INCIDENT DETAILS On 09-04-15, at approximately 0343 hours, Eric Clarkson called LVMPD Dispatch to report there were at least two males in his backyard and they were possibly armed. Officers Robertson and Grego-Smith were dispatched and responded to 6729 Oveja Circle. Upon Officers Robertson and Grego-Smith’s arrival, they made contact with Clarkson who allowed them into the residence and directed them to the back door, as Clarkson believed the suspects were possibly still in the backyard. Officers Robertson and Grego-Smith formulated a plan to clear the backyard. Officer Grego-Smith drew his firearm and stood to the left of the door while Officer Robertson stood behind him to his right. The backdoor required a key to unlock, so Officer Robertson holstered his gun to use both hands to unlock and open the door.

As Officer Robertson opened the door, the suspects, later identified as Steven Turner and Clemon Hudson, immediately fired their weapons. Turner, armed with an SKS rifle, fired three times, hitting Officer Robertson once in the right hip. Officer Robertson fell to the floor as Officer Grego-Smith took a kneeling position and returned fire. Officer Grego-Smith fired his weapon 12 times. Hudson fired his shotgun one time. The projectiles travelled over the top of Officer Robertson and struck the east window of the residence. Hudson’s shotgun was struck by one of Officer Grego-Smith’s rounds which jammed the weapon. One of Turner’s rounds ricocheted off the brick patio, fragmented, and hit him in the calf area. Turner fled the area, and Hudson took cover behind a pony wall that separated the patio and the grass area in the backyard. Officer Grego-Smith maintained cover over Robertson until additional officers arrived and performed a down officer rescue. K-9 Sergeant Bitsko, along with K-9 Officers Overson and Hemsey, gave Hudson verbal commands to drop his weapon. Hudson refused to comply with their orders so K-9 Sergeant Bitsko deployed his dog. The dog bit Hudson which allowed officers to approach and take Hudson into custody. Hudson was still in possession of the shotgun and suffered several bites to his hands and head. Hudson was transported to UMC trauma treated and booked into CCDC. Turner was later found at Westcliffe Drive and Upper Hills Court walking in the roadway by two perimeter officers. Turner was taken into custody. Turner was transported to UMC trauma for treatment of his gunshot wound, and later booked into CCDC. Upon arrival of investigators, Sergeant Marlow conducted a briefing. The following persons were present:

BODY WORN CAMERAS Officer Louis Russo Officer Russo advised FIT detectives he had responded to assist at 6729 Oveja Circle. Upon arrival Officer Russo activated his body worn camera (BWC). Officer Russo downloaded his BWC footage on 09-09-15 and was interviewed by Detective Jex. V. HOSPITAL Detective Jex and SCSA Scott responded to UMC and made contact with Officer Robertson. After a brief interview with Officer Robertson, Detective Jex made contact with and interviewed Hudson for the first time. VI. SCENE WALK-THROUGHS The purpose of the scene walk-through is to help investigators develop an understanding of the scene, including identifying officer location(s) at the time deadly force was used, identifying potential physical evidence, and re-creating a time line of the incident. On 09-04-15, at approximately 0923 hours, Officer Grego-Smith provided a walk-through of the scene in the presence of the following persons:

1) Captain McCarthy 2) Lieutenant Plummer 3) Detective Colon 4) Detective Patton 5) PPA representative Officer Yant 6) PPA attorney David Roger 7) PPA attorney Gill During the walk-through, which was not video or audio recorded, Officer Grego-Smith relayed the following information through PPA attorney David Roger: Officers Grego-Smith and Robertson responded to a prowler call where they were let into the residence by the homeowner. The officers were advised by the homeowner that the armed suspects were in the backyard. The officers formulated a plan to clear the backyard by exiting through the back door of the residence. Officer Robertson looked out the kitchen window and advised he did not see anyone but it was dark. Officer Grego-Smith took a position to the left of the door with his firearm drawn. Officer Robertson had to holster his gun in order to manipulate the key and the doorknob of the back door. Officer Robertson opened the door as Officer Grego-Smith took a kneeling position facing the backyard. As the door opened Officer Grego-Smith heard a gunshot from the outside and Officer Robertson advised he had been hit. Officer Grego-Smith saw a black male standing on the back patio. Officer Grego-Smith fired his weapon approximately eight to ten times. Officer Grego-Smith was unable to see the suspect’s location and posted at the rear door as officers arrived to rescue Officer Robertson.

PUBLIC SAFETY STATEMENT (PSS) On 09-04-15, at approximately 0722 hours, Detective Colon interviewed Lieutenant Donegan in reference to the Public Safety Statement she obtained from Officer Grego-Smith. VIII. OFFICER WEAPON COUNTDOWNS Officer Grego-Smith On 09-04-15, Officer Grego-Smith had his duty weapon counted down at LVMPD Headquarters. Officer Grego-Smith was photographed by CSI personnel for appearance purposes, and his weapons were photographed for identification purposes. The following persons were present during the countdown: 1) Detective Fasulo 2) Detective Jaeger 3) SCSA Stephens 4) PPA representative Officer Yant 5) PPA attorney David Roger Officer Grego-Smith was dressed in a standard LVMPD long sleeve summer uniform. He wore LVMPD patches on each shoulder and an LVMPD badge over his left breast. Officer Grego-Smith wore a black duty belt with attached tools and equipment as part of his position in patrol. Officer Grego-Smith’s handgun was carried on the right side of his body and secured in a holster. Prior to countdown, Officer Grego-Smith stated he carried 17 cartridges in the magazine loaded in his firearm and one cartridge in the chamber (17+1). Officer Grego-Smith carried three extra 17 round magazines on his duty belt. Officer Grego-Smith stated he did a tactical

Officer Jacob Longwell, P# 9183, took possession of Officer Robertson’s gear and transported it back to NWAC where it was secured. IX. SEARCH WARRANTS On 09-04-15, at approximately 0710 hours, a telephonic search warrant was obtained by Detective Patton from Judge Melanie Tobiasson for the residence at 6729 Oveja Circle, Las Vegas, NV and a 1997 Toyota Camry bearing NV license plate OOA787. Items Sought to be Seized: 1) Paperwork such as rent receipts, utility bills, and addressed letters, showing the names of

persons residing at the premise. Paperwork such as proof of insurance; DMV registration showing the names of persons that are responsible for the vehicles.

2) Items of potential value or evidence, such as jewelry, watches, money, credit cards, identification, and/or other like items including receipts of the same.

3) Photographs, video and/or audio tapes or discs. 4) Cellular phones, desktops, or laptop computers that could potentially lead to evidence

relating to the suspects. 5) Telephonic information to include: caller ID history, answering machines, messages,

phone directories, call history, photographs, and/or video stored electronically in residential and/or on suspects’ cell phones.

6) The thorough examination and documentation of the crime scene to discover trace evidence, to include but not limited to: fingerprints, blood, hair fibers, and bodily fluid samples.

On 09-04-15, at approximately 1349 hours, a piggyback telephonic search warrant was obtained by Detective Patton from Judge Melanie Tobiasson for DNA samples (epithelial cells) from Steven Turner and Clemon Hudson collected via buccal swab kit. 1997 Toyota Camry On 09-04-15, at approximately 1500 hours, Detectives Jaeger and Pazos served a search

warrant on a silver Toyota Camry bearing NV license plate 00A787 and VIN

JT2BG22K1V0007070. The vehicle had been sealed and towed to the LVMPD Forensics

Laboratory located at 5555 W. Badura Avenue, Las Vegas, NV.

SCSA Randall McPhail, P# 3326, photographed the vehicle’s overall condition. Each of the

The vehicle was processed for fingerprints and approximately 30 lifts were collected. A copy of the Duplicate Original Search Warrant and the Warrant Return were placed inside the vehicle and photographed in place. After the vehicle was processed, Fast Towing towed from the crime lab to their impound lot.

DNA Samples (Epithelial Cells) from Steven Turner and Clemon Hudson On 09-04-15, at approximately 1650 hours, Detective Jex collected epithelial cells via buccal swab kit from Steven Turner and Clemon Hudson at CCDC. Detective Pazos transported the buccal swab kits to the LVMPD Forensics Laboratory. The following items were impounded as part of the search warrant: 1) Buccal swab of Steven Turner 2) Buccal swab of Clemon Hudson Cellular Phones Historical precise location information was obtained from cellular phone number that was recovered from the above vehicle and impounded. Two cellular phones recovered from the suspects’ vehicle were submitted to the LVMPD Computer Forensics Laboratory. Specific evidence sought: 1) Digitally stored records, information, and data which may constitute evidence of suspects’

involvement in the planning or commission of crimes involving this incident.

At 0740 hours, Sr. Crime Scene Analyst (SCSA) R. Dahn #5947 (undersigned) and SCSA K. Meckler #14402 arrived to the scene at 6729 Oveja Circle. Oveja Circle is a cul-de-sac located at the west end of Oveja Street. Nunca Street is a northbound street which separates Oveja Circle and Oveja Street. The scene had been secured with yellow crime scene tape across Nunca Street preventing any south entry and across Lorenzie Street to prevent entry onto Oveja Street. Additional crime scene tape had been placed into the scene creating an inner perimeter.

