Notice is hereby given of the commencement of the selection process for “on-call” architectural services for small projects of $1,000,000 or less for Pittsburg State University. Three firms will be selected. The contracts will be for three years.

Notice is hereby given that the Kansas Department of Health and Environment (KDHE) is soliciting com-ments regarding a proposed air quality operating permit. KBK Industries, LLC has applied for a Class I operating permit in accordance with the provisions of K.A.R. 28-19-510 et al. The purpose of a Class I permit is to identify the sources and types of regulated air pollut-

ants emitted from the facility; the emission limitations, standards, and requirements applicable to each source; and the monitoring, record keeping, and reporting re-quirements applicable to each source as of the effective date of permit issuance.

KBK Industries, LLC, PO Box 216, Rush Center, KS 67575, owns and operates a fiberglass manufacturing fa-cility located at 1914 U.S. 183, Rush Center, KS 67575 and 2537 K-96, Rush Center, KS 67575.

The written request must be submitted to Shelley Schupp, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366, no later than noon Monday, July 16, 2018 in order for the secretary of Health and Environment to consider the request.

The U.S. Environmental Protection Agency has a 45-day review period, which will start concurrently with the public comment period, within which to object to the proposed permit. If the EPA has not objected in writing to the issuance of the permit within the 45-day review period, any person may petition the administrator of the EPA to review the permit. The 60-day public petition pe-riod will directly follow the EPA’s 45-day review period. Interested parties may contact KDHE to determine if the EPA’s 45-day review period has been waived.

Any such petition shall be based only on objections to the permit that were raised with reasonable specificity during the public comment period provided for in this notice, unless the petitioner demonstrates that it was im-practicable to raise such objections within such period, or unless the grounds for such objection arose after such period. If the EPA has not objected in writing to the issuance of the permit within the 45-day review period, any person may petition the administrator of the EPA to review the permit. Approval of Revisions to the Coffeyville Industrial Pretreatment Program

The City of Coffeyville (City) has proposed changes to its industrial pretreatment program, which regulates and controls wastewater contributions from industrial and other non-domestic wastewater sources, to the city sanitary sewer. The proposed changes would adopt technically-based local limits, previously approved by the U.S. Environmental Protection Agency (EPA) and the Kansas Department of Health and Environment (KDHE), specifically for the City Wastewater Treatment Plant.

The City has requested EPA and KDHE approval of the proposed changes. The proposed changes have been pre-pared in a manner that the City believes will remain fully protective of the environment. You may obtain a copy of the proposed program changes by contacting the City of Coffeyville, using the contact information below.

The City and Region 7 EPA will accept comments and views on the proposed industrial pretreatment program changes for a period of 30 days following the date of this publication. All written comments and views will be con-sidered by EPA and KDHE in determining whether it will issue final approval of the proposed changes. As part of the FFY 2015 program, Local Road Safety Plans (LRSP) are being piloted in four counties (Barton, Butler, McPherson, and Stafford).

The Kansas Department of Transportation (KDOT) in cooperation with Kansas counties is interested in con-tracting with a consulting firm pre-qualified in catego-ries 212–Highway Design–Minor Facility and/or 231–Traffic Control Analysis and Design to provide services to develop a Local Road Safety Plan (LRSP) for each county in Kansas that desires to participate in the LRSP program within the next 5 years. LRSPs for 4 counties that participated in the pilot LRSP project. With 101 counties remaining, LRSPs will need to be developed for approximately 20 counties per year for the next 5 years.)Project Background

Kansas’ Strategic Highway Safety Plan (SHSP) has found that in the five-year period between 2009-2013, 48 percent of fatalities and 55 percent of disabling injuries occurred on roads owned by local public authorities. The SHSP goal is to halve fatalities and serious injuries on all public roads in the state over a 20-year period end-ing in 2029. With limited funds, a county needs a plan to effectively make an impact on their crash statistics. The intent of this Request for Proposal (RFP) is to develop a Local Road Safety Plan (LRSP) for each county. KDOT has completed a pilot project for four counties and has developed the template to use for all future LRSPs for all Kansas counties.

The Local Road Safety Plan concept is designed to build on the foundation established by the SHSP. These plans will provide the basis for systemic implemen-tation of safety measures across the entire jurisdiction. Development of an LRSP will be advantageous for the county in securing future safety funds since the systemic identification of crash problems, identified roadway risk factors, and potential countermeasures will be a focus of Kansas’ local safety programs in the future. Local juris-dictions will also be able to use the information to meet their road safety planning needs. The Local Road Safety Plan should be a document that identifies several proac-tive measures, based on current crash trends, which will increase the overall safety for roadway users. The con-sultant will develop, for each county, a prioritized list of proposed safety improvements.

cations, if any. Low-cost systemic safety measures will be emphasized in the recommendations. More extensive improvements should be recommended only where sys-temic measures would not adequately address the risk. The final product will provide a prioritized list of safety improvements with a rough estimate of costs. The prior-itization will be based on crash history and risk factors.Tasks:

1. Project ManagementPerform day to day project management of this con-tract, including submission of monthly invoices/progress reports. Attend a monthly conference call to discuss project status. Attendees for each call are anticipated to be KDOT, the project representative for each county and any sub consultant(s) on the project. A total of ten (10) conference calls are antic-ipated per year. Coordinate and provide guidance to sub consultants on tasks to be performed by sub consultants.

