenon‐infringement.
(1)Itshallnotbeanactofinfringementtoimport,offerforsale,selloruse‐
(a)anypatentedproduct;or
(b)anyproductobtaineddirectlybymeansofthepatentedprocessortowhichthe
patentedprocesshasbeenapplied,
which isproducedby,orwith the consent, conditionalorotherwise,of theownerof the
patentorhislicensee.
(2)Forthepurposesofthissection,“patent”includesapatentgrantedinanycountryoutside
Malaysiainrespectofthesameoressentiallythesameinventionasthatforwhichapatent
isgrantedunderthisAct.
Section59.Infringementproceedings.
(1)Theownerofthepatentshallhavetherighttoinstitutecourtproceedingsagainstany
personwhohasinfringedorisinfringingthepatent.

(2)Theownerofthepatentshallhavethesamerightagainstanypersonwhohasperformed
actswhichmakeitlikelythataninfringementwilloccur,whichinthisPartisreferredtoas
an“imminentinfringement”.
(3)Theproceedingsinsubsections(1)and(2)maynotbeinstitutedafterfiveyearsfrom
theactofinfringement.
Section60.Injunctionandawardofdamages.
(1)Iftheownerofthepatentprovesthataninfringementhasbeencommittedorisbeing
committed,theCourtshallawarddamagesandshallgrantaninjunctiontopreventfurther
infringementandanyotherlegalremedy.
(2) If the owner of the patent proves imminent infringement the Court shall grant an
injunctiontopreventinfringementandanyotherlegalremedy.
(3)Thedefendantinanyproceedingsreferredtointhissectionmayrequestinthesame
proceedingstheinvalidationofthepatent,inwhichcasetheprovisionsofsubsections56(2)
and(3)shallapply.
Section 61. Infringement proceedings by licensee and beneficiary of compulsory
licence.
(1)Forthepurposesofthissection,“beneficiary”means‐
(a) any licensee unless the licence contract provides that the provisions of this
subsectiondonotapplyorprovidesdifferentprovisions;
(b)thebeneficiaryofacompulsorylicencegrantedundersection51.

(2)AnybeneficiarymayrequesttheownerofthepatenttoinstituteCourtproceedingsfor
anyinfringementindicatedbythebeneficiary,whoshallspecifythereliefdesired.
(3)Thebeneficiarymay,ifheprovesthattheownerofthepatentreceivedtherequestbut
refuses or fails to institute the proceedingswithin threemonths from the receipt of the
request,institutetheproceedingsinhisownname,afternotifyingtheownerofthepatentof
hisintentionbuttheownershallhavetherighttojoinintheproceedings.
(4)Notwithstandingthat thethree‐monthperiodreferredtosubsection(3)hasnotbeen
satisfied,theCourtshall,ontherequestofthebeneficiary,grantanappropriateinjunction
to prevent infringement or to prohibit its continuation, if the beneficiary proves that
immediateactionisnecessarytoavoidsubstantialdamage.
Section62.Declarationofnon‐infringement.
(1) Subject to subsection (4), any interested person shall have the right to request, by
instituting proceedings against the owner of the patent, that the Court declare that the
performanceofaspecificactdoesnotconstituteaninfringementofthepatent.
(2)Ifthepersonmakingtherequestprovesthattheactinquestiondoesnotconstitutean
infringementofthepatent,theCourtshallgrantthedeclarationofnon‐infringement.
(3) (a) The owner of the patent shall have the obligation to notify the licensee of the
proceedingsandthelicenseeshallhavetherighttojoinintheproceedingsintheabsenceof
anyprovisiontothecontraryinthelicencecontract.
(b)Thepersonrequestingthedeclarationofnon‐infringementshallhavetheobligationto
notify the beneficiaries of the compulsory licence granted under section 51 of the
proceedingsandthesaidbeneficiariesshallhavetherighttojoinintheproceedings.

