2.TERMOFLEASE:
ThepremisesarerentedbytheLandlordtotheTenantforatermcommencingatnoonon andendingatnoonon unlessthetermisendedsoonerasprovidedelsewhereinthisagreement.
Theleaseisfor12monthsminus6daysformaintenance.Thereisnosetofmoniesforthedaysrequiredformaintenance.Iftenantortenantsdon’twanttheoffsettime,thantheywilltakeoccupancy,asisandrequiringnoadditionalcleaning,paintingormaintenance.Ifnosetofftimeistaken,alltenantsmustsignareleaseform.
3.RENT:
ThetotalrentthattheTenantsagreetopaytotheLandlordforthepremises,fortheterm,is$ Thistotalrentisdueuponexecutionofthislease.However,fortheconvenienceoftheTenants,thisrentshallbepaidbytheTenantstotheLandlordininstallmentsasoutlinedinAddendumA–PaymentSchedule.RentisalwaysdueontheKirstofthemonthregardlessofleasecommencementdate.AcceptanceofpartialpaymentsfromsomeTenantsdoesnotrelievesuchTenantsfromtheirliabilityfortheentirerentsorastosharesownedbyotherjointandseveralTenants.Onexecutionofthislease,TenantsagreetopaytotheLandlordtheIirstandlastmonths’rentinstallmentsunlessotherwiseagreedinwriting;saidpaymentstobeconsideredareservationfeedueonexecutionuntiloccupancywhensaidpaymentswillbeconsideredrentdueandpaid.
Alatechargeof5%oftheoverduerentwillbeassessedonthesecondcalendardayofthemonthifanyrentinstallmentisnotreceivedbytheLandlordonorbeforetheIirstcalendardayofthemonth.Anadditional5%oftheoutstandingbalancewillbeassessediftherentremainsunpaidaftertheIifteenth(15th)calendardayofthemonth.Saidlatechargesshallbecomedueandpayableimmediatelyuponnotice,andifnotsopaid,maybedeductedbytheLandlordfromthesecuritydepositasaddedrent.

Achargeof$50.00willbemadebytheLandlordforeachcheckoftheTenantsreturnedforanyreason.IfTenantsmakepaymentofanyrentinstallmentinanamountlessthanthatdue,Landlordmayacceptsame,butshallnotbeboundbyanyrestrictiveendorsement,oranystatement,orotherwisetotheeffectthatsuchpaymentismadeinfullsatisfactionoftheamountsthendue.NotwithstandingsuchacceptancebytheLandlord,theLandlordmayavailhimselfofanyotherlegalremedieshemayhave.
IfTenantmakesanypaymentshereunder,andthenfailstooccupythepremisesorfailstocomplywithanyothertermorrequirementofthisagreement,Landlordmaykeepanysuchpaymentsaspartialliquidateddamages.Notwithstandingretentionofsuchpaymentsasliquidateddamages,theLandlordshallhave,inaddition,anyotherrightsaffordedLandlordunderthisleaseagainsttheTenantforbreachofthislease.
Inaddition,iftheIirstmonth’srentinstallment,and/orthelastmonth’srentinstallment,and/orthesecurityanddamagedepositarerequiredtobepaidatthetimeofexecutionofthisleaseandarenotpaidatsuchtime,orifsuchpaymentsaretobemadepursuanttoanagreeduponschedule(AddendumA),andsuchpaymentsarenotmadeatthetimesetforthinsuchschedule,thentheLandlordreservestherightatanytimeaftersuchtimebywhichsuchpaymentsshouldhavebeenmade,togiveTenant(s),oranyoftheTenant(s),Iivedayswrittennotice,bycertiIiedmail,returnreceipt,thatifthedeIicienciesintheseamountsarenotpaidinfullandreceivedbytheLandlordbytheendofsuchIivedaynoticeperiod,thentheLandlordmayrentthedemisedpremisestoothersandmayretainanyamountspaidtothatdateaspartialliquidateddamagesand,inaddition,mayseektoenforceanyotherrightstheLandlordmayhaveagainsttheTenant,andmay,inaddition,terminatethelease.
4.SECURITYANDDAMAGEDEPOSIT:

anypartthereofortoanyothercostsorpaymentsoutstandingduetoTenant’sviolation.UponnoticeofsuchusebytheLandlord,theTenantshallwithintwodaysrepaytotheLandlordsuchsumsusedbytheLandlordfromthisdeposit.Attheendoftheterm,theLandlordshallpaytotheTenantthedeposit(lessanysumsproperlyretainedaccordingtothisagreement)aftertheTenanthasreturnedallkeysandhasvacatedthepremisesandalsoaftertheLandlordhashadareasonableopportunity(atleastIivebusinessdaysafterTenanthasvacatedthepremises)toinspectthepremisesfordamageandprocessthedepositforreturn,whichusuallytakesapproximatelyonemonthaftertheendoftheleaseterm.IftheTenantshallfailtocomplywithalloftherequirementsforvacatingandsurrenderingthepremisesinoriginalcondition,lessnormalwearandtear,TenantagreesthatLandlordmaydeductfromthisdepositanamountforlabor,materials,andsupplies.See19.SURRENDER/TURNOVERCOSTS&PRACTICESofthisleasedocumentforfurtherelaboration.TenantspeciKicallyagreesnottoapplythisdeposittothepaymentofanyrentinstallment.
5.LIABILITYFORTAXES,UTILITIES,MAINTENANCE,Garbagedumpster.:
TheLandlordshallpayanyandallpropertytaxesonthepremises.TheTenantshallpayforalltelephoneandtelevisioncablefeesonthepremises.Thefollowingcostsshallbepaidbyandshallbetheresponsibilityofthepartyindicatedbelow:

InhousesorapartmentsinwhichTenantpaysutilitiesdirectly,theTenant(s)inwhosenametheutilitymeter(s)islisted,willprovidetheLandlordwithasignedCustomerRequestforServiceFormwhichwillbeIiledwiththeutilitycompany.ItisTenant(s)responsibilitytomaintaingasandelectricutilities,intheirname,forthefulltermofthelease.NYSEG1-800-572-1111.TheofIicewillprovidethenameofthepropanecompany.
WhereitistheTenants’responsibilityTenantagreestomaintainaminimumtemperatureofatleast62degreesFahrenheit,inallareasoftheresidence,atalltimes(includinglongbreakperiods)topreventdamagetothebuildinganditssystems.FailuretomaintainsuchtemperaturewillresultintheTenants’liabilityforanyandallresultingdamage.
WhereitistheTenants’responsibilityforsnowandiceremoval,allIinesand/orcoststoLandlordfornon-removalwillbepassedthroughtoTenant(s)bydirectinvoiceorsubtractedfromtheleasesecuritydeposit.InsuchcasesinwhichitistheLandlord’sresponsibilitytoremovesnowandicefromthesidewalksand/ordriveways,itisunderstoodandagreedthatLandlordwillmakeareasonableefforttodoso,butgiventhewinterconditionsinTompkinsCountytotalremovalmaynotalwaysbeaccomplished.Duringtheheatingseasonallwindowsaretobeclosedandlocked.Allairconditionersaretoberemovedfromwindows.
6.ADDRESSES:
AllnoticesandpaymentstobemadetotheLandlordshallbemadeattheaddresssetforthhereinabove;allnoticestobemadebytheLandlordtotheTenantshallbemadetotheTenantattheaddressofthepremisesrentedbythisagreement.WherethereismorethanonejointandseveralTenants,noticetoanyonesuchTenantshallbedeemedandacceptedasnoticetoallsuchjointandseveralTenants.

