The Kansas Department of Health and Environment issoliciting comments regarding a proposed air quality op-erating permit. Anadarko Gathering Company, LLC –Breech Booster Compressor Station has applied for aClass I operating permit renewal in accordance with theprovisions of K.A.R. 28-19-510 et al. The purpose of aClass I permit is to identify the sources and types of reg-ulated air pollutants emitted from the facility; the emis-sion limitations, standards and requirements applicableto each source; and the monitoring, record keeping andreporting requirements applicable to each source as of theeffective date of permit issuance.

Anadarko Gathering Company, LLC, P.O. Box 1330,Houston, TX 77251-1330, owns and operates the BreechBooster Compressor Station, an existing natural gas com-pressor station located at Section 23, Township 34S,Range 38W, Stevens County, Kansas.

A copy of the proposed permit, permit application, allsupporting documentation and all information reliedupon during the permit application review process isavailable for public review during normal business hoursat the KDHE, Bureau of Air, 1000 S.W. Jackson, Suite 310,Topeka, and at the KDHE Southwest District Office, 302W. McArtor Road, Dodge City. A person may request a public hearing be held on theproposed permit. The request for a public hearing shallbe in writing and set forth the basis for the request. Thewritten request must be submitted to Connie Ellis, KDHE,Bureau of Air, not later than noon October 13 in order forthe secretary of health and environment to consider therequest.

The U.S. Environmental Protection Agency has a 45-day review period, which will start concurrently with thepublic comment period, within which to object to the pro-posed permit. If the EPA has not objected in writing tothe issuance of the permit within the 45-day review pe-riod, any person may petition the administrator of theEPA to review the permit. The 60-day public petition pe-riod will directly follow the EPA’s 45-day review period.Interested parties may contact KDHE to determine if theEPA’s 45-day review period has been waived.

Any such petition shall be based only on objections tothe permit that were raised with reasonable specificityduring the public comment period provided for in thisnotice, unless the petitioner demonstrates that it was im-practicable to raise such objections within such period, orunless the grounds for such objection arose after such pe-riod. Pollution Control Permits and Applications

In accordance with Kansas Administrative Regulations28-16-57 through 63, 28-18-1 through 17, 28-18a-1 through33, 28-16-150 through 154, 28-46-7, and the authorityvested with the state by the administrator of the U.S. En-vironmental Protection Agency, various draft water pol-lution control documents (permits, notices to revoke andreissue, notices to terminate) have been prepared and/orpermit applications have been received for discharges towaters of the United States and the state of Kansas for theclass of discharges described below.

Asummary of the proposed regulations and the estimatedeconomic impact follows:

Summary of Regulations:K.A.R. 28-16-28b. Definitions. Adds definitions for the

terms digression, discharge design flow, duration of di-gression, EPA, excursion from numeric criteria, fre-quency of digression, numeric criteria value, and 30Q10flow. Deletes the definition for fecal coliform bacteria be-

cause it is no longer used in the Kansas Surface WaterQuality Standards.

K.A.R. 28-16-28c. General provisions. Adds paragraphtitles for clarity and consistent regulatory style in anti-degradation, mixing zones, special conditions and treat-ment requirements. Revises and updates adoptions byreference. Deletes special conditions for high flow be-cause the Environmental Protection Agency disapprovedthis part of the regulation in 2004.

K.A.R. 28-16-28d. Surface water classification and usedesignation. Adds titles to subsections (b) and (c) for clar-ity and consistency. Clarifies the term recreational use.Updates adoption by reference language for the KansasSurface Water Register.

K.A.R. 28-16-28e. Surface water quality criteria. Addsnew language specifying duration and frequency of nu-meric criteria for assessment purposes. Adds subsectiontitles to clarify content. Adopts the October 1, 2012,‘‘Kansas Surface Water Quality Standards: Tables of Nu-meric Criteria’’ in subsection (e) that updates the tablesas follows: Updates Table 1a with a new table which addsChemical Abstact Service (CAS) numbers for each param-eter if available, adds national recommended criteria andmaximum contaminant levels for parameters where cri-teria is adopted, adds criteria for toxic pollutants prom-ulgated by EPA’s National Toxic Rules that are applicablein Kansas but not adopted by KDHE, and regroups or-ganic chemicals including pesticides for improved clas-sification. Deletes equations for copper in Table 1b due tothe adoption of the Copper Biotic Ligand Model for de-riving acute and chronic aquatic life criteria of copper.Updates footnotes in Table 1g to modify and clarify ap-plication of the dissolved oxygen and temperature crite-ria. Updates Table 1h detailing the background concen-trations as determined through total maximum dailyloads (TMDL) development and approval. K.A.R. 28-16-58. Definitions. Updates definitions ofterms used in K.A.R. 28-16-57a through 28-16-63. Deletesthe term industrial user. Revises adoptions by reference.

Economic Impact:Costs to the agency: The proposed regulations will not

result in any increased costs to the agency.Costs to the regulated community: Default inputs or

KDHE stream chemistry data will be utilized to run theBiotic Ligand Model (BLM) when a facility is required tomonitor for copper. National Pollutant Discharge Elimi-nation System (NPDES) facilities may incur additionalcosts for sample collection and analysis for the parame-ters required for the BLM model if the facility elects to

utilize site-specific water quality data. Additional costsfor sampling and analysis will not likely be significant orburdensome to these facilities. Resulting effluent limita-tions for copper from the BLM model may be more strin-gent, less stringent or unchanged from limitations ema-nating from the existing hardness-based copper criteria.The new chlorophyll-a criteria for public drinking watersupply lakes is not anticipated to increase costs to theregulated community. Chlorophyll-a reflects the produc-tivity of plants and algae in lakes and is directly linkedto nutrient loading, as excessive algal growth leads to un-desirable eutrophic conditions. The new chlorophyll-acriteria, achieved through implementation of eutrophi-cation TMDL, will likely reduce the operating costs ofdrinking water plants, having to treat to prevent taste andodor problems. The criteria also provide warning to pub-lic water suppliers of threatening source water conditionsto allow for contingency planning. The benefits to thedrinking water plants, consumers, and local communitieswill offset and may outweigh the cost associated withnutrient reduction in the long term. Where nutrient re-duction is imperative, any related costs are unchangedfrom the narrative criterion that is being replaced withthe adoption of the numeric chlorophyll-a criteria. For allother proposed changes there are no known additionalcosts to the regulated communities or the public. Addi-tional details are provided in the regulatory impact state-ment that is available, as listed below.

