This action meets the original jurisdiction requirements of28 USC 1441(a7 and is removable by Defendants pursuant to 28 USC 1446(a). A case is removable8 from state to federal court ifthe action could have been originally commenced in federa9 court. 28 USC 1441(a); Grubbs v. General Electric Credit Corp., 405 US 699,702

    10 (1972). The propriety ofremoval is determined at the time the petition for removal is11 filed by reference to the plaintiffs complaint filed in state court. La Chemise Lacoste v12 Alligator Co., 506 F.2d 339, 343-344 (3d Cir. 1974). When the complaint states a claim13 invoking the original jurisdiction of the federal comi, the action is removable. [d. Und14 the Judicial Code, federal district courts have original jurisdiction over all actions15 brought under 42 USC 1983. See, 28 USC 1343(a)(3). Moreover, the Code confers16 original jurisdiction in the district courts over all actions involving federal questions.17 See, 28 USC 1331.18 3. The gravamen of this action are the federal civil rights claim set forth in the19 first, second, and fifth causes of action ofPlaintiffs Complaint. This claim confers20 original jurisdiction to this Court.21 4. State claims are also asserted in the third, fomih, and sixth causes of action o22 the Complaint. When an action originally filed in state court is removed to federal cour23 the federal tribunal has jurisdiction to determine not only the federal claims but all24 pendent state claims which derive "fi-om a common nucleus of operative fact." United25 Mine Workers v. Gibbs, 383 U.S. 715, 725, 86 S. Ct. 1130, 16 L. Ed. 2d 218 (1966).26 5.     Wolfwas forced to hire counsel to protect his rights and ultimately succeeded in having

    2 all of the criminal charges dismissed. Plaintiff Joseph Wolfnow brings forth this action3 to seek damage to compensate him for the unreasonable and unlawful actions of4 Defendants, and each ofthem.56 JURISDICTION7 2. Jurisdiction is confen'ed upon this court by Section 1983, ofTitle 42,8 United States Code. Concurrentjurisdiction was granted to this court under Williams vs.9 Horvath (1976) 16 Cal.3d 834, 837. Also, this Court has jurisdiction to award damages

    10 pursuant to Article VI Section 10 of the California Constitution.1112 PLAINTIFF13 3. PlaintiffJOSEPH WOLF, at all relevant times herein, was residing in the14 County ofLos Angeles, State ofCalifornia.1516 DEFENDANTS17 4.     I 10. At all times herein mentioned, the CITYOF LOS ANGELES, was a2 governmental entity organized and existing under the laws of the State ofCalifornia.3 II. Plaintiff is unaware of the true names and capacities of the Defendants4 named herein as DOES 1 through 25, inclusive, and therefore sue said Defendants by5 such fictitious names. Plaintiffwill seek leave ofcourt to amend this complaint to allege6 the true names and capacities of said Defendants when the same are ascertained, Plaintiff7 is informed and believes and thereon alleges that each of the aforesaid fictitiously named8 Defendants is responsible in somemanner for the happenings and occurrences hereinafter9 alleged, and the P1ilintiff's damages and i'1iuries as herein alleged were caused by the10 conduct of said Defendants.I I12 FACTS13 12. On or about December 12,2008, at approximately 9:30 a,m" JosephWolf,14 was awakened by the sound of a helicopter circulating above his home. He went outsideI5 to see what was happening and then went back inside to get a sweatshirt, because it was16 cold outside.17 13. When he came back outside, he was shot in the leg byOfficer Hernandez.18 In order to cover up the unreasonable use of force that is a bad shooting, allegations were19 fabricated that Plaintiffwas carrying a weapon and pointed it at Officer Hemandez.20 14. As a result of the false charges and accusations, Plaintiffwas arrested for21 assault with a deadiyweapon on a peace officer and remained in custody until December22 IS, 2008 when he was able to bail out of jail. Criminal charges for assault with a deadly23 weapon and exhibiting a fireaim in the presence of an officer were sought against hinl by

    FIRST CAUSE OF ACTION

    2 (Violation ofCivil Rights 42 U.S.C. 1983)3 (Plaintiff against all individual defendants and Does 1 through 10)4 16. Plaintiff incorporates by reference each and every allegation contained in5 the pr.eceding paragraphs as if fully set forth herein.6 17. At all times material to this Complaint, Defendants Hernandez, Grabiak,7 Orpin, Reade, Ulley, Randolf and DOES I through 10 were acting under color of the law8 in violating Plaintiff's constitutional rights as herein alleged under the Fourth to the9 Constitution of the United States. The Fourth Amendment is made applicable to the10 States pursuant to 42 U.S.C. 1983.11 18. Plaintiffwas deprived of rights, privileges, and immunities secured to him12 by the Constitution of the United States and laws enacted thereunder when Defendants13 used excessive force, arrested Plaintiffwithout probable cause and caused criminal14 charges to be brought against Plaintiffbased upon material omissions and/or false15 information being presented to the District Attorney.16 19. Defendants, and each of them, weremotivated by bad faith in that17 Defendants had a preference toward finding Plaintiffguilty and did not have an interest in18 the tmth ofthe charges,19 20, Plaintiff has a constitutional right to be free from an unreasonable seizure20 which was madewithout probable cause and also a seizure which was fraught with21 material omissions and false information to secure the seizure, and a bad faith22 prosecution, as alleged herein.23 21. Plaintiff has a constitutional right to be free from the use of excessive force