THE OUTDOOR SCENE Vehicle 1 V1 was parked along the north curb in front of 6720 Oveja Circle. The front end was oriented towards the northwest. The vehicle was located north and east of the scene at 6729 Oveja Circle. V1 was parked approximately 108' from the front porch at 6729 Oveja Circle. A search warrant was executed to enter the vehicle. A preliminary investigation of the vehicle on scene was conducted by SCSA J. Smith. A Samsung Galaxy cell phone was observed on the right rear floorboard. A HTC Cricket cell phone was located inside the compartment below the stereo. A black metal gun magazine (Item 4) was also located inside the glove compartment. The magazine contained five (5) cartridges bearing the headstamp "SUPER X". SCSA J. Smith recovered the magazine and cartridges. The two (2) cell phones were recovered by Detective J. Melvin #7455. V1 was sealed with orange LVMPD crime scene seals by SCSA S. Fletcher. The vehicle was towed to the CSI garage arriving at 1352 hours. SCSA J. Smith followed the vehicle to CSI. The vehicle was processed at CSI by SCSA R. McPhail #3326. Please refer to his crime scene report for further information on vehicle processing. Vehicle 2 V2, an LVMPD Patrol vehicle was parked along the north curb of Oveja Circle behind and east of V1. A red biohazard bag (item 49) was located on top of the hood of the vehicle. The bag contained two (2) items of clothing consisting of the following: a cut size medium black/gray camouflage "Northwest Territory" shirt (item 50) and a pair of black/orange/gray "Layer 8" socks with apparent blood (item 51). Vehicles 3 and 4 V3 and V4 were stopped on the south side of Oveja Street east of the crime scene at 6729 Oveja Circle. V3 was stopped in the street in front of 6705 Oveja Street. V4 was stopped in the street in front of V3 with the engine running. V4 was in front of 6709 Oveja Street. Apparent Blood Located Apparent blood was located on the north sidewalk of Oveja Street approximately 51'6" east of Nunca Street. The apparent blood was labeled AB1 and a sample was collected (item 36).

THE SCENE AT 6729 OVEJA CIRCLE The Driveway The residence faces towards the east with an east front yard and driveway. A white Scion bearing license plate NV 111WM was parked in the driveway. Apparent blood and cut clothing were located on the driveway behind the Scion. The shirt had an LVMPD name plate "J. Robertson" and an LVMPD badge attached to the front. The clothing consisted of the following: a pair of cut size 42-short "Flying Cross" LVMPD uniform pants with apparent blood and a material defect through the top of the right pants leg and a second material defect through the right rear pocket (item 45); one (1) size XL cut black "5.11" inner duty belt (Item 45A); one (1) cut "Conquerer" LVMPD long-sleeve uniform shirt with apparent blood and a material defect through the right back side (item 46); a "Point Blank" body armor vest (item 47) with apparent blood and a pair of size large "Hatch" gloves (item 48).

The Residence The residence was a four (4) bedroom/two (2) bathroom single story home. A large bedroom was located in the southeast corner of the residence. Two (2) hallways were located off of the south side of the living room and dining room. The east hallway leads to a southeast central bedroom. The west hallway allows access to a southwest central bedroom and to the west master bedroom suite. A long rectangular bathroom is located between the hallways allowing access from either hall.

The living room was located on the east central side of the house. The kitchen was located in the northwest corner of the house with the dining room being between the kitchen and the west hallway. The west dining room door exits out to a covered patio area. The backyard consists of a fenced pool area on the southwest end and an elevated sitting area surrounded by grass and planters west of the covered patio. Front Entrvway The east facing front door and metal security door were open when I arrived. The security door had a perforated hole through the metal from an apparent projectile. Several blood drops were observed on the entryway floor. Living Room The living room was located east of the entryway. The east living room window adjacent to the front door was covered by a set of white mini blinds. The mini blinds were closed and had numerous perforated holes consistent with being hit with shotgun pellets. The window was broken with broken glass on the windowsill and floor below. Multiple shotgun pellets (item 21) were collected from the interior windowsill. Two (2) pieces of shotgun wads (items 22 & 23) were also recovered from the windowsill.

A flat screen television was on a shelf in a television stand in front of the east living room window. The television stand was designed with a large decorative white metal ring around the shelf. Numerous small dents were located on the south side of the metal ring consistent with being impacted by shot pellets. Additional shotgun pellets (item 20) were located and recovered from the living room floor. A pedestal stand was located south of the television and in front of the east living room window. A 'Buddha" statue on the pedestal had also apparently been damaged by gunfire. Two couches were located along the north and west sides of the living room. A coffee table was located in front of the couches. A 9mm cartridge case bearing the headstamp "SPEER 9MM LUGER" (item 16) was located on the northwest living room floor near the couches. A large wood bookcase was against the south living room wall. A "Streamlight Strion" LED flashlight (item 7) was located on the floor south of the west couch and west of the bookcase. Dining Room The west dining room door was open with a set of keys hanging from the interior lock. The rectangular-shaped dining room table had apparently shifted northward out of its original location. A southwest table leg mark was observed on the floor east of the open door. The glass tabletop also had shifted and a small white round buffer pad was on the floor south of the table. The dining room chairs were disheveled with the north dining room chair tipped over on its side. A .40 HK USP semiautomatic handgun bearing serial (item 5) was lying on top of the northeast end of the dining table. The 4" barrel was oriented towards the south. The handgun was marked "Made in Germany" and had a black finish and black grips. A .40 cartridge headstamped .40 'SPEER 40 S&W" (item SC) was recovered from the chamber. The magazine (item SA) removed from the gun contained thirteen (13) .40 cartridges (item 58) headstamped "SPEER 40 S&W'. Ten (10) 9mm cartridge cases bearing the headstamp 'SPEER 9mm LUGER+P" were located and recovered on the dining room floor underneath and around the dining room table. Three (3) cartridge cases were located south of the table (items 8-10) and two (2) cartridge cases (item 11 & 12) were on the floor west of the table. One (1) cartridge case (item 19) was next to a trash can between the west dining room wall and the table. One (1) cartridge case (item 13) was near the southeast table leg and one (1) cartridge case (item 14) was under the south end of the table. Two (2) cartridge cases (items 17 & 18) were on the central east side of the table and near the overturned chair. A 9mm cartridge case bearing the headstamp "SPEER 9mm LUGER+P" (item 15) was also located and recovered on the dining room table south of the handgun. A 9mm "Glock" magazine (Item 6) was lying on the dining room floor against the west dining room wall south of the open patio door. The magazine contained five (5) 9mm cartridges (item 6A) headstamped 'SPEER 9mm LUGER+P".

Covered Patio Area The west dining room door opens out to a covered patio area. The patio was furnished with an oval table and six (6) chairs. The chairs were disheveled around the table. Two (2) chairs were together upright near the northwest comer of the table. A third upright chair was located several feet to the north of the table. The fourth and fifth chairs were located on the east side of the table. The more north chair on the east side of the table was overturned and lying on the ground. The other east chair was upright. Apparent blood drops were located on the patio near the overturned chair and continued northwest away from the east side of the table. The apparent blood drops were labeled AB2 and a sample was collected (item 37). The sixth chair was located at the south end of the table. The chair had a perforating bullet hole along the right edge of the seat back and material defects on the back side of the right arm rest. A bullet fragment (item 35) inside a piece of white stuffing was located and recovered from atop the south end of the patio table. An entertainment center was positioned along the south wall south of the patio table. A television and a few bottles of sunscreen were on the upper shelf. The upper left edge of the television, a bottle of "California Tan" sunscreen and the shelf had been damaged by gunfire. Several pieces of black plastic (item 32) consistent with being from the television were located on the ground between the entertainment center and the table. A bullet fragment (item 29) was located on the top shelf near the television. Three (3) bullet fragments (Items 28, 30 & 31) were located on the patio floor below the entertainment unit. A .25 black "Beretta", model 950 BS semiautomatic handgun (item 3) bearing serial

was on the ground below the south end of the patio table. A .25 cartridge (item 3C) bearing headstamp "FC 25 AUTO" was in the chamber. The metal magazine (item 3A) in the handgun contained eight (8) .25 cartridges (item 3B) bearing the headstamp "FC 25 AUTO". A bullet (item 24) was located and recovered on the southeast patio floor. Three (3) 7.62X39 cartridge cases headstamped "Tulammo 7.62X39" (items 25-27) were located and recovered from the south end of the patio. The west side of the patio (south end) had been built out with an orange piece of corrugated metal attached to the patio cover and a piece of orange corrugated metal on the ground. A sunscreen had apparently been hanging from the upper piece of metal to the lower piece of metal. The south side of the sunscreen was hanging down. The sunscreen had apparently been hit by gunfire with twelve (12) holes through the mesh material. The lower piece of corrugated metal was pushed inward onto the patio. A pair of size 12 black and white "Reebok" athletic shoes (item 33) were near the disturbed lower piece of corrugated metal. A black and tan Yugoslavian SKS model 59/66 7.62X39 semiautomatic rifle (item 1) bearing serial #478852 was lying on the ground on the exterior side of the