Costs to other governmental agencies or units: Thereare no known additional costs to other governmentalagencies or units.

The time period between publication of this notice and5 p.m. on the day of the scheduled hearing serves as therequired public comment period of at least 60 days forthe purpose of receiving written public comments on theproposed amended regulations. Article 2.—LICENSES AND PERMITS

128-2-1. General licensure requirements. (a) Eachapplicant applying for a license to compete or serve inany contest pursuant to this act shall comply with thefollowing requirements, in addition to the individual li-censure requirements:

(1) Each application shall be submitted on a form pro-vided by the commission.

(2) Each applicant shall submit the applicable fee, aslisted in K.A.R. 128-2-12, with the application. An appli-cation for a license that does not include the applicablefee and all required information and supporting docu-mentation shall not be processed by the commission.

(3) Each applicant shall be at least 18 years of age.

(4) Each applicant for a contestant license shall submita late fee of $10 with each completed application receivedby the commission less than three business days beforethe proposed contest or event.

(b) Each applicant shall be allowed to compete or servein a contest only after the commission has issued the ap-propriate license. Each individual participating in a con-test shall possess a current license issued by the commis-sion.

(c) Once the application is approved by the commis-sion, the licensee shall notify the commission, in writing,of any change of name or address within 10 business daysof the date on which the change becomes effective. Thenotice of each name change shall be accompanied by acopy of the court order approving the name change.

(d) Each licensee’s information retained by the com-mission shall be deemed accurate for purpose of notifi-cation unless the licensee notifies the commission. Thelicensee shall be responsible for reporting any change ofmailing address, electronic mail address, telephone num-ber, and any other change in the information providedon the application to the commission. Failure by the li-censee to comply with this subsection may result in a sus-pension of the license until the licensee notifies the com-mission of any changes.

(e) Any false statement submitted on the application tothe commission may be deemed grounds for any of thefollowing:

(1) Denial of the application;(2) revocation or suspension of the license, if the license

has already been issued; or(3) referral of the matter to the appropriate law enforce-

ment authority for prosecution.This regulation shall be effective on and after October

1, 2014. (Authorized by K.S.A. 2013 Supp. 74-50,187; im-plementing K.S.A. 2013 Supp. 74-50,186 and 74-50,187; ef-fective April 4, 2008; amended Dec. 20, 2013; amendedOct. 1, 2014.)

128-2-3. Contestant. (a) Each applicant seeking acontestant’s license from the commission shall meet thefollowing requirements, in addition to the requirementsspecified in K.A.R. 128-2-1:

(1) Submit the written certification of a physician meet-ing the requirements of K.A.R. 128-2-7 stating that theapplicant is physically able to compete in a contest. Thewritten certification shall be based on a complete physicalexamination performed by that physician, which shall in-clude the following:

(A) Neurological and cardiac testing within 30 days ofthe date of the application;

(B) a negative test for HIV, hepatitis B surface antigen,and hepatitis C antibody within one year of the date ofthe examination. If the contestant fails the hepatitis B sur-face antigen test, the contestant shall be required to passa hepatitis B ‘‘PCR’’ quantitative test. The quantitativelimit shall be within permissible limits according to thelaboratory where the test was administered; and

(C) an eye examination. No applicant shall be issued alicense if the applicant is found to be blind in one eye orboth eyes; and

(2) provide the commission with the applicant’s legalname and, if any, the applicant’s ‘‘ring name,’’ which is

the name that the applicant intends to use after receivinga contestant’s license but only when competing in anycontest. Each applicant with a ring name shall use thesame ring name in each contest.

(b) For each regulated sport in which the applicant in-tends to participate as a contestant, the applicant shallcomplete a separate application and submit the applica-tion and the applicable fee to the commission. 128-2-4. Judge. (a) Each applicant seeking a judge’slicense from the commission shall meet all of the follow-ing requirements, in addition to the requirements speci-fied in K.A.R. 128-2-1:

(1) Certify in writing that the applicant has read andunderstands the act and these regulations;

(2) provide evidence that the applicant has at least fouryears of judging amateur contests and two years of ex-perience judging professional contests;

(3) provide certification of competency from two indi-viduals with personal knowledge relative to the appli-cant’s qualifications to judge;

(4) provide certification that the applicant is in goodstanding in any other jurisdiction in which the applicanthas a license and has a record of past performance ofcompetent work;

(5) if seeking a license to judge professional boxing con-tests, be required to pass a written test approved by thecommission. Each such applicant shall be certified by theassociation of boxing commissioners within two years af-ter the issuance of the license;

(6) at the discretion of the boxing commissioner, submita written certification from a physician stating that theapplicant has undergone a physical examination by thephysician and is physically able to perform the duties ofa judge. The physician shall be licensed in the state wherethe physical examination was conducted. The certifica-tion shall be completed on a form provided by the com-mission. The form shall include an acknowledgementfrom the examining physician that the physician under-stands and certifies that the applicant is physically ableto officiate a regulated sport contest; and

(7) pay the applicable fee specified in K.A.R. 128-2-12.(b) For each regulated sport for which the applicant in-tends to act as a judge, the applicant shall complete aseparate application and submit the application and re-quired fee to the commission. 128-2-13. Permits. (a) Each promoter shall obtainfrom the commission a separate permit for each regulatedsport contest for which the promoter is responsible. Eachpromoter shall meet the following requirements for eachrequest for a permit:

(1) The permit application shall be submitted on a formprovided by the commission.

(2) The promoter shall submit the following fee or fees,as applicable, with the permit application, including thefollowing:

(A) For a permit for a contest, $40.00 for each day ofthe contest and $150.00 for each inspector assigned to thecontest. The boxing commissioner shall determine thenumber of inspectors required for each contest;

(B) for a permit for a professional wrestling perform-ance, $175.00 for each day of the performance; or

(C) for a permit for brazilian jiujitsu, grappling sub-mission wrestling, or pankration, $175.00 for each day ofthe event.

(3) The promoter shall submit with the application asurety bond in the amount of $10,000 to guarantee pay-ment of all state athletic fees due to the commission andany unpaid amounts owed to officials and contestants,including medical expenses and the purse.

(4) An additional bond may be required in an amountspecified by the commission if it is reasonable to expectthat the original bond will not provide sufficient liabilityprotection to the commission, officials, and contestants.

