Terms and Conditions – Discover the Great Outdoors Promotion

KEY TERMS

These terms and conditions provide information regarding the Discover the Great Outdoors Promotion. By participating, entrants agree to be bound by these terms and conditions. Entries must comply with these terms and conditions to be valid.

Promotion Website

Eligible Entrants Entry is open to residents of Australia aged 18 years of age and over subject to the Prize Limitations outlined below, including the limitation that car hire is only available where at least one person travelling is aged 21 years or over and has an eligible driver’s licence (full licence held for a minimum of one (1) year). Employees of the Promoter (and their immediate families), its associated companies, and any other agencies associated with this Promotion are ineligible to enter the Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, brother, sister, step-brother or step-sister.

Promotional Period

The period between 00.01 AEST on 11/09/2019 and 23.59 AEDT on 22/10/2019 or while stocks of Participating Products last. Participating Products must be purchased within the Promotional Period.

How to enter To enter the Promotion, Eligible Entrants must undertake the following steps during the Promotional Period:

1. purchase any three (3) Participating Products in a single transaction from any Woolworths Supermarket, participating Woolworths Metro store or Woolworths Online (www.woolworths.com.au);

2. either:

a. (“Rewards Card Entry”) prior to finalising the transaction, scan their Woolworths Rewards Card in store at the checkout or input their Woolworths Rewards Card number during checkout on Woolworths Online - the Rewards Card Entry option is not available to residents of Tasmania or Non-Registered Cardholders;

b. (“Frequent Shopper Club Card Entry”) prior to finalising the transaction, scan their Woolworths Frequent Shopper Club Card in store at the checkout or input their Woolworths Frequent Shopper Club Card number during checkout on Woolworths Online - the Frequent Shopper Club Card Entry option is only available to residents of Tasmania who are Registered Cardholders; or

c. (“Receipt Code Entry”) enter online, during the Promotional

Period, by visiting the Promotion Website woolworths.com.au/discoverygardenwin, following the prompts to the promotion entry page and inputting all of the requested details (including their full name, address, email address and mobile number, the Unique Receipt Code and submitting the fully completed online entry form (so that it is received during the Promotional Period),

(each, a “Qualifying Entry”).

Each Qualifying Entry:

● via the Rewards Card Entry option or the Frequent Shopper Club Card Entry option will automatically receive two (2) entries into the draw; and

● via the Receipt Code Entry option will automatically receive one (1) entry into the draw.

3. Limit applies of one Qualifying Entry per eligible transaction.

4. The Participating Products are set out in Annexure A.

5. All Eligible Entrants must retain their original purchase receipt or online invoice, as applicable, for all entries as proof of purchase.

Failure to produce proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entries and forfeiture of any right to a Prize.

In accordance with Woolworths Online Terms & Conditions (accessible at https://www.woolworths.com.au/Shop/Discover/about-us/terms-and-conditions, all online transactions must be for a minimum spend of $30 (excluding delivery fees). Minimum spend requirement for online transactions excludes any tobacco, flowers, liquor and Delivery Saver products purchased. Amounts spent online on Participating Products will count towards the minimum online spend of $30. Purchases at other Woolworths Group outlets (including but not limited to BIG W, BWS or Dan Murphy’s outlets, whether attached to or separate from a Woolworths supermarket), Caltex Woolworths co-branded Metro stores and Caltex/Woolworths co-branded fuel outlets are not eligible for the promotion.

“Registered Cardholder” means:

● in relation to the Woolworths Rewards Program - a cardholder of a Rewards Card, where all mandatory cardholder information (including cardholder’s legal name) has been correctly completed in the Woolworths Rewards Program database - cardholder is not a Registered Cardholder until confirmation has been issued by the Woolworths Rewards Program; and

● in relation to the Woolworths Frequent Shopper Club Program (for residents of Tasmania only) - a cardholder of a Frequent Shopper Club Card, where all mandatory cardholder information (including cardholder’s legal name) has been correctly completed in the Woolworths Frequent Shopper Club Program database - cardholder is not a Registered Cardholder until confirmation has been issued by the Woolworths Frequent Shopper Club Program.

“Rewards Card” means a Woolworths Rewards card issued by the Promoter as part of the Woolworths Rewards Program whether in a plastic or electronic (virtual). Only Registered Cardholders are eligible to enter the Promotion via the Rewards Card Entry option. For the avoidance of doubt, Non-Registered Cardholders (including holders of temporary Rewards Cards) are not eligible to enter via the Rewards Card Entry option.