corrugated metal. The rifle had a cartridge (item 1C) in the chamber bearing the headstamp "71 93". The tan "Tapco" 20 capacity magazine (item 1A) in the rifle contained six cartridges (item 1B). Five (5) of the cartridges were headstamped "Tulammo 7.62 X 39" and one (1) of the cartridges was bearing the headstamp "71 93". A black 12 gauge "Mossberg" model 500A pump action shotgun (item 2) bearing serial #P081210 was leaning against the disturbed metal adjacent to the SKS rifle. The shotgun had a damage forend at the time of recovery and could not be cleared on scene. The West Back Yard The west backyard had an elevated patio area furnished with patio furniture. The patio furniture consisted of two (2) brown wicker loveseats on the northwest and south sides. Three (3) brown wicker tables and three (3) brown wicker chairs were set up in between the loveseats around the elevated patio. The chairs and the love seats had cushions on them. A trash can was located on the north side of the patio furniture. Apparent bullet holes were located in the cushions of the northwest loveseat, the trash can and the west back yard perimeter wall. A black NHL knit beanie cap (item 34) was lying on a walkway between the covered patio area and the elevated deck in the back yard. The beanie cap had an orange stripe and an orange pom pom. Apparent blood and a tuft of black hair were located on the interior side of the cap. Apparent blood drops labeled AB3 were located on the walkway near the beanie cap. A sample (item 38) was collected of the apparent blood. The back yard had grass around the central elevated patio area. Brick planters were located along the west side of the house and in front of the west perimeter wall. A large black broken ceramic pot had apparently been hit with gunfire. A hammer and a hatchet were lying on the north end of the planter adjacent to the brown ceramic pot. A brick wall with a gate separated the back yard and the pool area located in the south corner of the pie-shaped piece of property. A broken collapsed lid covering the pool's northeast filter basket had been broken consistent with having been step on. TRAJECTORIES/BULLET PATHS SCSA S. Fletcher performed the trajectory determination during this investigation. Bullet holes "A-L" were located in the east facing side of the sunscreen hanging from the west side of the covered patio. The corresponding exit holes, labeled "A1-L1" were located on

the west-facing side of the sunscreen.

A bullet impact, labeled "M4, was located in the east-facing side of the west block wall. With the use of trajectory rods, it was determined that the bullet entered through the front of the smaller loveseat cushion ("M") exited out the back of the cushion ("M1"), entered

through the front side of the larger back cushion ("M2), exited out the back of the larger back cushion ("M3") terminating into the east facing side of the west block wall ("M4).

An entertainment center was positioned along the south wall of the residence underneath the covered patio in the backyard. There was a television inside the cabinet. A perforating bullet hole, labeled "U', was located through the front top edge of the television and exited out the top edge, labeled "U1". A perforating bullet hole, labeled "U2', was located though the underside portion of the wooden shelf positioned above the television and exited out the top side, labeled "U3. Numerous bullet fragment impacts, labeled "U4, were located into the interior east side of the upper cabinet. U: Measured approximately 5'0" up from the ground and approximately 11½' west of the east edge of the cabinet. U1: Measured approximately 5'1' up from the ground and approximately 8 ½' west of the east edge of the cabinet. U2: Measured approximately 5'1 ½ " up from the ground and approximately 8' west of the east edge of the cabinet. U3: Measured approximately 5'2' up from the ground and approximately 8' west of the east edge of the cabinet. U4: Measured approximately 5'6" up from the ground. With the use of trajectory rods, it was determined that the path of the bullet through the television set/entertainment cabinet entered through the front top edge of the television ("U') and exited out the top of the television ("U1"), continued through the shelf above the

television ("U2') and exited out the top side of the shelf ("U3"), where it terminated into the

interior east side of the upper cabinet ("U4). It had an upward vertical angle of impact of approximately 25° and a horizontal angle of impact of approximately 23° from right to left. Bullet holes, labeled “V” and "V1'' were located through the front entry door security gate. Bullet hole “V” was positioned on the interior side of the door with "V1”' positioned on the exterior side. They both measured in approximately 5'2' up from the ground and approximately 2' over from the leading edge of the door. Bullet hole “V” was tested for both lead and copper using the Bullet Hole Testing Kit with positive results for both. The east living room window had a shotgun pattern spread measuring approximately 1'9' X 1'3'. The center of the pattern measured approximately 3'10" up from the floor and approximately 2'10' north of the south front entry door frame.

DNA Collection

The following six (6) areas were swabbed at the residence for possible touch DNA: the exterior handle on the front security door (item 39); the exterior front door handle (item 40); the north exterior side garage door handle (item 41); the exterior rear patio door handle (Item 42); the handle of the hammer and the hatchet located on the southeast planter (Items 43 & 44).

SMITH'S PRELIMINARY PHOTOGRAPHY Digital images were recorded by SCSA Smith in the following locations: the exterior of V1 for identification, condition and location; interior views of V1 for location of the cell phones and the magazine; views of the patio and backyard at 6729 Oveja Circle for the condition and location of firearms; close-up views of the 7.62 X 39 SKS rifle and the 12 gauge Mossberg shotgun located on the west edge of the patio and close-up views of the .25 Beretta semicautomatic handgun on the patio near the southwest corner of the patio. PRELIMINARY RECOVERY OF FIREARMS

SCSA J. Smith recovered items 1, 2 and 3 from the scene at the beginning of the investigation in order to expedite latent print processing, DNA analysis and firearms examination on the guns. He cleared the scene with the firearms at approximately 0925 hours.

The "Mossberg" shotgun was taken to LVMPD firearms section to be cleared. The shotgun was made safe by LVMPD Firearms Examiner A. Lester #13771. A jacket fragment (item 2C) was removed from between the damaged forend and magazine tube. A bullet was apparently wedged inside the magazine tube and was not removed from the shotgun. An expended "Super X Xpert HV Steel Shot" shot shell (item 28) headstamped "Winchester 12 GA" was recovered from the chamber. Four (4) "Super X Xpert HV Steel Shot" shot shells (item 2A) headstamped "Winchester 12 GA" were removed from the magazine tube. CRIME SCENE PHOTOGRAPHY

Digital images were recorded by SCSA R. Dahn (undersigned) in the following locations: the above described crime scene and evidence located at 6729 Oveja Circle; V1 for location and identification; V2 for location of the bag of clothing on the hood; V3 and V4 for identification, location and the condition of the interior and hatch areas of both vehicles; views of the rocked ally between 6729 Oveja Circle and 6728 Oveja Circle; two (2) security cameras attach to the roof (front walkway and the front southeast comer at 6728 Oveja Circle.

Two (2) Traffic Officers were also photographed. Traffic Officer W. Villagrana #8426-T551 was photographed for identification and location of apparent blood on his shirt, right pants leg (knee) and the magazine and grip of his firearm. Traffic Officer J. THIRD PERSON VIDEO AND PHOTOGRAPHIC EVIDENCE On 09-04-15, Detective Byrd was conducting follow-up at 209 Redstone Street where there was surveillance video of a possible suspect crossing a rear wall to the front yard of the residence. Detective Byrd made contact with the resident, Jason Gomez, who gave detectives access to his surveillance video. Detective Byrd reviewed the footage and at 04:18:50 time stamped on the video, a black male wearing pants and shirt cross the rear wall and walk onto Redstone Street across from 208 Redstone Street. The subject left the view of the camera between 208 and 204 Redstone Street. Gomez stated he did not know how to copy video so detectives requested the assistance of Marc Moses at LVMPD Forensic Multimedia Detail. Moses responded and recovered the video.

On 09-04-15, Detective McHale conducted follow-up at 222 South Rainbow Boulevard, the Professional Office Plaza, and made contact with Yoram Yehuva, to view surveillance video footage of the parking lot. The video showed a black male, matching the suspect’s description, enter the property parking lot. Marc Moses responded and recovered the video. Detective Byrd created a map of Turner's path based on video surveillance as well as witness statements.

XIII. INVESTIGATION Officer Malik Grego-Smith Per LVMPD Policy 6/002.04, Post Use of Force Procedures, an involved officer may provide a recorded statement to FIT investigators. If given, involved officer statements are taken at least 48 hours after the incident unless waived by the involved officer. Lieutenant Plummer contacted the Las Vegas Police Protective Association and Officer Grego-Smith via conference call. Officer Grego-Smith expressed he wanted to provide a statement to FIT detectives.