2. Crash AnalysisCrash records (accident reports) for LRSP routes in the county will be furnished by the county for the most recent five years. Review the circumstances of the crashes to aid in the identification of potential countermeasures and any high accident locations.

3. Data Collection/AnalysisCollect attribute data that can be used to identify risk factor rankings for intersections, segments, and curves. Data collection will be conducted to deter-mine if an approved risk factor identified in Task I is present, and initially, this will be limited to pre-screening the LRSP routes using readily available data sources (e.g., existing KDOT and county map-ping or GIS records, existing aerial photography, Google, Bing, etc.). Each LRSP study route will then be driven once to collect additional limited field data that can be used to determine the presence of an approved risk factor. Video data may be collect-ed as part of this effort. More detailed data for road-way and shoulder characteristics (e.g., width, slope, superelevation, etc.) may need to be collected lat-er for the 10 recommended safety projects for each county to prepare preliminary improvement scopes and cost estimates. It is anticipated that a separate conference call with KDOT and each county will be held to discuss risk factors and finalize data collec-tion methods.The following information is relevant to support the systemic technical analyses:• Intersections

The initial prescreening will include estimating ADT information using the best information avail-able rather than collecting count data. Aerial pho-tography will be used for intersection approach angle, and entrance locations, and to verify rele-vant segment and curve data (e.g., pavement and shoulder width, proximity of fixed objects). General assessments will be made for assessing the presence and proximity of fixed objects (e.g., little to none, moderate, prevalent, etc.), shoulder characteristics, curve superelevation, and if possible, edge condi-tion. The limited field data collection drive through will be used to supplement the readily available data sources. It is anticipated this will be required for intersection sight distance (cursory assessments only, such as adequate or limited), and to verify or obtain pertinent intersection, segment or curve in-formation (e.g., edge condition, pavement width, shoulder width and slope, curve superelevation, existing signing). Data collected as part of previous studies on the LRSP routes, such as a Practical Road Safety Assessment or a Traffic Engineering Assis-tance Program study, will be supplied by KDOT or the county and may also be used as part of this task. The attribute data will be stored in a database to fa-cilitate viewing and processing.

4. List of Safety Strategies/Countermeasuresa. Utilize the KDOT Bureau of Local Projects (BLP)

list of safety strategies and countermeasures for each of the risk factors. Primary references for countermeasures include NCHRP 500 series re-ports, NHTSA’s Countermeasures That Work, FHWA’s Towards Zero Deaths (human factors strategies), FHWA’s Proven Safety Countermea-

sures, and FHWA’s Crash Modification Factors (CMF) Clearinghouse. Other references may be used in coordination with KDOT and/or county approval.

b. KDOT BLP will provide a table with a brief de-scription, an opinion of the probable cost to im-plement, and the expected effectiveness (CMF if available) for each of the safety strategies and countermeasures identified.

5. Safety Workshopsa. Develop, promote, and lead one safety work-

shop in each county. Local participants will be determined by the project representative for each county (e.g., county road and bridge super-visor, public works director, etc.) in coordination with the KDOT project manager. It is anticipated that participants will include county commis-sioners and key stakeholders from the county’s engineering, education, enforcement, and emer-gency services communities. The purpose of the workshop is to educate stakeholders on the mag-nitude of the issues and the effectiveness of pos-sible solutions, present the results of the crash and roadway data analysis, and obtain feedback on specific locations of concern as well as poten-tial strategies/countermeasures.

b. Prepare workshop invite and agenda in advance of the meeting. These materials will focus on communicating the intent of the workshop. Sub-mit to KDOT and the counties for review and approval prior to submitting it to participants. The project representative for each county will be responsible for booking a meeting room and sending out the invite/agenda to participants.

c. Prepare and distribute notes/minutes from the workshop. Final documentation will be distrib-uted after comments from attendees have been received. A follow-up meeting will be conduct-ed with each county’s project representative, as well as other core decision makers or stakehold-ers, to review and discuss engineering projects developed for their county. It is anticipated that the meeting will occur in conjunction with Task 6 services.

