AFFIDAVIT FOR ARREST

BEFORE ME, Jennifer J. Johnson a Judge of the above captioned court, personally appeared Inspector Harry K. Hutson II, who being first duly sworn, deposes and says:

Your affiant is Senior Inspector H. K. Hutson of the Office of the Inspector General, Florida Department of Corrections.

Your affiant has probable cause to believe that from September through November of 2018, at Cross City Correctional Institution East Unit, the defendant, Donna Christine Miranda-Dittmar, did commit the criminal offenses of Introduction of Contraband into a State Correctional Facility-a 3rd degree, felony violation of Florida State 944.47(1 )(a)(6), and Unlawful Written or Recorded

3rd Communication to Inmate, a degree, felony violation of Florida Statute 944.47(1 )(a)(1 ).

Investigation reveals that Donna Miranda-Dittmar-a correctional officer employed at Cross City Cl-was involved in a romantic relationship with Inmate Jesse Harrell, during the time that Inmate Harrell was incarcerated at Cross City East Unit.

On 12-11-2018, Inmate Harrell was placed in confinement after being accused by Officer Miranda-Dittmar of harassment. On 12-12-2018, in the confinement dorm at Cross City Main Unit, Sergeant Lyle Hartsfield conducted a search of Inmate Harrell's person and recovered a cellular telephone. Inmate Harrell provided the security password for the telephone and, when it was accessed, numerous photographs of Officer Miranda-Dittmar-some fully nude-were found on the phone.

File folders discovered on the cell phone were found to contain numerous photographs of Officer Miranda-Dittmar, including two (2) which showed her in FDC uniform. Four (4) of the photographs were of unidentified children, and five (5) were of Officer Miranda-Dittmar accompanied by children. Another file folder contained photos of a white female subject shown in various poses, and stages of undress-to include full nudity. Due to the numerous tattoos on the subject

shown in the photographs, Officer Miranda-Dittmar was positively identified in nine (9) of these photographs. The other eight (8) photographs were posterior views of a white female's genitalia either barely covered by a thong-type undergarment, or with the genitalia completely exposed. Inmate Harrell provided sworn testimony that the cell phone found in his possession had been brought onto the Cross City East Unit compound by Officer Miranda-Dittmar, and that Officer Miranda-Dittmar had placed the photographs on the phone.

JPay records revealed that a JPay customer using the name of "Destiny Harrell", customer ID #21971695, attempted to send three (3) photographs to Inmate Jesse Harrell, but the photos were rejected by JPay. Two of the three photographs appear to be from the same group of photos which contained nude photos of Officer Miranda-Dittmar on Inmate Harrell's phone. The third photo was similar to the others (as evidenced by the photo effects) and all the photos showed the buttocks and groin area of a white female with the genitalia covered by a thon~ arment. JPay records show "Destiny Harrell's" phone number as - with additional contact information as:

JPay records confirmed that "Destiny Harrell" and Inmate Harrell corresponded on approximately thirty-three (33) occasions between September and November of 2018.

Inspector Carrie Barcia also followed a link found on the contraband cell phone extraction report, on page 43, line 124. The link ~ ifey", which is the saved contact name for another phone number; - The link led to a Nextplus photo viewer and was a photograph of a white male child, approximately 1-year of age. This link had been sent to the contraband November 24, 2018 at 13:04 hours. Contact was then made with

Inspector Barcia showed - the photograph of the child recovered from the inmate's contraband phone. identified the child in the photograph as his son, which is the child he has in common with Officer Miranda-Dittmar. -- was also able to identify the infant car seat in the photograph as belonging to Officer Miranda-Dittmar. The extracti~ lnmate Harrell's phone reflects that this same phone number---was in direct communication with Inmate Harrell via Harrell's contraband phone on at least thirteen (13) occasions. According to the contacts shown in Inmate Harrell's contraband phone, "Wifey's" email is "[email protected]. SECURUS records later revealed that a SECURUS user named "D MHARRELL

·, FL," with the phone number of had received two phone calls from a Levy County Jail inmate-Ricky Alston, on 2019. During these calls, ~ wished "D MHARRELL" happy birthday. It was then learned that - is shown in the FDC Roster Management System d~ e Officer Miranda-Dittmar's official contact phone number; and that - •· is Officer Miranda-Dittmar's birthday according to FDC records.

Inspector Barcia also reviewed the portion of the contraband cell phone extraction report labeled "SD CARD-130." The report indicated that the secure data (SD) card from the contraband cellphone held 3,204 photographs, mostly dated from the year 2015. Most the photographs were of a young female in her twenties (approximate). Other pictures located on the phone featured the young woman and two young children.