Officer Jeremy Robertson On 09-04-15, at approximately 0600 hours, Detective Jex conducted a brief, non-recorded verbal interview with Officer Robertson at UMC Trauma. The following is a summary of the interview: Officer Robertson stated he and Officer Grego-Smith were dispatched to a prowler call. They approached the residence and were met at the front door by the homeowner. Both officers went into the residence and kept the lights off. Officer Robertson was covering the backdoor as Officer Grego-Smith opened the door. As soon as the door opened shots were fired from outside. Officer Robertson stated he saw two suspects then fell to the ground as Officer Grego-Smith returned fire. Officer Robertson stated he was then moved from the residence by other officers and transported to the hospital. Clemon Hudson On 09-04-015, at approximately 0627 hours, Detective Jex conducted an audio recorded interview with Clemon Hudson at UMC ER. Also present for the interview was Detective Pannullo from the Crisis Negotiation Team. The following is a summary of the interview; for complete details refer to the transcript. Detective Jex read Hudson the Miranda warning from his LVMPD card. Hudson acknowledged he understood his rights. Hudson stated he met up with Turner earlier in the evening. Turner told Hudson he knew of a girl that had and they could get it from her. Hudson and Turner arrived at the house in Turner’s vehicle, a white Nissan Maxima. At the residence they approached each carrying a firearm. Hudson was holding a shotgun and Turner had a rifle. Turner told Hudson the front door was going to unlocked and they would be able to walk in. When they got to the front door it was locked. They knocked on the door and no one answered. Hudson and Turner went over the fence into the backyard. Hudson stated he gave the shotgun to Turner. They checked the back and side doors and found both locked. Hudson stated they were going to break out the window and enter into the house and were standing next to the

window when shots began to be fired. Hudson stated Turner fired shots then dropped the two guns and took off running and jumped the back fence. Hudson dropped to the ground behind a short wall. He heard officers give him verbal commands not to move and to show his hands. He stated the officers told him they would send the K9 dog. After a short time the dog came at him and grabbed him by the left wrist. Officers then came up to him, took him into custody and moved him to the front of the residence where he received medical attention. Hudson was then transported to UMC ER where he received medical attention for the dog bites. Hudson further described Turner was wearing a purple shirt, black gym shorts, and Chuck Taylor Converse shoes. Due to the dynamic scene and active search for Turner, the information was forwarded to those actively seeking to locate Turner. Steven Turner (AKA Devonte Turner)

On 09-04-15, at approximately 0729 hours, Detective Pazos conducted an audio recorded interview with Steven Turner at Westcliff Drive and Rainbow Boulevard. The following is a summary of the interview; for complete details refer to the transcript. Turner was walking westbound on Westcliff Drive when Officers Vance and Henry stopped him because they believed he matched the description of the outstanding suspect. He was bleeding from his left leg and his shoe and sock were completely soaked in blood. Turner stated he cut himself on a fence. Turner was asked if he needed medical attention and he refused stating that it was a minor cut. Detective Pazos, Detective Woosnam and Deputy Chief Owens arrived in the area. Detective Pazos requested CSA and medical personnel respond. Detective Woosnam and Deputy Chief Owens asked Turner his name, and other identifying questions to establish his identity. Detective Pazos asked Turner if he would do an interview to which he agreed. Turner was escorted to the back of a marked SUV and was placed in the rear passenger seat. Turner was read his Miranda rights at 0730 hours and agreed to speak with Detective Pazos while being audio recorded. Turner identified himself as Devonte Turner (DOB -93, SSN ). He said his friend, Mar, called him while he was at home and asked if he wanted to go out. Turner agreed and Mar arrived in a tan colored four door vehicle. Turner entered the passenger seat and drove to the area of Westcliff Drive. Turner stated he did not know why they were there and did not know whose house they were going to. Mar told Turner they were going to rob someone. Turner did not argue with him because Mar had a SKS rifle and a shotgun in the car. Turner stated the SKS was green and brown in color and he had seen it before and that it might belong to his uncle. Turner said Mar may have taken the gun from his uncle. When they arrived at the house, Mar exited the vehicle and retrieved two guns from the back seat. Mar had the shotgun and rifle in his possession when he jumped the fence of a one story house with a white van in the driveway. Mar was gone for about 20 minutes when he heard several gunshots coming from the backyard. Turner who stayed back in the car got scared and ran. Turner stated that he jumped several fences and at one point he got snagged and cut himself

on a fence causing the injury to his left calf. Due to his injury, Turner was transported to UMC Trauma while still in the custody of police. SCSA Fletcher took pictures of Turner’s injury prior to transport. Both she and Detective Pazos agreed the injury to his left calf was not as a result of getting snagged on the fence. Turner had three defects to his left pant leg that appeared to be from a ricochet and one to his right pant leg. Shiran Fernando On 09-04-15, at approximately 0743 hours, Detective Archer obtained a written statement from Shiran Fernando at 6805 White Sands Avenue. The following is a summary of the statement; for complete details refer to the written statement. Shiran Fernando contacted LVMPD and advised he possibly had video surveillance footage of one of the suspects from the officer involved shooting. Shiran observed someone walking in front of his residence at 0401hours. Shiran later learned from news reports of the officer involved shooting that occurred somewhat close to his neighborhood. Detective Archer collected the video footage. Officer Jonathan Adkisson

On 09-04-15, at approximately 0805 hours, Detective Jaeger conducted an audio recorded interview with Officer Adkisson at LVMPD Headquarters. Also present for the interview was PPA representative Officer Grammas. The following is a summary of the interview; for complete details refer to the transcript. On 09-04-15, Officer Adkisson was assigned to Northwest Area Command. Officer Adkisson was clearing a call in the area of Grand Canyon Drive and Cheyenne Avenue when he heard another unit yell over the radio, “Shots fired! Officer Down!” Officer Adkisson assigned himself to the call and went en route. Officer Adkisson parked his vehicle on Lorenzi Street and sprinted towards the house. Officer Adkisson entered the residence through the front door. Once inside the residence Officer Adkisson saw Officer Robertson lying on the floor and Officers Grego-Smith and Russo were covering the backyard of the residence with their firearms. Officer Robertson stated he had been shot and was bleeding from his upper right leg. Officer Adkisson assisted other officers in carrying Officer Robertson out of the residence and to the driveway. Officer Robertson was placed on a gurney and transported to UMC by medical personnel. A suspect was brought out of the backyard by officers. Officer Adkisson was assigned to secure the suspect until medical personnel arrived.

Officer Terrence Vaughan

On 09-04-15, at approximately 0818 hours, Detective Jaeger conducted an audio recorded interview with Officer Vaughan at LVMPD Headquarters. The following is a summary of the interview; for complete details refer to the transcript. Officer Vaughan was on a person with a gun call in Bolden Area Command when a sergeant announced over the radio that Northwest Area Command officers had shots fired and directed officers to assist. Officer Vaughan switched his radio from Bolden Area Command’s channel to Northwest Area Command’s channel. Officer Vaughan learned an officer had been shot and was down. Officer Vaughan assigned himself to the call and went en route.

Officer Vaughan arrived and switched his radio back to Bolden Area Command’s radio channel to asked dispatch for the address where the officer was down. He learned the officer was down inside 6729 Oveja Circle. Officer Vaughan and other arriving officers approached the residence on foot. Officer Vaughan arrived and found the front door to the residence open. Officers entered the residence through the front door. Inside the residence Officer Vaughan saw two people who he believed to be the homeowners, sitting on the couch. They directed officers to the back of the residence.

Near the rear of the residence, Officer Vaughan observed Officer Robertson lying face down on the floor. Officer Robertson’s feet were toward the sliding glass door and his head was to the east. Officer Vaughan moved a table out of the way so he could roll Officer Robertson onto his back. Officer Vaughan could see a gunshot wound on his hip just under his duty belt. Officer Vaughan assisted carrying Officer Robertson out of the residence to the driveway. Officer Robertson was placed on a gurney and transported to the hospital.

Mark Wallace On 09-04-15, at approximately 0830 hours, Detective Leaman obtained a written statement from Mark Wallace at 6913 Acoma Court. The following is a summary of the statement; for complete details refer to the written statement. At approximately 0630 hours, Wallace observed a black male, approximately six feet tall, standing in the front yard of 205 Zia Street. The subject was wearing orange pants and purple shirt, which resembled pajamas. At approximately 0640 hours, while Wallace walked his girlfriend to her car, he observed the same subject walking in the cul-de-sac. Officer Villagrana was at Downtown Area Command with Officer Velicescu when he heard a broadcast of an officer-involved shooting. Officer Villagrana saw a nearby patrol Officer and asked him to pull up the event on the computer in his patrol car. Officer Villagrana learned Officer Robertson had been shot during the call. Officer Villagrana typed the address of the call into his GPS and went en route to the call. While driving to the call Officer Villagrana heard Officer Robertson broadcast he had been shot in the femur. Officer Villagrana turned on WestCliff Drive and saw an ambulance staged. Officer Villagrana parked his motorcycle on Lorenzi Street north of Oveja Circle and approached on foot following other arriving officers. Officer Villagrana arrived at the residence and saw Officer Robertson being carried out of the residence and placed in an ambulance. Officer Villagrana was told the residence had not been cleared and there was an outstanding suspect. Officer Villagrana and another officer, armed with a shotgun, cleared the interior of the residence. Officer Villagrana observed officers in the kitchen area covering the backyard with their handguns and took a position next to the officers. Officer Villagrana observed a small handgun about eight to ten feet from the sliding glass door on the patio floor. Officer Villagrana heard a suspect (Hudson) in the back yard talking, but he could not see him. The group of officers held their position, formed an arrest team and formulated a plan to take Hudson into custody. K9 officers arrived with a ballistic shield and gave Hudson verbal commands. Hudson failed to comply with the verbal commands and a K9 officer deployed his dog. After Hudson was bit by the dog the arrest team moved to Hudson’s location to take him into custody. Officer Villagrana was assigned as the “hands on” officer in the arrest team and he placed handcuffs on Hudson. When Officer Villagrana placed handcuffs on Hudson he could see him bleeding from his hands where he had been bitten by the police dog. While Hudson was being walked out of the backyard he was asked if he had been shot and stated, he had not been shot. Officer Villagrana walked Hudson to medical personnel where he was treated for his injuries. Officer Villagrana was then assigned to secure the crime scene until relieved by detectives. Officer Timothy O’Neill On 09-04-15, at approximately 0859 hours, Detective Jaeger conducted an audio recorded interview with Officer O’Neill at LVMPD Headquarters. Also present for the interview was PPA representative Officer Grammas. The following is a summary of the interview; for complete details refer to the transcript. Officer O’Neill heard two units from his squad dispatched to a prowler call. The description of the suspect was a younger black male adult, with no shirt, who rang the doorbell and was possibly hiding in the backyard. Officer O’Neill heard the officers broadcast they had arrived and approximately one minute later heard “Shots Fired! Officer Down!” Officer Robertson broadcasted he had been shot in