(5) The promoter shall submit with the permit appli-cation a policy of accident insurance on each contestantparticipating in the event in the amount of $10,000 tocompensate the contestant for any medical and hospitalexpenses incurred as the result of injuries received in theevent. The premiums on the policies shall be paid by thepromoter. The terms of the insurance coverage shall notrequire the contestant to pay a deductible for any medi-cal, surgical, or hospital care for any injuries that the con-testant sustains while engaged in an event. A professional

contestant who enters into a contract with a promotermay, if approved by the boxing commissioner, contractto pay any medical expenses, including deductibles, co-insurance, co-pays, and out-of-pocket costs.

(6) (A) The promoter of a professional wrestling per-formance shall provide documentation indicating that aphysician or other emergency medical provider certifiedby the board of emergency medical services or the boardof nursing will be present at the performance.

(B) The promoter of a contest shall provide documen-tation indicating that medical personnel will be presentat the contest pursuant to K.A.R. 128-4-6.

(7) The request for a permit shall be received by thecommission no later than 30 days before the date of theevent. Each request for a permit received less than 30 daysbut more than 14 days before the date of the event shallbe accompanied by a late fee of $60. Each request for aprofessional wrestling performance permit received lessthan 14 days before the date of the event shall be accom-panied by a late fee of $100.

(b) If the commission receives more than one requestfor a permit for the same date, a permit for both eventsmay be issued by the commission if each application iscomplete and the commission deems it to be in the bestinterest of the commission to issue more than one permit.Factors considered by the commission in making the de-termination shall include the geographic locations of theproposed events and the availability of the commissionstaff and officials. If the commission is unable to regulatemore than one event, a permit shall be issued to the firstapplicant that submits a complete application.

(c) Any application for a permit may be approved ordenied by the commission or may be issued with limita-tions, restrictions, or conditions as stipulated by the com-mission. Permits for the following types of contests shallnot be approved by the commission:

(1) Contests with any bouts between members of theopposite sex;

(2) contests with any bouts between contestants andnonhumans; and

(3) contests with any bouts using weapons.(d) Each promoter shall have an approved permit be-

fore any publicity is issued on the contest or professionalwrestling performance. Violation of this provision shallbe grounds for the nonissuance of permits. The promotermay be subject to disciplinary action, pursuant to K.S.A.2013 Supp. 74-50,193 and 74-50,197 and amendmentsthereto.

(e) The promoter shall notify the commission if theevent is to be televised or otherwise broadcast. The pro-moter shall provide a copy of the contract no later than10 days before the event.

(f) No promoter may serve in any capacity at any eventfor which the commission has denied or revoked a permitor for which a permit has not been issued. If a promoterserves in any capacity at an event without a permit forthat contest or performance, the promoter’s license maybe revoked or indefinitely suspended. The promoter maybe subject to action, pursuant to K.S.A. 2013 Supp. 74-50,193 and 74-50,197 and amendments thereto.

(g) No event shall be held until the commission hasapproved the application and the date for the program.

(h) If the promoter cancels the event within 24 hoursbefore weigh-in, the application fee shall be forfeited. Thefee may be applied to a subsequent event if the subse-quent event is scheduled to be held within 30 days of theoriginally scheduled event.

(i) The promoter may select the announcer for an event.(j) All judges, referees, and timekeepers for the event

shall be selected and approved by the boxing commis-sioner.

(k) If the permit is revoked, no refund for the permitshall be issued by the commission.

Article 3.—TICKETS AND FEES

128-3-1. Tickets and fees. (a) Each person admittedto an event shall have a ticket or pass.

(b) Each ticket shall indicate on the ticket the price, thename of the promoter, and the date and time of the event.The price of the ticket shall be indicated either on theticket and the ticket stub or on the electronic ticket. Eachticket shall be printed on cardboard or issued electroni-cally, with a different color for each event.

(c) The promoter shall not sell any tickets for a priceother than the price printed on the ticket.

(d) The promoter of each event shall prohibit the saleof any tickets for a price other than the price printed onthe ticket, except as provided in subsections (e) and (f).

(e) Each ticket for an event sold for less than the priceprinted on the ticket shall be overstamped with the actualprice charged. The overstamp shall be placed on theprinted face of the ticket as well as on the stub retainedby the ticket holder. Failure to comply with this subsec-tion shall result in the full ticket price being used for pur-poses of computing the athletic fee required to be paid.

(f) Each complimentary ticket shall be clearly marked‘‘COMPLIMENTARY.’’ A promoter shall not issue com-plimentary tickets for more than 15 percent of the seatsin the venue, without the boxing commissioner’s priorwritten authorization. Failure to comply with this sub-section shall result in the required use of the full ticketprice for the purpose of computing the athletic fee re-quired to be paid.

(g) The boxing commissioner, the commission’s staff,each inspector, and each member of the athletic commis-sion shall be admitted without a ticket or pass to anycontest or professional wrestling performance over whichthe commission has jurisdiction.

(h) No person without a ticket shall be admitted to anevent unless that person is one of the following:

(1) A contestant scheduled to compete at the event;(2) an employee or independent contractor who pro-

vides identification from the promoter indicating that theindividual is an employee or independent contractorworking for the promoter;

(3) a member of the media approved by the promoterto attend the event;

(4) an on-duty law enforcement officer; or

(5) an on-duty emergency responder.(i) The holder of a ticket for an event shall not be al-

lowed to perform either of the following:(1) Pass through the gate of the premises where the

event is being held, unless the ticket is separated from theticket stub, marked, scanned, or inventoried as havingbeen presented at the gate; or

(2) occupy a seat unless the ticket holder is in posses-sion of the electronic ticket, ticket stub, or marked ticket.

(j) If a ticket is electronic, the ticket shall be scannedbefore the ticket holder’s admission into the venue.

(k) Once the ticket holder gains entry to a venue byway of ticket, the individual shall be readmitted afterleaving only if the individual presents a ticket stub orother evidence of admission and a notation stamp orother similar marking indicating that the individual ispermitted to reenter.

(l) The following duties shall be the responsibility ofeach inspector assigned to each event:

(1) Supervising ticket sales, ticket boxes, and the en-trances and exits to the site of the contest or performancefor the purpose of checking admission controls; and

(2) ensuring that all tickets are counted and that a finalaccounting, including computation of the number of com-plimentary tickets and passes that are used, the price ofadmission charged for each ticket, and the gross receiptsfrom all ticket sales, is completed.

(m) The final accounting shall be conducted in a privateroom or secured area and in the presence of both the pro-moter’s representative and the assigned inspector. Thefinal accounting shall include a determination by the as-signed inspector of the amount of athletic fee due fromthe promoter.

(n) Each promoter who obtains a permit for an eventshall pay to the commission the athletic fee, which is fivepercent of the gross receipts derived from the admissioncharges for the event.

