    The landowner, Jeff Cole, also addressed the Commission. Mr. Cole said he did not believe he was reimbursed the amount he was told he would receive for building the pond. He informed the Commission that when he started this project, he was told by the district technician in Farmington that he would be reimbursed at 75 percent of his costs, up to a maximum $15,000. He said that is why he is

    asking to be reimbursed additional funds, because the Commission should back up what he was told. Mr. Cole said he was never told anything about cost per yard or county average costs limits. In addition, he said he would not have built the pond if he had known the amount he was going to receive. Mr. Cole indicated that he has over $22,000 of expenses in the practice.

    The Commission asked Mr. Cole questions about the invoices, number of hours charged by the contractor to build the structure and the i$�ues with the signing of the contract and contract payment documents.     Scott Brown from the University of Missouri and Davin Althoff from MDA are leading this effort.

    He reminded the Commission that the commodity organizations and MDA will be showcasing Missouri's agriculture products at Best of Missouri event later this evening and invited everyone to come and enjoy the event.

    MASWCD Ryan Britt, MASWCD President, said that he recently..:�ii�n:q�d the Soil Health Council meeting as well as the NACD regional me�.ti#g in Wisconsin. Mr. Britt said that one thing they both had in common wa�:;th&�1f9rt that they were putting toward improving water quality.     Sandy Stratman addressed the Conunission to let them know that the Maries SWCD is the first district to own their own building. They made their final payment in November. She thanked the Commission for their continued help and support.

    The Employees Association (EA) met for their ·regularly scheduled meeting on September 25, 2018 in Jefferson City at Missouri Farm Bureau. This committee was tasked by the Soil & Water Commission at their meeting on Sept. 12, 2018, to put forward a suggestion for addressing the employee stipend policy which was presented as a resolution from Lafayette Co. SWCD back in Nov. of _2017 at the MASWCD training conference.

    After discussion with program staff at this meeting on Sept. 251h, in addition to two committee members from the program operations and delivery committee, the EA has a suggestion to put forward. We value and appreciate all the hard work & commitment that the program operations & delivery committee has put into this. We will continue to support their efforts as programs and policies are looked at in the future and in no way does this association want to belittle in any way shape or form what they have done in serving on this committee.

    It was indicated that the current process lends to withholding pay increases, also tied to this, are the retirement benefits, until the quarter proceeding the quarter in which an employee earns this increase in pay. It has been stated that if district board of supervisors determine it necessary and fair to their employees to honor this increase at the time earned, having obtained required trainings/certifications and meeting their length of service, they have the opportunity to draw from their local funds to pay that employee. Not all boards may have this opportunity thru local funds and / or they feel this should be reimbursed back to the districts. In all fairness & consistency across the state, with local funds not being applicable to all districts, pay increases earned once all requirements are met as set forth by the wage progression scale, should come from th_e state allocation.

    To put things in perspective, the majority of employees across all 114 districts, have met their length of service & are working to earn the required certifications or receive the necessary training/testing. Out of #286 employees (as of Sept. 2018) 59% or #168 has been employed for greater than 5 years and 41% or #118 has less than 5 yrs. employment. For our newer employees looking ahead as to the wage progression that is available to them, it appears that once they have worked for the district 5 years, the pay increases are no more, you have capped out, unless you are a district that can consistently plan on local funds to support higher wages for the long term. Wage progression with length of service is something yet to be re-visited, even to support our long term employees especially with cost of living increases so few and far between. So be it only fair and honorable to our valuable employees, to receive their wage increase as soon as is feasible having met the requirements put forth by the program office.

    It has been stated by program office, that they are limited administratively speaking since not replacing employees. Currently Jim Boschert and Lori Bax are the designated staff to evaluate the stipend increase forms as

    · they come in and to allocate changes in the district's budget. It has also been stated that they are very busy with quarterly reports that are coming in from all districts the first two months of each quarter. It appears the 3 rd

    month of each quarter lends itself the best opportunity to look at stipend request forms and changes to a district's budget. The state budget allows for flexibility in that you have several employees who have reached the highest level on the current wage progression scale and program office is encouraging employees to reach the highest level, as well as you have employee turnover allowing for lower base wages to be paid out. So being that changes are made on a quarterly basis, let's just be prepared to make those changes ahead of the quarter versus after the quarter in which they are earned alleviating employees from waiting potentially several weeks before receiving their earned wage increase.

    Currently: Example 1 {LOS not met) which has been the concern, would be an employee has not met their length

    of service (LOS) yet (their anniversary date of hire) but has received the training and certification needed to move

    up once they do meet their LOS. So let's say they meet that LOS on Oct. 10th, 2018. Because it is after the start of

    the quarter, they cannot receive their wage increase until the next quarter which starts Jan. 2019, if the district

    submits correctly the stipend request form before the quarter ends. So that is at a minimum #5 pay periods thru

    the end of December before receiving their next quarter's allocation sometime in Jan.

    This is withholding pay and retirement benefits to an employee for a significant amount of time. If this LOS date

    falls in the middle of a pay period (Oct. 10th, which it does) it does make sense that the district and the allocation

    be planned for the pay period following this date; this makes accounting a whole lot easier on each end.

    Example 2 - (LOS met), with LOS already having been met & having completed a qualifying training &/or received

    a certification in October of 2018; district puts forth the signed stipend request form potentially in Oct. or Nov.

    (before the end of the quarter), the employee would get their wage increase effective the s.tart of the next

    quarter - Jan. 2019.