6. Identify Short List of Critical Strategies/Counter-measuresa. Prepare a list of priority safety strategies and

countermeasures that are recommended for im-plementation on the LRSP intersections, seg-ments, and curves. Safety strategies and counter-measures provided by KDOT BLP as part of the Task 3 services will be used as a starting point and refined to include those that have been demon-strated to effectively reduce the identified prior-ity crash types. Low-cost systemic improvements will be emphasized, along with proven, practical, and easily implementable solutions. These may be tailored to each county depending on findings from the crash and roadway data analysis.

b. Submit list of priority safety strategies and countermeasures developed in Task 5a to KDOT

and each county for review and approval. One conference call will be held with each county to discuss review comments.

7. Identify Safety ProjectsSafety projects will be identified for a total of 10 lo-cations in each county.a. Prepare risk factor ranking criteria for intersec-

tions, segments, and curves.b. Calculate risk factor scores for intersections, seg-

ments, and curves.c. Provide list of the results of the risk factor rank-

ing summary for intersections, segments, and curves to KDOT and the project representative for each county for their future use.

d. Develop project selection decision trees for use in the development of recommendations for in-tersections, segments, and curves that have the highest risk factor rankings. Priority strategies and countermeasures developed as part of the Task 5 services will be used as part of this task.

e. Develop a prioritized list of safety improvement locations for no more than the top ten intersec-tion, segment, and curve projects (for a total of 10 projects in each county). Locations with the same risk factor scores in a particular category (inter-section, segment, or curve) will be reviewed with the project representative for each county to de-termine the ten locations to be used.

f. Submit list of safety improvement locations de-veloped in Task 6e to KDOT and each county for review and approval. It is anticipated that the follow-up meeting identified in Task 4c will take place as part of this task to discuss review com-ments. Final approval of prioritized projects will come from KDOT and each county.

g. Develop unique project sheets for the approved safety improvement locations which depict proj-ect type, location, proposed improvements, and an opinion of probable project cost. It is antic-ipated that these project sheets will provide sufficient information for the counties to apply for High Risk Rural Roads Program (HRRR) or Highway Safety Improvement Program (HSIP) funding but will not include costs for Rights of Way and Utility Adjustments, if applicable.

8. Local Road Safety Plan Documenta. Develop a Local Road Safety Plan document for

each county. The document is anticipated to in-clude the following items:i. Executive summary which includes the pri-

oritized list of safety improvement projects for the top ten intersection, segment, and curve projects.

ii. Documentation and technical appendices sup-porting the selection of risk factors (outcome of Task I), priority strategies (outcome of Task 5) and priority locations (outcome of Task 6).

iii. Project sheets for the 10 approved safety im-provement projects which depict project type, location, proposed improvements, and an opinion of probable cost.

WHEREAS, more than 5 million Americans suffer from Alzheimer’s, and that number is estimated to more than triple by the year 2050; andWHEREAS, nearly one out of every three seniors who die each year suffer from some form of dementia; andWHEREAS, Alzheimer’s is a serious disease that affects not only those who have it, but also their families and caretakers; andWHEREAS, Kansas is the only state in the nation that is not currently drafting or implementing a comprehensive Alzheimer’s Disease Plan; andWHEREAS, the severity of this health crisis necessitates the implementation of a statewide response plan; andWHEREAS, this health crisis has a significant fiscal im-pact on the State of Kansas, which is estimated to keep increasing; andWHEREAS, Alzheimer’s and other forms of dementia negatively impact the health and quality of life of Kansans.NOW THEREFORE, pursuant to the authority vested in me as Governor of the State of Kansas, I hereby establish the Kansas Alzheimer’s Disease Working Group (“Work-ing Group”):

1. Membership of the “Working Group” shall be comprised of the following members:a. One member appointed by the Speaker of the

House;b. One member appointed by the House Majority

Leader;c. One member appointed by the Minority Leader

of the House;d. One member appointed by the Senate President;e. One member appointed by the Senate Majority

Leader;f. One member appointed by the Minority Leader

of the Senate;g. At least one person with Alzheimer’s disease;

h. At least one caregiver of a person with Alzhei-mer’s disease;

i. A representative of the nursing facility industry;j. A representative of the assisted living industry;k. A representative of the in-home care/hospice

industry; ;l. A representative of the medical care provider

community;m. An Alzheimer’s disease researcher;n. A representative of the of the Alzheimer’s As-

sociation;o. A representative of the Kansas Silver Haired

Legislature;p. A representative from the law enforcement

community;q. A representative from the Kansas Department

of Labor or Kansas Department of Commerce with knowledge of workforce issues;

r. Two (2) representatives from the Kansas De-partment for Aging and Disability Services with knowledge of mental health, developmental dis-abilities, aging, and long-term care issues; and

s. Two (2) representatives from the Kansas Depart-ment of Health and Environment with knowl-edge of Medicaid and public health issues.