7.JOINTANDSEVERALLIABILITYFORPERFORMANCE:
IfthereismorethanoneTenanthereunder,eachofthetenantsjointlyandseverallyagreestopaytherentandanyotherchargesunderthisagreementandtofullyperformalltheobligationsoftheTenanthereunder.Thatis,eachindividualTenantisresponsibletopayandagreestopaythefullamountoftherentandanyotherchargesandtoperformalloftheobligationsoftheTenantunderthisagreement,eveniftheotherTenantsorsomeofthemfailtomakesuchpaymentsorfailtoperformsuchobligations.LandlordneednotnotifyallTenantsofthedefaultbyanyoneTenantasaprecedenttotakinganyactionpermitteduponTenant’sbreachordefault.
8. PERMITTEDUSEANDOCCUPANCY:TheTenantshalluseandoccupythepremisesonlyasaresidentialdwellingforthenamedTenant(s)only.Nootherpersonsshallbepermittedtoliveinthepremisesonapermanentortemporarybasis,exceptpursuanttoanassignmentofleaseorsubletassetforthinparagraph9.Visitsbyguestsareonlypermittedaslongassuchvisitors’presencedoesnotinterferewithanyotherroommates’orTenants’comfortandenjoymentofthepremisesandcomplieswithalllaws,rules,andregulationsofanyandallgovernmentalagencies,departments,andbodies.Notwithstandingsuchprovisions,theLandlordreservestheunqualiIiedrightinhissolediscretiontolimitorprohibitextendedvisits.Smokingisnotpermitted.
Achargewillbeassessedforextrarefrigeratorsbroughtinbythetenant.Thechargewillbe$25.00perappliancepermonth.(Whileinuse)
9.ASSIGNMENT&SUBLEASING:
TheTenantmaynottransferanyofitsrightsunderthisleasetoanyotherpersonorentitywithoutthepriorwrittenapprovalandpermissionoftheLandlord.SaidapprovalandpermissionoftheLandlordshallbeinthesoleandabsolutediscretionoftheLandlord.Saidapprovalandpermissionwillnotbeunreasonablywithheld.Tenant(s)agreestoprovideLandlordwithSUBLETINFORMATIONANDAGREEMENTFORM,suchdocumenttobe

approvedby,andIiledwith,theLandlord.AlldepositsmadebytheoriginalTenant(s)willremainondepositwiththeLandlorduntiltheendoftheleaseterm.
10.DELAYSINVACATING;DAMAGES:
TheTenantwillberesponsibleforandagreestopaytotheLandlordallcostsincurredbytheLandlordduetoanydelaysbytheTenant,oranyoftheTenants,invacatingthepremisesattheendofthetermofthelease,including,butnotlimitedtoattorney’sfeesandcourtcosts.Notwithstandingsuchprovision,theTenantagreesnottoremaininthepremisesaftertheendofthetermoftheleasewithoutthewrittenapprovaloftheLandlord.TheTenantagreesthatforeachdaythattheTenant,oranyoftheTenants,staysinthepremisesafterthetermoftheleasehasexpired,achargeoftwicetheprorateddailyrentundertheleasewillbemade,andtheTenantagreestopaysame.Inaddition,theTenantagreestopayanyandallchargesforhousingthenewTenant(s)forthepremises,duringsuchtimeastheTenants(oranyTenant)holdoverbeyondtheoriginalleaseterm.
Notwithstandinganythingtothecontrarycontainedinthissection,theLandlordmayacceptanyandallpaymentsfromtheTenantaftertheendoftheleaseterm,andnonewleasetermwilltherebybecreated.Nonewleasetermmaybecreated,exceptbywritteninstrumentsignedbytheTenantandtheLandlord.Anysuchpaymentsreceivedshallbeappliedtoanyandallchargespermittedunderthislease.
11.DAMAGETOPREMISES:
IfthepremisesarepartlydamagedbyIireorotherwise,repairsshallbemadebytheLandlordasspeedilyaspossibleandwithoutlapseorreductionofrentdueandpayable.However,ifthepremisesaredestroyedorsomuchdamagedbyIireoranyothercausewithoutanyfaultoftheTenantorhisvisitors,invitees,orlicensees,astorenderthepremisesunusableinthejointopinionoftheLandlordandtheTenant,thentheLandlord,atitsoption,mayeithera.)forgivepaymentoftheproportionatepartoftherentduefromthedateofsuchdamagetothedatethepremisesareonceagaintenantable,or,inthealternativeb.)mayelecttoterminatethisleasebygivingtheTenantIive(5)dayswrittennoticethereof,