the thigh and was down in the rear of the residence. Officer Robertson requested officers rescue him from the residence because his leg was broken and he was not able to move on his own. Officer O’Neil assigned himself to the call and went en route. Officer O’Neill was the first Northwest Area Command unit to arrive and observed Bolden Area Command units already on scene. Officer O’Neil joined the Bolden Area Command officers and attempted to locate the residence. The group of officers cautiously approached the residence. When the group of officers entered the residence Officer O’Neill observed Officer Robertson on the floor in the kitchen area, near the rear sliding door. Officer Robertson said he could not stand because of his injury and needed to be carried out of the residence. Officer O’Neill slid under Officer Robertson, grabbed him by the gun belt and carried him out of the residence to the driveway. Officer O’Neill removed Officer Robertson’s firearm from his gun belt and handed it to Sergeant Hansen. At the time of the incident it was not known if Officer Robertson fired his duty weapon during the incident. Officer Robertson’s duty weapon was secured at the scene by Sergeant Hansen. Officer Robertson’s duty belt was removed by Officer O’Neill and secured in Officer O’Neill’s patrol vehicle. Officer O’Neill assisted placing Officer Robertson in the ambulance then followed the ambulance to UMC. Sergeant Jason Hansen On 09-04-15, at approximately 0905 hours, Detective Jex conducted an audio recorded interview with Sergeant Hansen at LVMPD Headquarters. Also present for the interview was PMSA representative Sergeant Hayes. The following is a summary of the interview; for complete details refer to the transcript. Sergeant Hansen arrived on the scene approximately two minutes after Officer Grego-Smith broadcasted shots had been fired. He entered the residence where he found Officers Grego-Smith and O’Neil assisting and covering Officer Robertson. Other officers were inside the kitchen and living room area covering on the back door into the backyard. An officer told Sergeant Hansen there was a suspect on the ground in the backyard and a rifle was near him. The suspect was later identified as Clemon Hudson. Officers picked Officer Robertson up and moved him out the front door. Officer O’Neill was holding Officer Robertson’s handgun and handed it to Sergeant Hansen. Sergeant Hansen placed the handgun on the table in the kitchen. Sergeant Hansen stayed in the residence with the officers. He ensured that no lights were turned on so not to illuminate the officers. Officers continued to give verbal commands to Hudson in the back yard. Sergeant Hansen had two officers clear the rest of the residence. After the house was cleared, the officers focused on Hudson in the backyard and waited for the Air Unit and K9 officers to arrive. The Air Unit arrived and gave the location and description of Hudson and advised there was a rifle next to him. The K9 officers arrived. K9 Sergeant Bitsko and Officers Overson and Hemsey arrived. Sergeant Bitsko gave commands to Hudson who did not comply. Sergeant

Hansen believed Hudson was baiting officers to come outside the residence. Sergeant Hansen stated the K9 dog, Loki, was released into the backyard and grabbed Hudson by the arm and began to drag him back towards the officers. Officers moved up to Hudson and took him into custody. Sergeant Hansen organized officers to clear the backyard and no additional suspects were located. The shotgun, rifle, and a small caliber handgun were located where Hudson was laying on the ground. Eric Clarkson

On 09-04-15, at approximately 0907 hours, Detective Kowalski conducted an audio recorded interview with Eric Clarkson at Oveja Circle and Nunca Street. The following is a summary of the interview; for complete details refer to the transcript. On 09-04-15, at approximately 0330 hours, Clarkson went to his bedroom to go to bed. Approximately fifteen minutes later, Clarkson heard a noise on the back patio adjacent to his room. Clarkson looked out the window and saw an unknown subject on the patio. Clarkson retrieved his cell phone and told his roommate, Willoughby Grimaldi. Clarkson called 911 while Grimaldi looked out the window. Grimaldi told Clarkson the subject on the patio was holding a gun and Clarkson relayed the information to the 911 dispatcher. While on the phone with 911, an unknown subject began knocking on the front door. Clarkson asked the dispatcher if the police had arrived. He was advised police had not arrived and that he should not answer the door. The subject knocking began ringing the doorbell and pounding on the security door. Grimaldi went into the south bedroom and told Clarkson he saw a subject running on the side of the house. Approximately two minutes later, officers arrived at the residence and Clarkson let them into the house through the front door. Clarkson told them the subject was on the patio to the rear of the house. Clarkson told officers how to unlock the back door and where the light switch for the patio was located. Clarkson and Grimaldi moved to the front of the residence away from the officers. As Officer Robertson opened the back door, three to five shots were immediately fired from the backyard. Clarkson took cover in the hallway directly in front of the main entrance. He heard Officer Robertson yelling that he had been shot and he was down. Officer Grego-Smith was heard yelling at the suspects not to move. Clarkson did not see the officers return fire. Clarkson directed the first two arriving officers to Officers Robertson and Grego-Smith’s location. The third officer directed Clarkson and Grimaldi to leave the residence. Clarkson and Grimaldi left the house and waited down the block before officers took them to the command post on Rainbow Boulevard.

Steven Turner On 09-04-15, at approximately 0913 hours, Detective Pazos conducted an audio recorded interview with Steven Turner at UMC Trauma, bed #6. The following is a summary of the interview; for complete details refer to the transcript. While at the hospital, Turner asked to speak with Detective Pazos. Turner informed Detective Pazos he had lied about his identity and wanted to correct his previous interview. Detective Pazos reminded Turner about his Miranda rights and that he could invoke his right not to speak. Turner advised that his real name was Steven Anthony Turner (DOB -90, SSN

). He lived with his mother at 5904 Eugene Drive, and that his friend Mar lived near them. Mar picked up Turner and he knew where they were going to a house he had previously been to at least twice. Willoughby Grimaldi On 09-04-15, at approximately 0929 hours, Detective Kowalski conducted an audio recorded interview with Willoughby Grimaldi at Oveja Circle and Nunca Street. The following is a summary of the interview; for complete details refer to the transcript. On 09-04-15, at approximately 0320 hours by his estimation, Grimaldi was woken up by his roommate Eric Clarkson. Clarkson told him there was someone on the patio and he was going to call the police. Grimaldi was skeptical and wanted to check himself so he looked out the kitchen window. Grimaldi saw an unknown race male he described as between five feet nine to six feet tall, no shirt, wearing a grey, tan, or black baseball cap. The subject on the patio was holding a shotgun. Grimaldi told Clarkson what he saw and he relayed the information to the dispatcher. Someone began knocking on the front door to the residence, then ringing the doorbell, and finally pounding on the metal security door. Grimaldi looked out the front window and saw a black male. Grimaldi described the male as young, approximately six feet tall no shirt, wearing black basketball shorts, and having a two inch afro. Grimaldi went into the south bedroom and saw a subject running through the yard who Grimaldi described as a black male with a messy afro. The subject at the front door stopped pounding and Grimaldi watched him run northeast across the cul-de-sac. A short time later, Officers Robertson and Greco-Smith arrived at the residence and Clarkson let them inside. Clarkson and Grimaldi told the officers how to open the backdoor. One of the officers looked out the rear window and broadcast there were two subjects in the backyard. Grimaldi and Clarkson moved to the front of the house and stood around the corner of the living room. Grimaldi looked around the corner and continued to watch the officers. Immediately when the door was open, someone outside fired three shots into the residence. One shot struck Officer Robertson and one shot travelled through the house striking the

window in the living room. Grimaldi ducked behind the corner. Grimaldi did not know if the officers returned fire. Officer Joshua Rowberry On 09-04-15, at approximately 0934 hours, Detective Jaeger conducted an audio recorded interview with Officer Rowberry at LVMPD Headquarters. Also present for the interview was PPA representative Officer Grammas. The following is a summary of the interview; for complete details refer to the transcript. Officer Rowberry was in the area of Cheyenne Avenue and Fort Apache Road when he heard Officer Grego-Smith broadcast over the radio, “Shots Fired!” Officer Rowberry assigned himself to the call and went en route. Prior to Officer Rowberry arriving on the call, it was updated that the suspect was armed with a rifle. Officer Rowberry arrived on the call and donned his tactical vest, rifle, and helmet and ran up to the residence. When Officer Rowberry entered the residence he saw officers tending to Officer Robertson. Officer Rowberry assisted Officer Grego-Smith covering the backyard with his rifle from inside the rear sliding door. Officer Grego-Smith was giving verbal commands to the suspect, Hudson, who he heard but did not see. Hudson was approximately seven feet away lying on the ground behind an approximately two foot high piece of metal flashing. Hudson was positioned in such a way the metal flashing was obstructing the officer’s view of the suspect. The Air Unit arrived on the call and advised Hudson was in a prone position behind the metal flashing. The Air Unit saw a rifle or long gun next to Hudson. Officers held their position until K-9 officers arrived with a ballistic shield. A K-9 dog was released and bit the suspect before he was taken into custody. Once Hudson was in custody Officer Rowberry cleared the rest of the backyard. No other suspects were located. Officer Rowberry located a black shotgun and an AK type rifle in the backyard near where Hudson was taken into custody. Officer Rowberry also located a small handgun between the metal barrier Hudson had hid behind and the glass sliding door. Sergeant Joshua Bitsko On 09-04-15, at approximately 0935 hours, Detective Jex conducted an audio recorded interview with Sergeant Bitsko at LVMPD Headquarters. Also present for the interview was PMSA representative Sergeant Hayes. The following is a summary of the interview; for complete details refer to the transcript. Sergeant Bitsko went en route to the incident upon hearing shots had been fired. Upon arrival he deployed with his dog Loki. K-9 Officers Hemsey and Overson also arrived. The three went into the residence to assist in taking Hudson into custody. Once in the residence, Sergeant Bitsko began to give verbal commands to Hudson. The Air Unit broadcasted Hudson had a