2. The Kansas Department for Aging and Disability Services shall convene the Working Group and provide the necessary staffing and administrative support to the Working Group.

3. The Working Group shall be chaired by one of the members named above, as determined by the Governor.

4. Other members with relevant experience may be invited to join the Working Group by the Governor or Chair.

5. The Working Group shall meet monthly or as needed, at the discretion of the Chair.

6. Members of the Working Group shall not receive compensation, subsistence, allowance, or associat-ed expenses. Officers or employees of state agen-cies who are appointed to the Working Group as part of their duties shall be authorized to partici-pate on the Working Group and may claim subsis-tence, allowance, mileage, or associated expenses as permitted by law.

7. It shall be the duty of the Working Group to:a. Assess the current and future impact of Alzhei-

mer’s disease on residents of the State of Kansas;b. Examine the existing industries, services, and

resources addressing the needs of persons with Alzheimer’s, their families, and caregivers; and

c. Develop a strategy to mobilize a state response to this public health crisis.

8. The Working Group shall also include an examina-tion of the following in its assessment and recom-mendations:a. Trends in Alzheimer’s population and needs,

including the changing population with de-mentia, including but not limited to:

i. State role in long-term care, family caregiver support, and assistance to persons with early- stage and early onset of Alzheimer’s;

ii. Surveillance of persons with Alzheimer’s disease for purposes of having proper esti-mates of the number of persons in the state with Alzheimer’s disease; and

iii. The inappropriate use of antipsychotic med-ications to treat symptoms of dementia, which is a multi-faceted issue that touches every major area of our state’s health care system, and comprehensive strategies to re-duce this use.

b. Existing services, resources, and capability, in-cluding but not limited to the:i. Type, cost, and availability of dementia

services;ii. Dementia-specific training requirements

for long-term care staff;iii. Quality care measures for long-term care

facilities;iv. Capacity of public safety and law enforce-

ment to respond to persons with Alzheimer’s;v. Availability of home- and community-

based resources for persons with Alzhei-mer’s and respite care to assist families;

vi. Inventory of long-term care dementia care units;

vii. Adequacy and appropriateness of geriatric- psychiatric units for persons with behavior disorders associated with Alzheimer’s and related dementia;

viii. Assisted living residential options for per-sons with dementia; and

ix. State support of Alzheimer’s research through Kansas universities and other re-sources.

c. Needed State policies or responses, including but not limited to directions for the provision of clear and coordinated services and supports to persons and families living with Alzheimer’s and related disorders and strategies to address any identified gaps in services.

9. The Working Group is directed to hold public meetings and to utilize technological means, such as webcasts, to gather feedback on the recommen-dations from persons and families affected by Alz-heimer’s disease and the general public. The Work-ing Group shall be subject to the Kansas Open Records Act and the Kansas Open Meetings Act. Plans, reports, or recommendations of any nature adopted by the Working Group shall be consid-ered advice to the Governor and Legislature, and shall not be construed as official policies, positions, or interpretations of laws, rules, or regulations by any department or agency of state government, nor shall any such department or agency be bound in any manner to consider such advice when con-ducting their regulatory affairs.

10. The Working Group is directed to submit a report of its finding and recommendations to the Legis-

lature and Governor in the form of a Kansas Alz-heimer’s Disease Plan by January 14, 2019, or as appropriate during the intervening period.

11. The Working Group shall sunset upon delivery of the Kansas Alzheimer’s Disease Plan to the Legis-lature and Governor. By further Executive Order, the Governor may reconvene the Working Group to update the plan in the future.

This document shall be filed with the Secretary of State as Executive Order No. 18-14 and shall become effective immediately.Dated June 1, 2018.

111-19-44. Powerball Power Cruise 2 Collect ‘N Win promotion. (a) The Kansas lottery may conduct three second-chance drawings entitled “Powerball Pow-er Cruise 2 Collect ‘N Win Promotion.” The Promotion will begin on April 14, 2018 at 5:00 a.m. Tickets may be registered beginning at 5:00 a.m. April 15, 2018. The first drawing will close for entries at 11:59 p.m. on May 10, 2018. Winners for the first drawing will be announced on May 15, 2018. The second drawing will close for entries

at 11:59 p.m. on May 31, 2018 and winners will be an-nounced on June 5, 2018. The third drawing will close for entries at 11:59 p.m. on June 12, 2018 and winners will be announced on June 19, 2018.

(b) The specific ticket eligible for entry into the draw-ing shall be any winning or non-winning Kansas lottery Powerball ticket purchased between April 14, 2018 and at the close of business on June 10, 2018 (which actual-ly occurs at 1:59 a.m. on June 11, 2018). The entry ticket may include single plays, multiple plays, power-play or multi-draws on a single ticket.

