COUNCIL REPORT

Yau Wuikinuxv April report:April 5, 2016 - Trustees meeting, discussion on Linda's actions regarding the frozen Bank account at CIBC and how to resolve. Trustees to meet with her but she refused to meet them. Council to appoint Rick Shaw as the Trustee replacing Fred, this will happen on the next Chief and Council meeting on April 26th. Spoke with Scott White, the CIBC branch manager to explain why he has frozen the WEDCO bank account. As he is unsure of who would win the lawsuit if this situation went that far he chooses to keep the account in abeyance. He stated that the Nation and Linda have to resolve this issue before he will unfreeze the account. As of April 15th we no longer have access to the account, as Linda does not agree to meet, except with the original Trustees. Our next recourse is litigation against the bank and with Linda.

Audit: The audit is now complete and is available for members to review if they so wish. The delay in the audit was due to numerous outstanding issues and lack of staff to complete. We are in deficit of between 200,000.00 and 300,000.00 down from one million. A finance committee will be set up to scrutinize the budget for the coming year, which I am a member as part of my portfolio this term.Carbon Credits: We received in total $802,000.00 for carbon credits from GBI and expect another $310,00.00 this summer, need to do a budget and work plan for this money. I.e.: cost sharing for the outdoor court, Alfie volunteered to

clear the land for the Court. Also, WKNTC provided $9250.00 for the Outdoor Court.

Treaty contracts: Robert to do a job evaluation on Paul and Alexander. Job descriptions for all staff will be reviewed. Make use of the MUP/LUP at the Negotiating table.

Dog By-law: To be enforced, enlist the RCMP if necessary. A request to all dog owners to find alternative living arrangements if they have more than TWO dogs as the by-law states. Everyone needs to be responsible for his or her dogs and keep them contained.

Wood: Separate the wood, move from current location. The logs need to be graded, set aside some for carving the Bighouse front.

Election: Nomination and voting packages must be sent out earlier. We will be working on a Custom Code process.

WEDCO: Discussion on the re-structuring process. The Trustees will consist of a member from each of the family poles. Cedar prices are high right now and we are making money.

April 6, 2016 -

Hatchery: Meeting with Sid Keay and Ted Walkus regarding the Wuikinuxv Hatchery they proposed last summer. The majority of the people in attendance agreed to move forward with it and I signed the Agreement, however, a Protocol Agreement will be drafted soon. Construction to begin immediately.

Employment for the construction and for the hatchery itself will be hired pending qualifications. This community engagement process needed to take place before any decisions were finalized. Sid will pay for a new building (shed) for the hatchery.

Gas Prices: Robert will check into this.

PCA: We are now charging them a Landing Fee. Wilderness Seaplanes will now be doing the run to the village, not PCA. Will inquire about being able to get Saturday flights.

Housing: Tenancy Agreements will be done with all those renting housing from the Nation; all requests must go to the committee. It is my understanding that housing repairs will begin soon and continue until all the houses are repaired.

Power Plant: One generator has failed and is too costly to buy a new one. The

Nicknaqueet project will be done in two years.

Gladstone Case: Wuikinuxv has completed its Declaration including our territorial map and will be ready for publication. Heiltsuk allowed Wuikinuxv to do the RoK in Mustang Bay this year.Education: O/S reports need to be completed. Treaty working on securing funding for Capacity Building. WKNTC provided some training dollars for the bookkeeper position. The Traditional Laws program also has money for this.

Discussion about the status of the Day Home.

Treaty meeting in Victoria, April 11, 2016 - Attended a governance workshop with Herb George (Satsan) as facilitator. Satsan took us through the Indian Act, which he states we must understand before going into self-governance. He starts by saying "we have the Inherent Right to Self Government". That we need to use our own laws reflecting our principles and values moving toward our self governance structure, consisting of tradition and modern approaches. A hybrid approach. That as an Indian Act Band we are "wards of the Crown". In Self-Government we will be able to have our own Constitution reflecting Wuikinuxv ideals, not some bureaucrat in Ottawa making decisions on our behalf. We have the right to make our own laws; we are entitled to our own laws. That to transition out of the Indian Act we need the consent of the people. (94% yes vote) for the Agreement-in-Principle.

Satsan informed the group (WTAC) and Treaty staff of the historical process of how we got to the point of Treaty, i.e.: Indian Act, Residential School system, The Constitution (1982) and the implications of. That we must develop a good strategy moving toward self-reliance from our view.