(4)Iftheactinquestionisalreadythesubjectofinfringementproceedings,thedefendantin
the infringement proceedings may not institute proceedings for a declaration of non‐
infringement.
(5) Proceedings for a declaration of non‐infringement may be instituted together with
proceedingstoinvalidatethepatent,exceptwhereinvalidationofthepatentisrequested
undersubsection60(3).

ofanentryinanysuchRegister,orproducesortendersorcausestobeproducedortendered
inevidenceanysuchfalsewriting,commitsanoffenceandisliableonconvictiontoafine

not exceeding fifteen thousand ringgit or to imprisonment for a termnot exceeding two
yearsortoboth.
Section64.Unauthorisedclaimofpatent.
(1) Any person who falsely represents that anything disposed of by him for value is a
patentedproductorprocesscommitsanoffenceand,subjecttothefollowingprovisionsof
this section, is liable on conviction to a fine not exceeding fifteen thousand ringgit or to
imprisonmentforatermnotexceedingtwoyearsortoboth.
(2)Forthepurposesofsubsection(1),apersonwhoforvaluedisposesofanarticlehaving
stamped, engraved or impressed on it or otherwise applied to it the word “patent” or
“patented”oranythingexpressingorimplyingthatthearticleisapatentedproduct,shallbe
takentorepresentthatthearticleisapatentedproduct.
(3)Subsection(1)doesnotapplywheretherepresentationismadeinrespectofaproduct
afterthepatentforthatproductor,asthecasemaybe,theprocessinquestionhasexpired
orbeeninvalidatedandbeforetheendofaperiodwhichisreasonablysufficienttoenable
thatpersontotakestepstoensurethattherepresentationisnotmadeordoesnotcontinue
tobemade.
(4)Inproceedingsforanoffenceunderthissection,itshallbeadefenceforanypersonto
provethatheusedduediligencetopreventthecommissionoftheoffence.
Section65.Unauthorizedclaimthatpatenthasbeenappliedfor.
(1)Anypersonwhorepresentsthatapatenthasbeenappliedforinrespectofanyarticle
disposedofforvaluebyhimand‐
(a)nosuchapplicationhasbeenmade,or
(b)anysuchapplicationhasbeenrefusedorwithdrawn,

commits an offence and, subject to the following provisions of this section, is liable on

(2)Paragraph1(b)doesnotapplywheretherepresentationismadeorcontinuestobemade
beforetheexpiryofaperiodwhichcommenceswiththerefusalorwithdrawalandwhichis
reasonablysufficienttoenablethatpersontotakestepstoensurethattherepresentationis
notmadeordoesnotcontinuetobemade.
(3)Forthepurposesofsubsection(1),apersonwhoforvaluedisposesofanarticlehaving
stamped,engravedorimpressedonitorotherwiseappliedtoitthewords“patentpending”,
oranythingexpressingorimplyingthatapatenthasbeenappliedforinrespectofthearticle,
shallbetakentorepresentthatapatenthasbeenappliedforinrespectofthearticle.
(4)Inanyproceedingsforanoffenceunderthissection,itshallbeadefenceforanyperson

Anypersonwhousesonhisplaceofbusinessoranydocumentissuedbyhimorotherwise,
the words “Patent Registration Office” or any other words suggesting that his place of
businessis,orisofficiallyconnectedwith,thePatentRegistrationOfficecommitsanoffence
andisliableonconvictiontoafinenotexceedingfifteenthousandringgitortoimprisonment
foratermnotexceedingtwoyearsortoboth.
Section66A.Unregisteredpersonspractising,etc.,asapatentagent.
Anypersonwhocarriesonbusiness,practices,acts,describeshimself,holdshimselfout,or
permitshimselftobedescribedorheldout,asapatentagentwithoutbeingregisteredunder
this Act commits an offence and is liable on conviction to a fine not exceeding fifteen
thousandringgitortoimprisonmentforatermnotexceedingtwoyearsortoboth.