(c) Any entry into the drawing(s) which is not selected as a winner in the first or second drawings shall remain eligible to win a prize in subsequent drawings. Players who are selected as alternates in a drawing also remain eligible for future drawings.

(d) A player shall enter the webcode from qualifying tickets through the Kansas lottery PlayOn program at www.kslottery.com. The player shall follow the hyper-link specifically developed for the purpose of accessing the “Powerball Power Cruise 2 Collect ‘N Win Promo-tion.” The player may enter the required data from the webcode on the online ticket manually for entry into the drawing. If the player does not enter the webcode ticket data manually, the player may scan, if available, the webcode to enter data to be used for entry into the drawing using a mobile device and a downloaded app. After the webcode ticket data is entered either manually or scanned using an app, a random number of symbols ranging from 2 symbols, 4 symbols, 6 symbols, 8 sym-bols, or 10 symbols will be generated on a player’s elec-tronic card. There will be six different symbols available to be collected: a symbol of a red Powerball (which is a free symbol); a symbol of a passport and Cococay, Baha-mas; a symbol of “Live!” Music; a symbol of a passport and Nassau, Bahamas; a symbol of a cruise ship; and a symbol of a stack of money. Once the player collects all six different symbols on his or her electronic card, the player will be entered automatically into the drawing. If a symbol is generated that already appears on the play-er’s electronic card, that symbol shall be moved automat-ically to another electronic card which shall be eligible to collect the remaining symbols. A player may have up to three electronic game cards active at one time. If a sym-bol is in place in three active game cards, the symbol will be removed from the rotation of symbols available to that player until that player’s game card is completed and en-tered into the drawing.

(e) For the first drawing described in subsection (a), 15 winners will be selected. The first, second, third, fourth and fifth entries selected in the first drawing shall each be awarded a Caribbean cruise prize package. Of those five entries, the first, second and third winners drawn will re-ceive ocean view staterooms on the cruise; the fourth and fifth winners drawn will receive an interior stateroom on the cruise. Entry numbers 6, 7, 8, 9, 10, 11, 12, 13, 14 and 15 selected shall be used as alternate winners, if neces-sary, in the order drawn.

For the second drawing described in subsection (a), 15 winners will be selected. The first, second, third, fourth and fifth entries selected in the second drawing shall each be awarded a Caribbean cruise prize package. Of those five entries, the first winner drawn will receive a balcony stateroom on the cruise; the second and third winners drawn will receive ocean view staterooms on the cruise; the fourth and fifth winners drawn will receive an inte-rior stateroom on the cruise. Lauderdale, Florida, on January 19, 2019; roundtrip coach class airfare for two persons from either Wichita, Kansas or Kansas City, Missouri to the destination airport; ground transportation between the destination airport and the hotel, from the hotel and the departure port, and between the arrival port to the desti-nation airport for the return flight; one double occupancy hotel room for the night before the cruise departure; the above listed prize stateroom aboard the chartered vessel for said Caribbean cruise; $250 nonrefundable ship cred-it; $1,000 and state and federal mandatory income with-holding taxes. The cruise portion of the prize includes all amenities aboard the ship including but not limited to all meals, non-alcoholic beverages, entertainment, port fees and ship taxes, attendance at the special concert event and opportunities to win on-board cash event prizes. The prize package has an approximate value of $8,378 for in-terior staterooms, $8,592 for ocean view staterooms, and $9,164 for balcony staterooms.

(f) A player may enter the drawing(s) as many times as their ticket purchases allow, but may win only one cruise prize package in this promotion.

(g) A player who is selected as a prize winner in any drawing must return his or her completed claim form, and the claim form must be received by the Kansas lot-tery within 14 days following the date of the online event drawing. In the event an alternate winner is awarded a prize, the winner must return his or her completed claim form within 14 days following the date the alternate winner was sent a claim form via U.S. mail. Failing to return the completed claim form or failing to meet any other contest requirements may result in the prize being awarded to an alternate winner.

(h) In the event any prize awarded for this drawing is postponed, changed, or canceled in whole or in part, no cash prize substitutions or other compensation shall be provided. There is no cash substitution for this drawing.

(i) Only registered PlayOn members may enter the “Powerball Power Cruise 2 Collect ‘N Win” drawings. PlayOn members must enter themselves into the draw-ings according to the terms and conditions of PlayOn. Article 401.—NORTHEAST GAMING ZONE

111-401-240. Name of the game; rules and regula-tions. The Kansas lottery shall conduct a lottery facility game at the Hollywood Casino at Kansas Speedway in Kansas City, Kansas, entitled “Three Card Poker with Six Card Bonus.”