(o) Gross receipts shall mean the total amount of allticket sales, including complimentary tickets and passes,after sales tax is deducted. For the purposes of this sub-section, complimentary tickets and passes shall be in-cluded in the calculation of gross receipts and counted asif the complimentary tickets and passes had been sold atthe average ticket price of all those tickets offered for salefor the event.

(p) If no admission is charged for an event and the pro-moter is promoting the event for a contracted amount,the five percent athletic fee shall be based on the contractprice. A copy of the contract shall be submitted to thecommission with the fee payment. If there is no writtencontract, the promoter and the entity with which the pro-moter has entered into an oral contract shall sign a no-tarized affidavit stating the amount paid to the promoterfor the event. Article 6.—PROFESSIONAL PRACTICE

66-6-1. Seals and signatures. (a) Each licensee shallobtain a seal of the design approved by the board in com-pliance with K.S.A. 74-7023, and amendments thereto.The seal may be a rubber stamp, an embossed seal, or acomputer-generated seal.

(b) Each original drawing, document, technical report,legal description, record, and paper prepared by or underthe direct supervision of the licensee in the licensee’s pro-fessional capacity shall be stamped with the licensee’sseal, unless the project is exempt from the requirementsfor licensure pursuant to K.S.A. 74-7031, K.S.A. 74-7032,K.S.A. 74-7033, K.S.A. 74-7034, or 2014 SB 349, sec. 26, andamendments thereto.

After the licensee’s seal has been applied to the originalor record copy, the licensee shall place the licensee’shandwritten signature and date across the seal.

(c)(1) Any licensee may use a digital signature if thesignature meets all of the following requirements:

(A) Is unique to the person using it;(B) is able to be verified;(C) is under the sole control of the person using it; and(D) is linked to an electronic document bearing the dig-

ital signature in such a manner that the signature is in-validated if any data in the document is altered.

(2) Each displayed copy of, and each hard copy printedfrom, a transmitted or stored electronic document con-taining a digital signature shall bear the facsimile of thesignature, date of signing, and seal and shall be a confir-mation that the electronic document was not altered afterthe initial digital signing of the document. If the electronicdocument is altered, the facsimile of the signature, date,and seal shall be caused to be voided. 66-6-4. Professional conduct. (a) For the purposesof this regulation, ‘‘licensee’’ shall mean an architect, alandscape architect, a professional engineer, a profes-sional geologist, or a professional surveyor.

(b) If any licensee’s professional judgment has been dis-regarded under circumstances in which the safety, health,or welfare of the public is endangered, the licensee shallinform the employer or client of the possible conse-quences, and the licensee shall notify the authority whoissued the building permit or otherwise has jurisdiction.

(c) The licensee shall not advertise to perform or un-dertake to perform any assignment involving a specifictechnical profession unless the licensee is licensed andqualified by education and experience in that technical

profession, as defined in K.S.A. 74-7003, and amendmentsthereto.

(d) A licensee in any technical profession shall not affixa personal or digital signature, seal, or both to any planor document dealing with subject matter that is outsidethe licensee’s field of practice as defined by K.S.A. 74-7003, and amendments thereto.

(e) If the competence of any licensee to perform an as-signment in a specific technical field is at issue, the li-censee may be required by the board to pass an appro-priate examination.

(f) In all professional reports, statements, and testi-mony, each licensee shall meet the following require-ments:

(1) Be completely objective and truthful; and(2) include all relevant and pertinent information.(g) When serving as an expert or technical witness be-

fore any court, commission, or other tribunal, each li-censee shall express only opinions founded on the follow-ing:

(1) An adequate knowledge of the facts at issue;(2) a background of technical competence in the subject

matter; and(3) an actual, good-faith belief in the accuracy and pro-

priety of the licensee’s testimony.(h) If a licensee issues any statements, criticisms, or ar-

guments on public policy matters that are inspired orpaid for by any interested party or parties, those com-ments shall be prefaced by and include disclosure of thefollowing:

(1) The identity of each party on whose behalf the li-censee is speaking; and

(2) the existence of any pecuniary interest of the li-censee.

(i) Each licensee shall disclose all known or potentialconflicts of interest to employers or clients by promptlyinforming them of any business association, interest, orany other circumstances that could influence that li-censee’s judgment or the quality of the licensee’s services.

(j) A licensee shall not accept compensation, financialor otherwise, from more than one party for services onthe same project or for services pertaining to the sameproject, unless the circumstances are fully disclosed andagreed to by all interested parties.

(k) A licensee shall not solicit or accept financial orother valuable consideration, directly or indirectly, fromeither of the following:

(1) Material or equipment suppliers for specifying theirproducts; or

(2) contractors, their agents, or other parties in connec-tion with work for employers or clients for which the li-censee is responsible.

(l) A licensee shall not solicit a contract from a govern-mental body on which a principal or officer of the li-censee’s organization serves as a member, except uponpublic disclosure of all pertinent facts and circumstancesand consent of the appropriate public authority.

(m) A licensee shall not offer, directly or indirectly, topay a commission or other consideration or to make apolitical contribution or other gift in order to secure work,except for payment made to an employment agency forits services.

(n) In all contacts with prospective or existing clientsor employers, each licensee shall accurately represent thelicensee’s qualifications and the scope of the licensee’s re-sponsibility in connection with work for which the li-censee is claiming credit.

(o) A licensee shall not be associated with, or permitthe use of the licensee’s personal name or firm name in,a business venture being performed by any person orfirm that the licensee knows, or has reason to believe, isengaging in either of the following:

(1) Business or professional practice of a fraudulent ordishonest nature; or

(2) a violation of K.S.A. 74-7001 et seq., and amend-ments thereto, or the regulations promulgated andadopted by the board, or both.

(p) Each licensee with knowledge of any alleged vio-lation of K.S.A. 74-7001 et seq., and amendments thereto,or the regulations promulgated and adopted by theboard, or both, shall report the alleged violation to theboard.

(q) Each licensee shall cooperate with the board in itsinvestigation of complaints or possible violations ofK.S.A. 74-7001 et seq., and amendments thereto, and theregulations of the board. This cooperation shall includeresponding timely to written communications from theboard, providing any information or documents re-quested within 30 days of the date on which the com-munication was mailed, and appearing before the boardor its designee upon request.

(r) A licensee shall not assist any person in applyingfor licensure if the licensee knows that person to be un-qualified with respect to education, training, experience,or character.