rifle next to him. Sergeant Bitsko believed Hudson was trying to bait the officer to go out of the residence. Sergeant Bitsko continued issuing verbal commands to Hudson to show his hands and crawl into the open where officers could see him. Sergeant Bitsko advised him if he did not comply he would release Loki into the yard. Hudson did not comply and Loki was released into the yard. Loki grabbed Hudson by the wrist and dragged Hudson a short distance. Sergeant Bitsko went to Hudson and he was taken into custody with the assistance of other officers. While Hudson was being taken into custody, Sergeant Bitsko moved the shotgun that was near Hudson. Sergeant Bitsko also observed the rifle near Hudson. After Hudson was in custody, Sergeant Bitsko organized officers into a search team and searched the backyard for the other suspect. During the search a small caliber handgun was also located near where Hudson was taken into custody. Sergeant Bitsko and the other K-9 officers then went outside and assisted in searching the perimeter for the second suspect.

Officer James Velicescu

On 09-04-15, at approximately 0957 hours, Detective Jaeger conducted an audio recorded interview with Officer Velicescu at LVMPD Headquarters. Also present for the interview was PPA representative Officer Grammas. The following is a summary of the interview; for complete details refer to the transcript.

Officer Velicescu was at Downtown Area Command with Officer Villagrana. Officer Velicescu heard the Downtown Area Command dispatcher broadcast an officer involved shooting in Northwest Area Command. Officers Velicescu and Villagrana assigned themselves to the call and went en route. When Officer Velicescu arrived on the call officers were carrying Officer Robertson out of the residence and down the driveway. Officer Velicescu entered the residence and assisted in clearing the residence. Officer Velicescu then teamed up with Officer Rowberry to clear the north half of the residence. After the interior of the residence was cleared, so Officer Velicescu positioned himself at the rear sliding door of the residence. An arrest team was formed and Officer Velicescu was assigned as the rear guard of the arrest team.

Two K-9 officers arrived and verbally challenged Hudson in the backyard. A police dog was deployed and the arrest team moved to take Hudson in custody. While Hudson was being taken into custody Officer Velicescu noticed a rifle on the ground next to the Hudson’s feet. Officer Velicescu also noticed a silver, small caliber handgun on the patio.

Hudson was taken into custody and walked out of the backyard. Officer Velicescu stayed in the backyard of the residence securing the Hudson’s weapons until relieved by detectives.

Officer Thomas Keller On 09-04-15, at approximately 1000 hours, Detective Jex conducted an audio recorded interview with Officer Keller at LVMPD Headquarters. Officer Keller heard the call broadcast that shots had been fired and an officer was down in the Northwest Area Command. Officer Keller switched channels and responded Code 3 to the area along with Officers Truax, Vaughn, and Fields from Bolden Area Command. Officer Keller stated they did not know exactly which house was the residence where shots had been fired. Officer O’Neil arrived and the officers moved up the street until they found an open door and located Officers Robertson and Grego-Smith. Officer Keller assisted in the downed officer rescue of Officer Robertson. Before moving Officer Robertson, Officer Keller took Officer Robertson’s handgun from his holster and gave it to Sergeant Hansen. They moved Officer Robertson to the driveway and provided medical attention until the ambulance arrived. Once Hudson was in custody in the backyard, Officer Keller assisted K-9 officers in the search for the second suspect. Officer Louis Russo On 09-04-15 at approximately 1030 hours, Detective Jex conducted an audio recorded interview with Officer Russo at LVMPD Headquarters. Also present for the interview was PPA representative Officer Clodt. The following is a summary of the interview; for complete details refer to the transcript. Officer Russo responded to the incident from BAC after hearing that shots had been fired and an officer was down. He arrived in the area with Officers Truax, Vaughn, and Fields. Officer Russo deployed his shotgun and activated his body worn camera as the officers moved up the street toward the residence where Officer Robertson had been shot. Once inside the residence, Officer Russo stepped over Officer Robertson and assisted Officer Grego-Smith in covering the backyard. The other officers assisted with the downed officer rescue of Officer Robertson. Officer Russo provided the cover on the door until K-9 Sergeant Bitsko and other K-9 officers arrived and took Hudson into custody. Officer Russo assisted in clearing the back yard and observed the rifle, shotgun and small handgun in the backyard. He then went out to the front yard and assisted the K-9 officers in the search for the second suspect. Officer Russo’s BWC was taken and the footage downloaded following the interview and later viewed by detectives. Officer Kyle Kyger On 09-04-15, at approximately 1055 hours, Detective Jex conducted an audio recorded interview with Officer Kyger at LVMPD Headquarters. en route to the incident. He deployed with his shotgun and ran to the house as the other officers were moving Officer Robertson out. Officer Kyger provided cover on the south side of the house while they officers began medical attention on Officer Robertson. Officer Kyger then went inside and with another officer cleared the rest of the residence. After the suspect was taken into custody, Officer Kyger covered Hudson while the other officers cleared the backyard. Officer Kyger was then assigned to Officer Grego-Smith as his Witness Monitor and took Officer Grego-Smith to the command post. Officer Marianne Truax On 09-04-15, at approximately 1108 hours, Detective Kowalski conducted an audio recorded interview with Officer Truax at LVMPD Headquarters. Also present for the interview was PPA representative Officer Grammas. The following is a summary of the interview; for complete details refer to the transcript. Officer Truax was in Bolden Area Command when Sergeant Kenny Nogle advised over the radio there had been an officer-involved shooting in Northwest Area Command and available units were to respond and assist. Officer Truax and the officers on her current call, Officers Russo, Keller, and Vaughn, responded to the scene. When Officer Truax turned her radio to the NWAC channel, she heard it broadcast that there was an officer down. Officer Truax and her fellow officers responded to the area of the call. They parked on the corner of Oveja Circle and Lorenzi Street and approached the target residence on foot. The group walked west on Oveja Circle until they located the residence. Radio traffic updated the event that there was an outstanding suspect and a high power rifle was involved. When they reached the residence, no officers had responded yet so a plan was made to execute a downed-officers rescue for Officer Robertson. Officers Russo, Keller, and Vaughn entered the residence and Officer Truax ran back to her vehicle. Officer Truax drove down and parked in front of the residence with her trunk open waiting for the officers to remove the injured officer from the residence. While she waited, medical units arrived on scene and the injured officer was loaded into the ambulance. Officer Truax took up a position covering the backyard of the residence from the north wall. Officer Truax maintained cover on the backyard until the suspect was taken into custody. Afterwards, Officer Truax assisted K9 officers searching backyards until she was relieved and returned to the command post. Officer Landers went en route to the incident after hearing that shots had been fired and an officer was down. Upon arrival at the residence, Officer Landers deployed with his rifle and moved up to the residence and covered the north side of the residence. He remained in that position until Hudson was taken into custody. He observed a traffic unit bring Hudson out of the house. He stated that Hudson was not being cooperative. Officer Landers then assisted the K-9 officers in search of the second suspect. Officer Justin Diebold On 09-04-15, at approximately 1139 hours, Detective Kowalski conducted an audio recorded interview with Officer Diebold at LVMPD Headquarters. Also present for the interview was PPA representative Officer Grammas. The following is a summary of the interview; for complete details refer to the transcript. Officer Diebold was conducting speed enforcement in Enterprise Area Command when it was broadcast over the radio there had been shots fired and an officer was down in Northwest Area Command. Officer Diebold responded to the scene and parked his motor unit on Lorenzi Street and Oveja Circle. Officer Diebold ran west on Oveja Circle and followed other officers responding on foot. When he reached the residence, Officer Diebold saw Officer Landers on the northeast corner of the residence covering the backyard with a rifle. Officer Diebold took up a position with him and covered the backyard. Officer Landers told Officer Diebold there was a downed officer either in the residence or in the backyard and there was a suspect in the backyard as well. Officer Diebold covered the backyard while a group of officers performed a downed officer rescue. Officers Diebold and Landers provided a human shield as the officers carried out Officer Robertson placing themselves between the residence and the officers while maintaining cover. Once they were informed Officer Robertson was safely away, Officers Diebold and Landers returned to the northeast corner and covered the backyard while the arrest team took Hudson into custody. Hudson was led out of the residence and Officer Diebold took custody of him. He switched out the handcuffs with his own and began walking him towards the fire department engine that was parked down the street. The suspect identified himself as Clemon Hudson with a date of birth of 6-12-95. Hudson had blood on his head and arms. Paramedics cut Hudson’s shirt off and removed his socks. Both were placed in a bag and given to Officer Diebold. Officer Diebold gave the bag to Traffic Officer Velicescu to give to patrol units on scene. Officer Diebold rode in the ambulance with Hudson while he was transported to UMC ER. Hudson told Officer Diebold that he had never been arrested and this was his first time. He stated he hadn’t fired any shots and that it was his friend who had hopped over the wall. Hudson identified his friend with the monikers “Chubbz,” “Turnip,” and “Turner P.” Hudson described him as a dark skinned black male with a thin build wearing a purple shirt. Officer Diebold remained with Hudson at UMC ER until he was relieved by other officers.