The rules and regulations for the game of “Three Card Poker with Six Card Bonus” are contained in K.A.R. 111-401-240 through 111-401-246, and applicable generic rules are contained in K.A.R. 111-201-1 et seq. (Authorized by K.S.A. 2017 Supp. 74-8710 and 74-8748; implementing K.S.A. 2017 Supp. 74-8710; effective, T-111-5-18-18, April 11, 2018.)111-401-241. Method of play. (a) Three Card Poker

with Six Card Bonus (hereinafter “three card poker”) is played with a standard deck of 52 cards, no jokers, with backs the same color and design. The rank of the cards used in three card poker, in order of highest to lowest rank, shall be: ace, king, queen, jack, 10, 9, 8, 7, 6, 5, 4, 3, and 2. All suits shall be considered equal in rank. Notwith-standing the foregoing, an ace may be used to complete a “straight flush” or a “straight” with a two and three.

(b) The permissible poker hands in the game of three card poker, in order of highest to lowest rank, shall be:

(1) “Straight flush” or “three card straight flush” is a hand consisting of three cards of the same suit in consec-utive ranking, with ace, king, and queen being the high-est ranking straight flush and three, two and ace being the lowest ranking straight flush.

(2) “Three-of-a-kind” is a hand consisting of three cards of the same rank, regardless of suit, with three aces being the highest ranking three-of-a-kind and three twos being the lowest ranking three-of-a-kind.

(3) “Straight” or “three card straight” is a hand con-sisting of three cards of consecutive rank, regardless of suit, with ace, king and queen being the highest ranking straight and three, two and ace being the lowest ranking straight.

(4) “Flush” or “three card flush” is a hand consisting of three cards of the same suit, regardless of rank.

(5) “Pair” is a hand consisting of two cards of the same rank, regardless of suit, with two aces being the highest ranking pair and two twos being the lowest ranking pair.

(6) “High card” is the highest ranking card when no higher ranking hand or card exists.

(c) The permissible poker hands in the optional six card bonus wager, in order of highest to lowest rank, shall be as follows:

(1) “Royal flush” is a hand consisting of an ace, king, queen, jack and ten, all of the same suit;

(2) “Straight flush” is a hand consisting of five cards all of the same suit and in consecutive ranking;

(3) “Four-of-a-kind” is a hand consisting of four cards of the same rank, regardless of suit;

(4) “Full house” is a hand consisting of a “three of a kind” and a “pair” (two cards of the same rank, regard-less of suit);

(5) “Flush” is a hand consisting of five cards of the same suit, regardless of rank;

(6) “Straight” is a hand consisting of five cards of con-secutive rank, regardless of suit; and,

(7) “Three-of-a-kind” is a hand consisting of three cards of the same rank, regardless of suit.

(d) A player who has made a winning six card bonus wager shall only receive the payout for the highest rank-ing five-card poker hand that can be formed with the cards of the player and dealer.

(e) A six card bonus wager shall have no bearing upon the outcome of any other wager made by a player at the game of three card poker, and no other wager made by a player at the game of three card poker shall have any bearing upon the outcome of a six card bonus wager made by a player. equipment, and table. (a) The game of Three Card Poker with Six Card Bonus is played on a table consisting of five to seven betting areas on a table layout approved by the lottery.

(b) Each betting area will contain:(1) An area for a pair plus wager,(2) An area for an ante wager,(3) An area for a play wager; and,(4) An area for a six card bonus wager. (Authorized by

K.S.A. 2017 Supp. 74-8710 and 74-8748; implementing K.S.A. 2017 Supp. 74-8710; effective, T-111-5-18-18, April 11, 2018.)111-401-243. Wagers and payout odds. (a) Mini-

mum and maximum wagers will be posted on a sign at each table.

(b) Maximum table payouts, if any, will be posted at each table and will not be less than the maximum bet times the maximum odds.

(c) If a player has been permitted to wager less than the table minimum, the dealer will take or pay based upon the amount actually wagered. If a player has been permitted to wager more than the table maximum, the excess will be returned to the player and the player will be paid the correct odds on the correct wager. The player will be informed of the table minimum and maximum for subsequent wagers.

(d) The following describes a list of the permissible wa-gers, payout odds, and what constitutes a win, loss, or tie:

(1) Pair plus wager:(A) An optional wager placed by a player in the desig-

nated area for the purpose of wagering the player’s hand will contain a pair or better.

(B) An additional pair plus wager may be made as a tip for the dealer.

(C) Payout odds on a winning pair plus wager will be:(i) If the player’s hand contains a pair, 1to 1;(ii) If the player’s hand contains a three card flush, 3 to 1;(iii) If the player’s hand contains a three card straight,

6 to 1;(iv) If the player’s hand contains three-of-a-kind, 30 to 1;(v) If the player’s hand contains a three card straight

flush, 40 to 1.(D) A pair plus wager will win if the player’s hand

contains a pair, a three card flush, a three card straight, three-of-a-kind, or a three card straight flush.