(s) Conviction of a felony or the revocation or suspen-sion of a professional license by another jurisdiction, iffor a cause that in Kansas would constitute a violation ofKansas law or of these regulations, or both, shall consti-tute unprofessional conduct.

(t) A licensee shall not violate any order of the board.(u) Each professional surveyor shall comply with the

minimum standards for the practice of professional sur-veying adopted by reference in K.A.R. 66-12-1.

(v) Each licensee shall take appropriate measures to en-sure that the licensee’s drawings and specifications meetthe following requirements:

(1) Remain the property of the licensee regardless ofwhether the project contemplated was executed;

(2) are not utilized for projects that were not contem-plated at the time of the completion of the drawings andspecifications; and

(3) are not used by the client on any other projects,including additions to the contemplated project, unlessthe licensee defaults or agrees in writing to this use. 66-6-6. Renewal of licenses and certificates of au-thorization. (a) Each licensee whose last name beginswith one of the letters A through L shall renew the licensein even-numbered years. Each licensee whose last namebegins with one of the letters M through Z shall renewthe license in odd-numbered years. A notice shall be is-sued by the board to each licensee during the appropriaterenewal year, and not later than 30 days before the fol-lowing expiration dates:

(1) Architects June 30;(2) landscape architects December 31;(3) professional engineers April 30;(4) professional geologists June 30; and(5) professional surveyors March 31.

(b) Each business entity whose name begins with oneof the letters A through L shall renew its certificate ofauthorization in even-numbered years. Each business en-tity whose name begins with one of the letters M throughZ shall renew its certificate of authorization in odd-num-bered years. A notice shall be issued by the board to eachbusiness entity during the appropriate renewal year, andnot later than 30 days before the December 31 expirationdate. 66-6-10. License statuses. For licenses that renewon or after November 1, 2014, any licensee may elect toplace the license, at the time of renewal, into one of thefollowing license statuses:

(a) Active status shall require renewal every two yearswith the appropriate fee. The individual shall have 30professional development hours (PDHs) of acceptablecontinuing education as required for renewal.

(b) Inactive status shall require renewal every twoyears with the appropriate fee. No continuing educationshall be required. The individual shall have no pendingdisciplinary action before the board. The individual shallnot practice a technical profession in Kansas.

(c) Emeritus status shall require the individual to be atleast 60 years of age. The individual shall submit a one-time application, with no fee and no proof of continuingeducation required. The individual shall have no pendingdisciplinary action before the board. Any individual whochooses this license status may use that individual’s pro-fessional title in conjunction with the word ‘‘emeritus.’’The individual shall not practice a technical profession inKansas. 66-8-4. Professional surveyor examinations. (a)The examinations required of each applicant for licensureas a professional surveyor shall be the following:

(1) The national council of examiners for engineeringand surveying (NCEES) examinations covering the fol-lowing:

(A) The fundamentals of surveying; and(B) the principles and practices of surveying; and(2) an examination covering Kansas surveying laws

and practices.(b) The fundamentals and the principles and practices

of surveying examinations shall be graded by the NCEES,subject to approval by the board.

(c) Any applicant who has passed one or more sectionsof previous registration examinations may be grantedtransfer credits if approved by the board.

(d) Each applicant for a license as a professional sur-veyor shall be required to pass the section on the funda-mentals of surveying and shall meet the surveying ex-perience requirements under K.S.A. 74-7022, andamendments thereto, before submitting an application totake the section on professional practice. 66-8-6. Reexamination. (a) Any applicant for a li-cense to practice engineering, surveying, or geology whofails an examination on the first attempt may take theexamination two additional times, except as specified insubsections (b) and (c).

(b) Except as specified in subsection (c), the fourth andany subsequent attempts by an applicant to retake an ex-amination may be allowed by the board if the applicantestablishes that the areas of deficiency identified in theexamination failure report provided by the testing ad-ministrator have been addressed through either of the fol-lowing:

(1) Additional coursework; or(2) experience under the supervision of a person li-

censed in the technical profession for which the applicantis seeking licensure.

(c) Any applicant’s examination results may be rejectedby the board and permission to retake an examinationmay be withheld by the board upon a report by the test-ing administrator of any possible violation by the appli-cant of the provisions of any candidate testing agreementregarding examination irregularities.

(d) Each applicant shall submit the appropriate fee foreach examination. 66-8-7. Geology examinations. (a) The examinationrequired of each applicant for geology licensure shallbe the national association of state boards of geology(ASBOG�) examination, consisting of a geology funda-mentals section and a geologic practice section.

(b) The examination shall be graded by the ASBOG�,subject to approval by the board.

(c) Each applicant for a professional license shall be re-quired to pass the section on geology fundamentals andshall meet the geology experience requirements under2014 SB 349, sec. 16, and amendments thereto, before sub-mitting an application to take the section on geologicpractice. 66-8-8. Examination standards acceptable to theboard for reciprocity applicants. (a) The reexaminationof an applicant from another jurisdiction shall not be re-quired for a license by reciprocity if that jurisdiction’s ex-amination requirements would have met the Kansasrequirements in effect on the date when the applicant’soriginal license was issued, as determined by the board.

(b) Another jurisdiction’s examination requirementsmay be accepted by the board if that jurisdiction did notrequire the national examination when the applicant wasoriginally licensed.

(c) In order to meet the standard acceptable to theboard, each applicant for a license by reciprocity as a pro-fessional surveyor shall be required to demonstrate pro-ficiency in Kansas surveying laws and practices. This pro-ficiency shall be presumed by the board upon theapplicant’s successful completion of the examination asspecified in K.A.R. 66-8-4(a)(2). Article 9.—EDUCATION

66-9-5. Surveying curriculum approved by theboard. Any applicant seeking licensure as a professionalsurveyor may fulfill the education requirement by any ofthe following:

(a) Graduation from an approved engineering curric-ulum as defined in K.A.R. 66-9-4;

(b) graduation from a four-year surveying baccalaure-ate curriculum accredited by the accreditation board forengineering and technology (ABET);

(c) graduation from an approved surveying curriculumof two years from a school or college approved by theboard;

(d) graduation from an approved four-year related sci-ence curriculum, which may include geology, mathemat-ics, chemistry, or physics; or

(b) Each applicant for a license to practice architectureby reciprocity shall provide proof of certification by thenational council of architectural registration boards(NCARB). The requirements for this certification shall bethose specified in sections one through five on pages 11-15 of the ‘‘certification guidelines,’’ published by the na-tional council of architectural registration boards and re-vised January 2014. (b) Each person who has successfully completed theland surveying curriculum specified in K.A.R. 66-9-5(e)and each graduate of an approved surveying curriculumof two years, as specified in K.A.R. 66-9-5(c), shall be re-quired to provide documentation of six years of survey-ing experience, as required by K.S.A. 74-7022(a) andamendments thereto. At least four years of experienceshall have been in progressive surveying as specified inK.A.R. 66-10-12(b)(1), and the remainder shall have beenin either progressive surveying or basic surveying, asspecified in K.A.R. 66-10-12(b)(2) or (3). (C) measurements and locations;(D) computations and analysis;(E) legal principles and reconciliation;(F) land planning and design;(G) monumentation; and(H) documentation and land information systems.(2) Surveying experience normally identified with en-

gineering projects, including construction staking, curband gutter projects, sanitary sewers, and design surveysfor highways or bridges other than those that relate toright-of-way surveys, shall not be considered progressivesurveying experience. This experience, however, may beconsidered by the board as basic surveying experience.