Section67.Offencesbycorporation.
(1)WhereanoffenceunderthisActwhichhasbeencommittedbyabodycorporateisproved
to have been committedwith the consent or connivance of, or to be attributable to any
neglect on thepart of a director,manager, secretary or other similar officer of the body
corporate,oranypersonwhowaspurportingtoactinanysuchcapacity,he,aswellasthe
bodycorporate,commitsthatoffenceandisliabletobeprosecutedagainstandpunished
accordinglyasprovidedbytheAct.
(2)Wheretheaffairsofabodycorporatearemanagedbyitsmembers,subsection(1)shall
applyinrelationtotheactsanddefaultsofamemberinconnectionwithhisfunctionsof
managementasifhewasadirectorofabodycorporate.

Section69.Powersofarrest.
(1)Anyauthorizedofficerorpoliceofficermayarrestwithoutwarrantanypersonwhomhe
seesorfindscommittingorattemptingtocommitorabettingthecommissionofanoffence
orwhomhereasonablysuspectsofbeingengagedincommittingorattemptingtocommitor
abetting the commissionof anyoffenceagainst thisAct if suchperson refusesor fails to
furnishhisnameandresidenceortherearereasonablegroundsforbelievinginthathehas
furnishedafalsenameorresidenceorthatheislikelytoabscond.
(2)Anyauthorizedofficerorpoliceofficermakinganarrestwithoutwarrantshall,without
unnecessarydelay,bringthepersonarrestedtothenearestpolicestation.
(3) No personwho has been arrested by an authorized officer or police officer shall be
releasedexceptonhisownbondoronbailoronthespecialorderinwritingofaMagistrate.
Section70.Searchwithwarrant.
(1)WheneveritappearstoanyMagistrateuponwritteninformationonoathandafterany
enquirywhichhemaythinknecessarythatthereisreasonablecausetobelievethatinany
dwellinghouse,shop,buildingorplacethereisbeingcommittedanoffenceagainstthisAct,
orany regulationsmade thereunder,hemay issueawarrantauthorizinganyauthorized
officerorpoliceofficernamedtherein,bydayornightandwithorwithoutassistance to
enterthedwellinghouse,shop,buildingorplaceandtheresearchforandseizeortakecopies
ofallbooks,accounts,documentsorotherarticleswhichcontainoraresuspectedtocontain
information as to any offence so suspected to have been committed or any other thing
relatingtotheoffence.
(2)Anysuchofficermayifitisnecessarysotodo‐
(a)breakopenanyouterorinnerdoorofthedwellinghouse,shop,buildingorplace,
andenterthereinto;

(b)forciblyenterthedwellinghouse,shop,buildingorplaceandeverypartthereof;
(c) remove by force any obstruction to enter, search, seize and remove as he is
empoweredtoeffect;and
(d)detaineverypersonfoundthereinuntilthedwellinghouse,shop,buildingorplace
hasbeensearched.
Section71.Listofthingsseized.
The authorized officer or police officer seizing any books, accounts, documents or other
articlesunderthisPartshallpreparealistofthethingsseizedandforthwithdeliveracopy
signedbyhimtotheoccupierorhisagentsorservantspresentinthepremises.
Section72.Returnofthingsseized.
WhereunderthisPartpossessionhasbeentakenofanybooks,accounts,documentsorother
articles,thentheauthorizedofficerorpoliceofficershallwithinfourweeksoftheseizure,
wherenocriminalproceedingshavebeeninstituted,restorepossessiontotheowner.
Section73.Powerofinvestigation.
(1)Anauthorizedofficerorpoliceofficershallhavethepowertoinvestigatethecommission
ofanyoffenceunderthisActorregulationsmadethereunder.
(2)Everypersonrequiredbyanauthorizedofficerorpoliceofficertogiveinformationor
produceanybook,account,documentorotherarticlerelatingtothecommissionofsuch
offencewhichisintheperson’spowertogiveshallbelegallyboundtogivetheinformation
ortoproducethebook,account,documentorotherarticle.