inwhichcasetheleaseshallterminateonthesaidIifthdayandtheTenantshallsurrenderthepremisesonorbeforethatday,andanyfuturerentinstallmentstogetherwithanyunusedportionofthesecurityanddamagedepositshallberefundedtotheTenantproratedtothedateofsuchdestructionordamage.NoclaimforcompensationwillbemadebytheTenantagainsttheLandlordforanypartoftheimprovementinwhichthepremisesareapartatanytime.
12.COMPLIANCEWITHLAW:
TheTenantagreestocomplywithandtoabidebyalllaws,ordinances,regulations,etc.ofanyandallgovernmentalauthorities,whichmayaffectthepremises.AllIinesimposedonthepropertywillbepassedontotenants.
13.OPENFIRES/COMBUSTIBLEMATERIALSPROHIBITED:
TheTenantagreesnottostoreanyhighlycombustiblematerialsnorpermitanyopenIires.Nocandlesburningonthepremises.
14.PERSONALPROPERTYLIABILITY:
TheLandlordshallnotbeliablenorresponsibleforanylossordamagetothepersonalpropertyoftheTenant,hisvisitors,invitees,orlicenseesfromwhatevercause,excludingLandlordnegligence.TheTenant(s)isstronglyurgedtoobtainpersonalinsuranceprotection.
15.INDEMNIFICATION,HOLDHARMLESS,DEFEND:
TheTenantagreestodefend,indemnify,andsaveharmlesstheLandlordfromandagainstanyandallliability,damages,expenses,fees,penalties,actions,causesofaction,suits,costs,claimsandorjudgmentsarisingfrominjurytopersonsortoproperty,occasionedwhollyorinpartbyanyactoromissionoftheTenant,hisinvitees,visitors,employees,

payanyjudgment,settlement,oranyothercosts,theTenantshallimmediatelypaytotheLandlordthefullamountofsuchjudgment,settlement,etc.
16.ACCESSTOPREMISES:
TheLandlord,itsagent,anditsinviteesshallbepermittedtoenterthedemisedpremisesforinspection,repairs,givingofnotices,emergencies,andfutureleasingandsale,atreasonablehours,whetherornottheTenantispresent.TheLandlordshall,however,makeanefforttonotifytheTenantbeforeshowingthepremisestootherprospectiveTenants.
17.BREACHOFLEASEBYTENANT:
IftheTenantfailstomakeanypaymentofrentorpartthereofwithinIive(5)daysofthedateitwasdue,oriftheTenant,oranyoneoftheTenants,ifmorethanone,doesnotabidebyorcomplywithanyotherpartofthisagreement,andiftheTenantdoesnotcorrecttheviolationorcomplywithintwo(2)daysafternoticebytheLandlord,orifapetitioninbankruptcyisIiledbyoragainsttheTenantoranyoneoftheindividualtenantsifmorethanone,orifanyTenantmakesageneralassignmentforthebeneIitofcreditors,thentheLandlordmayatitsoptionendthisleaseonthree(3)dayswrittennoticetotheTenant,afterwhichthreedaysthisleaseagreementshallautomaticallyterminateandtheLandlordmayimmediatelyre-enterandrepossessthepremiseswithoutfurthernoticetotheTenant.TheTenantagreesinsuchcasetovacatethepremisesattheendofsaidthree-dayperiod.TheTenantherebyauthorizesanyandallevictionproceedingsbytheLandlordagainsthimwithoutnoticeifthepremisesarenotvacatedbytheendofsaidthree-dayperiod.Eventhoughtheleasehasthusbeenended,theTenantshallremainliabletotheLandlordforthetotalrentsetforthinthisagreement.However,theLandlordshallhavetherighttore-rentthepremisestoothertenantsforwhatevertermandrentwhichtotheLandlordseemreasonable.Ifthepremisesaresorerented,therentcollectedfortheunusedpartofthetermofthisleaseshallbeusedIirstforexpensesoftheLandlordinre-entering,repossessing,andre-rentingthepremises,andanysurplusordeIiciencyremainingtobesubtractedfromoraddedtotheamountsowedbytheTenanttotheLandlordunderthisagreement.