(3) Teaching experience in surveying courses in an ac-credited engineering or surveying curriculum may beconsidered as equal to one year of basic surveying expe-rience. 66-10-13. Geology experience of a character that issatisfactory to the board. (a) The work experience re-quired of each applicant shall expose the applicant to allphases of work integral to the discipline of geology inwhich the applicant claims qualification to practice andshall be verified as specified in paragraph (b)(2).

(b) Geology experience shall meet the followingrequirements:

(1) Fall within the definition of ‘‘practice of professionalgeology’’ in K.S.A. 74-7003, and amendments thereto; and

(2) be directly supervised and verified by a licensedgeologist for work performed after July 1, 2000. However,direct supervision by a licensed geologist shall not be re-quired of the employees of any person, firm, or corpo-ration that does not offer services in the technical profes-sions to the public, although verification by theapplicant’s supervisor shall still be required.

(c) The following shall be used to assess credit for workexperience:

(1) Experience credit shall not be allowed for work per-formed before graduation.

(2) One year of credit toward the experience require-ment may be given for a master’s degree in geology or ina closely related specialty area acceptable to the board.

(3) Teaching geology in a college or university that of-fers a geology curriculum of four years or more approvedby the board may be considered geology experience.

(d) Each applicant shall supply references from at leastthree licensed geologists or licensed engineers who arefamiliar with the applicant’s geology experience. At leasttwo of these references shall be licensed geologists. Oneof the three references may be a licensed engineer. (2) supply references from at least three engineers whoare licensed in the United States and are familiar with theapplicant’s engineering experience.

(b) Each applicant for a professional surveying licenseby reciprocity shall meet the following requirements:

(1) Provide verification from the employer of at leasteight years of surveying experience or education, or acombination of these, pursuant to K.S.A. 74-7022 andamendments thereto, K.A.R. 66-10-10, K.A.R. 66-10-10a,K.A.R. 66-10-10b, and K.A.R. 66-10-11; and

(2) supply references from at least three licensed sur-veyors or licensed engineers who are familiar with theapplicant’s surveying experience. At least one referenceshall be from a licensed surveyor.

(c) Each applicant for a professional geology license byreciprocity shall meet the following requirements:

(1) Provide verification from the employer of at leastfour years of experience in the practice of professionalgeology, as defined in K.S.A. 74-7003 and amendmentsthereto. One year of credit toward the experience require-ment may be given for a master’s degree in geology or ina closely related specialty area acceptable to the board;and

(2) supply references from at least three licensed geol-ogists or licensed engineers who are familiar with the ap-plicant’s geology experience. At least two of these refer-ences shall be from licensed geologists. One of the threereferences may be from a licensed engineer. (1) Senior status in a geology curriculum described inK.A.R. 66-9-6; or

(2) completion of a geology curriculum described inK.A.R. 66-9-6. 66-11-5. Admission requirements for fundamen-tals of surveying examination. (a) Each application shallbe reviewed by the board to determine whether therequirements for admission to take the fundamentals ofsurveying examination have been met. Once the boardestablishes that these requirements have been met, theapplicant shall be allowed to sit for the examination.

(b) Each applicant shall meet one of the followingrequirements for admission before taking the examina-tion:

(1) Graduation from an accredited surveying curricu-lum, as defined in K.A.R. 66-9-5 (b) and (c);

(2) successful completion of the surveying curriculumspecified in K.A.R. 66-9-5(e); or

(3) verification of a combination of education and ex-perience of a character satisfactory to the board. In eval-uating an applicant’s record, a determination shall bemade by the board of whether, based on the applicant’seducational background, the applicant requires no morethan four years of additional progressive surveying ex-perience to qualify for admission to the practice of sur-veying examination. Article 14.—CONTINUING EDUCATIONREQUIREMENTS

66-14-6. Exemptions. A licensee may be exempt,upon board review and approval, from continuing edu-cation requirements in any of the following situations:

(a) The licensee is renewing for the first time.(b) The licensee is called to active duty in the armed

forces of the United States for a period of time exceeding120 consecutive days in a calendar year. This individualmay be exempt from obtaining the 15 professional de-velopment hours (PDH) required only during that year.

(c) The licensee chooses to have the license placed oninactive status or emeritus status as specified in K.A.R.66-6-10. If the licensee elects to return to practice, the li-censee shall earn 30 professional development hours forthe last renewal period or shall meet the requirementspecified in K.A.R. 66-14-10 or K.A.R. 66-14-11. Article 39.—ADULT CARE HOMES

26-39-500. Definitions. Each of the followingterms, as used in K.A.R. 26-39-500 through 26-39-506,shall have the meaning specified in this regulation:

(a) ‘‘Accredited college or university’’ means a collegeor university that is accredited by an accrediting bodyrecognized by the council on postsecondary accreditationor by the secretary of the U.S. department of education.

(b) ‘‘Clock-hour’’ means at least 50 minutes of directinstruction, excluding registration, breaks, and meals.

(c) ‘‘Continuing education’’ means a formally organ-ized learning experience that has education as its explicit,principal intent and is oriented toward the enhancementof adult care home administration values, skills, knowl-edge, and ethics.

(d) ‘‘Core of knowledge’’ means the educational train-ing content for the field of adult care home administrationspecified in K.A.R. 28-38-29.

(e) ‘‘Disciplinary action’’ means a final action by thesecretary or by a board or agency in this state or anotherjurisdiction on a professional or occupational health carecredential.

(f) ‘‘Domains of practice’’ means the knowledge, skills,and abilities specified in K.A.R. 28-38-29.