“Frequent Shopper Club Card” means a Woolworths Frequent Shopper Club card issued by the Promoter as part of the Woolworths Frequent Shopper Club Program. Only Registered Cardholders are eligible to enter the Promotion via the Frequent Shopper Club Card Entry option. For the avoidance of doubt, Non-Registered Cardholders (including holders of temporary Frequent Shopper Club cards) are not eligible to enter via the Frequent Shopper Club Card Entry option.

“Unique Receipt Code” means Woolworths’ unique code number provided for the transaction (displayed on the Woolworths receipt, for in-store transactions or online invoice/order number (displayed on the online invoice/order confirmation, for Woolworths Online transactions). “Woolworths Frequent Shopper Club Program” means the Woolworths Frequent Shopper Club loyalty program operated by the Woolworths Group (for residents of Tasmania only). Further details of the Woolworths Frequent Shopper Club Program (including terms and conditions of the program) are accessible at frequentshopperclub.com.au. “Woolworths Rewards Program” means the Woolworths Rewards loyalty program operated by the Woolworths Group. Further details of the Woolworths Rewards Program (including terms and conditions of the program) are accessible at woolworthsrewards.com.au.

Draw There will be one (1) draw conducted for each day of the Promotional Period for a total of 42 draws (“Daily Prize Draws”). Entries into each Daily Prize Draw will open and close each day (based on AEST/AEDT as applicable in NSW) and the draw for each Daily Prize Draw will be conducted on the Draw Date specified in the table below. All Daily Prize Draws will take place at 11:00am AEST/AEDT (as applicable) at Unit 6, 3 Central Avenue, Thornleigh, NSW 2120. For the avoidance of doubt Daily Prize Draws will take place on a weekly basis and there will be no draws conducted during the weekend or on a public holiday in NSW. Entries in each Daily Prize Draw will NOT be entered into any subsequent Daily Prize Draws.

For clarity, there will be a separate draw conducted for each Daily Prize Draw however all draws will be conducted on a weekly basis as per the table above.

Prizes There are 42 Prizes in total to be won. The first valid entry drawn in each Daily Prize Draw will win their choice of one (1) of the packages below. Activities specified for each destination below are indicative only and may be substituted in the Promoter’s sole discretion depending on various factors including, without limitation, the chosen destination, the age of winners and guests, dates of travel and availability. Option 1 - Darwin, NT: Prize is a trip for four (4) people to Darwin, NT valued at up to $9,840 depending on date and point of departure. Prize includes:

● Return economy airfares between the winner’s closest Australian state capital city and Darwin for the winner and three guests.

● Four (4) nights accommodation in a minimum four (4) star property or equivalent (twin/double share) in Darwin;

● One (1) Visa Gift Card pre-loaded with $600; and ● Half day Outback Floatplane tour for four (4) people. Aircraft weight

restrictions of 120 kg per passenger applies. Children under 4 years of age require prior approval and must be over 10kgs. Not suitable for women over 26 weeks pregnant. Women in any stage of pregnancy should seek their doctors approval prior to travel.

Option 2 - Uluru, NT: Prize is a trip for four (4) people to Uluru, NT valued at up to $9,840 depending on date and point of departure. Prize includes:

● Return economy airfares between the winner’s closest Australian state capital city and Ayers Rock Airport for the winner and three guests;

● Four (4) nights accommodation in a minimum four (4) star property or equivalent (twin/double share) in Uluru;

● One (1) Visa Gift Card pre-loaded with $600; and ● Private picnic at Uluru for four (4) people.

Option 3 - Rottnest Island, WA: Prize is a trip for four (4) people to Rottnest Island, WA valued at up to $9,840 depending on date and point of departure. Prize includes:

● Return economy airfares between the winner’s closest Australian state capital city and Perth for the winner and three guests;

● Return transfers from Perth airport to ferry terminal for four (4) people; ● Return ferry transfers to Rottnest Island for (4) people; ● Three (3) nights glamping accommodation (twin/double share) or

similar at Rottnest Island; ● One (1) night accommodation in a minimum four (4) star property or

equivalent (twin/double share) in Perth; ● One (1) Visa Gift Card pre-loaded with $600; and ● Bike riding or snorkelling activity for four (4) people.