Investigation later identified the adult female, shown in the majority of these photos s Ni e Dominque Hillesland, who had, at one time, resided at the

address as Officer Miranda:

Miss Hillesland provided sworn testimony that she had taken the photograi:,hs on the secure data card, sometime in 2015 or 2016, when she resided at the -Ill address with Officer Miranda-Dittmar's brother (Hillesland's husband at the time) and mother. Ms. Hillesland further explained that the cell phone she used to take the photos, used the android operating system. In approximately 2016, Hillesland purchased an iPhone with which her android SD card was not compatible. Since there were numerous photographs on the SD card in her old phone, before disposing of it, Ms. Hillesland removed the SD card and stored it in a jewelry box for safe keeping. Sometime after that, Ms. Hillesland separated from her husband and left the residence at t; leaving the jewelry box-containing the SD card-behind. This residence was shared with Hillesland's ex-husband, Officer Miranda and Officer Miranda's mother, Evelyn. Ms. Hillesland has not seen the SD card since, and never knew what had become of it. Ms. Hillesland stated that she is positive that the pictures on the SD card from the contraband phone were taken by her, and that they ~ SD card she left in the jewelry box when she left the residence in - · A review of departmental records revealed no indication that Miss Hillesland has, or has had, any contact or connection with inmates at Cross City Cl, or any other FDC facility.

Your affiant submits that probable cause has been established showing that Donna Miranda-Dittmar introduced contraband into a state correctional facility when she provided Inmate Harrell with an SD card for the cell phone found in possession of Inmate Jesse Harrell; in violation of Florida Statute 944.47(1 )(a)(6).

Your affiant submits that probable cause has been established showing that Donna Miranda-Dittmar introduced contraband in the form of written or recorded communications, with an inmate, outside of regular, approved channels, when she used text messaging to send a photograph of her minor child, sent other communicating text messages to Inmate Harrell's contraband cell phone, and used a false name and JPay account to communicate with Inmate Harrell on numerous occasions, while Harrell was incarcerated at Cross City East Unit; in violation of Florida Statute 944.47(1 )(a)(1 ).

Your affiant respectfully requests that a warrant be issued for Officer Donna Miranda-Dittmar, for one count of each of the aforementioned, felony charges.

uring these calls, Inmate Alston wished "D MHARRELL" happy birthday. It was then learned that is shown in the FDC R- ster Mana ement System database, to be Officer Miranda-Dittmar's official contact phone number; and that is Officer Miranda-Dittmar's birthday according to FDC records.

Inspector Barcia also reviewed the portion of the contraband cell phone extraction report labeled "SD CARD-130." The report indicated that the secure data (SD) card from the contraband cellphone held 3,204 photographs, mostly dated from the year 2015. Most the photographs were of a young female in her twenties (approximate). Other pictures located on the phone featured the young woman and two young children.

Investigation later identified the adult female, shown ~ority of these photos, as Ni~ Hillesland who had at e ti resided at the same ..... address as Officer Miranda: _....

Miss Hillesland provided sworn testimony that she had taken the photographs on the secure data card, sometime in 2015 or 2016, when she resided at the - address with Officer Miranda-Dittmar's brother (Hillesland's husband at the time) and mother. Ms. Hillesland further explained that the cell phone she used to take the photos, used the android operating system. In approximately 2016, Hillesland purchased an iPhone with which her android SD card was not compatible. Since there were numerous photographs on the SD card in her old phone, before disposing of it, Ms. Hillesland removed the SD card and stored it in a jewel~ ~9- Sometime after that, Ms. Hillesland separated from her husband and left the residence at __... - leaving the jewelry box-containing the SD card-behind. This residence was shared with Hillesland's ex­husband, Officer Miranda and Officer Miranda's mother, Evelyn. Ms. Hillesland has not seen the SD card since, and never knew what had become of it. Ms. Hillesland stated that she is positive that the pictures on the SD card from the contraband phone wer- taken b her, and that they were on the SD card she left in the jewelry box when she left the residence in A review of departmental records revealed no indication that Miss Hillesland has, or has had, any contac or connection with inmates at Cross City Cl, or any other FDC facility.

Your affiant submits that probable cause has been established showing that Donna Miranda-Dittmar introduced contraband into a state correctional facility when she provided Inmate Harrell with an SD card for the cell phone found in possession of Inmate Jesse Harrell; in violation of Florida Statute 944.47(1 )(a)(6).

Your affiant submits that probable cause has been established showing that Donna Miranda-Dittmar introduced contraband in the form of written or recorded communications, with an inmate, outside of regular, approved channels, when she used text messaging to send a photograph of her minor child, sent other communicating text messages to Inmate Harrell's contraband cell phone, and used a false name and JPay account to communicate with Inmate Harrell on numerous occasions, while Harrell was incarcerated at Cross City East Unit; in violation of Florida Statute 944.47(1 )(a)(1 ).

Your affiant respectfully requests that a warrant be issued for Officer Donna Miranda-Dittmar, for one count of each of the aforementioned, felony charges.