(g) ‘‘In-service education’’ means learning activitiesthat are provided to an individual in the work setting andare designed to assist the individual in fulfilling job re-sponsibilities.

(h) ‘‘Long-term care provider organization’’ means anyprofessional association concerned with the care andtreatment of chronically ill or infirm elderly patients orany association concerned with the regulation of adultcare homes.

(i) ‘‘Registration’’ means the credential issued by thesecretary to each applicant who meets the requirementsfor an operator specified in K.A.R. 26-39-501.

(j) ‘‘Relevant experience’’ shall include work experiencein business, hospitality, gerontology, or health and hu-man services, or other fields as approved by the secretary.

(k) ‘‘Relevant field’’ shall include degrees in business,hospitality, gerontology, or health and human services,or other degrees as approved by the secretary.

(l) ‘‘Sponsor’’ means any entity approved by the sec-retary to provide continuing education programs orcourses on a long-term basis.

(m) ‘‘Sponsorship’’ means an approved, long-term pro-vision of programs or courses for the purpose of fulfillingthe continuing education requirements for registration re-newal or reinstatement. (Authorized by and implement-ing L. 2014, ch. 94, sec. 4; effective, T-26-9-2-14, Sept. 2,2014.)

26-39-501. Registration. Each applicant for initialregistration as an operator shall meet the followingrequirements:

(a) Submit an application and meet the requirementsspecified in K.A.R. 26-39-502;

(b) pay the applicable fee specified in K.A.R. 26-39-505;(c) be at least 21 years of age;(d)(1) Have a high school diploma or equivalent, with

one year of relevant experience;(2) have an associate’s degree in a relevant field; or(3) have a bachelor’s degree; and(e) have successfully completed an operator course as

specified in K.A.R. 26-39-503. (Authorized by and imple-menting L. 2014, ch. 94, sec. 4; effective, T-26-9-2-14, Sept.2, 2014.)

26-39-502. Application for registration. (a) Eachapplicant for registration shall submit a completed appli-cation, pay the applicable fee, and provide evidence sat-isfactory to the department of having met the require-ments in K.A.R. 26-39-501.

(b) Each applicant shall provide the department withone of the following:

(1) Academic transcripts or proof of receipt of an as-sociate’s degree, if qualifying with an associate’s degreein a relevant field;

(2) academic transcripts or proof of receipt of a bache-lor’s degree or graduate degree, if qualifying with a bach-elor’s degree; or

(3) both a high school diploma or the equivalent andevidence of one year of relevant experience, if qualifyingwith a high school diploma and one year of relevant ex-perience.

(c) Each applicant shall arrange for transcripts to beprovided directly to the department by the school or theaccredited college or university.

(d) Each applicant who has received an associate’s de-gree, bachelor’s degree, or graduate degree outside theUnited States or its territories and whose transcript is notin English shall submit an officially translated Englishcopy of the applicant’s transcript and, if necessary, sup-porting documents. The transcript shall be translated bya source and in a manner acceptable to the department.Each applicant shall pay all transcription fees directly tothe transcriber.

(e) Each applicant who has received an associate’s de-gree, bachelor’s degree, or graduate degree outside theUnited States or its territories shall obtain an equivalencyvalidation from a department-approved entity that spe-cializes in educational credential evaluations. Each ap-plicant shall pay the required equivalency validation feedirectly to the validation agency.

(f) If adverse information concerning the applicant isreceived through criminal history records, abuse, neglectand exploitation information, or disciplinary action in-formation or from any other source, the applicant shallprovide, upon request, all necessary records, affidavits,or other documentation required by the secretary con-cerning the disciplinary action, the abuse, neglect or ex-ploitation findings, or the criminal conviction, includingany evidence that all disciplinary action or sentencingrequirements have been completed. All costs for the ac-quisition of these documents shall be the applicant’s re-sponsibility.

(g) If an applicant has been subject to disciplinary ac-tion or has been convicted of a felony or misdemeanor,the applicant shall have the burden of proving that the

26-39-503. Operator course. (a) Each applicantshall have successfully completed an operator course onprinciples of assisted living that is approved by the sec-retary.

(b) Each operator course shall be conducted by one ofthe following training providers:

(1) A long-term care provider organization;(2) a community college;(3) an area vocational-technical school;(4) a postsecondary school under the jurisdiction of the

state board of regents; or(5) an equivalent training provider approved by the

secretary.(c) Each training provider shall ensure that each indi-

vidual responsible for administering the operator coursehas at least two years of professional experience in long-term care or as an instructor of long-term care and meetsone of the following requirements:

(1) Has a bachelor’s degree; or(2) is a registered professional nurse.(d) Each training provider seeking approval to conduct

an operator course shall submit the following at leastthree weeks before the first anticipated start date of theoperator course:

(1) A course outline that includes all content areas inthe department’s document titled ‘‘operator courseguideline,’’ dated July 31, 2014 and hereby adopted byreference. The operator course shall consist of at least 45clock-hours of instruction, excluding breaks, lunch, andtest time, and a test;

(2) the policy and procedure to be followed to maintaintest security, which shall include at least the following:

(A) Securing the tests in a manner that ensures confi-dentiality;

(B) not providing the test content to any individual be-fore test time; and

(C) notifying the department of any breach in the se-curity of the test;

(3) a list of the printed materials provided to each par-ticipant, which shall include at least the following:

(A) The Kansas adult care home statutes and regula-tions for assisted living facilities and residential healthcare facilities, home pluses, and adult day cares;

(B) a functional capacity screening manual and form;(C) the ‘‘dietary guidelines for Americans’’ and ‘‘tu-

berculosis (TB) guidelines for adult care homes,’’ asadopted by reference in K.A.R. 26-39-105; and

(D) an example of a negotiated service agreement; and(4) after initial approval, submit each proposed change

in the operator course to the secretary for approval beforethe change is implemented.

(e) If the operator course does not meet or continue tomeet the requirements for approval or if there is a ma-terial misrepresentation of any fact with the informationsubmitted by the training provider to the department, ap-proval may be withheld, made conditional, limited, orwithdrawn by the secretary.