Option 4 - Launceston, TAS: Prize is a trip for four (4) people to Launceston, TAS valued at up to $9,840 depending on date and point of departure. Prize includes:

● Return economy airfares between the winner’s closest Australian state capital city and Launceston for the winner and three guests;

● Five (5) days standard car hire with unlimited kilometres (petrol not included) from Launceston. Car hire is only available where at least one person travelling is aged 21 years or over and has an eligible driver’s licence (full licence held for a minimum of one (1) year);

● Three (3) nights accommodation in a minimum four (4) star property or equivalent (twin/double share) in the Tarkine Region;

● One (1) night accommodation in a minimum four (4) star property or equivalent (twin/double share) in Launceston;

● One (1) Visa Gift Card pre-loaded with $600; and ● 4WD tour for four (4) people. 4WD Tour operates from September to

mid-July only, except Christmas Day, and is subject to minimum numbers and guide availability. Minimum passenger age of 6 years applies.

Option 5 - Cairns, QLD: Prize is a trip for four (4) people to Cairns, QLD valued at up to $9,840 depending on date and point of departure. Prize includes:

● Return economy airfares between the winner’s closest Australian state capital city and Cairns for the winner and three guests;

● Return transfers between airport and accommodation in Cairns; ● Four (4) nights accommodation in a minimum four (4) star property or

equivalent (twin/double share) in Cairns; ● One (1) Visa Gift Card pre-loaded with $600; and ● Half day private tour of the Daintree River and Cassowary Falls for

four (4) people. Minimum age of 4 years applies. Option 6 - Barossa Valley, SA: Prize is a trip for four (4) people to Barossa Valley, SA valued at up to $9,840 depending on date and point of departure. Prize includes:

● Return economy airfares between the winner’s closest Australian state

capital city and Adelaide for the winner and three guests; ● Five (5) days standard car hire with unlimited kilometres (petrol not

included) from Adelaide. Car hire is only available where at least one person travelling is aged 21 years or over and has an eligible driver’s licence (full licence held for a minimum of one (1) year);

● Four (4) nights accommodation in a minimum four (4) star property or equivalent (twin/double share) in the Barossa Valley;

● One (1) Visa Gift Card pre-loaded with $600; and ● Vineyard picnic for four (4) people. Minimum age of 18 years applies

for this activity. Option 7 - Jervis Bay, NSW: Prize is a trip for four (4) people to Jervis Bay, NSW valued at up to $9,840 depending on date and point of departure. Prize includes:

● Return economy airfares between the winner’s closest Australian state capital city and Sydney for the winner and three guests;

● Five (5) days standard car hire with unlimited kilometres (petrol not included) from Sydney. Car hire is only available where at least one person travelling is aged 21 years or over and has an eligible driver’s license (full license held for a minimum of one (1) year);

● Four (4) nights accommodation in a minimum four (4) star property or equivalent (twin/double share) in Jervis Bay;

● One (1) Visa Gift Card pre-loaded with $600; and ● Sea kayaking and a dolphin cruise for four (4) people.

Option 8 - Broome, WA: Prize is a trip for four (4) people to Broome, WA valued at up to $9,840 depending on date and point of departure. Prize includes:

● Return economy airfares between the winner’s closest Australian state capital city and Broome for the winner and three guests;

● Four (4) nights accommodation in a minimum four (4) star property or equivalent (twin/double share) in Broome;

● One (1) Visa Gift Card pre-loaded with $600; and ● 1 hour camel tour for four (4) people. Camel tours operate Monday to

Saturday only. A weight limit of 90kg per passenger applies for this tour.

Option 9 - Noosa, QLD: Prize is a trip for four (4) people to Noosa, QLD valued at up to $9,840 depending on date and point of departure. Prize includes:

● Return economy airfares between the winner’s closest Australian state capital city and Noosa for the winner and three guests;

● Four (4) nights accommodation in a minimum four (4) star property or equivalent (twin/double share) in Noosa;

● One (1) Visa Gift Card pre-loaded with $600; and ● 4WD tour for four (4) people. Minimum age of 7 years applies.

Option 10 - Phillip Island, VIC: Prize is a trip for four (4) people to Phillip Island, VIC valued at up to $9,840 depending on date and point of departure. Prize includes:

● Return economy airfares between the winner’s closest Australian state capital city and Melbourne for the winner and three guests;

● Five (5) days standard car hire with unlimited kilometres (petrol not included) from Melbourne. Car hire is only available where at least one person travelling is aged 21 years or over and has an eligible driver’s licence (full licence held for a minimum of one (1) year);

● Four (4) nights accommodation in a minimum four (4) star property or equivalent (twin/double share) in Phillip Island;

● One (1) Visa Gift Card pre-loaded with $600; and ● VIP Penguin tour for four (4) people.