(E) Pair plus wager will lose if the player’s hand does not contain a pair, a three card flush, a three card straight, three-of-a-kind, or a three card straight flush.

(2) Ante wager:(A) An optional wager placed by a player in the desig-

nated area for the purpose of playing against the dealer’s three card hand.

(B) An additional ante bet may be made as a tip for the dealer.

(C) Payout odds on winning ante bets will be:(i) If the player decides to continue by adding an ad-

ditional play bet in an amount equal to the original ante bet, winning ante bets will be paid odds at the rate of 1 to 1.

(ii) A bonus payout will be paid if the player’s hand consists of a three card straight, 1 to 1; if the player’s hand consists of a three of a kind, 4 to 1; and if the play-er’s hand consists of a three card straight flush, 5 to 1.

(D) The ante bet will win if:(i) The dealer’s hand does not contain a queen high or

better, or(ii) The player’s hand consists of any combination of

cards ranking higher than the dealer’s hand consisting of a queen high or better.

(E) The ante bet will lose if:(i) The player forfeits, or(ii) The player’s hand consists of any combination of

cards ranking lower than the dealer’s hand consisting of a queen high or better.

(F) The ante bet will tie or push when the dealer’s hand contains at least a queen high and the player’s hand is equivalent to the dealer’s hand.

(3) Play wager:(A) An additional wager placed by a player in the des-

ignated area. A play bet is only allowed if the player has also placed an ante bet for the purpose of playing against the dealer’s three card hand.

(B) An additional play bet may be made as a tip for the dealer only if the player has made an ante bet for the dealer.

(C) Payout odds on a winning play bet will be 1 to 1.(D) Play bets will win if the dealer’s hand consists of

at least a queen high or better and the player’s hand con-sists of a combination of cards ranking higher than the dealer’s hand.

(E) Play bets will lose if the dealer’s hand consists of at least a queen high or better and the player’s hand con-sists of a combination of cards ranking lower than the dealer’s hand.

(F) Play bets will tie or push if:(i) The dealer’s hand consists of a combination of cards

ranking lower than at least a queen high, or(ii) The dealer’s hand consists of a combination of cards

equivalent to the player’s cards.(4) Six card bonus wager:(A) An optional six card bonus wager may be placed by

a player in the designated area. The six card bonus wager is considered a side wager and is comprised using the player’s three card hand and the dealer’s three card hand to form the best five-card poker hand.

(B) An additional six card bonus wager may be made as a tip for the dealer.

(C) Payout odds on a winning six card bonus wager will be:

(i) If the player’s five card hand contains three-of-a-kind, 5 to 1;

(ii) If the player’s five card hand contains a straight, 10 to 1;

(iii) If the player’s five card hand contains a flush, 15 to 1;(iv) If the player’s five card hand contains a full house,

25 to 1;(v) If the player’s five card hand contains a four-of-a-

kind, 50 to 1;(vi) If the player’s five card hand contains a straight

flush, 200 to 1;(vii) If a player’s five card hand contains a royal flush,

1,000 to 1.(D) A six card bonus wager will win if the player’s five

card hand contains a three-of-a-kind, straight, flush, full house, four-of-a-kind, straight flush or a royal flush.

(E) A six card bonus wager will lose if the player’s five card hand does not contain a three-of-a-kind, straight, flush, full house, four-of-a-kind, straight flush or a royal flush. fling procedures.(1) A shuffle machine may be used. When a shuffle ma-

chine is used, the dealer may be required to mix the cards prior to placing them into the shuffle machine.

(2) In the event a shuffle machine is not used, the deal-er will place the cards in the dealer’s work area and sep-arate the deck into two stacks. The dealer will mix the two stacks.

(b) No card cutting procedures are used in the game of Three Card Poker with Six Card Bonus when using a shuffle machine. After a manual shuffle, the dealer sets the whole deck flat on the layout in front of the chip area to cut the deck. The dealer will take approximately one-half of the cards from the deck and place them on top of the cut card. The dealer will then place the remaining portion of the deck on top of the other cards.

(c) Dealing and taking of cards:(1) Hands will be dealt to players as follows:(A) The hands will be dealt face down from left to right.(B) In the event a shuffle machine is used, each player

will receive all three cards at once.(C) In the event a manual shuffle is used, cards will

be dealt beginning with the leftmost player clockwise to all players and the dealer face down and one at a time. Players may, but are not required to, view their cards. If a player views his or her cards, the player shall place the cards back in his or her betting area on the table before the dealer’s cards are exposed.

(b) After the dealer exposes the dealer’s hand, the deal-er will expose the hand of each player starting with the rightmost player, one at a time. The dealer will pay each winning wager, collect each losing wager, or indicate a push for each wager placed by the player and collect the player’s cards. posed card does not necessarily constitute a misdeal. The dealer, upon direction from the table games supervisor or higher ranking casino official, may turn the card over and continue dealing as if the card were not exposed.