(f) Each approved training provider shall meet the fol-lowing requirements:

(1) Notify the department, electronically or in writing,at least three weeks before each operator course, includ-ing course dates, time, and location;

(2) administer and score the test provided by the de-partment after each individual’s completion of the oper-ator course. The individual may have access to the ap-plicable statutes and regulations during the test. A scoreof 80 percent or higher shall constitute a passing score.Any individual who fails the test may retake the test onetime. An alternative test version shall be used. Each in-dividual who fails the test a second time shall be requiredto retake the operator course;

(3) within three weeks after the end of the operatorcourse, provide a certificate of completion to each indi-vidual who completed the operator course and passed thetest. Each certificate shall contain the following:

(A) A statement that the named individual completedthe operator course; and

(B) the course approval number assigned by the de-partment;

(4) maintain a record of the certificates issued to theindividuals who have successfully completed the opera-tor course; and

(5) within three weeks after the end of the operatorcourse, submit to the department a copy of each certificateof completion issued and a list of the individuals whosuccessfully completed the operator course. The list shallcontain the following:

(A) The course approval number;(B) the name, address, and date of birth of each indi-

vidual; and(C) any other information as required by the secretary.

26-39-504. Registration renewal and reinstate-ment; continuing education. (a) Each registration shallexpire biennially on April 30. Each initial registrationshall be issued for at least 12 months but not more than24 months.

(b)(1) On or before April 30 of the calendar year inwhich the registration expires, each operator shall submitelectronically or have postmarked a completed renewalapplication and the renewal fee specified in K.A.R. 26-39-505.

(2) The registration may be renewed within the 30-dayperiod following the expiration date only if the completedapplication and the renewal fee and renewal late fee spec-ified in K.A.R. 26-39-505 are received electronically orpostmarked on or before May 30 of the calendar year inwhich the registration expires.

(3) If the completed renewal application and the appli-cable fee or fees are not received electronically or post-marked within the 30-day period following the expirationdate, the registration shall be deemed to have lapsed forfailure to renew and shall be reissued only after the reg-istration has been reinstated.

(c) Each individual whose registration has lapsed fornot more than 24 months shall submit a completed ap-

plication, on department-approved forms, showing com-pletion of 30 clock-hours of continuing education. Theapplication shall be accompanied by the renewal fee andthe reinstatement fee specified in K.A.R. 26-39-505.

(d) Each individual whose registration has lapsed formore than 24 months shall submit a completed applica-tion on department-approved forms showing successfulcompletion of the operator course within the most recent24-month period. The application shall be accompaniedby the renewal fee and the reinstatement fee specified inK.A.R. 26-39-505.

(e) Continuing education requirements shall be pro-rated on a monthly basis for each operator whose initialor reinstatement registration period is less than 24months.

(f)(1) Each application for renewal shall include an at-testation verifying that the operator has completed atleast 30 clock-hours of continuing education during theperiod covered by the most recent registration. Continu-ing education in excess of the required 30 clock-hoursshall not be carried over to the next renewal period.

An operator’s renewal application may be randomlyselected for audit to confirm completion of continuingeducation requirements. Each operator whose renewalapplication is selected for audit shall provide all docu-mentation requested by the secretary.

The 30 clock-hours of continuing education shall beearned through participation in or attendance at contin-uing education offerings pertaining to the core of knowl-edge or the domains of practice and shall be accumulatedwithin subject areas as follows:

(A) At least 15 clock-hours in administration, whichmay include the following subjects:

(i) General administration;(ii) applicable standards of environmental health and

safety;(iii) local health and safety regulations;(iv) departmental organization and management; and(v) community interrelationships;(B) at least 10 clock-hours in resident care, which may

include the following subjects:(i) Psychology of resident care;(ii) principles of medical care;(iii) personal and social care; and(iv) therapeutic and supportive care; and(C) a maximum of five clock-hours in electives, which

shall be in the domains of practice or the core of knowl-edge or in health-related fields.

(2) Five hours of continuing education credit in elec-tives shall be approved for attendance, if verified by thesponsor, at state or national annual conventions that per-tain to long-term care, in addition to continuing educa-tion credit approved for individual sessions at the stateor national annual conventions.

(g) In-service education shall not be deemed a contin-uing education activity for the purpose of registration re-newal or reinstatement.

(h) Fifteen clock-hours of continuing education creditshall be approved for each college credit hour that per-tains to the domains of practice or the core of knowledgeand is earned within the renewal period.

(i) Each operator or nonapproved provider of contin-uing education who seeks approval of a continuing ed-ucation offering shall submit a request for prior approvalto the department at least three weeks before the offeringis to be presented. The request shall provide informationabout the proposed offering, including objectives, con-tent, and agenda, on a form provided by the department.

(j) Each operator who attends a continuing educationoffering and who also serves as a presenter shall receivetwo clock-hours for each clock-hour of presentation time.Presenters shall not receive additional credit for repeti-tion of these presentations.

(k) Each sponsor shall meet the following require-ments:

(1) Offer at least six continuing education activities, in-cluding workshops, seminars, academic courses, self-study courses, teleconferences, and educational sessions,over a two-year period;

(2) designate one person as the coordinator, who shallbe responsible for administering all requirements andoutcomes of the sponsorship program. The departmentshall be notified in advance of any staff change involvingthe coordinator, including proof of that person’s creden-tials to be the coordinator. Each coordinator shall meetone of the following requirements:

(A) Be currently licensed as an administrator, as de-fined in K.A.R. 26-39-100, or be currently registered as anoperator, as defined in K.S.A. 39-923 and amendmentsthereto;

(B) have relevant experience or have a degree in a rel-evant field;

(C) serve as staff member of a professional organizationrelated to the field of adult care home administration; or

(D) have a background or academic preparation inadult education or training;

(3) submit a completed application, in a department-approved format. The application and all required doc-umentation shall be received by the department at least30 days before the initial continuing education offering;

(4) ensure that all continuing education offerings per-tain to the domains of practice or the core of knowledge;and

(5) submit an annual report on department-approvedforms no later than January 31 of each year for the pre-ceding calendar year. This report shall describe the ap-proved continuing education activities provided and thequality improvement methods used, including how eval-uation data is incorporated in planning future continuingeducation activities.

(l) If a sponsor fails to meet the requirements in thisregulation after receiving the secretary’s approval or ifthere is a material misrepresentation of any fact with theinformation submitted to the secretary by a sponsor, ap-proval may be withdrawn or conditions relating to thesponsorship may be applied by the secretary after givingthe sponsor notice and an opportunity to be heard. 26-39-506. Change of name or address. Each op-erator shall notify the department of any change in theoperator’s name or address within 30 days of the change.

(b) Notice of each name change shall meet the follow-ing requirements:

(1) Include the operator’s previous name, new name,and registration number; and

(2) be accompanied by one of the following:(A) A certified copy of the operator’s marriage certifi-

cate or license;(B) a certified copy of the operator’s court decree evi-

dencing the name change; or(C) a photocopy of the operator’s driver’s license or
