根据移民法规定，如果你有违反移民法的第 212 条的行为，那么

你就有可能需要通过申请 I-601 豁免才进入美国。在申请豁免过程中，

最关键的一点就是要证明符合资格的美国公民亲属或者绿卡持有者亲属

（qualifying relative）会受到极端困难（extreme hardship）.

移民法上没有“极端困难”的定义。但是根据法院的判例，可以

通过以下方面来证明“极端困难”：美国亲属所受到精神和心理的伤

害，美国亲属在美国和境外的联系，美国亲属若定居他国的国情，申请

人的年龄，在美国居留的时间和对美国做的贡献等等因素。

美国公民客人为其墨西哥籍的先生申请 I-601 豁免，但是被移民

局要求补件。客人在找到我们律师所的时候，已经距离补件截止日期只

有两个星期的时候。我们律师经过仔细阅读客人已经提交的材料，根据

客人的实际情况，递交更多证明其生活和精神陷入极端困难。

最终移民局批准了这 I-601豁免的申请。