Section74.Examinationofwitnesses.
(1)Anauthorizedofficerorpoliceofficermakingan investigationunder section73may
examineorallyanypersonsupposedtobeacquaintedwiththefactsandcircumstancesof
thecaseandshallreduceintowritinganystatementmadebythepersonsoexamined.
(2)Suchpersonshallbeboundtoanswerallquestionsrelatingtosuchcaseputtohimby
suchofficer:
Providedthatsuchpersonmayrefusetoansweranyquestiontheanswertowhichhavea
tendencytoexposehimtoacriminalchargeorpenaltyorforfeiture.
(3)Apersonmakingastatementunderthissectionshallbelegallyboundtostatethetruth,
whetherornotsuchstatementismadewhollyorpartlyinanswertoquestions.
(4)Anauthorizedofficerorpoliceofficerexaminingapersonundersubsection(1)shallfirst
informthatpersonoftheprovisionsofsubsections(2)and(3).
(5)Astatementmadebyanypersonunderthissectionwhetherornotacautionhasbeen
administeredtohimundersection75shall,wheneverpossible,bereducedintowritingand
signedbythepersonmakingitoraffixedwithhisthumb‐print,asthecasemaybe,afterit
hasbeenreadtohiminthelanguageinwhichhemadeitandafterhehasbeengivenan
opportunitytomakeanycorrectionhemaywish.
Section75.Admissionofstatementsinevidence.
(1)WhereanypersonischargedwithanyoffenceunderthisActoranyregulationsmade
thereunder,anystatementwhetherthestatementamountstoaconfessionornotorisoral
orinwriting,madeatanytime,whetherbeforeorafterthepersonischargedandwhether
inthecourseofinvestigationsmadeundersection74ornotandwhetherornotwhollyor
partlyinanswertoquestionsbythatpersontoorinthehearingofanyauthorizedofficeror
policeofficeroforabovetherankofInspectorandwhetherornot interpretedtohimby

anotherauthorizedofficer,policeofficerorotherperson,shallbeadmissibleinevidenceat
histrialand,ifthepersonchargedtendershimselfasawitness,anysuchstatementmaybe
usedincross‐examinationandforthepurposeofimpeachinghiscredit:
Providedthat‐
(a)nosuchstatementshallbeadmissibleorusedasaforesaid‐
(i)ifthemakingofthestatementappearstotheCourttohavebeencausedby
anyinducement,threatorpromisehavingreferencetothechargeproceeding
fromapersoninauthorityandsufficientintheopinionoftheCourttogivethe
personchargedgroundswhichwouldappeartohimreasonableforsupposing
thatbymakingithewouldgainanyadvantageoravoidanyevilofatemporal
natureinreferencestotheproceedingsagainsthim;or
(ii)inthecaseofastatementmadebythepersonafterhisarrest,unlessthe

(a)refusesanyauthorizedofficerorpoliceofficeraccesstoanyplace;
(b)assaults,obstructs,hindersordelaysanyauthorizedofficerorpoliceofficer in
effectinganyentrancewhichheisentitledtoeffectunderthisAct,orintheexecution
ofanydutyimposedorpowerconferredbythisAct;or
(c)refusesorneglectstogiveanyinformationwhichmayreasonablyberequiredof
himandwhichhehasitinhispowertogive,
commitsanoffenceandisliableonconvictiontoafinenotexceedingthreethousandringgit
ortoimprisonmentforatermnotexceedingoneyearortoboth.
Section77.Institutionofprosecution.
No prosecution for any offence under this Act shall be instituted except by or with the
consentinwritingofthePublicProsecutor.
Section78.JurisdictionofsubordinateCourt.
(1)Notwithstandinganyotherwrittenlaw,asubordinateCourtshallhavepowertotryany
offenceunderthisActandonconvictiontoimposethefullpenaltytherefor.
(2) For the purpose of subsection (1), “subordinate Court”means a Sessions Court or a

Section78O.Enteringthenationalphase
(1)Whereinaninternationalapplication,theapplicantdesignatesMalaysiaforthepurpose
of obtaining a patent under this Act, the applicant shall, before the expiration of thirty
monthsfromtheprioritydate—
(a)submittothePatentRegistrationOfficeacopyoftheinternationalapplicationin
theEnglishlanguage;and
(b)paytheprescribedfee.