Each element of the Prize listed above is subject to availability and is further subject to any Prize Limitations listed under these terms and conditions. Winners may elect to forfeit the flight component of their prize for any reason of their choosing, including if they live close to the departure point or destination. However, no cash alternative or compensation will be offered to winners who elect to forfeit the flight component. Each prize is valued up to AUD$9,840.00 inclusive of GST (if any) depending on date and point of departure as at 07/06/2019. The Promoter takes no responsibility for any variations in the value of a prize. Limit applies of one prize per person.

Limits on entry Multiple entries are permitted, subject to the following: (a) for Receipt Code Entries, only one (1) entry permitted per Qualifying Entry; (b) for Rewards Card Entries and/or Frequent Shopper Club Card Entries, only two (2) entries permitted per Qualifying Entry; (c) each Qualifying Entry must be submitted separately and in accordance with entry requirements; and (d) a limit of five (5) Qualifying Entries per day applies (which equates to 10 entries per day into the relevant Daily Prize Draw for Rewards Card Entries and Frequent Shopper Club Card Entries, and 5 entries per day into the relevant Daily Prize Draw for Receipt Code Entries).

Notification and publication of winners

Winners will be notified in writing by email within two (2) business days of the applicable draw date. Winners will be published online on the Promotion Website woolworths.com.au/discoverygardenwin, for a minimum 28 days, from the applicable ‘draw date’ specified in the table in the ‘Daily Prize Draws’ section above. Winners may also have their surname, first initial and state of residence published via in store marketing channels. In addition, winners of a prize will have their surname, first initial and state of residence published in The Australian on the applicable ‘published’ date specified in the table in the ‘Daily Prize Draws’ section above.

Claiming the Prize

● Winners must claim their prize by 20/01/2020. ● Winners must finalise their prize booking by 17/02/2020. ● Winners, including any second chance draw winner, must book at

least 60 days prior to intended travel departure date.

Prize Limitations ● All travel must be completed by 22/10/2020. ● All travel is subject to availability at all times and maybe dependent on

select seat class with airlines or specific room category availability with accommodation partner. Winners and their guests are subject to the individual limitations as stated by destination activity prize providers, including weight and age restrictions.

● Activities in each destination will be determined at the Promoter's sole discretion depending on various factors including, without limitation, destination selected, age of guests, availability and dates of travel.

● The winner may select guests of any age however, all guests under 18 years of age must travel with their parent or legal guardian. Guests under the age of 18 may not be permitted to participate in all activities.

● Winner will be required to sign a prize booking form including liability and publicity waiver within one month of claiming their prize.

● Guests will also be required to sign a prize acceptance form including liability and publicity waiver before the prize booking can be made.

● Prize is a single event holiday and cannot be separated into different holiday vacations or components.

● Availability cannot be guaranteed during Christmas, school holidays and special event periods.

● All winners and guests must travel together on the same flights, stay at the same property and depart from and return to the same departure point.

● No compensation or alternative travel plans will be arranged should the winner and/ or their guest miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the winner and guests.

● A credit card imprint may be required from the winner at check-in to the accommodation for all incidental charges.

● Once booking is confirmed no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion and if permitted will incur a service fee plus applicable supplier charges which are payable by the winner. The Promoter, Creata Holdings Pty Ltd and their nominated travel prizing agency accept no responsibility or liability for any component that is outside of the original stipulated scope of the prize. Winners are responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed.

● Travel suppliers/airlines to be chosen at the discretion of Creata Holdings Pty Ltd or their nominated travel prizing agency.

● Travel itinerary will be determined by the Promoter in its absolute discretion.

● The winners agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation other than Creata Holdings Pty Ltd, their nominated travel prizing agency, or the Promoter.

● All bookings and documentation regarding the prize must be made via Creata Holdings Pty Ltd or their nominated travel prizing agency.

● It is the winner's responsibility to organise transport to/from the airport departure/return point.

● The Promoter recommends that winners and guests have valid travel insurance for their period of travel, however any travel insurance will

be at the winner’s (and guests) own expense and is not included. If the winner chooses not to purchase travel insurance they will be required to complete a travel insurance waiver form acknowledging that they understand the benefits of travel insurance but declined to take out a policy.

● Frequent flyer points will not form part of the prize. ● All taxes (excluding GST) which may be payable as a consequence of

receiving a prize are the sole responsibility of the winner. ● A prize will only be awarded following any winner validation and

verification that the Promoter, Creata Holdings Pty Ltd or their nominated travel prizing agency require in their sole discretion.

● For prizes that include car hire: ○ Car hire is only available where at least one person travelling

is aged 21 years or over and has an eligible driver’s licence (full licence held for a minimum of one (1) year).

