JMD CareSWhereas the beneficiary member as named in the Confirmation Certificate having applied for membership & having agreed to abide by the terms & conditions of this scheme, JMD Auto India Pvt. Ltd. (hereinafter called the "Company") for the benefits & services hereinafter contained during the period stated in the Confirmation certificate.

The Company hereby agrees subject to the terms, conditions and exclusions herein contained or otherwise expressed hereon, to offer following benefits & services related to the car as stated in the Confirmation Letter;

1. Arrange for one free VAS scanning.2. Arrange for up to one General Check-Up & Electrical Check-Up of the car.

3. Arrange for up to two standard car washes. 4. Arrange for up to two pick up of car for repairs. This benefit can be availed for maximum distance of 50 kilo meters from nearest workshop of the Company.5. Arrange for up to two towing of car when damaged, as per arrangement with & stipulations of concerned service provider / vendor. This benefit can be availed for maximum distance of 50 kilo meters or maximum upto Rs.3000/- in one year , from nearest workshop of the Company.The above benefits are subject to Terms & Conditions applicable of company for such works & services and as specifically recorded in workshop documents like job-card, challan, etc. The benefits are also subject to satisfactory condition of car & as per standard practice of the company.Apart from the above benefits & services the Company will also be liable for and make good & / or discount towards the cost incurred by the beneficiary towards bearing the depreciation amount applicable under the Motor Comprehensive Package Policy for the concerned vehicle following an identifiable and admissible own damage repair basis claim for which concerned insurer has either paid or agreed to pay such claim under the Motor Comprehensive Package Policy subject to the following Special Provisions, Terms and Conditions of this scheme;

A. This benefit is available & valid only if the Motor Comprehensive Package Policy issued through Company & its associates is valid at the time of material accident.

B. This benefit is available & valid only if the material own damage claim under such Motor Comprehensive Package Policy is admitted by insurer under the said policy terms and conditions & concerned insurer has either paid or agreed to pay such claim.C. This benefit is not applicable for any total loss, constructive total loss or theft claim as stipulated under the said insurance policy & claim there under.D. This benefit is available & valid only if the relevant accident repairs & related replacement of parts is done with workshops of JMD Auto India Pvt. Ltd. & its authorized associates.

E. The company will not be liable for any deductible amount & or Compulsory or Voluntarily Deductible over Rs.2,000/- (Rupees two thousand) stipulated under said insurance policy. Such deductible / excess over Rs.2,000/- shall be reduced from Companys liability towards the depreciation amount for each and every accident.

F. This benefit is applicable for car registered as Private Car and used for private purposes only.

G. The benefit is applicable only for maximum Three accidents during the period as stated in Confirmation Letter.H. The Company will not be liable for depreciation applicable for and pertaining to parts, sub-parts, assemblies, etc. not approved & / or disallowed by the insurers under its motor insurance claim for any reasons. I. Notice shall be given to the Company immediately upon the occurrence of any accidental loss or damage and for claiming benefit the beneficiary shall give all such information and assistance as the Company shall require. In no case whatsoever shall the Company be liable for any loss or damage after the expiry of seven days from the happening of the material accident.

GENERAL TERMS & CONDITIONS :-I. All benefits under this scheme ceases to attach if the interest & / or ownership of the car is changed.II. The Company at its option, arrange for services & or benefits under this scheme and in so doing, the Company shall arrange the required works & services only as circumstances permit and in reasonably sufficient manner.

III. The Company will not be liable in any manner towards consequential loss or damage or legal liability of any kind.

IV. The benefits under this scheme shall be void in the event of misrepresentation, misdescription or non-disclosure of any material fact & / or circumstances.

V. The Company may cancel this scheme or any part thereof by sending seven days notice by ordinary post or courier or email or sms to the beneficiarys last known contact details. VI. The Company will not be liable in any manner for inability to execute & / or offer any benefit/s or part thereof due to circumstances beyond its control like Force-Majeure, etc.VII. For any dispute or difference related to this scheme or benefits there under, the cause of action shall be deemed to arise in Mumbai & any legal proceeding in same respect shall be instituted with competent court of law in Mumbai city only.