(2)ThePatentRegistrationOfficeshallnotexaminetheinternationalapplicationsubmitted
undersubsection(1)priortotheexpirationofthirtymonthsfromtheprioritydate.
(3)Notwithstandingsubsection(2),thePatentRegistrationOfficemay,ontherequestofthe
applicant,examineaninternationalapplicationpriortotheexpirationofthirtymonthsfrom
theprioritydate,iftheapplicanthas—(a)submittedtothePatentRegistrationOfficeacopy
oftheinternationalapplicationintheEnglishlanguage;and7Patents(Amendment)(b)paid

(4) If the applicant does not comply with the requirements of subsection (1), the

havebeenwithdrawn.
(5) Any application which has entered the national phase shall comply with the
requirementsofthisAct.
Section78OA.Reinstatement
(1)Whereaninternationalapplicationisconsideredtobewithdrawnundersection78O,the
applicantmay,inwriting,applytothePatentRegistrationOfficetohavetheinternational
applicationreinstatedby—
(a)submittingtothePatentRegistrationOfficeacopyoftheinternationalapplication
intheEnglishlanguageandpayingtheprescribedfeeundersubsection78O(1);
(b)submittingawrittenstatementstatingthereasonsforthefailuretocomplywith
subsection78O(1)andadeclarationorotherevidenceinsupportofthereasonsfor
suchfailure;and

(c)payingtheprescribedfee.
(2)Theapplicationundersubsection(1)shallbemadewithinwhicheverofthefollowing
periodexpiresfirst:
(a)twomonthsfromthedateofremovalofthecauseofthefailuretomeetthetime
limitprovidedinsubsection78O(1);or
(b) twelve months from the date of the expiration of the time limit provided in
subsection78O(1).
(3)Where the Patent Registration Office is satisfied that the failure by the applicant to
comply with the requirements of subsection 78O(1) was unintentional, the Patent
RegistrationOfficeshallreinstatetherightsoftheapplicantwithrespecttotheinternational
application.
(4)WherethePatentRegistrationOfficeisnotsatisfiedthatthefailurebytheapplicantto
comply with the requirements of subsection 78O(1) was unintentional, the Patent
RegistrationOfficeshallnotifytheapplicantthatitintendstorefusetheapplicationandgive
anopportunitytotheapplicanttomakeawrittenrepresentationonthe intendedrefusal
withinfourteendaysfromthedateofthenotice.
(5)Afterconsideringanyrepresentationmadebytheapplicantundersubsection(4),the
PatentRegistrationOfficeshalldecidewhethertoreinstatetheinternationalapplicationor
torefusetheapplicationforreinstatementandnotifytheapplicantofitsdecision.

(2)TheRegistrarshallnotmakeanamendmentunderthissectioniftheamendmentwould
have the effect of disclosing a matter which extends beyond that disclosed before the
amendmentoriftheamendmentwouldhavetheeffectofextendingtheprotectionconferred
atthetimeofgrantofthepatent.
(3) The Registrar shall notmake an amendment under this section if there are pending
beforeanyCourtproceedingsinwhichthevalidityofthepatentmaybeputinissue.
(4)Everyrequestundersubsection(1)shallbeaccompaniedbytheprescribedfee.
(5)Notwithstanding subsection (4), no fee shall be payable by the owner of a patent in
respectofarequesttocorrectamistakeoranerrorinanydocumentissuedbythePatent
RegistrationOfficeunlesssuchmistakeorerroriscausedorcontributedtobysuchowner.