Clemon Hudson On 09-04-15, at approximately 1425 hours, Detective Jex conducted an audio recorded follow up interview with Clemon Hudson at CCDC. The interview was to obtain information on a possible third suspect possibly involved with the shooting. The following is a summary of the interview; for complete details refer to the transcript. Hudson was advised his Miranda warning given earlier by Detective Jex still applied. Detective Jex asked Hudson what he was wearing. Hudson described he was wearing black basketball shorts and a dark camouflage shirt. Detective Jex asked Hudson about a third person and he stated there was not a third person. He and Turner were the only ones that arrived at the residence. Hudson stated he drove up in his car and parked in the cul-de-sac and Turner pulled onto another street with his white Maxima. Hudson stated Turner then jumped the wall into the cul-de-sac with Hudson. Hudson stated he met up with Turner on the north side of the cul-de-sac in front of 6725 Oveja Circle. Hudson stated several times there was not a third person. Again Hudson stated he and Turner were the only ones in the back yard with the shotgun and rifle. Detective Jex asked Hudson about the small caliber handgun found in the back yard and who had brought it to the back yard. Initially Hudson denied their being a handgun and a third person. He later stated he brought the handgun with him. He had the handgun in his pocket then moved it to his sock where it fell out after the shooting took place. Hudson continued to state there was not a third person. Hudson described their intent was to steal the occupants of the residence. He described again the way they went into the backyard and checking the doors. Hudson stated the shooting started when someone from inside the back door shot first. He indicated Turner was up close to the door and he was to his left. In the earlier interview with Hudson, he stated to Detective Jex that Turner had both the shotgun and SK rifle with the shooting started. Hudson now indicated Turner had the rifle and he was now holding the shotgun. When shots started being fired, Hudson stated he fired one shot from the shotgun at the bottom area of the window then fell to the ground. Hudson stated he was not sure if Turner had fired but thought he may have because it was so loud. Hudson stated after the shots started to be fired Turner took off running to the back of the yard and over the fence. Hudson stayed on the ground until being bitten by the K-9 dog taken into custody. Hudson stated he was positive there was not a third suspect. He further described he brought the shotgun from his house. Hudson stated he got the shotgun from a friend approximately a week prior to the incident. Hudson stated Turner got the rifle from an uncle named “Big John” but did not know his real name. Hudson stated he had seen the rifle at Big John’s house a few days before the incident. Hudson had handled the rifle but had never shot it.

Hudson stated he worked at the Walmart at I-215 and Decatur Boulevard and Turner worked at the Nike Outlet at the mall but did not know which one. Detective Jex again asked Hudson about a third suspect and Hudson denied there being anyone but he and Turner at the house. Hudson stated that his involvement was not something that he would normally do. He stated he was truly blessed to not be dead. He further stated he was sorry for what happened to the officer that was shot. Hudson further described he had been in the cul-de-sac before with Turner and Turner had a girlfriend in the residence. Turner told Hudson there in the residence and they were going to steal it from the homeowner. Hudson stated Turner had been inside the residence before but were going there that night to break into the house. At the end of the interview Hudson stated he drove his own car to the cul de sac and Turner drove his to another location and they met up at the residence. He further stated the whole plan was Turner’s. Steven Turner On 09-04-15, at approximately 1535 hours, Detective Jex conducted an audio recorded interview with Steven Turner at CCDC. The interview was a follow-up to the interviews conducted by Detective Pazos. The following is a summary of the interview; for complete details refer to the transcript. Turner was advised his Miranda warning still applied. Turner reconfirmed he was at the scene of the shooting and had the SK rifle. Turner then asked Detective Jex if he had to talk to him at that time. Detective Jex advised Turner that it was up to him whether or not he talked. Turner stated that he wanted to talk to his attorney. The very next comment, Turner stated to Detective Jex that he would talk to him about the incident and began talking about it. Turner stated he was in the backyard with the rifle. He stated Hudson had the rifle in his car in the back seat and saw it there. Turner took it into the backyard. In the backyard he and Hudson were at the back door when shots were fired from inside the house. He heard the homeowner start screaming. Turner dropped the rifle and went over fence and ran westbound across Rainbow Boulevard and into the neighborhood. He found a couch in an alleyway and sat down. Turner stated he arrived in the cul-de-sac with Hudson and did not own a vehicle. Detective Jex asked Turner about a third suspect. Turner stated there was not a third person. He and Hudson were the only people involved. Turner stated he did not know the police were involved until hearing sirens and seeing the helicopter flying around the area. He stated he did not hear the police announce their presence at all. He heard screaming inside and shots being fired. Turner stated he was shot in the leg by one of the officers. Turner stated he went to the house for the purpose of from the owners. Turner indicated he had been there . Turner stated that he did not fire the

rifle and dropped the rifle when shots began to be fired from inside the house and took off running. Again, Turner stated he did not fire the rifle and did not know the police were there. Detective Jex asked Turner where he got the rifle and he stated he stole it from his uncle, Lawrence Robinson. Turner stated he took the rifle to the residence to intimidate the homeowner and to

. He further stated he had been at the residence before approximately two years prior. Turner indicated Hudson knew about there at the residence and asked Turner to go there with him to get it. Turner stated that he lied to the officers and detective he had talked to earlier. At the hospital Turner was advised he was being booked in CCDC for attempt murder on a police officer. Turner again stated he did not know the police were on the scene when shots were fired. He also advised he did not come to the residence in a white Maximum, but arrived in Hudson’s vehicle. Turner was asked about the small handgun that was found on the scene. He stated Hudson brought the gun and showed it to him several days before the incident and knew it was Hudson’s. Turner stated he had shot the rifle before at a gun range with his uncle. He further stated he intended to intimidate the owners at the residence with the rifle. He stated he did not shoot the rifle. He was confident that there were no police officers on the scene at the time of the shooting and he would not shoot at the police. He finished by apologizing that a police officer was shot.

Officer Cord Overson

On 09-04-15, at approximately 1623 hours, Detective Kowalski conducted an audio recorded interview with Officer Overson at LVMPD Headquarters. The following is a summary of the interview; for complete refer to the transcript.

Officer Overson was working in Enterprise Area Command when it was broadcast there had been an officer involved shooting in Northwest Area Command and an officer was down. Officer Overson responded to the scene and met up with K-9 Sergeant Bitsko. Sergeant Bitsko, Officer Overson and Officer Hemsey formed an arrest team. Officer Overson retrieved a ballistic shield from his vehicle. Officer Hemsey would provide cover with his rifle and Sergeant Bitsko brought his canine partner Loki. As they approached the house, Officer Robertson was receiving medical treatment in the driveway. Officers were set up on the northeast and southeast corners of the house covering the backyard. A group of officers were posted up inside the residence covering the back door. Information from the Air Unit and Officer Robertson indicated there was at least one suspect in the backyard and he was armed with a rifle. The Air Unit provided updates that there was a rifle on the ground near the suspect’s location.

Officer Overson provided cover with the ballistic shield at the rear door while Officer Hemsey provided cover with his rifle. Officer Overson challenged the backyard, announcing to any suspect to surrender with their hands up or they would be bit by a police dog. Officer Overson heard the suspect yell something unintelligible that sounded defiant to Officer Overson. Officer Overson announced a second time, telling the suspect to crawl out to where officers could see him or he would be bit. There was no response to the second challenge. The decision was made to release Loki into the backyard to search for the suspect. Loki located Hudson to the west of the patio behind a bush and a short wall. Loki bit Hudson on his arm. The arrest team of Sergeant Bitsko, Officer Overson and Officer Hemsey moved up towards Hudson’s location. Officers Overson and Hemsey moved past Hudson to provide cover to Sergeant Bitsko while he took physical control of Loki. The backyard had not been completely cleared and was poorly lit. Officer Overson did not know if the second suspect was lying in wait. Patrol officers moved up and assisted taking Hudson into custody. Officer Overson asked Hudson if he had been shot and Hudson replied that he didn’t know. Patrol officers moved Hudson into the residence. Officers Overson and Hemsey as well as other patrol officers cleared the backyard of the residence to confirm there were no outstanding suspects. Once the backyard was clear, Officer Overson returned to the residence. Officer Overson noted an AK-47, a black shotgun and a small handgun in the area where Hudson was taken into custody. He also saw multiple 7.62mm shell casings and blood on the ground. Eric Clarkson

On 09-04-15, at approximately 1650 hours and while executing a search warrant at Clarkson’s residence, Detective Patton received a phone from Clarkson. Clarkson stated he had information related to the shooting at his residence and needed to speak with detectives immediately. Detective Patton requested Clarkson return to his residence so they could speak. On 09-04-15, at approximately 1727 hours, Detectives Patton and Colon conducted an audio recorded interview with Eric Clarkson at 6729 Oveja Circle. The following is a summary of the interview; for complete details refer to the transcript. Clarkson was at a friend’s house until he could return to his home when he began to watch the news. As Clarkson was watching the news he heard one of the suspects arrested from the shooting at his house was a man named Steven Turner. The first of several text messages were received at 3:23 am. Below are the messages Clarkson received from Turner.

