Last Will and Testament

Edward Allan Richardson

I, Edward Allan Richardson a resident of Marion County, West Virginia, being of sound mind and

disposing memory and over the age of eighteen (18) years, and not being motivated by any duress,

menace, fraud, mistake, or undue influence, do make, publish, and declare this document as my Last

Will and Testament. This will revokes all wills and codicils that I may have previously executed and

disposes of all property that I own at the time of my death, wherever situated.

FIRST: My Executor, named in Paragraph 8, shall pay all of my funeral expenses, expenses of

administering my estate, and debts, other than debts that I have incurred by borrowing against the cash

surrender value of life insurance policies on my life and debts to the extent secured by the assignment

of life insurance policies on my life. Nothing herein shall require the payment of any installment prior to

its due date or the payment of any indebtedness secured by a mortgage or other lien on any property.

My Executor may extend or renew any debt upon any terms and for any period of time as he may deem

appropriate. My estate, however, shall not bear my spouse's share of any community debts or expenses

allocable against (his/her) share of our community property. My Executor shall also pay all taxes

(including any interest or penalties thereon) payable by reason of my death, including taxes on property

passing outside of my probate estate. The ultimate burden of all taxes, debts, funeral expenses, and

estate administration expenses shall be apportioned among and collected from the beneficiaries of all of

the assets included within my gross taxable estate, whether passing under my will, by trust instrument,

contract or beneficiary designation, or otherwise, but excluding my personal and household effects

passing under Paragraph 4 of this Will. I direct my executor to take any action necessary to collect

these taxes, debts, and expenses from the responsible beneficiaries, including withholding of an

appropriate amount from any property distributable to a beneficiary. Any charges to be made against

my residuary estate shall be paid in such order and out of such of the assets in my residuary estate

(including its income) as my Executor deems appropriate.

SECOND: Mark Richardson (son) because he has not heard from him in over ten years.

THIRD: (devise if there is one)

FOURTH: 2005 Chevrolet Corvette to his brother Mathew Richardson

FIFTH: (demonstrative bequest)

SIXTH: The guardian of Elizabeth Richardson should be her mother Claudia Louise Richardson

her mother and if her mother is unable to care for Elizabeth then her guardian will be Mark Richardson

her uncle. She will be under their guardianship until she turns 18 years old.

SEVENTH: I leave all of my remaining property, including any lapsed or void gift, to Claudia

Louise Richardson, (wife). If she dies before I do then three out of four of my kids are to each receive a

equal share (kids Mary Richardson, Elizabeth Richardson, and Donald Richardson). I want my grandkids

to inherit from a parent under per stirpes.

EIGHTH: I hereby nominate and appoint Claudia Louise Richardson, my wife, as Executor of this

my Last Will and Testament and request that she shall not be required to give surety upon her official

bond. In the event that she predeceases me, or is unwilling or unable to qualify as such, then I nominate

and appoint Mark Richardson, my brother, as Executor, and request that he shall not be required to give

surety upon his official bond.

My Executor shall be authorized to carry out all provisions of this. My executor may sell,

exchange, assign, transfer, and convey any security or property, real or personal, held in my estate at

public or private sale, at a time and price and upon those terms and conditions (including credit) that he

may determine. In addition, without further license or order of any Court, my Executor shall have the

power to employ and to compensate from my estate such surveyors, attorneys, and other advisors as

my Executor shall deem necessary or advisable and to execute on behalf of my estate deeds or other

documents necessary to complete the sale and transfer of my real or personal property or undivided

interest therein.

NINTH: If any part of this Will is declared invalid, illegal, or inoperative for any reason, it

is my intent that the remaining parts shall be effective and fully operative, and that any Court so

interpreting this Will and any provision in it construe in favor of survival.

TENTH: I further request that the attesting witnesses hereto to make and subscribe an affidavit

or the purpose of proving this Will then the same is offered for probate.

AFFIDAVIT

The foregoing instrument, consisting of 5 typewritten pages, including this page, each bearing the signature of the Testator, was on February 25, 2015, signed, published and declared by Edward Allan Richardson, as and for his Last Will and Testament, in the presence of us, who at his request and in the presence of each other, all being present at the same time, have hereunto subscribed our names as the attesting witnesses on February 25, 2015. We declare that we are of sound mind and of the proper age to witness a will, and that to the best of our knowledge, the Testator is of the age of majority, is otherwise legally competent to make a will, and appears of sound mind and under no undue influence or constraint.

This day personally appeared before me, the undersigned authority, a Notary Public in and for the County and State

aforesaid, _____________________________, as Witness No. 1, and ________________________________, as Witness No. 2,

both of whom being first being duly sworn, upon their oaths, do depose and say:

We do hereby declare to the undersigned authority we are the attesting witnesses and were present at the execution

of the Last Will and Testament of Edward Allan Richardson, hereto annexed; that we saw the Testator sign the annexed Will

and heard him publish and declare the same to be his Last Will and Testament; that we subscribed our names as witnesses to

the Will at the request of the Testator in his presence and in the presence of each other, all being present at the same time;

that the Testator signed the Will willingly; that he executed it as his free and voluntary act for the purposes therein expressed;

and that to the best of our knowledge, at the time of the execution of the annexed Will, the Testator was above the age of

eighteen (18) years, of sound mind, and under no constraint or undue influence.
