ProjectModify an existing Class A Marina to replace up to two seasonal berthing customers with two Tour Boats. Three of the four Tour Boats at this facility are proposed as new Tour Boats to be operated by Brodies Lakeside and offering tubing, sightseeing, and water tax services.
BackgroundThe applicant has submitted an application to operate 3 new Tour Boats from the subject facility. To accommodate the Tour Boats, the applicant has submitted a companion application to modify an existing Class A Marina to replace up to two seasonal berthing customers with two Tour Boats. The facility is presently authorized for two Tour Boats.
The marina facility provides onsite parking, restrooms, and garbage disposal. Portable restrooms are utilized onsite in support of the marina.
The facility is located in zone 3A according to the Lake George Recreation Study. This zone is roughly 855 acres. The maximum number of motorized vessels observed underway in this zone was 23, which equates to a density of 37 acres per vessel.
There is no apparent jurisdiction for the Town, APA, or DEC.
No public comments have been received. Regulatory DeterminationsSEQRA:This is an Unlisted Action and review is uncoordinated. A draft negative declaration has been prepared by staff.
Docks, Wharfs, Moorings, and MarinasSection 646-1.6(a) Prior to granting any permit relative to a dock, wharf, mooring or marina, the Commission shall ascertain the probable effect of the proposed facility and the operation thereof on the health, safety and welfare of the public and on the resources of the Park. The Commission shall also ascertain the impact of the proposed facility upon the congestion of Lake George and the probable visual, cultural and audible effects of the proposed facility on the neighborhood in which the facility is proposed and on the Park. Where the Commission determines that the facility will have an undue impact upon the health, safety, or welfare of the public of the resources of the park, lead to overcrowding or congestion, or cause undue visual, cultural or audible impacts on the neighborhood or the Park, a permit shall be denied.

The marina facility provides onsite parking, restrooms, and garbage disposal. Portable restrooms are utilized onsite in support of the marina.
The facility is located in zone 3A according to the Lake George Recreation Study. This zone is roughly 855 acres. The maximum number of motorized vessels observed underway in this zone was 23, which equates to a density of 37 acres per vessel.
The project is not anticipated to have a significnat impact on vehicle traffic or recreational boating traffic.
There is no apparent jurisdiction for the Town, APA, or DEC.
The waters of Lake George, all land lying under such waters and within 500 feet of the mean high-water mark of such waters, and wetlands located adjacent to the waters of Lake George and all land within 500 feet of such wetlands are designated a Critical Environmental Area pursuant to Section 617.4(h) of the State Environmental Quality Review Act regulations (6NYCRR) and 645-3.8 of the Lake George Park Commission regulations (6NYCRR).

1. I do not think I have an updated copy of the site plan facility but I did reach out to Devin Dickinson to confirm. However, I can provide pictures (provided in a separate email) of the property of before and after since the improvements have been completed. I did add 2 stormwater management basins (with the help of the LGA) when we removed all the pavement from the front of the house (lakeside) down to the lake. It is now all grass where the pavement was. Yes, many improvements have been made to the facility, including (but not limited to) removing 30 yards + of junk, garbage, old engines, hundreds of beer bottles and hundreds of thousands of cigarette butts at the waterfront. I also replaced the rotted delapidated 6 x 6 retaining wall between the LG Suites and the small ("bath house") down by the lake. I am also currrently working with the town of Lake George (Dan Barusch) on 2 projects that will continue to improve the property.
2. The picture I provided was for my 3 tour boats, to be operated at the boat house. The 4th tour boat is Diamond Point Boat Tours (operated by Dave Whalen). He was operating there when the marina was purchased, has a 23 ft pontoon boat and I have allowed him to continue in the past and will allow him to continue for this coming summer. His dock is the far North dock slip at the marina…Dave walks from his house to the marina (so no vehicle) and meets his customers in the lot. They are limited to 1 car.
3. As I put on the permit the maximum number of daily boat tours will be 4, however our intention is to do 2 ‐ 4 hours tours per day.
4. We envision the Maximum number of guests per tour boat to be 10 people, however we anticipate having families of 4‐6 people on average
5. To be clear, we do not do any onsite land maintenance of boats (as Gilchrist did), do not store empty trailers on site (as Gilchrist did) and do not store any boats on land during the season (as Gilchrist did)…We have a very large parking area and have not had parking issues in the past. Also, As I mentioned, we are adding 2 additional tour boats but have non‐renewed 4 seasonal customers, (it said 3 in the application but that has since changed). We also do not have any seasonal customers on our 3 permitted moorings (only used occasionally by my boats) .
6. As in the past few years, since purchasing the marina we have used "Platinum" Portable Restrooms and have 2 onsite for the use of our seasonal dock customers and rental customers. They are pumped regularly and cleaning daily. Also, we are also working on regular bathrooms for our customers but that would not be completed for this summer (Phase 4).
7. Our marina is located in a very large "No Wake Zone" bay and our boats will obviously operate and leave the bay at its slowest possible forward speed, leaving no wake. I have PV Captains that are and will be very aware of this. Our tour boats will operate a far distance from shore (500 + ft) as to avoid any shoreline erosion, property damage, and public hazards. We will, however, if doing a shoreline sightseeing cruise on our pontoon boat, possibly travel within 500 ft of shoreline but would be at a "No Wake Zone" speed as to not to create any wakes resulting in shoreline erosion, property damage, public hazard, etc. I will make sure my Captains (myself being

one) will be VERY aware of the rules and regulations required of tour boats. All my Captains are seasoned LG boaters and understand and respect the lake and its importance.
8. All our boats have garbage cans, and will have extra garbage bags on the boat. ALL debris and garbage will be brought back to Brodie's Lakeside and put in our dumpster. There will be no litter or debris thrown or discharged overboard the vessel. If such an incident occurs the boat will immediately turn around and remove it from the water. The lake and its cleanliness are our livelihood and we will respect it as we always have.
9. While all our boats are equipped with marine radios we will adhere to the rules and regulations set forth by the Commission and our Captain's common sense. We will not operate before 8:00 am and will rarely operate after 7:00 pm.

Joe, This is in response to Application from Jonathan Brodi on 3686 Lakeshore Drive. We are homeowners in the same bay and naturally have concerns over any additional boat traffic in our small bay. The Brodi’s have been good neighbors and we are happy to see the improvements they have made to the property. Upon reviewing codes section 646‐1.1 for a class A marina we question the amount of docks and wharfs that are existing and whether they are in compliance based on the 225 feet lake frontage. Perhaps you can let us know if our concerns are valid. Also at present the three moorings are several feet away from the docks. As we recall boats tied to the mornings are to be secured to a dock and not allowed to drift. This has not been the case. We would stress that as renters to the public that all are made fully aware that it is a 5 MPH zone. There has been times that boats have been exceeding the limit and we are concerned about our young children and the kayakers and paddle boards using the bay. We respect that they are trying to run a successful business and hope they can continue at the same level but would like to know that they are in full compliance with all the codes on Lake George.