Clarkson responded to Turner’s text messages at 7:24 pm with a question mark and Clarkson never heard back from Turner. Clarkson stated he did not know why Turner would want to hurt him. Clarkson never had more than personal , never left cash out, and he never had fights with Turner. Clarkson explained the reason he stopped hanging out with Turner was due to Turner being too young and immature.

Steven Turner On 09-04-15, at approximately 1739 hours, Detective Jex conducted an audio recorded follow up interview with Turner at the Clark County Detention Center after learning Turner may have had a where the shooting took place. The following is a summary of the interview; for complete details refer to the transcript. Turner was again advised his Miranda warning still applied. He indicated he understood. Detective Jex started the interview by asking Turner about the house where the shooting took place and was asked why he had been there in the past. Turner stated that he had a

. Detective Jex asked for the name of the person and Turner stated he did not remember it. Turner then stated that he did not want to talk about it anymore. He stated he had talked to his attorney and was advised not to talk about it. He continued on stating that he did not know the police were there and he was shot in the leg and he ran. stated he did not want to talk about it and wanted to talk to his lawyer first. Turner quit talking and the interview was stopped. As Detective Jex was leaving the interview room, Turner started talking again about the

. They had no intention to kill anyone only to intimidate them and going on the robbery was totally random. He further stated Hudson had been to the residence with him in the past. Again Turner stated there was not a third person involved and if there was he would definitely say who it was because he did not want to take the fall for the whole incident. Turner also stated he had no idea the police were there and it was the homeowner inside that started shooting first. Officer Malik Grego-Smith On 09-08-15, at approximately 0815 hours, Detectives Patton and Colon conducted an audio recorded interview with Officer Grego-Smith at LVMPD Headquarters. Also present for the interview was PPA representative Officer Yant. The following is a summary of the interview; for complete details refer to the transcript.

Officer Grego-Smith responded to an incident at 6729 Oveja Circle where Clarkson reported there was a prowler in the backyard. Officer Robertson was also assigned to the incident. While en route, Dispatch broadcasted several updates. Clarkson, who originally reported a subject in the backyard, heard someone banging on his front door and ringing the doorbell.

Before Officer Grego-Smith arrived, Dispatch broadcasted the subject was in the backyard again and had a firearm.

Officers Grego-Smith and Robertson arrived and both parked their patrol vehicles approximately five houses away from 6729 Oveja Circle and tactically approached on foot. Officer Grego-Smith remained on the front sidewalk as Officer Robertson checked the north backyard gate and found it to be locked. As Officer Robertson checked the opposite gate side on the south side of the house Officer Grego-Smith heard footsteps coming from the backyard. Officer Grego-Smith advised Officer Robertson who then advised Dispatch to have Clarkson let them in to enter the backyard through the house.

Clarkson let the officers into the residence through the front door. As the officers entered, Clarkson advised he still heard someone in the backyard. Officer Grego-Smith advised Clarkson to stay towards the front of the house. There were no lights on inside the residence and as the officers walked toward the rear of the residence they noticed the backyard lights were also off. Officer Robertson looked out the kitchen window, which was to the right of the back door, and advised he did not see anyone.

The officers devised a plan to clear the backyard. Officer Robertson would open the door, which would have to be unlocked with a key, and Officer Grego-Smith would enter the yard. Officer Robertson would follow close behind and both officers would clear the backyard.

Officer Grego-Smith had his gun at the low ready position posted on the left side of the door (which opened in, left to right) and Officer Robertson stood on the right side to manipulate the key and open the door. As Officer Robertson pulled the door open, Officer Grego-Smith remembered taking a step toward the doorway and heard two gunshots fired from outside into the residence. Officer Grego-Smith observed a light skinned black male adult with no shirt standing in the doorway. Officer Grego-Smith stepped back using the wall for cover, crouched to one knee and returned fire eight or nine times. Officer Grego-Smith did not hear any additional shots coming from the backyard and stood up to assess the situation. Officer Robertson advised he had been shot. Officer Grego-Smith asked Officer Robertson if he was able to move out of the doorway and Officer Robertson responded he could not.

Officer Grego-Smith stood in between Officer Robertson and the doorway and gave verbal commands of, “Show me your hands. Don’t move,” to any suspects in the backyard. Officer Grego-Smith was not able to see into the yard because of the darkness but heard a voice say, “Don’t shoot me. Don’t kill me. Don’t shoot me.” Officer Grego-Smith was still not able to see anyone and advised Dispatch that shots had been fired and an officer was down. Officer Grego-Smith verbally comforted Officer Robertson while maintaining his position covering the backyard.

The Air Unit arrived and advised a suspect (Hudson) in the backyard was lying in the prone position with his hands above his head in close proximity to a rifle. Officers arrived and they performed a down officer rescue for Officer Robertson. They formed an arrest team while they waited for a K9 unit to arrive. A K-9 unit arrived and advised Hudson numerous times to walk backwards toward the officers or he would deploy the dog.

Hudson did not respond to the officer’s commands. The dog was deployed and located Hudson which allowed the officers safely take him into custody.

Officer Jeremy Robertson On 09-24-15, at approximately 0935 hours, Detectives Colon and Patton conducted an audio recorded interview with Officer Robertson at his residence. Also present for the interview was PPA representative Officer Yant. The following is a summary of the interview; for complete details refer to the transcript.

Officer Robertson was at Northwest Area Command when he was assigned to a prowler call at 6729 Oveja Circle. Officer Robertson responded along with Officer Grego-Smith. Shortly before their arrival, they were advised the subject was knocking on the front door of the residence. The officers arrived simultaneously and parked approximately four or five houses away from the residence. As the officers approached on foot, they observed the house was dark and there was no one at the front door or surrounding area.

Officer Robertson recalled both the front gate on the north side of the residence and the wall on the south of the residence were fairly high and was not able to see into the backyard. Officer Robertson told Dispatch to advise the homeowner, Clarkson, to let the officers in the front door. As the officers approached the front door Officer Grego-Smith advised Officer Robertson he heard something in the backyard.

Clarkson let the officers in the residence. Officer Robertson noticed it was “pitch black” inside. Officer Robertson looked out of the kitchen window, which is to the right of the backdoor and was not able to see anything.

Officer Robertson noticed the back door utilized a key to unlock the door from the inside. Officer Robertson advised Officer Grego-Smith they should attempt to clear the backyard using the same tactics they would use to clear a room. Officer Robertson and Officer Grego-Smith would stand on opposite sides of the door. Officer Robertson would manipulate the key, open the door as Officer Grego-Smith would enter the yard and Officer Robertson would follow behind. Officer Grego-Smith agreed on the tactic and took his position with his firearm drawn. Officer Robertson asked for a Code Red, unlocked the door and opened it.

Officer Robertson advised detectives that his mind had blocked the incident and his recollection of the incident is foggy. Officer Robertson struggled through this section of the interview but did recall a few things.

Officer Robertson stood to the right of the door, opened it, observed how dark it was and possibly saw two shadows. Officer Robertson took a step to the left to draw his gun and remembered seeing a high powered rifle and heard a pop-like sound. Officer Robertson felt a numbing sensation in his leg and felt that time had slowed. Officer Robertson spun to his left and fell face forward to the ground. Officer Robertson recalled hearing gunfire and heard Officer Grego-Smith broadcasting shots fired over the radio.

Officers arrived and carried Officer Robertson out of the residence. Officer O’Neil retrieved Officer Robertson’s gun from his holster for safekeeping.

Comparisons The twelve SPEER 9mm Luger +P cartridge cases were identified as having been fired by the submitted Glock pistol. Suspect Firearm Examination On 09-09-15, an LVMPD Forensic Laboratory Request was submitted on Hudson and Turner's firearms for a function test and ballistic comparison evidence. On 12-29-15, Forensic Scientist Anya Lester, P# 13771, submitted the Firearms & Tool Marks Report with the following results: Firearms and Magazines The Yugo rifle was examined, test fired and found to be operational with no noted malfunctions. This rifle has a barrel length of approximately 24 ¼ inches, an overall length of approximately 42 ¾ inches and a trigger pull of 4 ¾ - 5 ¼ pounds. The submitted magazine has a capacity of twenty-one cartridges. The Mossberg shotgun was examined and was noted to have an area of damage, consistent with a bullet impact, to the fore-end and magazine tube. This damage rendered the shotgun inoperable and unable to be test fired.

The Beretta pistol was examined, test fired and found to be operational with no noted malfunctions. This pistol has a barrel length of approximately 2 3/8 inches, an overall length of approximately 4 ¾ inches and a trigger pull of 5 ¼ - 5 ¾ pounds. The submitted magazine has a capacity of 8 cartridges. Cartridge Case Examination The three 7.62 x 39mm cartridge cases shared a similar general overall appearance and some limited corresponding microscopic information with the test fired cartridge cases from the submitted Yugo rifle; however, insufficient microscopic detail precludes a conclusive identification to this rifle. The submitted shot pellets were determined to be consistent in size, weight and composition with number 6 steel shot. The submitted wad pieces were determined to be consistent in size, appearance and composition with the wad contained in the disassembled evidence evidence shotshell.