○ Winner must meet all the rental conditions for car hire as prescribed by the car rental company, for example (including but not limited to) minimum driver age must be 21 years or older and maximum driver age is 85 years of age and the nominated driver must have held a full licence for at least 1 year.

○ If the winner does not meet the criteria (e.g. suspended licence) they must nominate a guest who meets the car rental company’s requirements and they must be the nominated driver on the rental agreement.

○ The Promoter will not be liable for any expenses incurred by the hirer through mistreatment, illegal behaviour, or a violation of the vehicle hire's terms and conditions of use. All insurance, petrol, fines, tolls and damage costs, and any other related expenses, will be the responsibility of the winner.

○ The hire vehicle must be returned to the original pickup location.

● iChoose Visa Gift card: ○ The iChoose Visa Gift Card is subject to its prevailing terms

and conditions of use (available at ichoosegift.mycardplace.com) and is not replaceable or refundable if lost, stolen or damaged.

○ iChoose Visa Gift Cards are valid at most retail stores where Visa is accepted.

○ iChoose Visa Gift Cards are not exchangeable for cash. ○ iChoose Visa Gift Cards are issued by Heritage Bank Limited

○ Distribution to Australian addresses only. ○ Card holder full name, mobile phone number and address is

required for card issuance.

Unclaimed prizes

If any Prize remains unclaimed in accordance with these Terms and Conditions or is otherwise forfeited despite the Promoter making all reasonable efforts to notify a winner, or because a winning entry does not comply with these Terms and Conditions (including if a winner does not provide sufficient verification to the Promoter’s reasonable satisfaction), the Promoter may deem any winner as ineligible to receive the respective prize.

Second Chance Draw

If any Prize remains unclaimed in accordance with these Terms and Conditions, the Second Chance Draw will take place at Unit 6, 3 Central Avenue,Thornleigh, NSW 2120 on 24/01/2020 at 11:00 AEDT in the presence

of an independent scrutineer and subject to any directions from a regulatory authority. Second Chance Draw winners, if any, will be notified in writing within two (2) business days of the draw and their names will be published on the Promotion Website from 29/01/2020. The name and locality of winner(s) in the Second Chance Draw will be published in The Australian on 14/02/2020. Second Chance Draw winners (if any) must claim their prize by 17/04/2020 and must finalise the prize booking by 15/05/2020.

In the event that a Second Chance Draw winner does not accept a Prize in accordance with these Terms and Conditions, or a Prize is otherwise unclaimed following the Second Chance Draw for any reason whatsoever, the Promoter may dispose of unclaimed Prize(s) in its discretion (subject to any written directions from a regulatory authority).

FURTHER DETAILS

1. Unless specifically stated otherwise in the ‘Key Terms’, all ancillary costs including but not limited to insurance, taxes (excluding GST), meals, drinks, transport (unless specified), additional transfers, additional spending money, in-room charges, items of a personal nature and any and all other expenses incurred as a consequence of receiving the prize are the sole responsibility of the winner.

2. Prizes are not transferable and are not redeemable for cash. The Promoter’s decision is final and binding - no correspondence will be entered into. In particular, prizes may not, without the prior consent of the Promoter and any applicable third-party supplier of the prize (“Supplier”), be resold or offered for resale (including via online auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a prize is sold or used in breach of this condition, the Promoter or the Supplier may, at their absolute discretion, withdraw the prize(s). Where a prize has been withdrawn in accordance with this clause, no refund, substitute or compensation will be offered and if the prize is a ticket, the winner and any person has purchased or otherwise bears that ticket will be refused entry.

3. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches, theft or destruction, any cause beyond the Promoter’s control, acts or omissions of third parties, unauthorised access to or alteration of the promotion, or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion. Further, the Promoter at its sole discretion may recommence this promotion under the same conditions.

4. If any prize (or any portion of a prize) becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize (or portion of a prize) of equal or greater value, subject to any written directions from the various authorities. Winners will not be entitled to any additional compensation in the event that the prize or portion of a prize has been substituted at equal or greater value.

5. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

6. All reasonable attempts will be made to contact the winners. If a winner does not claim their

prize by the stipulated date above, their entry will be deemed invalid and the Promoter may conduct the Second Chance Draw, subject to relevant regulatory authority instructions.

7. If an Eligible Entrant’s contact details change at any time between the date which they enter the promotion and the Second Chance Draw date, then that Eligible Entrant must notify the Promoter of their correct contact details immediately.

8. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.

9. The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information from Eligible Entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final.