    The emRloyee association suggests that: once the training certification has been met by the employee and they

    are waiting to meet their LOS in the following quarter that the district put forward by the 1st of the month

    preceding the next quarter, the stipend request form. Those submission dates would be by Sept. 1st, Dec. 1st,

    March 1st, and June 1st. This then gives the program office the 3rd month of each quarter (Sept., Dec., March, and

    June) the most opportune time preceding the quarter in which the employee meets their LOS, to determine the

    District's budget a/location. Using the example above for when employee meets their LOS on Oct. 10th, the budget

    a/location would be based on the current wage from Oct. 1st thru the pay period inclusive of their anniversary

    date, in this case Oct. 19t1'. This way the employee would receive timely pay increases and receive them in the

    quarter inclusive of their anniversary date, rather than in the quarter after. This should not pose any additional

    hardship on program office staff. If the employee has already met their length of service & then obtains passage

    of designated training or certification in a quarter, districts could then put forth the stipend request form asap in

    that quarter, preferably by the same submission dates above (Sept. 1, Dec. 1st, Mar.1st, June 1st ) in order to receive

    the increase in the next quarter's allocation. We are suggrumg this be im12lemented at the start of the next fiscal

    year (July 2019) to allow for planning & with submissions for stipend changes as suggested, allowed as of 6-1-19 for

    increases in the 1st Qtr. of the next FY. It is suggested that trainings/testings be scheduled in the first and second

    months of__QJJ,uarter.

    The group did have discussion in that communication and transparency is important when hiring new staff. It too

    could be beneficial to districts to have a new employee packet that outlines wage progression and benefits during

    the interview process.

    }his is a way to encourage & help develop the SWCD employees to their full potential and by respecting and

    · ·Serving the district employees. They in turn are serving the greater need with boots on the ground and pressing

    on toward the common goal of conserving our soil & water resources for future generations.

    Dear Commissioners:

    The Cole County landowner, George Sternberg, constructed a pond in December of 2016 and has a maintenance violation that was found during a spot check on the practice. A certified letter was sent to Mr. Sternberg on October 29, 2018 informing him of the maintenance violation and what was needed to correct it. He was given 30 days to complete the work.

    In a follow-up telephone call with Mr. Sternberg on December 5, 2018, he indicated there had not been,any work completed to correct the maintenance violation on the pond. Another certified letter was then sent to Mr. Sternberg on December 12, 2018 requesting repayment of the cost-share funds prorated according to Commission policy. Based on the formula in the Commission rules, there are 98 months left on the maintenance of the pond. The cost-share amount of $10,000 divided by the maintenance life of the practice of 120 months equals' $83.33 cost-share per month. The total cost-share being requested for repayment is $8,166.34 (98 x 83.33).

    Mr. Sternberg was told he could request in writing within 30 days of the receipt of the letter for the Soil & Water Commission to review the demand for repayment. Following the review, if the commission determines that no violation has qccurred, or that extenuating circumstances justify his position, the demand for repayment shall be withdrawn. If the commission determines the Violation did occur, he would be notified by certified mail renewing the demand for repayment. Mrs. Sternberg did call the office on December 18th stating she wanted to meet with the staff and possibly the board to discuss the amount of repayment requested. She was informed the next board meeting was January 15th at 9 am so it was set up for her to meet with the staff at 8:30 am the morning of January 1_5

    th.

    She did not show up this morning to meet with the staff and board, nor has she contacted the office again since the December 181h phone call. We are forwarding the request for repayment of the cost-share funds to you since-it has been over 30 days since they received the letter requesting the repayment of funds. Included are copies of the' letters mailed to Mr. Sternberg as well as a copy of the assistance visit notes and photos. If you have any questions in regards to the above, please let our office know.

    On a drive by spot check of the pond built on your property in December 2016 with State Cost Share funds through our office, it was noted that the principal spillway pipe had been modified. It is a requirement when receiving state cost share for this practice not be altered and to be maintained, as built, for 10 years.

    The above inspection findings were brought before the board at our board meeting on October 23, 2018. The principal spillway pipe that was modified, and any other component modifications that have been done, must be restored to the original designed elevation per NRCS standards and specifications. This must be completed by December 1, 2018.

    We will be doing a follow-up visit to make sure the corrections have been completed. If they have not been completed by December 1, the State Soil and Water Commission will be notified for further action through the Attorney General's office. Until this matter is resolved, you will not be eligible to participate in the state cost-share program as well.

    The St. Charles County District Board would like to submit a request to the Soil and Water Program Commission to reactivate a cancelled contract for a field border practice, N386. The practice pays for critical area seeding and a one-time out of production incentive. Staff entered the contract and then cancelled the contract after verifying that the practice had been seeded without prior approval from the board.

    In August 2016, district staff began discussion of the practice with the landowner, Ray Huber, and provided the cost-share handbook policy for field borders. Staff further discussed the practice with the landowner on several occasions.

    In August 2018, a cost-share contract was started in MOSWIMS. Final planning and the costshare contract were not completed. Mr. Huber was not given approval to plant the field border. District staff were unaware that the practice had been planted until Mr. Huber contacted the office and requested a field check. The district technician made a site visit on October 17, 2018, and confirmed the field border had been planted, but fertilizer and lime had not been applied. A GPS was also used to record the seeded area. The technician informed Mr. Huber that he will not receive cost-share due to starting the practice without approval. The costshare contract in MOSW1MS was deleted.

    The board is asking for the commission to consider this request to have the contract reinstated and pay Mr. Huber for the field border practice. The landowner and staff agree that better communication from both parties would have prevented him from starting the practice prior to approval. Mr. Huber also indicated he will complete the practice by applying the fertilizer and lime as required.