(b) A table games supervisor or higher ranking casino official will be notified of any incorrect number of cards being dealt. Depending on the situation, the table games supervisor or higher ranking casino will determine how to proceed. Players receiving an incorrect number of cards will have a dead (void) hand. If the dealer has an incorrect number of cards, the round is a misdeal and the cards are dealt again.

(c) If the sensors start flashing during a round because the shuffle machine signaled an incorrect card count, the table games supervisor or higher ranking casino official will verify the correct number of cards is in play. If all players and the dealer have the correct number of cards, the remaining cards in the deck will be counted down. If the card count is correct (52 cards), the table games su-pervisor or higher ranking casino official may direct the dealer to resume play. If the card count is incorrect (any number of cards other than 52), that round is void, all players’ wagers shall be returned, and the deck of cards shall be replaced with a new deck of cards.

(d) It will be a misdeal if the dealer presses the start button to unload the remaining cards in the shuffle ma-chine prior to delivering the dealer’s hand. (Authorized by K.S.A. 2017 Supp. 74-8710 and 74-8748; implementing K.S.A. 2017 Supp. 74-8710; effective, T-111-5-18-18, April 11, 2018.)

Article 501.—SOUTH CENTRAL GAMING ZONE

111-501-143. Play. (a) The game of High Card Flush is played with a standard 52-card deck of playing cards.

(b) All ante wagers, flush bonus wagers and straight flush bonus wagers shall be placed prior to the first card being dealt in a round of play.

(c) A shuffling machine may be used in the game of High Card Flush. When a shuffling machine is used, the machine will deal seven (7) cards at a time. Beginning with the first player to the left of the dealer and continu-ing clockwise in order around the table, the dealer shall deal each player and the dealer seven (7) cards one stack at a time face down. In the event a shuffling machine is not used and the dealer manually shuffles the cards, be-ginning with the first player to the left of the dealer who has placed an ante wager and continuing clockwise in order around the table, the dealer shall deal each player who has placed an ante wager and the dealer seven (7) cards face down. Each player shall be dealt all seven (7) cards before the next player or dealer is dealt his or her seven (7) cards.

(d) After all cards have been dealt, each player may examine his or her cards. Each player who places a wa-ger shall be responsible for his or her own hand and no person other than the dealer and the player to whom the cards were dealt may touch the cards of that player.

(e) After examination of his or her cards, each player who has placed an ante wager shall have the option to either forfeit the ante wager and end his or her participa-tion against the dealer’s hand or make a raise wager. A raise wager must be equal to the amount of the player’s ante wager unless the player’s hand consists of five (5) or more cards of the same suit. If the player’s hand consists of five (5) cards of the same suit, the player may make a raise wager up to two (2) times the amount of the player’s ante wager. If the player’s hand consists of six (6) or sev-en (7) cards of the same suit, the player may make a raise wager up to three (3) times the amount of the player’s ante wager. If a player has placed an ante wager along with a flush bonus wager and/or straight flush bonus wager but does not make a raise wager, the player shall forfeit the ante wager.

(f) After each player has either placed a raise wager on the designated area of the table or forfeited his or her wager and hand, the dealer shall collect all forfeited wa-gers and associated cards, placing them in the discard rack or automatic shuffling machine. The dealer shall then reveal the dealer’s cards and place the cards so as to form the highest possible ranking hand available for the dealer’s cards.

(g) The dealer shall then settle the wagers remaining on the table by performing the procedure in subsection (h) below. All cards collected during the procedure shall be placed in the discard rack or automatic shuf-fling machine.

(h) Starting with the player farthest to the dealer’s right and continuing counterclockwise around the table the dealer shall:

(1) Reveal the cards of each remaining player, one play-er at a time;

(2) Determine the highest ranking hand of each re-maining player;

(3) Collect all losing wagers;(4) Pay each winning wager in accordance with the

payout odds listed below; and,(5) Collect all player cards and place them in the dis-

card rack or automatic shuffling machine.(i) All cards collected by the dealer shall be picked

up in order and placed in the discard rack or automatic shuffling machine in such a way that they can be readily arranged to reconstruct each hand in the event of a ques-tion or dispute.

(j) There are three winning payout types, as follows:(1) A player in competition against the dealer shall be

paid at odds of one to one on both the ante wager and the raise wager if the player’s hand is ranked higher than the dealer’s hand, except that to win both wagers the dealer’s hand must contain at least a three card flush containing a 9 or higher ranking card and the player’s hand must be ranked higher than the dealer’s hand. If the dealer does not hold a hand with at least a three card flush contain-ing a 9 or higher ranking card, the player’s ante wager