18.WHOLEAGREEMENT:
Thisagreementisthewhole,entire,andIinalagreementwithrespecttotheleaseofthesubjectpremisesandnothingsaidbytheLandlordortheTenanteitherbeforeorafterexecutionofthisleaseisorwillbebindingoneitherparty.AnyandallchangestothisleasemustbewrittenandsignedbyboththeLandlordandtheTenanttobevalidandbinding.
TheLandlordmay,fromtimetotime,issuememorandatoadviseTenantsofpolicy,procedure,and/orruleadditionsorchangestofacilitatemorecomfortableorefIicientresidency.Tenantswillberequiredtoacceptthesememorandaasextensionsoftheleasedocument.
19.SURRENDER/TURNOVERCOSTS&PRACTICES:
TheTenantwillgiveuptotheLandlordthepremises,itsappurtenancesandappliances,andanyotherpersonalpropertybelongingtotheLandlordattheterminationofthisleasebylapseoftimeorotherwise,inasgoodconditionaswhentaken,exceptingonlyordinaryweararisingfromproperusage.
IfthepremisesrequireadditionalcleaningaftertheTenant(s)hasmovedoutofandcleanedthepremises,theLandlordwill,athisdiscretionhavetheapartmentcleanedtoprepareitforthenextTenant.LandlordwilldeductfromTenant’ssecuritydepositotherchargesattherateof$40.00perhour.LandlordmayfurtherdeductfromTenant’ssecuritydepositotherchargesasmaybenecessaryincluding,butnotlimitedto,thecostofshampooingthecarpetsandsofas,andpainting.Iftheunitand/oritsIinishesandfurnishingsrequirecleaning,deodorizing,painting,orreplacementduetosmokesmell,soot,and/orsmokeIilm,allsuchcostswillbepassedthroughtoTenant(s)bydeductionfromTenant(s)securitydepositand/ordirectinvoice.Paintingwillbechargedattherateof$40.00.00perhour,plusmaterialsandsupplies.

TheTenantagreesthatthefairandreasonablecostofsuchrepairorreplacementshallbedeterminedbystatementsrenderedbytheLandlordtotheTenantforsumsactuallyexpendedbytheLandlordplusa10%handlingfee,or,inthealternative,astatementrenderedbytheLandlordfortheestimatedoranticipatedcostofsuchrepair,plus10%handlingfee,ifthedamageisascertainedbytheLandlordbeforetheendoftheleaseterm.ThesumsodeterminedshallbepaidbytheTenanttotheLandlordupondemandtherefore.TheLandlordshallpayforallotherrepairstotheproperty.
21.KEYS&LOCKS:
Tenantshallnotchangelocksorlockcylindersondoors,norshallTenantinstallneworadditionallocksonthepremises.TenantswillreceivealloriginalkeysfromtheLandlordandwillnotmakeadditionalduplicatekeys.TheTenantwillbecharged$15,non-refundable,foreachoriginalorreplacementoradditionalkeywhichisnotreturnedtotheLandlordattheendoftheleaseterm.Ifakeyorkeysarenotreturnedattheendoftheleaseterm,Landlordhastheadditionalrighttochangethelockorlocksonthepremises,andmakenewkeysattheTenant(s)expense,plus10%administrativecharge.
TenantmustgivetheLandlordasleastfourdaysnoticeofTenants’intentiontopickupkeysat