isliableonconvictiontoafinenotexceedingtwothousandringgitortoimprisonmentfora
termnotexceedingsixmonthsortoboth.
(3)CostsawardedbytheRegistrarmayindefaultofpaymentberecoveredinaCourtof
competentjurisdictionasadebtduebythepersonagainstwhomthecostswereaccorded
tothepersoninwhosefavourtheywereaccorded.
Section81.Exerciseofdiscretionarypower.
WhereanydiscretionarypowerisgiventotheRegistrarbythisActoranyregulationsmade
thereunder,heshallnotexercisethepoweronanypersonwhomaybeadverselyaffectedby
hisdecisionwithoutgivingtothepersonanopportunityofbeingheard.
Section82.Extensionoftime.
Subjecttosubsection27(1A),subsection29A(8)andsubsection30(4),where,bythisActor
anyregulationsmadethereunderatimeisspecifiedwithinwhichanactorthingistobe
done,theRegistrarmay,unlessotherwiseexpresslydirectedbytheCourt,extendthetime
eitherbeforeorafteritsexpiration,uponpaymentoftheprescribedfee.

(a)where there is national emergency orwhere the public interest, in particular,
nationalsecurity,nutrition,healthor thedevelopmentofothervitalsectorsof the
nationaleconomyasdeterminedbytheGovernment,sorequires;or
(b) where a judicial or relevant authority has determined that the manner of
exploitationbytheownerofthepatentorhislicenseeisanti‐competitive,
theMinistermay decide that, evenwithout the agreement of the owner of the patent, a
Governmentagencyora thirdpersondesignatedby theMinistermayexploitapatented
invention.

(2)Theownerofthepatentshallbenotifiedof thedecisionof theMinisterassoonas is
reasonablypracticable.
(3)Theexploitationofthepatentedinventionshallbelimitedtothepurposeforwhichit
wasauthorizedandshallbesubjecttothepaymenttotheownerofthepatentofanadequate
remunerationforsuchexploitation,takingintoaccount‐
(a)theeconomicvalueoftheMinister’sauthorizationasdeterminedinthedecision;
and
(b)whereadecisionhasbeentakenunderparagraph(1)(b),theneedtocorrectanti‐
competitivepractices.
(4)TheMinistershallmakehisdecisionundersubsection(3)afterhearingtheownerofthe
patentandanyotherinterestedpersoniftheywishedtobeheard.
(5)Theexploitationofapatentedinventioninthefieldofsemi‐conductortechnologyshall
onlybeauthorizedeither‐
(a)forpublicnon‐commercialuse;or
(b) where a judicial or relevant authority has determined that the manner of
exploitationofthepatentedinvention,bytheownerofthepatentorhislicensee,is
anti‐competitiveandiftheMinisterissatisfiedthattheauthorizationwouldremedy
suchanti‐competitivepractice.
(6)Theauthorizationshallnotexclude‐
(a)thecontinuedexercisebytheownerofthepatentofhisrightsundersubsection
36(1);or

(b)theissuanceofcompulsorylicencesunderPartX.
(7)WhereathirdpersonhasbeendesignatedbytheMinister,theauthorizationmayonly
betransferredwiththegoodwillorbusinessofthatpersonorwiththatpartofthegoodwill
orbusinessinwhichthepatentedinventionisbeingexploited.
(8) The exploitation of the invention by the Government agency or the third person
designatedbytheMinistershallbepredominantlyforthesupplyofthemarketinMalaysia.
(9)Upontherequestof‐
(a)theownerofthepatent;or
(b) theGovernmentagencyor the thirdpersonauthorized toexploit thepatented
invention,
theMinistermay,afterhearingtheparties,ifeitherorbothwishtobeheard,varytheterms
of the decision authorizing the exploitation of the patented invention to the extent that
changedcircumstancesjustifysuchvariation.
(10) Upon the request of the owner of the patent, the Minister shall terminate the
authorizationifheissatisfied,afterhearingtheparties,ifeitherorbothwishtobeheard,
thatthecircumstancesmentionedinsubsection(1)whichledtohisdecisionhaveceasedto
existandareunlikelytorecurorthattheGovernmentagencyorthethirdpersondesignated
byhimhasfailedtocomplywiththetermsofthedecision.
(11)Notwithstandingsubsection(10),theMinistershallnotterminatetheauthorizationif
he is satisfied that the need for adequate protection of the legitimate interests of the
Governmentagencyorthethirdpersondesignatedbyhimjustifiesthemaintenanceofthe
decision.