As we will be working on developing our own Custom Code, he reminds us that it is still under INAC but is a good vehicle for transition of Self-Government. This is something we were directed to do at the AGA two years ago, to develop our own Custom Code.

Review our policies and amend them and adjust job descriptions to reflect our

new governance structure. A need for community involvement, which is the purpose of the CCP (Comprehensive Community Plan) process that we are engaged in. For everyone's information, Hope Johnson, is now the lead on this and has scheduled meetings in Nanaimo and Campbell River for next week, so please attend and make your voice heard. Other meetings will be held in Port Hardy, Vancouver and Bella Bella shortly. People need to see the legitimacy of the budget and work plan so that they see what benefit is there for them, for them to own it. In this Treaty process we are creating a movement for change, for the betterment of Wuikinuxv. We need to take control of our own destiny to make it work for future Wuikinuxv generations and us.

April 12, 2016 - The WTAC team attended the second day of the workshop with Satsan where he discussed the different Aboriginal Court Cases involving our Aboriginal Rights and Title. I attended a special Chief Negotiator meeting with Canada's Chief Negotiator Gavin McLeod and Chief Negotiator for BC, Heinz Dick. Canada announced they increased our Fiscal transfer by 5 million, which brings the total to 13 million. They hope to have the Final Agreement by December 2016. BC is unsure that is viable from their perspective.

Some of the discussion included:Capacity Development: the need for training dollars to prepare our people for jobs that will be required to run the new Wuikinuxv governance structure, through the Transition document that was

discussed last December. I requested $500,000.00 at that meeting for training purposes, so they know the number we are looking for. I've heard some people say that is not enough, but it is a start. I suggest anyone wanting training in a specific area to write to the Education Coordinator to express your desire for training, as although, we may not have the funding now we expect to have Capacity funding in the future.

Fish: DFO is willing to negotiate Fish. Wuikinuxv is looking for an Incremental Agreement on Fish, there may be TRM funding to do Fish.

Forestry: We want to acquire an additional 50 thousand m3 of wood for a total of 100 thousand m3 per year for our OSR (Own Source Revenue) for the operation our new government system.Our new motto is "NO TREES, NO TREATY" BC has committed to look into it.

April 13, 2016 – Main table meeting: The main topics we discussed were: Fiscal, Certainty and Economic independence for Wuikinuxv. An Incremental Treaty Agreement requires a Framework Agreement, Approval of the Framework, and an A-i-P. The Wuikinuxv Treaty team will meet the first week of May, no Main table as Canada and BC do not have a mandate at this point in time.

April 15, 2016 - Met with Corby, Fugg, Alexander and Fred. Strategy on moving forward with WEDCO, develop an action plan to get the CIBC bank account unfrozen so that we may continue to carry on business. One of the former

Directors is still holding out claiming due process was not followed in re-naming Trustees and Board Members for WEDCO. We had two lawyers in the room when this took place so those claiming it was illegal have no legitimate proof it was done otherwise. Council and Trustees have every right to make changes if they believe the best interests of the Nation are not being met. The previous Council, which I was a part of, did not believe this was the case after reading the audit.

Protocol Agreement with Hakai: Christina Munk sent me a copy of the Protocol Agreement for Wuikinuxv and Hakai that they want engagement with. There are some things in the Agreement that do not meet Wuikinuxv interests so I have some people reviewing it before i sign it. This consists of the list of activities and details of this year's work to be done in Wuikinuxv territory.

Spoke with Robert re: his contract, which ends May 15, 2016. A performance review will be done at the next Chief and Council meeting on April 26, 2016.

Discussion on the MaP and P & ID funding for a bookkeeper. Capital Projects discussion.

Spoke with Maureen McCurdy re: payables.

Spoke with John Ebell regarding the Nicknaqueet Project and who is the point person. Needs clear direction.

Spoke with RCMP spokesperson Terry Bedard regarding the Police Service Agreement. A new process is being

developed due to the change with the Public Safety Canada's mandate.

Update Jim and Tony regarding the WEDCO situation and its frozen bank account, strategy to rectify the dispute of a former Director. Corby will engage a lawyer unfamiliar with the case so as to have a purely objective opinion on next steps.

Signed two TRM's for Treaty.

This is the first year for this work, but it is expected that this will be required in 2016, and in every year afterwards. The Coordinator work initially can be done from home, but during the period when community fishing is undertaken at Wuikinuxv, the Co-coordinator will live and work in Wuikinuxv NationWithin the parameters and work plan set by Treaty and Stewardship, work with the membership to identify how each member would prefer to access fish, and to identify the barriers that currently exist to receiving a share of the community fish available.