Intheeventofalockoutinwhichthelandlordiscalledtogainaccesstoapartmentafeeof$70.00willbecharged.Thisfeeisduewiththefollowingmonthsrentpayment.
22.RULESANDREGULATIONS:
TheTenantforhimselfandforotherpersonsinthedemisedpremiseswithhisconsent,agreestocomplyfullywiththefollowingrulesandregulations:
a.)TheTenantshallnotmakenorpermitanydisturbingnoisesinoraboutthepremisesbyhimselforothers,nordoorpermitanythingbysuchpersonsthatwillinterferewiththerights,comforts,orothers,nordoorpermitanythingbysuchpersonsthatwillinterferewiththerights,comforts,orconvenienceofneighbors.TheTenantshallnotoperateanymechanicaldeviceincluding,butnotlimitedto,radios,televisions,stereosystems,etc.atanytimeatavolumewhichisdisturbingorannoyingtoothers.Nopianos,drums,orothermusicalinstrumentsshallbeplayedinthepremises,exceptasspeciIicallyapprovedbytheLandlord.
b.)Noanimals,birds,orpetsofanykindshallbetakeninorkeptinoraboutthepremises.IfthisclauseisbreachedtheLandlordmayinsistonpermanentremovaloftheanimal(s)andchargetheTenantforanyexterminationservices,carpetorfurniturecleaningorreplacement,and/oranyandallcostsrelatedtotheexistenceofsuchanimal(s).Inaddition,theLandlordmaypursuealllegaloptionsavailabletohim.ThedecisionofthenecessityforsuchactionsandresultantcostsareinthesolediscretionoftheLandlord.
c.)TheTenantshallnottamperwith,orattempttodisconnectoroverride,heatorsmokedetection,oranyotherlife-safetydevicesin,on,oraboutthepremises.TheTenantshallnotmakeanychangesin,orconnectionto,theplumbing,heating,electrical,telephone,ortelevisioncablesystem.TheTenantshallnotuseelectricalextensioncordstoexpandelectricaloutletsorsockets.Surgeprotectorsareallowed.

e.)Grease,oils,coffeegrounds,Condoms,Iibrousmaterials,feminineproducts,wipes,refuseandrubbishofanykind,andcausticsubstances(Drano,LiquidPlumber,etc),mustnotbeIlusheddowntoiletsordrains.Tenant(s)agreestobeliablefordamagetodrains,pipesorthesewersystemcausedbyhisinviteesorlicensees.TenantisresponsibleforplunginghisowntoiletifitbecomescloggedandfornotifyingLandlordifplungingdoesnotcorrectthe

h.)Norefuse,furnishings,personaleffects,orunsightlyorhazardousitemsofanykindshallbeplacedontheexteriorofthepremisesoronthewindows,porches,balconies,orotherexteriorstructurepertainingtothepremises.TheTenantshallneitherplacenorpermitanyobjectorperson,animal,orotherthingontheIireescapes.Fireescapes,ifany,shallbeusedonlyforegressinthecaseofemergency.
i.)TheTenantshallkeepthepremisesinacleanandsanitarycondition,andshallreturnthepremisesattheendoftheleaseterminacleanandsanitarycondition.Tenantsortenantshallnotobstructorlitterthehalls,stairs,porches,walksoryards.
j.)CarsandothervehiclesshallnotbeparkedonthelawnoranyotherplacenotspeciIicallydesignatedforparking.Mechanicalworkonmotorvehiclesandwashingofsameisprohibited.
k.)Tenant(s)mustseekwrittenpermissionfromthelandlordbeforeconductinganyhomebasedbusinessesorsales.Thisincludesbutisnotlimitedtoyardsales,productbasedsalesparties,etc.