(12)Theownerofapatent,aGovernmentagencyorthethirdpersonauthorizedtoexploit
apatentedinventionmayappealtotheCourtagainstthedecisionoftheMinisterunderthis
section.
(13)Inthissection“Governmentagency”meanstheFederalGovernmentortheGovernment
ofaStateandincludesaMinistryorDepartmentofthatGovernment.
Section85.RefusaltograntpatentbytheRegistrar.
TheRegistrarintheexerciseofhispowersshallhavetherighttorefusetograntapatentfor
products or processes scheduled under regulationsmade by theMinister under this Act
whereitappearstotheRegistrarthatthegrantingofsuchapatentwouldbeprejudicialto
theinterestorsecurityofthenation.
Section86.Patentagents.
(1)ThereshallbekeptatthePatentRegistrationOfficeaRegisterofPatentsAgents.
(2)Nopersonshallcarryonbusiness,practice,act,describehimself,holdhimselfout,or
permithimselftobedescribedorheldout,asapatentagentunlessheisregisteredinthe
RegisterofPatentsAgents.
(3)Theregistrationofapatentagentmentionedinsubsection(2)shallbe inaccordance
withtheregulationsasmaybeprescribedbytheMinisterunderthisAct.
(4)The appointmentor changeof a patent agent shall not be effective against any third
personunlessitisregisteredintheRegisterofPatentsAgents.
(5)ApersonwhohasneitherhisdomicilenorresidenceinMalaysiamaynotproceedbefore
thePatentRegistrationOfficeundertheprovisionsofthisActinrespectofhispatentexcept
throughapatentagent.

Section87.Regulations.
(1)SubjecttotheprovisionsofthisAct,theMinistermaymakeregulationsforthepurpose
ofcarryingintoeffecttheprovisionsofthisAct.
(2)Inparticularandwithoutprejudicetothegeneralityofsubsection(1),suchregulations
mayprovideforalloranyofthefollowing:
(a) toregulatetheproceduretobefollowedinconnectionwithanyproceedingor
othermatter before theRegistrar or thePatentRegistrationOffice under thisAct
includingtheserviceofdocuments;
(b)toclassifygoodsincludingmethodsandprocessesforthepurposeofregistration
ofpatents;
(c)tomakeorrequireduplicationofpatentsorotherdocuments;
(d)tosecureandregulatethepublishing,sellingordistributing,insuchmanneras
theMinistermaythinkfit,ofcopiesofpatentsandotherdocuments;
(e)toprescribethefeespayableforapplicationsforpatentsandotherfeespayable
forothermattersprescribedunderthisAct;
(f) to prescribe forms, books, registers, documents and othermatters to be used
underthisAct;
(g)toregulategenerallyonmatterspertainingtothebusinessofpatentscarriedon
inthePatentRegistrationOfficewhetherornotspeciallyprescribedunderthisAct.

(1)AnypersonaggrievedbyanydecisionororderoftheRegistrarortheCorporationmay

non‐use,andshallalsobeaccompaniedbytheprescribed
fee.

(4) Wheretheownerofacertificateforautilityinnovation
intends tokeep thecertificate in force,heshall, twelve
months before the expiration of the third and each
succeedingyearduringthetermofthecertificate,paythe
prescribedannualfee:
Provided,however,thataperiodofgraceofsixmonths
shallbeallowedafter thedateof suchexpirationupon
paymentofsuchsurchargeasmaybeprescribed.
(5) Iftheannualfeeisnotpaidinaccordancewithsubsection