    I in the underlying criminal matter, all in an amount to be determined at the time of triaL2 24. Due to the conduct ofDefendants, and each of them, Plaintiffhas been3 required to incur attorneys' fees and will continue to incur attorneys' fees, all to Plaintiff's4 damage in a sum to be proved at trial and recoverable pursuant to 42 U.S.C. 1988.5 25. The individual defendants acted with a conscious disregard ofPlaintiff's6 rights conferred upon him by Section 1983, Title 42 of the United States Code, the Fourth7 Amendment to the United States Constitution and California Civil Code Section 3333, by8 virtue of intentionally shooting Plaintiffand then covering up a bad shooting and causing9 the arrest ofPlaintiff and the filing of criminal charges against him. Defendants, and

    10 each of them, had an interest in seeing Plaintiffcharges with criminal conduct to detractII from Defendants' bad conduct and unreasonable shooting. Such conduct constitutes12 malice, oppression and/or fraud under California Civil Code Section 3294, entitling13 Plaintiff to punitive damages against the individual Defendants in an amount suitable to14 punish and set an example of said Defendant.IS16 SECOND CAUSE OF ACTION17 (Violation ofCivil Rights-Monell by Plaintiff against the18 City ofLos Angeles and DOES 11 througb 20)19 26. Plaintiff incorporates by reference each and every allegation contained in20 the preceding paragraphs as if fully set forth herein.21 27. Defendants, City ofLos Angeles and Does II through 20, knowingly, with22 gross negligence, and in deliberate indifference to the Constitutional rights of citizens,23 maintain and pennit an official policy and custom ofpermitting the occurrence of the

These policies and customs include, but are28 not limited to, the deliberately indifferent training of its law enforcement officers in the

    use of excessive force, in making lawful arrests, These policies and customs also include

    2 the express and/or tacit encouragement of excessive force and arrests without probable3 cause, the ratification of policemisconduct and the failure to conduct adequate4 investigations of police misconduct such that future violations do nbt occur.5 29. Plaintiff is informed and believes, and thereon alleges, that the customs and6 policies were the moving force behind the violations ofPlaintiffs rights, Based upon the7 principles set forth in Monell v. New York CityDept, ofSocial Services, the City ofLos8 Angeles and Does II through 20 are liable for all of the injuries sustained by Plaintiff as9 set forth above.10 30. In acting as alleged herein, Defendants, and each of them, caused PlaintiffII severe physical and emotional injuries, and caused Plaintiffother damages, including12 incurring attorney fees in the underlying criminal case, all in an amount to be determined13 at the time oftrial.14 31. Due to the conduct ofDefendants, and each of them, Plaintiff has been15 required to incur attorneys' fees and will continue to incur attorneys' fees, all to Plaintiffs'16 damage in a sum to be proved at trial and recoverable pursuant to 42 U.S.C, 1988.1718192021 32,

    THIRD CAUSE OF ACTION(Negligence byPlaintiff as against Defendant Hernandez

    and the City ofLos Angeles)Plaintiff realleges and incorporates paragraphs 1 through 15 and hereby

At all times herein mentioned, Defendant Hernandez was acting within the~ scope and course ofhis employmentwith the City ofLos Angeles.~ 34. The City is liable for the acts, omissions and conduct of its employeesb26 pursuant to California Government Code 815.2.1.ti7 35. In conducting himself in the manner set forth herein above, and28 specifically by negligently shooting Plaintiff, Plaintiffhas sustained injuries and damages

    1 in an amount to be proved at the time of trial.2 36. Plaintiff filed timely claim pursuant to Cal. Government Code 910 et. seq.3 The claim having been rejected within the past six months, this action is timely.45 FIFTH CAUSE OF ACTION6 (Violation of Civil Code 52.1 by Plaintiff against all Defendants)7 37. Plaintiffrealleges and incorporates paragraphs 1 through 15,33,34,35 and8 36 and incorporates the same as though fully set forth hereinafter.9 38. The conduct ofDefendants constituted interference by threats,10 intimidation, or coercion, or attempted interference, with the exercise of enjoyment by11 Joseph Wolfof rights secured by the Constitution oflaws of the United States, or secured12 by the Constitution or laws of the State ofCalifomia, including interference with his right13 to be secure in his person and free from the use of excessive force under the Fourth14 Amendment and Cal. Const. Art. I sec. 13 as well as Cal. Civ.Code 43, and the right of15 protection from bodily restraint and hann and a bad faith prosecution.16 39. As a direct cause ofDefendants' conduct, Wolfs rights pursuant to17 California Civil Code 52.1 were violated, causing injuries and damages in an amount to18 be proved at the time of trial.19 40. Due to the conduct ofDefendants, and each of them, Plaiutiffhas been20 required to incur attorneys' fees and will continue to incur attorneys' fees, and pursuant21 to California Civil Code 52.1 are entitled to recovery of said fees.2223 SIXTH CAUSE OF ACfION~ (Battery by Plaintiff against Defendant Hernandez and the City of Los Angeles).;'