Thisleaseshallbefullysubordinatetothemortgageoranygroundleasecoveringthedemisedpremisesand/oranyfuturemortgageorgroundleaseandshallnotrequirethelendertograntarightofnon-disturbanceasaconditionforsubordinationoftheleasewithouttheexpresswrittenconsentofthelender.Tenantagreestoexecuteanyandalldocumentstoeffectuatetheprovisionsofthisparagraphwithintwodaysofrequest.
25.QUIETENJOYMENT:

premisesforthetermofthisleaseagreement.“QuietEnjoyment”doesnotmeanthattheneighborswillnotmakenoiseorotherwisedisturbyou.Itdoesmeanthatyouruseandoccupancywillnotbeinterferedwithbyothersclaimingtherighttouseandpossessthepremisesduringthetermofthelease,solongasyouarenotindefault.
26.COMMENCEMENTOFTERM:
IfthroughcircumstancesbeyondtheLandlord’scontrol,theLandlordisunabletogiveTenantpossessionofthepremisesonthedatesetasthecommencementdateoftheterm,theLandlordshallnotbeliableforanydamagestotheTenantandthisleaseshallcontinueinfullforceandeffectandpossessionofthepremiseswillbegivenassoonasreasonableconvenienttotheLandlord.Notwithstandingsuchdelay,thetermoftheleasewillnonethelessendaspreviouslystated.Incaseofsuchdelay,however,theLandlordwillallowtheTenantaprorataabatementofrent.
Ifatthecommencementofthetermofthelease,thereremainspaintingorminorrepairsstilltobecompleted,theLandlordmaygivetheTenantspossessionandwillcompletesuchpaintingandminorrepairswhenconvenienttotheLandlord.Therewillbenoabatementordiminutionofrentinsuchcase.
27.STORAGE;PERSONALPROPERTYLEFTONPREMISES:
AllpersonalpropertyplacedinstorageonthepremisesshallbeclearlymarkedwithTenant’sname.TheTenantassumesallriskoflossofanysuchpersonalpropertystoredanywhereinthedemisedpremisesoritsimmediatevicinity.AnysuchpersonalpropertynotsomarkedwiththeTenant’snameorleftinstorageafterterminationofthislease,shallbedeemedtrash,andtheLandlordmaydisposeofsameasheseesIitwithoutfurthernoticeorobligationtotheTenant.
Anypersonalpropertybroughtontothepremiseswhichshallnothavebeenremovedattheterminationofthislease,shallbedeemedtobeabandonedpropertyandmayeitherberetainedbytheLandlordasitsproperty,ormaybedisposedofbytheLandlordinanymannertheLandlorddeemsappropriate.

28.VENUEOFACTIONS:
ThepartiestothisleaseagreethatanyactionorjudicialproceedinginvolvingorarisingfromthisleasemaybebroughtonlyinthecourtsoftheCountyofTompkins,StateofNewYork.Thepartiesfurtheragreethatnoothervenueisproper.IfeitherpartybringsanyactionorjudicialproceedinginvolvingorarisingfromthisleaseinanycourtotherthanacourtinTompkinsCounty,NewYork,theotherpartyshallbeentitledtodismissalofsuchmatterfromsuchothercourtand/orremovaltoacourtofcompetentjurisdictioninTompkinsCounty,NewYork.Insuchcases,thepartywhoinitiallybroughtanyactionorjudicialproceedinginvolvingorarisingfromthisleaseinanycourtotherthanthoseinTompkinsCounty,NewYork,shallpaytotheotherpartyalllegalcosts,including,butnotlimitedtoattorneysfees,Iilingfees,servicefees,anddisbursements,incurredinhavingsuchactionforjudicialproceedingsdismissedorremoved.
