TO THE HONORABLE JUDGE OF SAID COURT:

COMES NOW, Kim-Lene Williams, Respondent herein, to file her First Amended

Petition and Third-Party Petition against Tera E. Bellemare, Third-Party Defendant. Petitioner

would respectfully show the Court the following:

1. Discovery Level

Discovery in this case is intended to be conducted under Level2 of Rule 190 of the Texas

Rules of Civil Procedure.

2. Parties

This suit is brought by Kim-Lene Williams, Petitioner, who resides in Kaufman County,

Texas.

Eric Lyle Williams, Respondent, resides in Kaufman County, Texas, has made a general

appearance herein, and may be served pursuant to the Texas Rules of Civil Procedure ..

Tera E. Bellemare ("Bellemare") is a resident of Tarrant County, Texas, residing at 8424

Shallow Creek Drive, Fort Worth, Texas 76179 where she may be served with citation.

3. Domicile

Petitioner has been a domiciliary of the State of Texas for the preceding six-month period

and a resident of this county for the preceding 90-day period.

4. Service

Petitioner has made a general appearance herein and service upon him may be had

pursuant to the Texas Rules of Civil Procedure.

Tera E. Bellemare may be served at 8424 Shallow Creek Drive, Fort Worth, Texas

76179.

5. Protective Order Statement

No protective order under title 4 of the Texas Family Code in effect, and no application

for a protective order is pending with regard to the parties to this suit.

6. Marriage and Separation

The parties were married in 1996, and ceased to live together as husband and wife on or

about April12, 2013.

7. Grounds

The marriage has become insupportable because of discord or conflict of personalities

between Petitioner and Respondent that destroys the legitimate ends of the marriage relationship

and prevents any reasonable expectation of reconciliation.

Respondent is guilty of cruel treatment toward Petitioner of a nature that renders further

living together insupportable.

8. Children of the Marriage

No children were born to or adopted by the Petitioner and Respondent and none are

expected.

Afarua/Propeny

Petitioner requests the Court to order a division of the estate of Petitioner and Respondent

in a manner that the Court deems just and right, as provided by law.

Petitioner has separate property which should be set aside to her.

Petitioner's separate property was used to acquire community property and Petitioner

requests that said property be established as part separate and part community or that the

community estate be required to reimburse the Petitioner's separate estate for its interest in said

property.

10. Separate Property

Petitioner owns certain separate property that is not part of the community estate of the

parties, and Petitioner requests the Court to confirm that separate property as Petitioner's

separate property and estate.

11. Reimbursement

Petitioner requests the Court to reimburse the community estate for funds or assets

expended by the community estate to benefit or enhance Respondent's separate estate. The

community estate has not been adequately compensated for or benefited from the expenditure of

those funds or assets, and a failure by the Court to allow reimbursement to the community estate

will result in an unjust enrichment of Respondent's separate estate at the expense of the

community estate.

12. Equitable Interest

Petitioner requests the Court to award to the community estate an equitable interest equal

to the net amount of the enhancement in value of Respondent's separate property due to the

financial contribution expended by the community estate to benefit or enhance that separate

estate.

Petitioner requests the Court to award to Petitioner's separate estate an equitable interest

equal to the net amount of the enhancement in value of the community property due to the

financial contribution expended by Petitioner's separate estate to benefit or enhance the

community estate.

Petitioner requests the Court to award to Petitioner's separate estate an equitable interest

in the community property of the parties as a result of the use of Petitioner's separate property to

discharge all or part of a debt on property owned by the community.

13. Claim Against Third-Party Defendant

Bellemare is the sister of Respondent and is alleged to hold his power of attorney.

Bellemare has converted the separate property of Petitioner to her own use or possession and

continues to convert said property on a monthly basis. Bellemare has taken possession of

Petitioner's separate personal property. Bellemare is also in possession and control of

Petitioner's disability benefits, which are also separate property, and refuses to tum those over to

Petitioner or her attorney. Bellemare has also converted the parties community property to her

control and possession and has used Petitioner's separate property or the parties' community

property to make improvements to her home or her parents home. These conversions occurred in

Kaufman County, Texas, and Bellemare refuses to account for any of her conversions.

Petitioner requests a judgment against Bellemare in the amount of$100,000.00.

14. Kaufman County Standing Order Regarding Cltildren, Property and Conduct oftlte Parties in Family Cases

Petitioner has attached a copy of the Kaufman County Standing Order Regarding

Children, Property and Conduct of the Parties and incorporates the same into this petition.

I 5. Attorney's Fees and Expenses

It was necessary for Petitioner to secure the services of John A. Stewart, a licensed

attorney in the State of Texas, to prepare and prosecute this suit. To effect an equitable division

ofthe estate of the parties, judgment for attorney's fees and expenses through final judgment after

appeal should be granted against Respondent and in favor of Petitioner for the use and benefit of

Petitioner's attorney.

/6. Prayer

Petitioner prays that citation issue as required by law and that the Court grant a divorce

and such other relief requested in this petition.

Petitioner prays for a judgment against Tera E. Bellemare in the amount of$100,000.00.

Petitioner prays for attorney's fees, expenses and costs.

Petitioner prays for general relief.
